ABSTRACT

Despite the fact that LGBTQ individuals are at greater risk of victimization than the average citizen, the LGBTQ community’s relationship with law enforcement has been a turbulent one. Using a mixed-methods approach, including surveys, semi-structured interviews and observations of town hall meetings, and following the participatory action research framework, this study examines the interactions between the LGBTQ community and law enforcement, and the perceptions of police within the LGBTQ community. The current study demonstrates how members of the LGBTQ community continue to have negative experiences with police that adversely impact their perceptions of law enforcement. Moreover, the findings underline the importance of examining how multiple identities impact an individual’s experiences with and their perceptions of law enforcement. Expanding past research on this topic, this study offers an analysis based upon suggestions of the study’s participants of what steps must be taken in order to improve relations between these two groups.  相似文献

Novel psychoactive drugs (NPDs) such as synthetic marijuana, bath salts, and salvia have increasingly entered into the American drug landscape. As law enforcement, researchers, and policy makers attempt to better understand, regulate, and detect these novel substances, other practitioners invested in drug abuse prevention and treatment may lack the knowledge to adequately handle patients and adolescents abusing NPDs. The current study employs interviews with 64 practitioners employed in positions that interact with potential recreational substance users in southeast Georgia in order to assess NPD knowledge, placing particular emphasis on those 22 respondents employed in public health, healthcare, or educational roles. Findings indicate that knowledge about NPDs among medical and educational practitioners is lacking, much of the information they ‘know’ is inaccurate, and that practitioners clearly recognize a need for NPD training. We discuss these findings relative to their broader impact on treatment and prevention programs.  相似文献

Our paper presents the results of a meta-analytical review of street level drug law enforcement. We conducted a series of meta-analyses to compare and contrast the effectiveness of four types of drug law enforcement approaches, including community-wide policing, problem-oriented/partnership approaches that were geographically focused, hotspots policing and standard, unfocused law enforcement efforts. We examined the relative impact of these different crime control tactics on street-level drug problems as well as associated problems such as property crime, disorder and violent crime. The results of the meta-analyses, together with examination of forest plots, reveal that problem-oriented policing and geographically-focused interventions involving cooperative partnerships between police and third parties tend to be more effective at controlling drug problems than community-wide policing efforts that are unfocused and spread out across a community. But geographically focused and community-wide drug law enforcement interventions that leverage partnerships are more effective at dealing with drug problems than traditional, law enforcement-only interventions. Our results suggest that the key to successful drug law enforcement lies in the capacity of the police to forge productive partnerships with third parties rather than simply increasing police presence or intervention (e.g., arrests) at drug hotspots.

In the wake of high-profile deadly force cases in the post-Ferguson era, a number of negative psychological outcomes have been depicted by law enforcement officers. We examine if negative post-Ferguson outcomes predict current cynicism, motivation, and apprehensiveness. Further, we account for whether role orientations, specifically support for a law enforcement orientation or a community policing orientation, mediate the psychological effects of the post-Ferguson period. Since the law enforcement orientation, exercised through strict enforcement of the law, has been called out of favor in the post-Ferguson area, supporting this role may negatively impact officers via role conflict. The opposite may be observed for those supporting a community policing orientation. We test these arguments using results from an online survey of law enforcement officers in the USA, administered 6 months following highly publicized incidents in Dallas and Baton Rouge where police were targeted and killed. Results showed that post-Ferguson psychological impacts continued to affect current levels of cynicism, motivation, and apprehensiveness. Support for law enforcement or community policing orientation did not mediate the effects of post-Ferguson sentiments. Nonetheless, role orientations played a significant role in predicting current cynicism, motivation, and apprehensiveness and provided support for the theory of role conflict.  相似文献

This paper presents a model of a vertically organized distribution network of illicit drugs. The key assumptions are costs imposed by law enforcement on drug sellers and the vertical relationship between trackers and retailers. We study the effects of a tougher drug law enforcement policy on wholesale and retail prices of drugs according to the identity of the pursued member of the distribution network, trafficker or retailer. We show that these effects are different according to the used law enforcement tool (probability of detection or sanction) and according to the seller who undergoes the law enforcement (retailer or trafficker). Moreover, results of tougher law enforcement can be opposite to a usual objective of the drug policy, namely, the decrease of the number of consumers. This model could partially explain the failure of the “war on drugs” in the United States in the 1980s.  相似文献

Many law enforcement agencies around the world have adopted risk assessment methodologies to analyse organised crime. These assessments, which are intended to provide law enforcement management with rigourous analysis to enable rational and objective decision-making processes, are an integral part of intelligence-led policing. Despite the prevalence of these assessments, as the assessments and their methodologies are often tightly restricted within the law enforcement community, it is often unclear how law enforcement defines, analyses and makes decisions about organised crime. While the use of risk assessment methodology in policing to analyse organised crime is generally under-evaluated, critics point to serious methodological weaknesses. Another less-explored aspect in the scholarly literature is how law enforcement conceptualises and measures the impact of “harm” from organised crime and uses this analysis to inform priority-setting processes. This article explores how law enforcement assesses organised crime-related harm by examining five policing methods—one each from Australia and the Netherlands and three from the United Kingdom. The article finds that the methods have significant shortcomings: the main concepts are generally ill-defined and the operationalisation of these concepts is problematic. More importantly, the problems evident in the harm methods raise several critical questions, specifically whether measuring organised crime-related harms is empirically feasible and, if so, can be undertaken in a manner that meaningfully informs law enforcement’s decision-making and limits undue political interference.  相似文献

The economic recession throughout the history has always been accompanied by relaxation or abandonment of anti-monopoly laws, but this crisis is not experiencing substantive recession of anti-monopoly law enforcement in major countries and regions. This has mainly resulted from the recognition that anti-monopoly law enforcement could ease adverse effects of economic recovery. Considering China’s short history of anti-monopoly law enforcement and consistent tradition of government intervention in the economy, more strict anti-monopoly law enforcement should be adopted, and more attention should be paid to government-led anti-competitive efforts.  相似文献

Survey research was conducted to examine the effects of education, perceptions of community attitudes, and career commitment upon overall job satisfaction of campus law enforcement officers in North Carolina. Thirteen (13) campus departments participated in the 1984 study. Findings revealed both significant and insignificant relationships. The attained level of post-secondary education was not significantly related to an officer’s perception of having his/her authority questioned, nor was education related to an officer’s feeling of boredom with the job. However, significant relationships were found between several variables including an officer’s willingness to recommend the job to another person and his/her perceptions of community attitudes and the rank of the officer and his/her commitment to the current position.(1)  相似文献

This article examines the role of NGOs in wildlife law enforcement, drawing on empirical research conducted within UK environmental law enforcement but also drawing on a review of the academic literature and policy debates concerning NGOs and pressure group activity. It examines the theoretical basis for NGO actions and different policy perspectives, the ideologies employed by NGO's and how these manifest themselves in law enforcement policies and practice. While the focus of this essay is UK and US NGO activity with its professional enforcement activity and policy networks, the impact of wildlife and environmental NGOs is significant in a range of jurisdictions and is a vital component in effective policing of wildlife legislation.  相似文献

China increasingly relies on its legal system to regulate a broad spectrum of social and economic activity. There is, however, widespread failure to observe the law, which periodically leads to social crises and popular unrest. The Chinese state is not, of course, alone in experiencing this, but it responds to enforcement failures in distinctive ways. This article examines one such response. In this article, we explore the role played by the enforcement campaign in the development of the Chinese legal system. We focus on one campaign in particular: the campaign that was waged between 2004 and 2007 to redress the chronic failure to pay wages. Chinese enforcement campaigns are not simply directed at securing greater compliance with existing law. They are integrally linked to cycles of law reform in the PRC. Whilst their main impact is on enforcement, they also have an important role in influencing the drafting of legislation and the interpretation of law. This article documents the impact of this campaign on the production of law: in speeding up the iterative process of lawmaking, interpretation, and implementation, with production of important reforms to existing labour law in 2007 and 2008. It is the strong “planned” nature of the campaign and its emphasis on state leadership of lawmaking and enforcement that continues to shape the development of China's particular version of the “rule of law.”  相似文献

In order to protect the objectives of competition policy, companies as undertakings are primarily targeted for the competition law infringements based on the mixed approach of compliance and deterrence theories relying on the view that company directors are incentivised to comply with the rules of competition law by the internal compliance programmes and corporate fines are the consequences of incompliance. This enforcement strategy gives rise to a tension between corporate governance, company law and competition law, as the former two focus on the behaviour of individuals within the corporate structure, while the latter concerns the impact of the company’s behaviour in the market. The question that arises in this tension is whether or to what extent competition law actually considers the way in which the company is run internally while it seeks to promote these primary objectives. This article analyses the deterrent effectiveness of primary enforcement strategy employed in the UK competition law regime and argues that competition law does not tend to localise the source of conduct or particular decisions and does not aim to correct the right wrongdoer. Despite that lack of effectiveness of public enforcement strategy to deter further anti-competitive behaviour has led individual sanctions to be introduced by the Enterprise Act 2002 and the Enterprise and Regulatory Reform Act 2013 in the UK, companies are still primarily targeted by corporate fines even though directors have intentionally breached the rules of competition law and this strategy is unlikely to deter directors from engaging with undesirable behaviour which exposes the company to risk of liability and loss.

In the past decade, municipal police organizations have devoted significant resources toward drug enforcement. One popular strategy in addressing the American drug problem is the formulation of multijurisdictional drug task forces. Despite their popularity, the impact of these cooperative ventures on law enforcement agencies has not been adequately evaluated. The research reported here examined the effect of membership in a drug enforcement task force on levels of drug enforcement outputs and perceptions of effectiveness by comparing law enforcement agencies participating in drug task forces to agencies which do not participate. Results suggest that task force membership impacts perceptions, but does not appear to influence objective measures of drug enforcement outputs.  相似文献

This study investigated the sociocultural determinants of policewomen–taxi drivers’ interactions on the major highways in Ibadan metropolis. Purposive sampling technique was utilized for the selection of 11 policewomen and 35 taxi drivers. Data were generated through key informant interview and focus group discussion methods. Findings revealed that gender had no impact on the ability of policewomen to enforce traffic law. Policewomen were adjudged to be strict on traffic law enforcement. However, the size of the accolade generated by this feat has been slightly attenuated by the action of officers who habitually demand for bribe from apprehended taxi drivers.  相似文献

Wilson identified three policing styles by analyzing the approach of police in order-maintenance and law enforcement situations Styles can also be developed by considering policing methods in relation to their impact upon the general community. This paper reviews 18 publications that advocate the use of product tampering and other poisoning methods as techniques for exacting revenge against individuals and corporations, as methods of committing murder, and for other criminal purposes. Several of the particular techniques recommended in these publications subsequently have been used in criminal tampering incidents. The published sources of technical guidance for the would-be tamperer and poisoner are examined in detail to alert forensic scientists, law enforcement authorities, and the food and drug industry to the particular techniques that are being advocated. Possible criminal and civil liability of the publishers and authors is discussed. The author suggests that food and drug retailers consider the wisdom of selling magazines that advertise the availability of revenge and murder manuals advocating product tampering and poisoning, that food and drug manufacturers test the effects on their products of the contaminants that are being recommended, and that investigators be alert to the existence of such manuals and mail-order suppliers of poisons.  相似文献

Supply reduction efforts by drug law enforcement departments are a significant factor in improving the effectiveness of drug control policies. The performance of drug law enforcement departments is one of the most important concerns for policy makers. Therefore, improving the performance of these departments is crucial in order for governments to constrict illegal drug markets and prevent illegal drug distribution. The literature suggests that social capital may have significant impacts on organizational performance. Using survey data from 12 city law enforcement departments in Turkey, this study examines the effects of three social capital dimensions (structural, relational, and cognitive dimensions) on the perceived performance of drug law enforcement departments by using structural equation modeling. The results of this conceptually grounded and empirical study suggest that drug law enforcement departments should pay close attention to promoting social capital among officers in order to fight effectively against drug trafficking.  相似文献
