北京仲裁委员会(北仲)发展的成功经验是坚持民间化方向,实行事业单位企业化管理。北仲在本次分类推进事业单位改革中遇到的最大困境是没有与其性质、职能相近的事业单位分类类型和适应其发展的相关政策。为了更好地发展我国仲裁事业,建议在事业单位分类推进改革中,增加一种事业单位类型,类似2007年事业单位改革方案中的公益三。  相似文献

The principal and agent relationship is important in the public sector. There, elected or appointed representatives act on behalf of the citizens of their jurisdictions. This paper examines the importance of the budget referendum, which allows the principals to approve or disapprove the proposal of a set of agents, in the context of local public expenditure decisions. We test the null hypothesis that the institution of referendum, when compared to a nonreferendum institution, does not lead to significantly different expenditure behavior.  相似文献

The ombudsman institution, in both the public and private sectors, is increasingly identified with the ethos of consumerism and the protection of consumer rights. The current trend is exemplified and reinforced by the EU ADR Directive and by the government response to a recent inquiry into complaints conducted by the Public Administration Select Committee. This article argues that the dominant consumerist ethos diminishes the ability of the ombudsman institution to fulfil its potential. If the ombudsman institution, in particular as manifest in the office of the UK Parliamentary Ombudsman, is to serve the public interest, it must instead promote human rights principles and constitutional morality, adopt a process that is marked by public reasoning and participation and seek by a whole‐system approach to realise a vision that is integrated and truly democratic.  相似文献

The institution of citizen suits is a decentralized form of public participation that allows citizens to influence the implementation of public laws in courts. How does this institution influence policymaking? This article proposes a model of citizen suits. It then analyzes how this institution influences legislative decisions. The legislature bargains to choose the budget, distributive spending, and spending on an ideologically contested public good (e.g., health care or environmental protection). I find that citizen suits enable courts to forge a compromise between opponents and proponents of the public good by responding to the diverse claims of citizens. Anticipating the mobilization of citizens in courts, legislators in turn craft more socially efficient bills, with less distributive spending, which better represent the distribution of preferences for the public good compared to when citizens have no role in the implementation of legislation.  相似文献

Although the Supreme Court is a countermajoritarian institution by design, many scholars have contended that without concrete powers, the Court relies on public support for legitimacy. Accordingly, it is important to understand the relationship between people’s ideological proximity to the Court and their support for it. Existing empirical research suggests a correspondence between public opinion and the Court’s positions, but these studies do not directly compare masses and elites in a common space. To address these issues, we conducted an original survey asking respondents about their positions on ten recently decided Supreme Court cases. This allows us to estimate the positions of citizens and justices on the same ideological scale. Further, while some existing theories of perceptions of judicial legitimacy suggest similar relationships between ideological distance and various types of support for the Court, we propose a theory of heterogeneous responsiveness which posits that citizens’ ideological distance from the Court should be negatively related to their approval of and trust in the institution, but positively related to their support for its countermajoritarian function. In this paper we develop a model to predict the seniority turnover, and transition consequences of term limit reforms for any institution with a regularized procedure for rotating membership. With this model we can predict the number of members who will be serving in their last term at any given time once an institution reaches a stable state under term limit reforms. For example, our results show that for the U.S. Senate current term limit proposals will result in a substantial increase in the number of “lame duck” members and a significant reduction in average seniority. We make no claims as to the public policy effects of term limit proposals. However, our model can be used to design a proposal that will maximize any benefits or minimize any public policy effects found to be associated with term limit reforms.  相似文献

主要的论题是政府在公共预算制定过程中,通过怎样的机制实现公共投资效率的最大化.采用了规范研究与实证案例研究相结合的研究方法.研究表明,公共投资效率的涵义是公共投入为相关民众带来福利的最大改进,其规范性制度意义是相关民众就公共预算方案达成一致同意.研究指出,实现公共投资效率的核心问题是居民偏好的有效表达与偏好的集结;基于偏好表达与偏好集结的不可能性困境,在居民偏好给定的情况下,通过居民参与公共预算方案的讨论与协商,居民的偏好能够有效表达,并在协商过程中理性地、非强制地改变自己的偏好,进而就公共决策达成一致同意.浙江省温岭市泽国镇实施的参与式公共预算模式,有效解决了公共投资决策中的偏好表达与偏好集结的问题,促进了公共投资效率的实现,在基层公共预算制度改革中具有普遍意义.居民在公共预算制定过程中的协商参与,不仅使得政府公共决策具有了政治上的合法性,公共决策满足了民众需求,更重要的是促进了公共投资效率的实现.  相似文献

在宁波市审批制度的改革过程中,削减审批事项和规范政府行为的审批制度改革(以下简称审改)是如何展开的,有哪些变量影响审改政策执行的成功与失败,这些变量之间又有着什么样的逻辑关系,通过对宁波市审改的政策过程分析,运用执行结构转换理论,对宁波市审改政策的执行过程进行了解释.认为审改政策执行是政策执行结构不断转换的过程.在审改政策的执行过程中,改革决策团体和执行团体之间是权力互动的.执行结构转换和权力互动过程是影响审改政策执行成败的因素.在宁波市审改的案例中,削减审批事项的执行结构从"有限分权"模式开始,逐渐向"有限分权与关系主导互动"模式转换;在规范政府行为时,政策执行结构又从"有限分权与关系主导互动"模式开始,逐渐向新的"有限分权"模式转换.在不同的执行结构模式下,审改决策团体和执行团体运用各自的权力资源讨价还价、策略互动的方式是不同的,从而影响到审改政策的执行结果.  相似文献

地方政府作为正式制度供给的主体之一,在民营经济发展过程中起着特殊而又重要的作用。以温州民营经济发展为背景,实证描述和分析了地方政府政策在突破旧制度约束过程中所呈现出的显著跃迁性的特征。温州地方政府适时的政策创新,促使民营企业的非正式制度创新逐步转变为正式制度安排,为民营企业从非法走向合法奠定了坚实的基础。温州地方政府在公共政策设计过程中,既符合了温州民营企业的利益和制度知识,又符合了政策者的既得利益和意识目标,政策供给兼备了社会可行性和组织可行性,从而使得政策效能得到了充分的发挥。  相似文献

This article's purpose is to examine the role of institutions in the innovation and dissemination of advanced technology in the international policy arena, focusing specifically upon multinational cooperation in the acquisition of advanced technology weapons. The analysis examines interrelationships among different national public policy processes and compares cross-nationally the role of governmental and non-governmental organizations in policy formulation. An analytic framework for comparative analysis of organizational objectives is developed and then applied to four cases of multinational cooperation. Based upon the results of this comparative analysis, the article's conclusion sets forth some observations potentially applicable to a policy aimed at furthering transatlantic cooperation in particular, and more generally, to public policy and technology.This is a revised version of a paper originally prepared for a Technology and Public Policy Workshop held under the auspices of the Technology and Policy Program at MIT on 16–17 February 1979. Today, most Americans dislike the news media as an institution. This has led to considerable debate about why people dislike the media and how their public standing could be improved. This paper contributes to this literature by using a survey experiment to test the effect of several different considerations on evaluations of the media. It finds, consistent with the broader literature on political persuasion, that elite partisan opinion leadership can powerfully shape these attitudes. Additionally, it finds that tabloid coverage creates antipathy toward the press regardless of predispositions and that horserace coverage has a negative effect on opinions among politically aware citizens on both sides of the political spectrum. Contrary to some claims in the literature, this study finds no detectable effect of news negativity.  相似文献

公立医疗机构民营化改革是新自由主义思潮波及并影响医疗卫生领域的重要表现,是当代全球公共部门治道变革的有机组成。尽管全球金融危机的爆发引起了人们对新自由主义思潮的全面反思,但是公共部门民营化改革的取向不会因此发生重大的转变。从国内公立医疗机构民营化改革的实践来看,托管经营模式、股份合作制模式和产权整体转让模式是较为典型的三种模式,这三种模式不论是在改革的进路、力度、目标,还是在绩效、阻力与风险等方面均存在着较为显著的差异。文章借助于浙江公立医疗机构民营化改革的实证材料,对上述三种模式进行了多维度的比较分析,以期更好地解读公立医疗机构民营化改革的不同模式及其适用性。  相似文献

The fall of the Soviet empire and the transition to democracy that has taken place in Central and Eastern Europe (and elsewhere) during the past three decades has focused new attention on both the processes of, and the issues involved in, democratic institution building. These experiences have shown that issues of linguistic and ethnic difference are often key elements in such matters. Ukraine, a country of considerable strategic importance, has struggled with both the transition to democracy and the relative roles of the Ukrainian and Russian languages in the task of nation-state building. This article examines the emergence of linguistic conflicts in Ukrainian government and public policy and explores, through a survey of higher education institutions, its impact on the preparation of the next generation of the nation's public administrators. The article concludes by explaining why the impact of this politically divisive issue has been more modest than might have been expected.  相似文献

构建政府廉政评价的公民参与机制,可以促使公民建立对反腐倡廉的理性认知,增强党和政府廉政工作公信力,提升公民满意度。依据参与深度的渐次推进,公民参与廉政评价对廉政建设能够发挥象征功能、鉴定功能、诊断功能、监督功能、战略功能。案例梳理表明,在当前中国各地政府实践探索中,政府廉政评价已逐步从内部评价走向引入民意调查和第三方评估,公民参与正处于从"无效参与"向"有限参与"的推进阶段,只是参与式评价的政府主导色彩仍然浓重。要想进一步增强公民参与廉政评价的动力,使公民在廉政评价动态过程的各环节实现主体身份,关键在于激发被评价对象和参与者两个方面的内在动因,形成公民参与的拉力和推力,进而从"理念—制度—环境—手段"四维度构建公民自主、有序、有效参与廉政评价的合理机制。  相似文献

Unesco (the United Nations Educational, Scientific and Cultural Organisation) was established in 1946, and the Australian government organisation responsible for advising on the implementation and coordination of Unesco policies and programs in Australia is the Australian National Commission for Unesco. Working from a Rawlsian notion of a public institution, a range of reforms are suggested for the commission: development of a charter, publication of an Annual Report, widening the membership of the commission, funding reforms, training of the membership of the commission, establishing a right of appeal against Commission decisions, and developing programs for public participation. It is suggested that the above reforms may assist in establishing and strengthening the Australian Commission for Unesco as a significant and independent public institution in Australia, and thus assist in the implementation of Unesco programs and projects in the future.  相似文献

This paper exploits uniquely detailed data and cross-institution variation in aid for three large public universities to identify the effects of aid on the probability of college graduation. The results indicate that need-based and merit-based aid both increase graduation rates at large public institutions, but primarily through the types of students that ‘select’ these institutions. Merit-based aid facilitates an institution attracting students who have higher observed academic ability that raises the probability of graduation. Need-based aid enables an institution to attract students with non-academic attributes such as social and cultural networks that, while often unobserved, improve graduation success. Broadly, our results suggest that recent aid policy that has moved away from need-based aid for low-income students (reducing their ability to find the best institutional match) and toward merit-based aid (that alters the distribution of high ability students across colleges) could foster stagnant graduation rates even with rising enrollment rates that have been observed over the last three decades.

There is a sameness to writing on public accountability which does not always do justice to the subject. With responsibility and accountability conflated and an idealised version of the Westminster model held up as the only test, ministers constantly appear irresponsible. Yet a more complex account of public accountability is possible, one which acknowledges that no single institution can undertake the important work of ensuring accountability from ministers, the parliament and public servants.  相似文献
