This paper sheds light on previous inconsistencies identified in the literature regarding the relationship between medical marijuana laws (MMLs) and recreational marijuana use by closely examining the importance of policy dimensions (registration requirements, home cultivation, dispensaries) and the timing of when particular policy dimensions are enacted. Using data from our own legal analysis of state MMLs, we evaluate which features are associated with adult and youth recreational and heavy use by linking these policy variables to data from the Treatment Episode Data Set (TEDS) and National Longitudinal Survey of Youth (NLSY97). We employ differences‐in‐differences techniques, controlling for state and year fixed effects, allowing us to exploit within‐state policy changes. We find that while simple dichotomous indicators of MML laws are not positively associated with marijuana use or abuse, such measures hide the positive influence legal dispensaries have on adult and youth use, particularly heavy use. Sensitivity analyses that help address issues of policy endogeneity and actual implementation of dispensaries support our main conclusion that not all MML laws are the same. Dimensions of these policies, in particular legal protection of dispensaries, can lead to greater recreational marijuana use and abuse among adults and those under the legal age of 21 relative to MMLs without this supply source.  相似文献

In the last few decades, drug testing has become a major policy issue in the workplace, with a host of actors competing to promote their own needs and interests. Employers, for example, seek ways to combat the use and abuse of illegal substances by employees. At the same time, unions and their employees legitimately seek to limit overly intrusive or unfair methods of testing. The courts have also been major players in the policy arena of drug testing, as witnessed by the surfeit of case law setting parameters around what is and is not legal and constitutional in terms of drug testing.
In an effort to move the drug-testing debate forward, this article examines the competing interests in drug testing, interests that ultimately frustrate the courts, policy makers, employees, and their unions from reaching a consensus on the use of drug tests in the public sector. To systematically examine this issue, Rosenbloom's competing-perspectives model of public administration is applied. The article concludes with policy recommendations for public managers.  相似文献

We investigated the differential effect of mandatory seat belt laws on seat belt use among socioeconomic subgroups. We identified the differential effect of legislation across higher versus lower education individuals using a difference‐in‐differences model based on state variations in the timing of the passage of laws. We find strong effects of mandatory seat belt laws for all education groups, but the effect is stronger for those with fewer years of education. In addition, we find that the differential effect by education is larger for mandatory seat belt laws with primary rather than secondary enforcement. Our results imply that existing socioeconomic differences in seat belt use would be further mitigated if all states upgraded to primary enforcement.  相似文献

This article specifies and estimates a logit model of ATM adoption by commercial banks. The model provides evidence that permissive sharing laws increase the odds of adoption, which suggests that the antitrust laws may impede the efficient diffusion of the technology. The model also provides evidence that mandatory access laws decrease the odds of adoption for small banks. This suggests that the benefit of such laws in terms of promoting competition in the banking market may be offset by the cost of slower technological diffusion. Finally the model provides evidence that banking markets overlap to a varying degree, which implies that banks compete on the dimensions of price and location. This evidence suggests that mandatory access laws are a more appropriate policy tool when competing banks provide services at similar locations, and permissive sharing laws are more appropriate when competing banks are differentiated by location.  相似文献

Policy implementation is usually studied at the micro level by testing the short‐term effects of a specific policy on the behavior of government actors and policy outcomes. This study adopts an alternative approach by examining macro implementation—the cumulative effect of aggregate public policies over time. I employ a variety of methodological techniques to test the influence of macro criminal justice policy on new admissions to federal prison via three mediators: case filings by federal prosecutors, conviction rates in federal district courts, and plea bargaining behavior. I find that cumulative Supreme Court rulings influence the incarceration rate by altering conviction rates in district courts; however, I find only mixed evidence of congressional and presidential influence. The results suggest that U.S. macro policy influences bureaucratic outputs by altering the behavior of subordinate policy implementers; however, the Supreme Court may enjoy an advantage in shaping criminal justice policy.  相似文献

The Australian Government announced in its 2017 budget that it would trial random drug‐testing of recipients of the Newstart Allowance and Youth Allowance in three locations from January 2018. The Prime Minister described it as a policy ‘based on love’, but that sentiment is hard to find in the policy rhetoric, which situates it in a suite of measures designed to ‘ensure taxpayers’ money is not being used to fund drug addictions which are creating significant barriers to employment'. The policy may make it harder for people to buy drugs with their welfare payments, through income management, but research suggests it will not help them overcome addiction and its costs will exceed any savings it generates in income support. Furthermore, the policy perpetuates ‘medicalisation’ of the problem of long‐term unemployment by suggesting it stems from deficiencies in individuals that can be ‘treated’, despite evidence to the contrary. Finally, the policy claims to close loopholes in enforcement of mutual obligation requirements without addressing structural weaknesses in the welfare‐to‐work model. Each of these issues will pose challenges for those charged with implementing the policy.  相似文献

We distinguish two types of public policy issues: direct issues, in which concern comes bottom-up from the electorate at large; and derived issues, in which pressure for change comes top-down from expert opinion. We outline two continuing, contentious issues: policies towards illegal drug use and policies towards the prospect of global climate change. We argue that the media play a role in both policies' formulation: chaneling concern up in direct policy, and maintaining general interest and motivating the electorate to accept the pain of change in derived policy.  相似文献

This paper estimates the effect of the 2005 vending machine ban in French secondary schools on nutrient intakes and on the frequency of morning snacking at school. Using data before and after the ban, and exploiting the discontinuity associated with the age‐dependent exposure to the ban, we specify a difference‐in‐differences regression discontinuity design. Since the relationship between age‐at‐interview and school level is not precise, we introduce fuzziness in the model. We find that the ban has generated a 10‐gram reduction in sugar intakes from morning snacks at school, and a significant reduction in the frequency of these morning snacks. However, we find no evidence that the intervention affects total daily intakes, and our results are suggestive of compensation effects.  相似文献

New findings are presented on the effectiveness (in terms of fatal crash reductions) of state‐level public policies related to drunk driving. Conventional estimates of policy effects might be biased because of the endogeneity of policies; this concern is addressed by analyzing the time pattern of policy effects with respect to the date of adoption. For the 0.08 BAC law, the results suggest that a bias upward exists, but the policy is still somewhat effective. Graduated licensing programs for young drivers and the Mothers Against Drunk Driving (MADD) organization are also evaluated for the first time in this type of analysis. The estimated time pattern of effects for graduated licensing suggest that its effects are also overstated in conventional analyses, but the policy is still effective for young drivers. The estimates for MADD do not imply an effect, but this result could be due to the crudeness of the variable used. © 2003 by the Association for Public Policy Analysis and Management.  相似文献

The policy of hospital autonomy has been discussed for some time in Uganda. There is little evidence from Uganda or elsewhere that increased autonomy will improve hospital performance. This article compares the performance of three private not‐for‐profit (PNFP) and public hospital pairs to address this question. PNFP and public hospitals have similar management structures but PNFP hospitals had better trained managers and a church affiliated chair in the hospital management committee. Both types have problems with personnel management but these appear more pronounced in public hospitals. Drug supply management appears better in PNFP hospitals. Overall, workloads are similar, but analysis of patterns of utilisation and prices across services suggest that patient choice of facilities is influenced by relative price levels, and that willingness to pay is higher for PNFP services. PNFP hospitals are more successful at generating revenue. There are no clear differences in efficiency between PNFP and public hospitals but there is some evidence of higher quality levels in PNFP hospitals. PNFP hospitals' performance is plausibly related to three areas of managerial autonomy. First, better management of drug supply is facilitated by their freedom to purchase drugs from the open market. Second, greater success with personnel management is plausibly related to their greater autonomy over staffing. Third, higher levels of cost recovery are enabled by their freedom to set fees. However, differences in accountability and competence of hospital management, and population willingness to pay for services may also help to explain differences. Further, the use of PNFP financing strategy by public hospitals has implications for universal access to hospital services. Although there appear to be potential advantages from greater public hospital autonomy, the Ugandan government should ensure it has developed strategies to enhance public hospital management and to protect access to public hospitals before advancing further with hospital autonomy policy. Past research indicates that diversity at the level of larger geographic units (e.g., counties) is linked to white racial hostility. However, research has not addressed whether diverse local contexts may strengthen or weaken the relationship between racial stereotypes and policy attitudes. In a statewide opinion survey, we find that black‐white racial diversity at the zip‐code level strengthens the connection between racial stereotypes and race‐related policy attitudes among whites. Moreover, this effect is most pronounced among low self‐monitors, individuals who are relatively immune to the effects of egalitarian social norms likely to develop within a racially diverse local area. We find that this racializing effect is most evident for stereotypes (e.g., African Americans are “violent”) that are “relevant” to a given policy (e.g., capital punishment). Our findings lend nuance to research on the political effects of racial attitudes and confirm the racializing political effects of diverse residential settings on white Americans.  相似文献

While the fertility effects of improving teenagers’ access to contraception are theoretically ambiguous, most empirical work has shown that access decreases teen fertility. In this paper, we consider the fertility effects of access to condoms—a method of contraception not considered in prior work. We exploit variation across counties and across time in teenagers’ exposure to condom distribution programs in schools. We find that access to condoms in schools increases teen fertility by about 12 percent. The results suggest that the effects of condom access varied significantly across different programs; the positive fertility estimates are driven by communities where condoms are provided without mandated counseling. Programs that mandated counseling have zero or negative fertility effects, but estimates on these counties are less robust across specifications.  相似文献

Interest group networks are crucial for understanding European Union (EU) integration, policymaking and interest representation. Yet, comparative analysis of interest organisation networks across EU policy areas is limited. This study provides the first large-scale investigation of interest group information networks across all EU policy domains. We argue that interest groups prioritise access to trustworthy and high-quality information coming from partners with shared policy goals. Thus, interest organisations form network ties with other organisations if the latter are from the same country, represent the same type of interest, or are policy insiders. The effect of these three factors varies across policy domains depending on the extent to which the institutional setting assures equal and broad organisational access to decision-making. Our empirical analysis operationalises information ties as Twitter-follower relationships among 7,388 interest organisations. In the first step of the analysis, we use Exponential Random Graph Models to examine tie formation in the full network and across 40 policy domains. We find strong but variable effects of country and interest type homophily and policy insiderness on the creation of network ties. In the second step, we examine how the effect of these three variables on tie formation varies with policy domain characteristics. We find that shared interest type and policy insiderness are less relevant for tie formation in (re-)distributive and especially regulatory policy domains characterised by more supranational decision-making. Sharing an interest type and being a policy insider matters more for tie formation in foreign and interior policies where decision-making is more intergovernmental. The effect of country homophily is less clearly related to policy type and decision-making mode. Our findings emphasise the importance of institutional and policy context in shaping interest group networks in the EU.  相似文献

This paper explores the role of conferences as “convergence space”: temporary events with lasting material effects. Drawing on three harm reduction conferences occurring between 2011 and 2012, I argue that conferences are both ephemeral fixtures in the landscape of policy activism, and are important nodes through which policy mobilization occurs. Conference spaces provide opportunities for ideas to be shared, produced and advocated. They serve as important sites for the construction of relationships that are required to form and maintain policy advocacy networks and harness political opportunity structures for drug policy reform.  相似文献
