One of the surprising things about the resurgence of piracy in the Gulf of Aden is that there is not yet a clear standard of conduct when suspected pirates are eventually caught. There are many cases in which pirates have been released by the military navies that arrested them and other cases of excessive use of force. This article addresses the possibility of providing a fair trial to suspected pirates, also on the ground of new developments in establishing dedicated courts in states of the region. Judging suspected pirates presents a variety of problems associated to evidence collection, availability of witnesses and national laws to be applied. In spite of these difficulties, Western powers, which have invested so much in patrolling the Indian Ocean with their navies, have so far been unexpectedly reluctant to provide fair trials.  相似文献

In this paper, I examine how the incentives of regions to unite and to separate are related to the incentives to provide public goods. Separation allows for greater influence over the nature of political decision making while unification allows regions to exploit economies of scale in the provision of public goods. From a social welfare perspective, there are excessive incentives for separation and for the provision of public goods. When incentives for public good provision are not taken into account, however, these incentives can be misinterpreted as incentives for separation.  相似文献

In this paper I begin by examining the role of extra-parliamentary institutions of representation within Australian democracy. I suggest that such institutions are an important supplement to majoritarian political institutions in ensuring that 'weak voices' are heard in the policy process. I then look at the impact of the Howard government on such extra parliamentary forms of community representation, drawing parallels with contemporaneous developments in Canada. I find that changes were in fact initiated under Labor governments, seeking to impose managerialist models on community-based representation. The further controls introduced by the Howard government have, however, seriously reduced the capacity of community-based peak bodies to represent their constituencies. These constraints create the danger of a less inclusive democracy, where the voices of those outside the mainstream can be ignored or misrepresented.  相似文献

The emphasis of a public budget depends on the time and circumstances in which it is developed. During the 1990s, for example, the emphasis has increasingly been on accountability due to widespread public belief in recent years that government is uncontrollable and responds only to special interests. Over the past few years, local budgeters have begun to adapt to this new environment by improving the accountability of the budget to the public. This article summarizes some of the changes taking place and suggests some additional changes that could be adopted to make local budgeting more accountable.  相似文献

The status of universalism has been much debated by feminists at the end of the twentieth century. Poststructuralist feminism is readily positioned in these debates as antagonistic to normative universalism. It is criticized as such: how is injustice to be judged and condemned if contestation and the openness of ungrounded universalism are the only ideals? This paper is a 'sub-philosophical' enquiry into the normative commitments to equality implicit in poststructuralist feminism and its relationship to 'actually existing' human rights for women as they have been re-worked by the international feminist movement. It argues that poststructuralist feminism can be used to provide support for one possible understanding of equality encoded in the Convention on the Elimination of All Forms of Discrimination Against Women. It addresses feminist concerns over universal rights as androcentric and ethnocentric, arguing that extending human rights to women is compatible with poststructuralist commitments to anti-essentialism and anti-foundationalism and required by the model of 'deconstructive equality' implicitly shared by CEDAW and poststructuralist feminism.  相似文献

Citizen participation in the local budget process is not prevalent, despite encouragement from scholars and professional organizations. This case study of two Kansas cities that have used a variety of input mechanisms in the budget process analyzes the effectiveness of citizen budget participation. Limited effectiveness was found, which may largely be due to the timing of the input, unstated or unclear goals, implementation difficulties, and political and environmental constraints. Citizen input appears to have had little effect on budget decisions, and neither city has institutionalized participation in the process. However, the input mechanisms serve other purposes, such as education and support for specific proposals. Describing the benefits as well as the difficulty of involving citizens in a meaningful way is beneficial to other governments as they wrestle with the issue of defining the citizens' role in the budget process.  相似文献

The citizenship literature now renders blurry the boundaries between ‘private’ and ‘public’. Feminist analyses of caregiving have contributed to this evolution. But while feminist circles widely depict caregiving to be on par with employment as a social aspiration and obligation of citizenship, the literature has stopped short of recognizing that caregiving can also represent political citizenship. The author argues that some caregiving for identity should be afforded this status. This recognition has implications for multiscalar approaches to environmental and queer citizenship studies; feminist visions of citizenship that imply a right to time for care; and multicultural citizenship.  相似文献
