THE CONSUMER INFORMATION OVERLOAD CONTROVERSY AND PUBLIC POLICY

It is widely believed that providing consumers with more product information produces "overload" and leads to confusion and poorer quality consumer decisions. The existence of a consumer information overload phenomenon has been used by marketers and others to argue against regulations and legislation mandating additional consumer information provision. The belief that a consumer information overload phenomenon exists is based largely on misinterpretations of research findings. The present paper reviews the consumer information overload research literature and concludes that existing research data support the contention that provision of more information, rather than producing overload, actually improves consumer decision making. Implications of the information overload research controversy for consumer policy makers are discussed.     

THE COMPARATIVE POLITICS OF AGENDA SETTING: THE EMERGENCE OF CONSUMER PROTECTION AS A PUBLIC POLICY ISSUE IN BRITAIN AND THE UNITED STATES

This article compares the emergence of consumer protection as an issue on the public policy agendas of Britain and the United States in the 1960s. Similar forces caused the emergence of consumer protection in both cases. Governmental responses to consumer protection issues also have been similar, but distinctive features of each country's political system are evident as well. The analysis draws upon existing consumer protection literature for each country as well as the author's interviews with a number of Britons involved in this policy area. The principal conclusion is that consumer protection gained each country's policy agenda as a discretionary item. Events of the past few years demonstrate that it is not yet a durable agenda item in either case.     

EVALUATING THE IMPACT OF CONSUMER PROTECTION REGULATIONS: THE FEDERAL TRADE COMMISSION EXPERIENCE

Evaluation of consumer protection regulations promulgated by the Federal Trade Commission is a formal, ongoing activity employing a wide variety of commonly accepted research designs. This paper describes the variety of evaluation designs and gives examples of the application of these designs in assessing the impact of FTC Trade Rules in the marketplace. The authors also consider the future of consumer protection evaluation in an environment of severe budget constraints.     

THE DOCTRINE OF STRICT LIABILITY: AN ALTERNATIVE APPROACH TO CONSUMER PROTECTION REGULATION

Using a legal system of strict liability allowing contributory negligence as a valid defense provides an alternative to consumer protection regulation. In addition, the strict liability system allows rapid and responsive compensation to injured individuals. Corporate uncertainty as to future costs and business environment are substantially reduced, thus allowing firms to make accurate and rational long-term, strategic plans. This paper presents the basic functional constructs required for developing a viable regulatory framework using strict liability and then looks at an example where it could be employed. The scenario deals with an environmental pollution and protection problem. In the example, a strict liability system allowing for a defense of contributory negligence is shown to be conceptually more efficient and desirable than the existing regulatory system and negligence liability procedures.     

AMBIGUITY, CONTRADICTIONS, AND FRUSTRATIONS AT THE BALLOT BOX: A PUBLIC CHOICE PERSPECTIVE

A theoretical analysis of citizen participation in politics from a public choice perspective indicates that widespread apathy and disinterest are not aberrations in citizen behavior due to civic irresponsibility or the personal failings of individuals. Rather such responses are highly rational adapta- tions to a political system and political decision-making process over which the individual has little control and participation in which, while demand- ing, yields few tangible returns. Elections and voting are poor mechanisms for aggregating choice, allocating resources or directing public policy.     

SURFACE MINING CONTROL AND RECLAMATION ACT: A UTAH PERSPECTIVE

The authority to regulate the coal industry a t the state level, under state statute and rules, the importance of the coal industry to the state, the importance of an environmentally sound regulatory program, and the benefit of a state-managed abandoned mine reclamation program, in short the ability of the state to manage its own natural resources, make state primacy a necessity, not an option.
Implementation of SMCRA cannot be measured in the myriad of oversight statistics. Effectiveness means cost-effective, timely reclamation of abandoned sites; consistent, workable rules and regulatory practices; responsive program management; and compliance which is internalized in the mine's operations.     

NEW DIRECTIONS IN EMPLOYMENT AND TRAINING POLICY: A FEDERAL PERSPECTIVE

The U.S. Department of Labor's "Work Force 2000" project has identified long-term trends that will affect future employment and training policy. These include demographic trends such as a decline in the pool of young labor market entrants and an increase in women, minority, and immigrant workers; the continued shift from goods-producing industries to the service sector; and continued technological innovation in response to increased international competition. These projected changes in the labor market and workplace present a national challenge and an opportunity to tackle the longstanding problems of disadvantaged workers. Cooperative public and private programs to eliminate illiteracy and increase job skills and competencies, ease labor mobility and provide retraining, and attack underlying social problems that support the cycle of welfare dependency and unemployment are needed to provide the workforce America needs for the future.     

FINANCIAL INDICATORS AND TRENDS FOR LOCAL GOVERNMENTS: A STATE-BASED POLICY PERSPECTIVE

Recent federal reports, the projected "new" federalism, research in financial and economic trends, and the emerging consensus concerning local government distress have highlighted the fact that no comprehensive or systematic federal, state, or local policies exist to deal with the problems that have been identified. The purpose of this article is to perform a statebased study of financial patterns and trends in local governments that have implications for state policy. Included in the analysis were correlations between constant dollar financial indicators and an instability index for four data points. The results of the analysis and trends suggest that certain consistent patterns which have implications for state policy exist.
