T. Dale Stewart's contributions had a considerable influence on the development and early evolution of the field of forensic anthropology. This composition provides a perception of Stewart from the viewpoint of an advanced graduate student and then a young colleague. It explains, in part, the quiet leadership and assistance that Stewart provided at various professional and familiar levels to one individual and is indicative of the broad effect that Stewart had on generations of students and professionals in anthropology, osteology and forensic anthropology.

A friend in need: the role of friendship quality as a protective factor in peer victimization and bullying

This study examined friendship quality as a possible moderator of risk factors in predicting peer victimization and bullying. Children (50 boys and 49 girls, ages 10 to 13 years) reported on the quality of their best friendship, as well as their bullying and victimization tendencies. Parents reported on their child's internalizing and externalizing behaviors, in addition to bullying and victimization tendencies. Results indicated that externalizing problems were related to bullying behavior; however, friendship quality moderated this relation such that among children with externalizing behaviors, a high-quality friendship significantly attenuated bullying behavior. Internalizing problems and low friendship quality were significantly related to victimization; however, friendship quality did not moderate the relation between internalizing problems and victimization. Implications for interventions based on these findings are discussed.

“Dangerousness” within a juvenile institution

Experiments were conducted to test three hypotheses within a maximum security juvenile institution: (1) that the Overcontrolled Hostility (OH) scale, the Socialization (So) scale, and the Hand Test may be used to differentiate dangerous from nondangerous inmates; (2) that an instrument can be constructed that will differentiate dangerous from nondangerous youths; and (3) that there is a negative correlation between staff's perception of a youth's degree of dangerousness and their desire to not work with dangerous youths.The So, OH, and Hand Test were administered as was a twenty-five-word adjective checklist (the “TB”) with four response levels so that low scores signified dangerousness. A questionnaire produced a list of subjects with whom staff wanted to work and those with whom they did not want to work.The hypothesis that the So scale, the OH scale, and the Hand Test could discriminate between dangerous and nondangerous “subjects” was not confirmed. The hypothesis that an instrument could be constructed that would differentiate dangerous from nondangerous youths was confirmed. The hypothesis that staff's perception of dangerousness affects their working relationship with youths was solidly confirmed.

This article examines the Advocate-General's comments on the ‘hosting’ provision in the eCommerce Directive (00/31/EC). He suggests the existence of a ‘neutrality’ principle in respect of intermediary liability, which operates irrespective of an intermediary's knowledge about the legality or otherwise of the hosted content. This article critically examines this suggestion within the broader debate about the role and responsibilities of intermediaries in a cyberspace context.     

The European Democratic Challenge: The Forging of a Supranational Volonté Générale

This article explores in a systematic manner the different components of the democratic legitimacy of the Union from the standpoint of deliberative democratic theory. Contrary to standard accounts, it is claimed that the democratic deficit must be disaggregated, given that the Union has not only several shortcomings, but also some democratic surpluses. On the one hand, the Union was created to tackle the democratic deficit of nation states, and has been partially successful in mending the mismatch between the scope of application of their legal systems and the geographical reach of the consequences of legal decisions. Moreover, the European legal order is based on a synthetic constitutional law, which reflects the common constitutional traditions of the Member States, which lend democratic legitimacy to the whole European legal order. On the other hand, the lack of a democratically written and ratified constitution is a central part of the democratic challenge of the Union. But equally important is the structural bias in favour of certain material legal results, which stems from the interplay of the division of competences and the plurality of law-making procedures.
