This can have a severe impact on survivors of domestic violence who are prevented from leaving dangerous situations by threats of dissemination. Victims of revenge porn and domestic violence often face isolation, threats of violence, and thoughts of suicide. This Note proposes that threats of revenge porn become family offenses under the New York Family Court Act § 812.

我国冲突法立法应拓展意思自治原则的适用范围

从冲突法的价值取向上分析,以往我国学界对当事人意思自治原则根基的认识失之狭隘,往往仅笼统地论及该原则的正义性,而没有将之细分为“冲突正义”和“实体正义”加以考察,更没有明确涉猎“冲突效率”和“实体效率”之价值取向。正因为当事人意思自治原则将正义与效率融于一炉,故其在冲突法中的存在和发展较之其它冲突规范具有明显的“比较优势”。有鉴于此,在不损害国家利益和社会政策的前提下,我国冲突法立法应拓展当事人意思自治原则的适用范围,并将当事人默示同意选择法院地法的自治权利扩大至更为广泛的法律冲突领域。     

An Eye for an Eye: Proportionality as a Moral Principle of Punishment

The lex talionis of the Old Testament has been widely perceived—understandably,but mistakenly—as a barbaric law of retribution in kind.It is better understood as a seminal expression of restraintand proportionality as moral principles of punishment. Thishas been recognized from the earliest times. Over the interveningcenturies, the lex talionis has lost neither its moral significancenor its penal relevance. This is reflected in H.L.A. Hart'ssynthesis of modern retributivist and utilitarian theories ofpunishment and, again, in contemporary Canadian law throughthe recognition of proportionality as the fundamental principleof sentencing under the Criminal Code. The tension between thisfundamental principle and Canada's increasing resort to mandatoryminimum sentences of imprisonment is examined briefly in thislight.     

An Investigation of Mental Health and Personality in Swedish Police Trainees upon Entry to the Police Academy

This study aimed at personality and mental health status of Swedish police trainees considering gender differences; and at relationships between personality and mental health. 103 individuals were investigated by means of the SCL-90-R and the Temperament and Character Inventory (TCI) upon entry to the police academy. By contrast, the police trainees were mentally much healthier than individuals from the general population. They reported low Harm Avoidance and their character dimensions were more developed in terms of strength, responsibility and reliability. Harm Avoidance (positively) and Self-Directedness (negatively) were found to be associated with all facets of psychopathology. The good mental health and mature personality characteristics reported by trainees, particularly the females, suggest that they have the strength to master the stressful situations which they will face in their professional lives. In order to prevent possible psychological disturbances later in life, due to the high level of distress in their work, the development of trainees’ personality in terms of particular coping skills should be regarded as an integral part of their professional training at the police academy.

Effect on Eyewitness Accuracy When Witnesses Are Told versus Not Told That They Will Be Allowed a Second Viewing

Lindsay, Lea, and Fulford (J Appl Psychol 76:741–745, 1991) found that false identifications increased, correct rejections decreased, and correct identifications minimally increased when witnesses were allowed a second viewing of a sequential lineup. We conducted a similar study in which we allowed mock witnesses a second viewing of a sequential lineup. Results indicated that participants who were allowed a second viewing made mostly incorrect identifications. Participants correctly identified the perpetrator more often when they were not told in advance that they would have a second viewing than when they were told. Additionally, those participants who were told that they would be allowed a second viewing incorrectly rejected the lineup more often than those who were not told. The findings yielded conclusions similar to those of Lindsay et al. (J Appl Psychol 76:741–745, 1991) suggesting that witnesses should not be allowed to view the lineup a second time. The results also suggest that, if a repeated lineup is used, witnesses should not be informed of that in advance.     

Police Integrity and the Czech Police Officers

The Velvet Revolution of 1989 ended the socialist period in former Czechoslovakia. Sixteen years after the transition toward democratic policing, we explore the integrity contours of the Czech police. In the summer of 2005, we surveyed more than 600 police officers from East Bohemia regarding their perceptions about the seriousness of police corruption, the appropriate punishment such misconduct deserves and would receive, and their willingness to report misconduct. The results indicate that the majority of the respondents correctly labeled behaviors described in our questionnaire as rule‐violating. Furthermore, with the exception of the least serious forms of corruption, they supported and expected the two most serious forms of discipline: a cut in salary and dismissal. Finally, the majority of the respondents said that they would not be willing to tolerate the most serious forms of corruption in silence.
