From 1941 to 1944, MI5 faced determined attempts to penetrate Allied Air Forces using trained pilot agents recruited by German Military Intelligence (Abwehr). The mission of these pilot agents was to gather military intelligence and to return to German held territory. This pattern of targeting Allied Air Forces has not been recognized by historians. This article examines MI5's responses to the threat using recently released files in the National Archives.  相似文献

The network of public agencies, private firms, nonprofit organizations, ad hoc groups, and individual volunteers that deals with natural and technological hazards and disasters did a remarkable job of responding to and helping us recover from the September 11th attacks. That national emergency management network, along with the national security and law enforcement networks, provides a foundation for our war on terrorism, helps us mitigate the hazard of terrorism, and improves our preparedness for future violence. However, coordinating the efforts of the networks will be a real challenge for the director of homeland security and his or her state and local counterparts. Coordination will necessitate using legal authority to assure compliance, economic and other incentives to encourage compliance, formal partnerships to encourage collaboration, informal understandings to encourage cooperation, and personal encouragement to influence appropriate action. A top–down, command–and–control approach to the war on terrorism, such as the proposed Department of Homeland Security is intended to provide, may be counterproductive.  相似文献

The Nigerian Constitution of 1989 establishes a system of federaland state courts, but within a structure of unified federal-statejurisdiction from the federal and state high courts, to thefederal Court of Appeal, and to the national Supreme Court.Thus, both sets of courts exercise jurisdiction with respectto federal and state laws. Although this system mitigates certainfederal-state jurisdictional conflicts, it does not eliminatesuch conflicts. At the same time, however, the Constitutionalso provides for Sharia courts of appeal under Moslem law andfor customary-law courts of appeal, thus establishing a tripartitesystem of justice. Although this system seeks to accommodateNigeria's ethnic and religious diversity, it does raise problemsfor national unity, judicial uniformity, and equity in the administrationof civil and criminal justice.  相似文献

As an increasing number of scholars have argued, the fiction of popular culture and the reality of politics are inseparable. Fact and fiction, rather than remaining distinct, are mutually constitutive and interact to produce new meaning. A critical reading of Fox Television's intensely popular series 24 suggests that the series (re)produces key elements of the global war on terrorism discourse and is therefore a particularly useful case for under standing the importance of intertextuality for the production of meaning. Though the packaging of 24 may be new and exciting, the underlying messages remain the same, in the process rendering commonsensical the US global war on terrorism and the way that it has been waged.  相似文献

国家的刑事责任长期以来都是各国政府和国际法学者争议且没有定论的问题。虽然国家的国际刑事责任在国际法上还没有充分的依据,但不能因此否定国家刑事责任的存在。自二战以来,国际社会已经有对犯有国际罪行的国家予以制裁的实践,但这些实践并未最终促成国际社会在国际法上制订出相应的追究国家刑事责任的法律,因此,对于如何追究国家的国际刑事责任并没有具体的法律依据。本文从国家恐怖主义的角度论证国家应该承担国际刑事责任的必要性,从一个新的方面来探讨从立法上追究国家刑事责任的可行性。  相似文献

Through an analysis of government reports, political testimony, influential periodicals and interviews, this paper holds that claims of North Korean drug trafficking and producing are greatly exaggerated. An assessment of the 1999 International Narcotics Control Strategy Report, 1999 North Korea Advisory Group Report, 2000 International Crime Threat Assessment, and 2004 United Nations Report on World Drugs, among other sources, reveals only inconclusive and anecdotal support for the contention that North Korea is a drug state. This lack of reliable intelligence allows American security analysts to construct North Korea as a drug sponsoring country, making the “truth” about North Korea's relationship to drugs come from endless repetition rather than sustained analysis. As a result, US approaches towards security and drug policy in the region need to be reexamined and contextualized.

Following the tragic, massive terrorist attacks on the United States in September 2001, many antiterrorist laws, policies, and institutions have emerged to wage war on terrorism. These antiterrorist initiatives have major consequences for individuals, societies, and nations all over the world. Although controversies have proliferated with regard to the implications of counterterrorism for people's basic rights, the debate remains fragmented and often unfocused. This article examines the critical impact of new antiterrorist initiatives on the fundamental rights and responsibilities of citizens and others, with special reference to public administration.  相似文献
