我国民主政治发展的路径依赖及路向选择——基于路径依赖理论的分析视角

从路径依赖理论的视角来考察,我国民主政治的发展在取得诸多成就的同时,也存在着思想观念、民主制度体系、民主组织行为等方面的非良性路径依赖,阻碍了我国民主政治的发展。加快我国民主政治发展必须打破非良性的路径依赖,实现路径替代,需要在更新民主观念、深化市场经济体制改革、推进政治体制改革、以及扩大公民有序政治参与等方面做出努力。     

On the System of Rights Underlying the Right to Health and Constraints on the Right to Health——Including a Commentary on the Basic Healthcare and Health promotion Law(Draft)

Conceptually, health is subjective, procedural and socially reliant.This three-fold nature determines the connotations of the right to health as well as the constraints thereof.The right to health encompasses both the right to freedom and social rights.The right to freedom in the context of health means that the state should respect the health status and choices of its citizens and trust that the people are able to optimize their health through their own efforts, whereas the right to basic healthcare services is an important component of the right to health from the perspective of social rights.The review system stipulated in administrative normative documents increases, to a certain degree, the possibility that citizens can realize their right to health.The right to health is constrained in three aspects: "precondition of the possible", concurrent requirements imposed by society and conflicts among basic rights.When there is financial restraint on what the state can afford, the right to health is constrained by limits to healthcare institutions and the provision of healthcare services.over-emphasis of individual responsibility on the part of the insured can possibly transform the right to health into an obligation to be healthy .     

社会心理认知与构建社会主义和谐社会

构建社会主义和谐社会的核心是实现人的和谐,关键是通过认知社会成员的心理状况,及时调整相关政策措施,满足人们的合理需要,解决所存在的社会问题并干预或消解不良社会行为的发生以及通过激励有利于社会发展的社会行为,塑造积极健康的社会心理,在社会心理认知的基础上为构建社会主义和谐社会创造条件。     

论我国监狱的行刑社会化

行刑社会化,是指我国监狱在对罪犯执行刑罚的过程中,积极组织和充分利用社会各方面的积极力量,参与对罪犯的改造和矫正,放宽自身与社会隔离的界限,使内在的行刑环境与社会环境相衔接,以促进罪犯顺利回归社会。行刑社会化是我国监狱行刑的重要原则。文章根据我国监狱行刑社会化的实施现状,提出五项建议:一是扩大假释的适用;二是设置半开放式监狱或监区;三是充分利用社会教育;四是组织罪犯监外劳动;五是完善社区矫正的制度。

近年来，随着我国房地产事业的蓬勃发展，小区物业公司随之普遍，越来越多的业主与物业公司的纠纷诉至法院，解决此类案件的关键就是确定物业管理公司是否负有必要的安全保障义务以及其承担这种安全保障义务的合理范围。以2012年初诉至鞍山市铁东区人民法院的一起生命权、健康权、身体权纠纷为引。展开对物管公司的安全保障义务相关问题的探讨。

乡镇政府回应：意义、存在的问题及对策

乡镇政府及其工作人员能否对乡村社会和广大农民的需求做出积极、负责任的回应，直接关系到新农村建设的成效。因此，提升乡镇政府回应能力就要改革压力型行政体制，合理划分各级政府的事权；把握好回应指向；转变乡镇政府职能；建立健全乡镇政府回应机制和注重对乡镇政府回应进行科学的绩效评估等。     

The New Development Concept and the Protection of the Right to Development of Chinese Disabled Children

The new development concept proposed in the 5th Plenary Session of the 18 th CPC National Congress plays a significant role in protecting the right to development of vulnerable groups, including Chinese disabled children. Owing to the specialty of disabled children, their rights to education and to rehabilitation services are the core contents in facilitating the realization of the right to development of disabled children. Up to now, great progress has been made in the legislative and administrative protection of the right to education and the right to rehabilitation services of disabled children, but there are still some drawbacks. In terms of protecting the right to education of disabled children, the innovation is conducive to boosting the mechanism innovation represented by the pilot zones of special education reform; coordination and sharing are conducive to protecting the disabled children to realize the equal right to education; opening-up promotes absorbing the advanced experience of the international integrated education and sharing experience of Chinese special education. In terms of protecting the right to rehabilitation services of disabled children, innovative development boosts the mechanism innovation and the application of new technologies regarding disability prevention and the disabled rehabilitation; the coordinated and shared development pushes the equal realization of the right to rehabilitation services of disabled children; the green development requires the favorable ecological environment for the healthy development of disabled children; the open development promotes absorbing the advanced international experience and sharing experience from China.     

新媒体语境下的公安微博舆情引导

以公安视角为切入点,探索微博环境下以新技术应对新技术引导舆情面临的挑战以及迅速发展的"官博"在规模与作用、个例与整体间矛盾突出,后继发展乏力的困境。就当前处置网络突发事件和涉警舆论实践中暴露出的引导语言缺位、引导话语无力、引导力量单薄等问题进行分析,并提出突破困境的具体对策:在方针原则层面,坚持群众路线、实事求是和理性包容;在引导策略层面,要及时应对、反客为主,理性平和、坦诚沟通,把控风向,引领舆论,密切协同、合力发声;在方法手段层面,要加强微博平台建设、完善微博舆情监测、创新舆情引导手段、培养引导人才队伍。     

社区矫正在未成年人犯罪中的适用

鉴于未成年人犯罪的日益严重性,以及对未成年人适用监禁刑的弊端,本文从未成年人犯罪的特点和犯罪成因入手,分析对未成年人适用社区矫正制度的必要性,在此基础上对未成年人犯罪的社区矫正制度加以建构。     

新农村建设公共政策的社会性别分析——兼论社会性别主流化的实现途径

公共政策是政府对社会公共利益做出的一种权威性分配,公正性是其本质要求,中国公共政策的公正性应以"实质的平等"为追求目标,注重对弱者的保护。社会性别是分析问题的一种新的理论或方法。将社会性别意识纳入公共政策对于改善女性地位、调整原有的性别利益格局,具有十分重要的意义。本文通过对湖北省DC乡的新农村建设公共政策进行社会性别分析,发现存在着决策层中女性的势单言轻、价值目标中女性的工具化、性别定位中复制传统以及性别中性化的现象,导致新农村建设在推进城乡公正的同时,却忽略了两性的公正,背离了公共政策的"公正性"价值追求。而要推进社会性别的主流化进程,需要赋予妇联监测公共政策的权力,提高女性决策者的数量和影响,对决策者进行社会性别意识的宣传和教育,加强对现实社会性别问题的调查研究。

目前大陆地区《宪法》和台湾地区＂宪法＂均未对职业自由权作出明文规定,而是通过劳动立法或宪法解释的方式对职业自由权提供保护。职业自由权包括职业选择的自由和职业执行的自由。保障职业自由必须反对强迫劳动。基于公共利益保护的需要,海峡两岸均通过法律对职业自由权的主体及其该权利的行使进行一定的限制,同时明确了职业自由权受侵害时的救济途径和强迫劳动的法律责任。

Introduction: The DPP in power

The transition of power from the KMT to the DPP in Taiwan has not been easy. Instead of bringing in a new way of thinking, it is noted that ideology is too ingrained for the new ruling party to make a break from it. Instead of providing a new form of governance, the DPP has proved to be inexperienced at coping with the intricacies of a modern democratic polity. Rather than building new state-civil society relations, the DPP has been unable to expand its outreach to segments beyond its traditional constituencies. Most painful has been the effort required to try to change the general mindset from confrontational to accommodative. The DPP went on to form a minority government and to challenge the still powerful now-opposition KMT in almost every important policy debate. Consequently, components for effective governance such as coordination, compromise, institution-building, etc., are rare stock. The inherent factional schism is hurting the party as virtues like coherence of policy, coordination of bureaucracies, and even channel of command are compromised. Ethnic incongruence seems to be aggravating the situation.
