税收征管法第45条确立了税收优先权制度,这对于保障国家税收的实现起到了重要作用。我国税收优先权的种类和适用范围,包括税收及滞纳金。税收优先权制度建立的理论基础包括税收人公益性、风险性要求等。由于我国税收优先权与其他债权的关系欠缺一定的公示性,将导致债权人设置抵押、质押时无法查清债务人在此之前具有欠缴税款的情形,同时税收优先于留置权的规定违反了物权法的规定。可借鉴日本和我国台湾地区的有关做法,在税收征管法修正时予以改进。

试析建设工程优先受偿权的构成条件

建筑业是国民经济的支柱产业,建设工程款拖欠问题一直是困扰建筑商的严重问题之一,为此,《合同法》第286条赋予了承包人建设工程款优先受偿权,最高人民法院也出台了相关的司法解释,为解决这一问题提供了新的途径。建设工程优先受偿权是一项效力强大的权利,对这一权利的享有必须具备一定的条件,本文认为,建设工程优先受偿权的主体为承包人,建设工程必须已经竣工或者已经超过合同约定的竣工时间,承包人的债权为依照建设工程合同所应支付的价款,标的物不包括不宜折价、拍卖的建设工程。

随着城市机动车数量的日益增多,城市道路渐进饱和、道路交通流不断增大,城市公交车的通行也受到很大阻碍。文章基于公交优先的理念,结合大连市道路状况,针对交叉口处的公交优先问题,从静态控制和动态控制两方面提出一些解决办法,其中包括：公交优先的车速设计、交叉口的车道设置、公交优先信号控制、港湾车站设置等。通过这些方法,在一定程度上可以缓解交叉口的拥堵状况,公交车的通行相对通畅。
