Child witnesses and the confrontation clause

InMaryland v. Craig, the United States Supreme Court relied heavily on a brief prepared by a committee of the American Psychology-Law Society on behalf of the American Psychological Association (APA). The APA brief concluded that sexually abused children may be particularly vulnerable to distress in the legal process, especially when forced to confront the defendant face to face, and that such acute distress may be inconsistent with the state's interests in promotion of reliable testimony and child welfare. Case comment: Moore v. Regents of the University of California.

The increasing use of human tissues in medical research has spawned a host of ethical and legal debates. Legal analysis in this area has almost exclusively focused on the question of property rights in both the tissues used in research and in the resulting products. One illustrative case is Moore v. Regents of the University of California, in which a patient sued his doctor for conversion of his spleen which had been removed for therapeutic purposes. The doctor later used the spleen to develop a patented and profitable cell-line. This Comment examines and rejects the property law approach to this issue. Instead, this Comment proposes two legislative changes which would 1) eliminate any trade in human tissues and 2) require doctors to inform their patients of any research interest in proposed medical procedures. These proposals resolve the problem presented in Moore, and avoid the misleading, and inevitably unanswerable, question of property rights.

Jonestown tragedy revisited: the role of dentistry

The authors record the contribution of dentistry to the identification of victims of one of the most significant tragedies of the 20th century--the mass suicide of members of a religious cult, which initially resulted in 913 deaths and ultimately in 923. Though forensic dentistry played a significant part in identifying victims, the only report by members of the United States identification team did not examine dentistry's valuable role. Furthermore, the dental-investigation aspects have been mentioned merely in passing by the news media despite an infinite number of stories on the tragedy ranging from factual to expose. The dental team's organization, methodology, and significant contributions to forensic dentistry and a variety of remarkable problems that the team encountered and the lessons learned from them are documented in this paper.     

Tenerife revisited: the critical role of dentistry

The authors record the contribution of dentistry to the identification of victims of one of the most significant disasters in the history of aviation-the March 1977 collision of two Boeing 747 jumbo jets in the Canary Islands, which resulted in 583 fatalities. Dental identification was the primary method of victim identification because a high percentage of the bodies were severely burned. Virtually all aspects of the U.S. identification efforts have been reported with the exception of the valuable role of dentistry. The dental team's organization, methodology, and significant contributions to forensic dentistry and a variety of remarkable problems that the team encountered are documented.     

The good, the bad, and the ugly: how the due process clause may limit comprehensive health care reform

This article examines atopic which has receivedlittle attention from the media or other scholarly publications: The due process concerns that arise when engaging in comprehensive federal health care reform and regulation. First, the article provides a background discussion detailing the factors necessitating health care reform in the United States. Second, it analyzes whether a constitutionally protected right to make personal health care decisions exists under the Fifth and Fourteenth Amendments' Due Process Clauses. Finally, the article analyzes the susceptibility of government-sponsored health care-specifically proposals which include a public option-to due process challenges and makes suggestions to avoid any potential fundamental rights violations.
