The Early Warning System gives national parliaments the right to intervene in European Union policy-making. This article investigates their incentives to submit reasoned opinions. It analyses the reactions of 40 parliamentary chambers to 411 draft legislative acts between 1 January 2010 and 31 December 2013 by ReLogit models. The article argues that, beyond institutional capacity, political motivation explains cross-chamber and inter-temporal variation. Higher levels of party political contestation over EU integration have a positive effect, but greater party dispersion on the left–right dimension negatively affects submissions. Furthermore, salient and urgent draft legislative acts incentivise parliaments to become active in the Early Warning System. Finally, some findings suggest that minority governments and economic recession represent positive conditions for unicameral parliaments and lower chambers to submit reasoned opinions. The findings are discussed with reference to the role of national parliaments in EU democracy.  相似文献

Abstract. The vast majority of West European polities feature an agency relationship between members of parliaments and members of cabinets as the latter depend on the confidence of the majority of the former to remain in office. In this article, the terminology used by principalagent theory to characterise oversight activities – contract design, screening, monitoring and the use of institutional checks – and elements of transaction cost economics are applied to the agency relationship between members of parliaments and cabinet members in Western Europe. Traditional studies of parliamentary oversight have narrowly concentrated on monitoring, although parliaments (with considerable cross–national variations) use a broad range of oversight mechanisms including equivalents of contract design, screening and institutional checks. In addition, traditional studies have focused almost exclusively on one particular type of monitoring often referred to as 'police–patrol oversight', whilst neglecting or underestimating the effectiveness and low transaction costs associated with 'fire–alarm oversight'. Despite the valuable insights the principal–agent framework has already added to the study of executive–legislative relations in parliamentary democracies, future research will have to account more realistically for the role and organisation of political parties which structure the delegation process, help to solve a number of co–ordination problems in parliaments (for example, the co–ordination of committees and floor activities) and generate important internal agency relationships that are fundamental to an understanding of executive–legislative relations in Western Europe.  相似文献

The project approach to development assistance has been criticized for failing to build lasting capacity. The problem lies not in the project approach itself, but in a failure to understand the constraints to capacity development and a consequent misdirection of effort. Policy analysis capacity is developed as an example. Policy analysis requires skills and abilities that public sector institutions in developing countries cannot sustain, owing to a combination of structural and organizational factors, among which personnel constraints are key. These factors inhibit the effectiveness of the standard approach, which seeks to establish analytic capacity within a specialized government unit (‘internal’ capacity). An alternative approach is to build ‘process’ capacity—the ability to get analysis done by other institutions, rather than the ability to do analysis internally. The author concludes that project strategies should be redirected toward a greater emphasis on building process capacity as a useful adjunct to internal capacity.  相似文献

Conventional wisdom ascribes to Land parliaments at best a supportingrole in German politics and a minor influence on public decisionmaking. Land parliaments are often dismissed as having few substantiallegislative or other functions. However, a closer analysis revealsa more complex picture. Even though the legislative functionof Land parliaments is limited, these regional bodies of representationare indispensable institutions for the German federal system.This article analyzes the legislative role, the elective function,and the participation of Land parliaments in coalition buildingas well as developments in the Land party systems. It is shownthat in these areas the Land level is more important than iscommonly thought. Recent changes indicate that Land parliamentsmay play an even more pronounced role in the future. The prevailingtheoretical approach that sees federalism dominating Germanconsensus democracy thus seems too general.  相似文献

Parliaments are more than legislative bodies. However, we lack an adequate understanding of the theoretical relationship between different facets of parliamentary activity or ‘parliamentary functions’. Relying on the principal–agent framework, this article argues theoretically that parliamentary power is a multidimensional concept comprising three distinct mechanisms to ensure policy outputs in line with the collective preferences of parliaments: direct influence on policymaking, the ex ante selection of external officeholders, and the ex post control of the cabinet. These mechanisms mirror the classic legislative, electoral, and control functions of parliaments. Empirically, the paper uses factor analysis of newly developed indicators for electoral powers and established measures of legislative and control resources to show that the institutional powers of 15 Western European parliaments comprise four distinct dimensions. These dimensions match the three theoretically derived mechanisms with committee power as an additional factor. Locating the 15 parliaments in this multidimensional space of parliamentary powers demonstrates that classifications based solely on lawmaking lead to biased assessments of parliamentary strength and weakness. Instead, the paper provides a more nuanced picture of the ways in which Western European parliaments can influence policymaking under the conditions of delegation.  相似文献

Does European Union membership influence coalition patterns in national parliaments? For governments in the Scandinavian countries – with their relatively high share of minority governments requiring external parliamentary support to form parliamentary majorities – the question of ‘coalition management’ is highly relevant. This article provides an empirical test of three central arguments in the Europeanisation literature on the impact of EU membership on national parliaments when political parties pass legislation in the Danish Folketing. The effect of EU content in a law on coalition patterns is compared across policy areas and four electoral periods from 1998 to 2011 encompassing 2,894 laws. The data provide support for the argument that the loss of national agenda‐setting over the legislative process has an impact on coalition patterns in the Danish parliament. It is shown that the coalition patterns on Europeanised legislation are both broader and more stable compared to national, non‐EU‐related legislation. The focus on Europeanisation of legislative coalitions goes beyond previous analysis with an institutional focus, and demonstrates an example of how the EU systematically has an effect on legislative coalition formation in a national parliamentary system.  相似文献

Chile is a country where path dependency made energy policy change extremely difficult by international standards. However, the country has recently become a renewable energy poster child thanks to a gradual process of policy change. How was this possible? This article contributes to discussions about policy change driven by ideas and to explaining the puzzling case of Chilean energy policy change. It does so by discussing the mechanism of bricolage—the recombination of old and new ideas by policy entrepreneurs—and its capacity to produce policy change in contexts of high path dependency. The article develops the political manifestations and consequences of bricolage and problematizes how actors continue to contest and change ideas' meaning after they have been institutionalized, a key question when analyzing processes of bricolage. The analysis is based on an array of data sources including interviews with key actors, newspaper notes, and legislative proceedings.  相似文献

Abstract

This paper analyses Transatlantic Trade and Investment Partnership (TTIP) negotiations in order to assess how the move towards tighter economic integration within the EU?US strategic partnership impacts on legislative?executive relations in EU trade policy. The analysis examines the institutional, substantive and party political dimensions of national parliaments’ scrutiny of the Common Commercial Policy. Based on insights into both domestic and EU channels of parliamentary monitoring of TTIP negotiations, the paper argues that, although the government remains the central object of democratic control, the involvement of national parliaments in transatlantic trade extends to encompass the EU’s own transatlantic and trade policies. This is rooted in the legislatures’ legal capacity to constrain the executive in the negotiation, conclusion and, where applicable, ratification phases of EU trade agreements. It is argued that national parliamentary influence takes the shape of politicisation of the legitimacy of the expected policy outcomes of these agreements.  相似文献

How does the internal organization of legislatures shape the legislative party system? We argue that the size and nationalization of the national legislative party system is related to the size of the legislative prize—namely, to how the legislature's internal rules and structures concentrate policy-making authority in the hands of the largest party. To test this argument, we draw on studies of legislative organization to develop a measure of the concentration of legislative policy-making authority. Using two time series cross sectional data sets of post-war elections, one of advanced industrial democracies with pure parliamentary systems and one of all advanced industrial democracies, we find support for our argument and note that the effect of internal legislative structures is larger than that of the electoral system. We also show that the incentives to aggregate and consolidate the legislative party system are generally stronger where there are few external constraints on the legislature.  相似文献

For more than half a century, scholars have been studying legislative effectiveness using a single metric—whether the bills a member sponsors progress through the legislative process. We investigate a less orthodox form of effectiveness—bill proposals that become law as provisions of other bills. Counting these “hitchhiker” bills as additional cases of bill sponsorship success reveals a more productive, less hierarchical, and less partisan lawmaking process. We argue that agenda and procedural constraints are central to understanding why lawmakers pursue hitchhiker strategies. We also investigate the legislative vehicles that attract hitchhikers and find, among other things, that more Senate bills are enacted as hitchhikers on House laws than become law on their own.  相似文献

Immigrants and their descendants are becoming increasingly visible in Germany’s political life. What determines immigrant political incorporation into parliamentary positions over time and in specific contexts? The article focuses on the regional parliaments of Germany’s 16 states. A comparative analysis enables us to specify whether, how and under what conditions factors thought to impact levels of immigrant representation are indeed influential and how they interact with local and situational conditions. The article first outlines immigrant representation in Germany’s states over time. It then discusses several possible explanations for the striking variation between states. Rather than one key factor, it is found that interactions between demographic, institutional, cultural and political conditions account for different levels of immigrant representation in Germany’s state parliaments.  相似文献

This article explores the different ways governments express dissent in the Council of the European Union (EU) through ‘No’ votes, abstentions and recorded negative statements. A game-theoretical model is presented that studies voting behaviour and analyses how the national parliaments’ levels of control over their governments’ EU policies affect it. It is concluded that governments that are strongly controlled by their parliaments are not more likely to express dissent. However, when they do express dissent, they vote ‘No’ more often. Parliamentary control depends on the presence of formal oversight institutions as well as the motivation of parliamentarians to hold their governments accountable. Empirical support is found in an analysis of votes on 1,387 legislative proposals that represent more than a decade of Council decision making in the period 2004–2014. This article contributes to the discussion on the involvement of national parliaments in EU affairs, and clearly distinguishes the different forms of dissent in Council decision making.  相似文献

The Treaty of Lisbon introduces an early warning mechanism (EWM) which empowers national parliaments to intervene directly at the EU level; they may now raise objections to – and even play a role in blocking – EU legislation. The EWM represents a new model of parliamentary involvement in international relations: national parliaments now constitute a virtual third chamber for the EU. Though they do not meet together in the same physical space, national parliaments collectively form a body that can, at least to some degree, perform three key parliamentary functions – legislation, representation, and deliberation. First, it gives national parliaments the power to influence legislative outcomes at the EU level. Second, it provides a new channel of representation linking the citizen with the EU. Third, it creates a new forum for debating the substantive merits of proposed EU legislation, particularly regarding its compliance with the principle of subsidiarity.  相似文献

Strengthening the budgetary powers of legislatures through nonpartisan budget offices adds to the capacity‐building repertoire of development donors. Budget offices are supposed to provide legislatures with information and analysis independent from the executive. The United States Agency for International Development believes that strengthening the legislature's power of the purse improves governance. We highlight USAID‐funded legislative strengthening projects implemented in Jordan, Kenya, Morocco, and Afghanistan to show how these budget offices function. There is a significant potential for these units to assist members of parliament in understanding the budget process, the broad fiscal challenges facing government, and expenditure control and budgetary trade‐offs that affect present and future spending. These cases demonstrate the challenges of creating and sustaining a parliamentary budget office. Finally, in an effort to make budget offices effective and sustainable, we outline several key steps that we believe are important both for donors and the legislative bodies.  相似文献

While the European Union’s Lisbon Treaty has important implications for regional parliaments with legislative competences, most studies have focused on cross-country differences or examined the activities of regional parliaments at the EU level. This contribution shows the existence of substantial intra-country differences in the formal scrutiny rights of regional parliaments. We analyse how German regional parliaments (Landtage) have addressed the challenge of controlling their governments in EU affairs. Using fuzzy-set comparative qualitative analysis, we find that institutional and partisan factors (vote share in the second chamber, economic potential, and conservative governments) explain the differences found among German Landtage particularly well. Landtage with otherwise weak parliamentary prerogatives were successful in using the reform momentum to strengthen their rights in the field of EU policy. Combined with the party political salience of EU policy-making, the integration process has thus empowered formally weaker Landtage.  相似文献

In majoritarian parliaments, the executive branch typically enjoys an informational advantage over the legislature. In theory, legislators can reduce this asymmetry with information from interest groups. In practice, the government is almost always better informed than the legislature. This article develops a model whereby a politician's access to outside information depends not just on her parliamentary power but on the diffusion of legislative agenda control among political parties—for example, during minority government. Using a new panel data set of 41,619 lobbying communications, it finds interest groups are more likely to communicate with government frontbenchers than with opposition or backbench members. This gap diminishes as agenda control diffuses to opposition parties. It also finds evidence of partisan clustering in lobbying networks during majority government. Strong legislative parties weaken accountability by restricting access to outside information, but this is conditional on the governing party's control over the agenda.  相似文献

The Lisbon Treaty has led to an expansion of the rights of parliaments in scrutinizing EU decision making, including—for the first time—also regional parliaments. Yet, theoretically informed empirical work on how regional legislatures adapt to the increasing relevance of the EU for subnational jurisdictions remains scarce. Drawing on data from an original survey of 251 MPs, conducted in seven German Länder in 2011, we explore regional MPs' involvement in EU affairs. We find strong variation among MPs' level of EU involvement. Exploring different sets of explanations, we show that individual-level factors—the perceived salience of the EU and MPs' perceived influence in EU matters—hold the highest explanatory power.  相似文献

Party institutionalisation is a central problem in political science. The literature tends to understand it as a syndrome and therefore has difficulty explaining variations. This article suggests a new approach based on the transaction between a legislative party and its deputies, the failure of which is observable in party switching. Three routes to institutionalisation are identified by appealing to the vote‐seeking, office‐seeking or policy‐seeking motivations of deputies. Poland has had a large volume of party switching, along with wide variation in the incentives facing differently‐motivated deputies. Survival analyses of switching in four Polish parliaments find that vote‐seeking is the most likely route to institutionalisation for Polish parties. Moreover, in this article a concrete hypothesis is established for comparative testing: legislative parties can survive as long as their popular support exceeds 40 per cent of their share in the previous election.  相似文献

Research on political communication effects has enjoyed great progress over the past 25 years. A key ingredient underlying these advances is the increased usage of experiments that demonstrate how communications influence opinions and behaviors. Virtually all of these studies pay scant attention to events that occur prior to the experiment—that is, in “pretreatment events.” In this article, we explore how and when the pretreatment environment affects experimental outcomes. We present two studies—one where we control the pretreatment environment and one where it naturally occurred—to show how pretreatment effects can influence experimental outcomes. We argue that, under certain conditions, attending to pretreatment dynamics leads to novel insights, including a more accurate portrait of the pliability of the mass public and the identification of potentially two groups of citizens—what we call malleability reactive and dogmatic.  相似文献

Abstract

Community development partnerships (CDPs)—local intermediaries that gather support from foundations, corporations, and the public sector—are giving increased attention to building the capacity of community development corporations (CDCs). This article evaluates CDPs’ efforts to help nonprofit CDCs increase their capacity to revitalize low‐income communities. We identified five types of capacity and conducted interviews and focus groups with CDPs and CDCs across the nation. The nature of capacity and capacity building among CDCs, the ways partnerships help increase CDC capacity, what the partnerships and CDCs learn from each other, and how they could better gauge the effectiveness of capacity‐building support were discussed.

We learned that CDCs and CDPs have forged an effective alliance and continue to work together: Community organizations require help in building capacity, and local partnerships provide the requisite funding, technical assistance, and other elements to help them grow and serve their neighborhoods.  相似文献
