Abstract

The aim of the study was to investigate the relative importance of psychological, criminological, and substance abuse variables in differentiating between alleged false confessors and other prison inmates. The participants were 509 inmates newly admitted to all Icelandic prisons over a four-year period. Sixty-two (12%) of the inmates claimed to have made a false confession to the police sometime in the past. A discriminant function analysis was used to identify the variables that best discriminated between the alleged false confessors and the other prison inmates. Out of 17 psychological variables and 16 criminological and substance abuse variables, two variables (number of previous imprisonments and the score on the Gough Socialisation Scale) correctly classified 93% of the non-false confessors and 32.3% of the alleged false confessors, with a total classification rate of 82.7%. The findings suggest that among Icelandic prison inmates, antisocial personality characteristics and the extent and severity of criminal behaviour, as judged by number of previous imprisonments, are the best predictors of offenders claiming to have made a false confession to the police. The implication is that among some prison inmates, making a false confession is a part of their criminal life style.  相似文献

Purpose. The main aim of the study was to examine the reasons and personality factors associated with confessions and denials. It was hypothesized that antisocial personality traits and active involvement in criminal behaviour would distinguish true confessors and true deniers from false confessors and false deniers. Method. The participants were 1,080 students in further education in Iceland. Each was asked about false admissions made to teachers and parents in the past, as well as about confessions or denials (true and false) made to the police during questioning, and the reasons for having responded in the way they did. The participants also completed questionnaires relating to offending, personality and self‐esteem. Results. One‐quarter (25%) of the participants stated that they had in the past been interrogated by the police in relation to a suspected offence, of whom 59% said they had confessed. A small minority of those interrogated (3.7%; 1% of the total sample) claimed to have made false confessions to the police, whereas 10% claimed to have made false confessions to teachers or parents. Males were significantly more likely to report false confessions than females. False confessions and false denials were significantly associated with antisocial personality traits, with Eysenck Personality Questionnaire Psychoticism being the single best predictor. Those participants who made true confessions and true denials were most normal in their personality. Conclusions. Personality is a significant predictor of who makes false confessions and false denials.  相似文献

Abstract

There is increased recognition that people interviewed by the police are often psychologically vulnerable due to modest intelligence, mental health problems, disturbed mental state, and personality problems. The current study aimed to investigate differences in the mental state and personality between suspects and witnesses. The participants were 78 individuals (47 suspects and 31 witnesses) who had been interviewed by the Icelandic police. They were assessed psychologically immediately after the interview with the police was completed. Significant differences emerged between the two groups with the suspects being more depressed, hopeless, compliant and personality disordered than the witnesses. Four of the suspects claimed to have made a false confession to the police due to their immediate need or psychological problems.  相似文献

In this study all offenders admitted to Icelandic prisons over a one year period were approached and 229 (95%) agreed to co-operate with the study. Twenty-seven (12%) of the 229 subjects claimed to have in the past made a false confession during police interviewing. Women prisoners more commonly claimed to have made a false confession than males. The main motives given for having made the false confession were to protect somebody else (48%) and police pressure or escape from custody (52%). The great majority (78%) of the subjects had never retracted the confession, claiming that they had perceived no point in dong so. Twenty-one (78%) of the subjects were convicted of the offenses to which they had, allegedly, made a false confession. The findings in the present study raise the possibility that within an inquisitorial system false confessions may go relatively undetected by the judiciary and be rarely retracted or disputed.  相似文献

Purpose . The main aim of the study was to examine false confessions to police, parents and teachers and their relationship to personality and self‐reported offending. Method . The participants were 715 students in further education in Denmark. Each was asked about false admissions made to teachers and parents in the past, as well as about confessions or denials (true and false) made to the police during questioning. The participants completed questionnaires relating to offending and personality. Results . Seventy‐three (10%) of the participants said they had been interrogated by the police, of whom thirty‐seven (51%) said they had committed the offence. Five (7%) said they had given a false confession to police, whereas one hundred and seven (15%) of the total sample said they had given a false confession to parents or teachers. False confessions to teachers and parents were best predicted by the rate of self‐reported offending and high compliance. The single most commonly reported reason for making a false confession was to protect a friend. Conclusions . The findings in the present study corroborate many of those found in similar Icelandic studies, although there were some differences, including fewer people being interrogated in Denmark and a higher base‐rate of innocence of those interrogated. The study indicates that false confessions to police do happen on occasions which needs to be recognized by the authorities.  相似文献

Abstract

Jurors are often provided with confession evidence and must determine whether the confession was true, false, coerced, or voluntary. As more juveniles are tried in adult criminal court, jurors must increasingly make these determinations about minors’ statements. In this study, mock jurors read an actual interrogation of a child suspect that included confession evidence, and then provided judgments regarding the coerciveness of the interrogation, the child's and police's knowledge and behaviors, and guilt. Child age (11 versus 14 years) and gender were manipulated and examined in relation to participant gender and pre-existing sympathy levels for juvenile offenders. Factors external to the suspect – participant gender and sympathy for juvenile offenders – interacted with child suspect factors to influence perceptions of the child, the interrogation, and guilt. When multiple factors were considered, perceptions of suspect credibility and police fairness were the strongest predictors of guilt and perceived culpability. The findings have implications for decision-making in cases involving juvenile defendants and confession evidence.  相似文献

Abstract

We describe a study of more than 1000 interrogations by Metropolitan Police Officers. Obtaining a confession is found to be the paramount reason for interviewing a suspect. However, few suspects who did not initially confess changed their minds during the interview. 42% of suspects admitted their guilt—about the same number as obtained before tape recording of interviews was introduced. Strength of evidence and legal advice were the principal factors associated with confessing. The confession rate also varied according to which police station hosted the “interview”. An “accusatorial” style of questioning was associated with the possession of strong evidence against the suspect.  相似文献

Abstract

The purpose of this study is to explore sex offenders' perceptions of how the police should interview suspected sex offenders to facilitate confessions, and to investigate whether there is a relationship between sex offenders' perceptions of how the police interviewed them and their decisions to confess or deny. Forty-three convicted sex offenders were interviewed using two 35-item questionnaires that contained five questions on each of seven interviewing strategies. An additional 20 violent offenders were included for comparison purposes. The strategies were evidence presenting strategies, ethical interviewing, displays of humanity, displays of dominance, use of minimization and maximization techniques, and demonstrating an understanding of sex offenders' cognitive distortions. One questionnaire concerned how the police should interview sex offenders and the other concerned how they perceived the police who interviewed them. Generally speaking, evidence presenting strategies, ethical interviewing, and displays of humanity were perceived to increase the likelihood of a confession. Interviewer dominance was perceived to be associated with a reduction in the likelihood of a confession.  相似文献

Purpose. Videotaped confession evidence elicits harsher evaluations against a defendant if initially recorded with the camera focused primarily on the suspect, compared with other presentation formats. Unfortunately, most videotaped confession evidence employs this biasing suspect‐focus camera perspective format, leaving defendants with no recourse. The present study examined the utility of judicial instructions in mitigating the effects of the camera perspective bias on individual juror verdicts. Methods. Through random assignment, 156 mock jurors did or did not receive explicit instructions to correct for the camera perspective bias prior to viewing a video recording of an authentic true or false confession. Results. As expected, mock jurors who received instructions to correct for the camera perspective bias reported more lenient judgments of confessor guilt after viewing a suspect‐focus confession recording compared to those who did not receive such instructions. However, this relative leniency emerged only in response to false, and not true, confessions. Conclusions. Results demonstrated that judicial instructions used in the present research mitigated the effect of camera perspective on mock‐juror judgments of suspect guilt.  相似文献

Abstract

Confession evidence presented at trial is extremely damaging to the defense. This study examines the impact of a recanted confession on jurors’ perceptions of a murder case in which the defendant claimed to have falsely confessed due either to an underlying medical condition, a psychological disorder, or the general stress of the interrogation. Also included were an inadmissible confession condition and a no-confession control condition. Results showed that the impact of the confession was mediated in part by the circumstances surrounding it. Although probability-of-commission estimates were as high in all of the conditions involving a confession, conviction rates were marginally higher when the disputed confession involved mental illness or interrogation-induced stress than when there was no confession, yet did not differ when the disputed confession involved a medical disorder or there was no confession. These findings show that not all recanted confessions are treated equally and that people selectively discount confessions depending on biases and beliefs they hold.  相似文献

ABSTRACT

Few studies have examined police interrogation strategies from suspects’ perspectives, yet assessing suspects’ views about interviewer approaches could provide important insights regarding confession decision making. The current study is the first American survey to assess a diverse sample of adult jail inmates’ views on police interrogation tactics and approaches. The study explored US jail inmates’ (N?=?418) perspectives about how police should conduct interrogations. Potential dimensionality among 26 survey items pertaining to police tactics was examined using exploratory factor analysis. Group differences according to demographic and criminological variables were also explored. Four factors emerged, conceptualized as Dominance/Control, Humanity/Integrity, Sympathy/Perspective-Taking, and Rapport. Respondents most strongly endorsed Humanity/Integrity and Rapport strategies and were unsupportive of approaches involving Dominance/Control. Gender differences emerged for Dominance/Control and Humanity/Integrity, and Black respondents were more likely to value strategies related to Sympathy/Perspective-Taking. Suspects endorsed interrogation strategies characterized by respect, dignity, voice, and a commitment to the truth; they reported aversions to the false evidence ploy and approaches involving aggression. Overall, results from this incarcerated sample suggest that interviewees may be more responsive to rapport-building, non-adversarial strategies.  相似文献

Abstract

The criteria used by Swedish courts for assessing credibility of plaintiffs' accounts were for the first time scientifically evaluated. Furthermore, unlike much previous deception detection research, we used offenders as participants instead of college students. False and truthful confessions by 30 offenders were analysed, and few significant effects were obtained. Truthful confessions were rated as having a higher degree of clarity than false confessions. Women's truthful confessions were rated as more credible than their false confessions. The offenders who were most experienced in being interviewed by the police gave a stronger impression of talking about something self-experienced in their false than in their truthful confessions; hence, it seems that offenders with more police interview experience have developed a kind of expertise in telling a convincing lie about crime. Overall, the criteria for credibility assessment used by Swedish courts had very limited usefulness in discriminating truthful and false confessions. A critique of the current status of evaluating statements in Swedish courts is provided.  相似文献

College students and police investigators watched or listened to 10 prison inmates confessing to crimes. Half the confessions were true accounts; half were false—concocted for the study. Consistent with much recent research, students were generally more accurate than police, and accuracy rates were higher among those presented with audiotaped than videotaped confessions. In addition, investigators were significantly more confident in their judgments and also prone to judge confessors guilty. To determine if police accuracy would increase if this guilty response bias were neutralized, participants in a second experiment were specifically informed that half the confessions were true and half were false. This manipulation eliminated the investigator response bias, but it did not increase accuracy or lower confidence. These findings are discussed for what they imply about the post-interrogation risks to innocent suspects who confess.  相似文献

In relation to American policemen, Japanese officers want to be known for the warmth of their care rather than the strictness of their enforcement.1

Much of the most disturbing police behaviour stems from two connected facts: the system's overwhelming dependence on admissions of guilt, and the absence of checks on police power in the interrogation room. In Japan, the conditions of interrogation—the duration and intensity of questioning, the duty to endure questioning even after the right to silence has been invoked, and the unavailability of defence lawyers—means that an ‘overborne will’ is more than merely an occasional problem.2  相似文献

Abstract

The present experiment examined the ability of fifty-two uniformed police officers to detect deception. The experiment differed from previous experiments into detecting deceit because of its high stake lies scenario. The judges were exposed to videotaped press conferences of people who were asking the general public for help in finding their relatives or the murderers of their relatives. They all lied during these press conferences and they all have been found guilty of killing their own relatives. The judges did not perform better than could be expected by chance. Additional analyses showed that accuracy was unrelated to confidence, age, years of job experience in the police force, or level of experience in interviewing suspects. There was, however, a significant positive correlation between having experience in interviewing suspects and being confident in detecting deception. Finally, men were better at detecting deception than women.  相似文献

Abstract

The prosecution and recent legal reversals in the New York “Central Park Jogger” case are discussed with a focus on the preoccupation with crime in US society and concerns regarding racial discrimination in the legal system. It is argued that the inherently coercive nature of interrogation, and the secrecy that surrounds custodial interrogation, create conditions that are ripe for abusive treatment. The phenomenon of false confession is presented and discussed with regard to the Central Park Jogger and other cases. The author advocates the recording and preservation of the entire period of custodial questioning so that there is an objective record of the interrogation methods that lead to “confession” statements.  相似文献

Abstract

The present experiment examined the apparently incongruent findings that police officers (i) believe that suspects show nervous behaviour when they lie but (ii) seem able to detect deceit in suspects who do not show nervous behaviours. It was hypothesized that police officers’ judgements about whether a suspect is lying would not be correlated with their judgements regarding whether the suspect is tense, but, instead, would be correlated with their judgements regarding whether suspects are having to think hard or attempting to control their behaviour.

Each of 84 police officers saw seven truths and seven lies told by suspects during their police interviews. Participants in Condition 1 were asked to indicate after each clip whether the suspect was lying, whereas participants in Condition 2 were asked to note after each clip to what extent the suspect appeared to be tense, having to think hard or attempting to control their behaviour. Condition 3 was a combination of Conditions 1 and 2 and participants were asked all the above questions. The findings support the hypotheses and therefore negate the assumption that police officers primarily look for cues of nervousness when they attempt to detect deceit.  相似文献
