In recent years there has been considerable debate over the legal and ethical issues associated with posthumous reproduction. This article analyses recent cases and legal regulation of reproductive technologies in Australia. The issues associated with posthumous reproduction are explored through a consideration of the nature of an individual's interest in their reproductive material. The suitability of a property-based model as a means of conceptualising interests in reproductive material is explored. The article concludes that the issues in this area need to be analysed in terms of autonomy interests that are understood relationally.  相似文献

This paper describes the development of New Zealand policy on posthumous reproduction in assisted human reproduction. It outlines five perspectives: medical, ethical, cultural, psychosocial and legal and shows the multidisciplinary approach taken by the National Ethics Committee. It is argued that each of these perspectives has important contributions to make to the multidisciplinary approach. The guidelines determined by the Committee are outlined, along with the processes used in arriving at these.  相似文献

随着我国机动车的增加,交通事故中遗腹子的抚养费问题日益突显,我国目前的法律就此问题未作明确规定,在司法实践中,各地法院的判决各异,在理论上也存在争议。遗腹子可分为胎儿状态以及出生状态两种基本形态,其中,胎儿的民事权利能力问题在学界也存在一定争议。根据生命法益说、人身权延伸保护说等理论,胎儿的抚养费应得到支持。出生后的遗腹子又要区分是否亲生、是否为活体、是否保持稳定的生命体征以及是否借助辅助生殖技术等不同情形,进而再作出是否支持其抚养费的判断,而根据不同的情形,原被告的举证责任又会有所不同。  相似文献

Summary In this article I have attempted to theorize the relations of reproduction in a manner that makes their operation in history more apparent. Using an historical materialist analysis, I have diverged from previous analysis by situating reproduction in the base and positing a co-determinative relation between production and reproduction. I have argued that due to the distinctly different dynamic of reproduction, its longer completion time and its political subordination in class societies, we must pursue different research strategies than those used to illustrate the impact of production on reproduction. This article serves only to give the broadest outline of concerns and questions to focus upon in developing new strategies. As such it suggests that the ubiquity of patriarchy and its preservation, even in the face of structural contradictions with production, provide a starting place for such inquiry. To this end I have developed a model of the modes of reproduction in order to rediscover reproduction in history, its dynamic and its interaction with production.This perspective permits us to reanalyze old rules and customs previously understood exclusively as rules of production (e.g., rules of inheritance and property, certain labour and welfare laws), and discover within them the impact of the reproductive as well as the productive imperative. The model emphasizes the inextricable connection between production and reproduction at the same time that it calls attention to the distinctiveness of their dynamics. Dynamics which, because of their distinctiveness, do not automatically guarantee balance between the two spheres. Hence the continuous necessity for socially engineering this balance, a necessity requiring even more intervention as the two spheres become structurally more alienated.  相似文献

This article is the result of a study aimed at grasping the knowledge of ‘prostitution’ since 1999 when the purchase of sexual services was criminalised in Sweden. Key informants drawn from the police, social services and voluntary organisations, who work in close proximity to prostitution, were interviewed. We focus on how the position of the informant, considering governmental and non-governmental exercise, effects her or his understanding, and reproduction, of the phenomena. The central themes are the question of definition, the importance of exposure and the occurrence of male prostitution. It is suggested that a study of these themes shows how the traditional position of the bad woman as vendor and the invisible man as purchaser is preserved. Hereby all the other constellations, that may as well be considered to be prostitution, remains unproblematized.  相似文献

The process of building human faces by applying clay to skulls to generate leads for identification of unknown human remains is plagued by the use of a number of terms which are already used for other purposes. Reconstitution, reconstruction, restoration, death mask, moulage, and sculpture have all been used, but each is used in another context in forensic science. "Facial reproduction" is suggested as a term which is not already in use in forensic science, which is precise, and which would thus be preferred over any of the other terms.  相似文献
