While teachers and students of law tend to take for granted that critical legal campaigning originates in the late 20th century, many historians suggest that the summons of law and its state of accusation before the tribunal of critique dates back to the days of the Enlightenment. I am arguing, in contrast, that, in the West, the history of legal critique is by no means shorter than the history of law; that Western legal evolution embraces and supposes anti-legalism or ‘antinomianism’ since the days of early Christianity and throughout; that, conversely, an adequate assessment of Christianity must stress its character as an anti-institutional, anti-legal, and anti-religious campaign; that the standard view of Humanism, Enlightenment, and Modernity, which tends to foreground their antagonism to Christian institutions and to deny their nature as instantiations of the Christian campaign, misses the crucial point both about them and about Christianity (and, implicitly at least, about geopolitics); that key concepts of political modernity thrust their roots, not only and not most importantly into Political Theology, but rather into Saint Paul’s legal ‘new deal’; that, far from giving rise, as intended, to a deactivation of law, Paul’s action has resulted, instead, in the interlinking build-up of a militant denial of law on the one hand, and an emerging intensification of law on the other hand. Evaluation appointment orders provide enforceable scaffolding for conduct of family court parenting plan evaluations, and use of the evaluator's reports, feedback, file, and testimony. Unlike a contract, a stipulated or adjudicated appointment order is directly enforceable by the family court. It unambiguously positions the evaluator as the family court's appointee – answerable directly to the court and, in some jurisdictions, protected by quasi-judicial immunity from damages claims. A well-crafted appointment order governs the roles and expectations of the court, the evaluator, the parties, the lawyers, and the collateral witnesses. An appointment order mandates the legal duties, rights, powers, and responsibilities of the professionals, the parties, and the collateral witnesses. At minimum, an appointment order articulates the legal basis for the appointment, the purpose and scope of the evaluation, compensation of evaluator, and the duty of the parties to participate in the process. A written evaluation protocol or procedures statement discloses in advance the methods of investigation and assessment that the evaluator intends to use. Together, the appointment order and written protocol help the evaluator, lawyers, parents, and judge manage the complexity of the evaluation process.  相似文献

Under the public utilities franchise system, the executive branch may transfer the task of providing public utilities services for the common good to a private party. It should undertake to regulate and prevent the private party from pursuing its own interests to the detriment of public interest while discharging its duty under the public utilities franchise. Since any public interest must be enjoyed by all individuals, we can say that the obligations owed under administrative regulations aim at the ultimate goal of increasing individual welfare. In the public utilities franchise system, regulations of this kind can be divided into six different categories: maintaining and promoting necessary market competition, ensuring the continuity of public utilities services, ensuring non-discriminatory provision of public utilities services, ensuring the quality of public utilities services, ensuring reasonable charges for public utilities services, and ensuring the conservation of energy and protection of the environment while providing public utilities services. The absence of governmental regulation of the provision of public utilities and of reforms in such services in China has harmed both public interest and the rights and interests of consumers. Some of the problems caused include chaotic market access for public utilities, no guarantee of the sustainability of public utilities, the failure of the universality of public utilities, declining quality of public utilities, sharp rise in the prices of public utilities, insufficient regulations on the conservation of energy and environmental protection, and so on. In order to achieve the effective implementation of the administrative regulations and obligations therein with respect to public utilities and the maximization of public interest, the Chinese government should enhance its consciousness of regulating public utilities, improve the legal system to regulate public utilities, perfect the regulatory system for public utilities, and establish a system of liability to compensate for failures in regulation.  相似文献

我国关于赦免制度只是在宪法、刑法和刑事诉讼法的相关条款中有零星规定,这种立法现状在法治日益健全的今天几乎注定了其被悬置的命运。完善我国的赦免制度,首先要从实体上丰富赦免的种类,包括大赦、特赦、赦免性减刑和复权四部分。其次要从程序上予以完备,以保证赦免制度的规范运行。在特别赦免中,死刑案件特别赦免程序值得专门研究。关于赦免的立法模式,就我国的实际情况看,制定一部专门的《赦免法》,明确赦免实施的各项实体和程序条件,比较科学可行。  相似文献

This paper provides a framework for thinking about oppression and how to overcome it. It considers the value premise underlying the use of the term “oppression.” It then discusses the nature of oppression, the forms it takes, and what keeps it in place. In its final two sections, it focuses on awakening the sense of injustice and the strategies and tactics for overcoming injustice. An earlier version of this paper, entitled “Oppression and Conflict,” was presented as a plenary address at the Annual meeting of the International Society of Justice Research in Skovde, Sweden on June 17, 2002. This paper was the starting point of an ongoing, informal seminar on social justice held at Teachers College, Columbia University. The other participants in the seminar included Peter Coleman, Michelle Fine, Beth Fisher-Yoshida, Janet Gerson, Eric Marcus, Susan Opotow, Ellen Raider, Esther Salomon, Janice Steil, and Melissa Sweeney. From the discussions of theory, research, and practice during the meetings of the seminar, emerged plans for a Conference on Interrupting Oppression and Sustaining Justice. Its aim was to stimulate interaction about overcoming oppression among scholars from different academic fields, social and political activists, and graduate students in different disciplines. The Conference took place on February 27 and 28, 2004 at Teachers College. This issue of Social Justice Research presents some papers that were prepared before the Conference (and revised afterwards) and some that emerged from the Conference. 司法救助与法律援助虽然同为保障困难群众合法权益,确保实现社会公平、公正的司法制度,但由于两种制度实施的主体、审查程序、适用范围、条件等不同,造成两种制度在实施过程中出现不协调、不配合的情况,影响了两种制度的功能发挥。因此,必须加强两种制度的衔接与配合,包括制定统一的法律援助法,加强法院与法律援助机构的联系与沟通,强化政府责任,进一步加强法律援助工作等。  相似文献
