Acid rain controls are one of the more salient policy issuesfor contemporary environmental federalism. Agenda prominence,however, does not guarantee agreement on the components of aregulatory program. Depending on how many tons of emissionsreduction one wants, when one wants them, and how one permitsemitters to achieve compliance, a control program's costs canvary by billions of dollars annually. This article discusses the principal recent developments in,and future prospects for, constitutional change, judicial review,fiscal arrangements, local government, public policy, and intergovernmentalrelations since the 1977 Publius issue on Australian federalism,taking into account the arguments presented in the other contributionsto this volume. It highlights the continuing vertical imbalanceof Australian fiscal federalism, and the Hawke Labor government'srecent initiative for a closer working partnership with thestates for reforming intergovernmental arrangements. It arguesthat while there is scope for the latter, there is greater needfor the former. Nevertheless, the 1980s was significant as adecade of predominantly Labor governments working with the federalConstitution, while the 1990s promises to be a decade of celebratingthe centenary of the Australian Constitution and working towardimproving the functioning of its federal system.  相似文献

This article traces the major developments in German federalismfrom 1949 to the present. From a system based on a concept of"dual federalism," which was different in important ways fromthe American system, German federalism became somewhat morelike the postwar American cooperative federalism. Criticismof this system in the 1970s led to various reform efforts, whichmade little headway until the 1980s and the formation of a CDU/CSU-FDPcoalition government under Chancellor Helmut Kohl. The "turnabout"promised by this government and carried out to some extent includedplans and policies to strengthen the Länder by some sortingout of functions. These efforts were successful at first, butthe federal government has oriented its policies more towardthe national arena. Financial constraints, the nationalizationof basic rights, technological concerns, and pressures by theEC have led to new tendencies toward intergovernmentalizingand centralizing the relations between the federation and Landgovernments.  相似文献

This study argues that the modern political philosophy of federalismis directly linked to the Swiss Reformed idea of religious covenant,which was first formulated in the 1520s and 1530s by HeinrichBullinger in Zürich. Bullinger's concept of religious covenanthad roots both in the Old Testament and in the early federalideal and reality that had come out of the Swiss Middle Ages;it therefore had important social and political implicationsas well as theological meaning. During the sixteenth and earlyseventeenth centuries, this theological idea of federalism fedinto and helped to create the modern political concept of federalism,especially in the thought of Philippe Duplessis-Mornay and JohannesAlthusius. Political federalism became a reality in the Constitutionof the United States in the late eighteenth century. The Swissfederal Constitution of 1848 was instructed by the mature conceptof political federalism, by the Constitution of the United States,and by the long tradition of Swiss federalism. All of theseinfluences had some basis in the uniquely Swiss idea of religiouscovenant.  相似文献

近年来,公共政策研究正变得越来越多样化,出现了大量方法和理论,也表现为这些研究分散在各种特定领域的政策中。国家概念是政策理论的中心,但要将国家理论应用于政策研究却不容易“。阶段”方法是政策研究中长期以来占主导地位的研究方法之一,但它只是一种初级方法。新制度主义方法将政策制定过程推向了一种重要的比较分析方式,为解释政策的异同提供了制度解释维度,但它太笼统,考虑范围过于宽泛。而新制度主义者经常选择特定政策领域或部门进行分析,这是一个重要进展,因为政策制定是在特定部门或领域中进行的,仅仅集中关注国家及其行政、立法、司法机构是不够的。政策网络方法体现了研究者对于政策制定中国家与社会组织之间更普遍、更早的兴趣,但它除了描述外并不能帮助我们在理论发展中走得更远。理性方法是一个很有用的方法,当然它不能把理性选择作为对决策的惟一解释。在合作模式中,国家及其各个层次不再被看作合作的惟一机制,它表明市场和网络作为合作的另一种机制或原则正越来越受到重视。而时下十分流行的治理理论并没有形成真正行之有效的手段和方法,它可能仅仅是一个时髦词汇。如果把治理的要点放在使国家、市民社会、市场、网络这些不同工具和机制的互相协作上,治理就会成为一个有创造性的和深刻的分析方法。  相似文献

Although a number of measures have been proposed during thepast decade to require the U. S. Congress to take more accountof state and local interests, whether in regard to mandates,preemptions, regulations, or grants-in-aid, the only major successhas been passage of the Unfunded Mandates Reform Act of 1995(UMRA). This article examines the fate of the dozen bills thatprogressed far enough to be the subject of a committee hearingor receive a vote in the House or Senate. Only a few of thesemeasures, most of them rather modest in scope, were enacted,while the most significant measures were rejected, largely becausestate and local governments have experienced a number of difficultiesin reproducing the conditions that were present for the passageof UMRA. Health, labor, and environmental groups were able toblock a number of these bills. Business groups occasionallyparted company with state and local governments and worked todefeat federalism legislation. Finally, state and local governmentgroups have not always been united in support of these measures.  相似文献

Try Federalism     
The present article follows up a previous study (Anckar 1998) which showed a strong association between size and party system fragmentation. The aim of the article is to see whether the explanatory power of size can, in fact, be attributed to a federal form of government. 77 countries with free party systems constitute the research population. The dependent variable has three components: number of parties, electoral support for the leading party, and the 'effective number of parties' calculated according to the Laakso-Taagepera formula. Preliminary tests reveal that federal states have a more fragmented party system than unitary states. However, when controlling for size, electoral system, the 'effective threshold,' and presidentialism, the results clearly show that federalism is overshadowed by size and also, to a lesser extent, by the effective threshold.  相似文献

Famously, federalism combines self-rule with shared rule or unity with diversity. Typically, the mix is achieved by creating or preserving two levels of government, each with a direct relationship with the people, and by dividing power between them. Traditionally, unity is achieved through the exercise of power by the central government, in relation to the polity as a whole. Diversity is the consequence of the exercise of power by sub-national governments over a portion of the population, generally territorially identified. The boundaries of power between the two spheres are secured by entrenching them in a written Constitution established as fundamental law, which is interpreted and applied by a court or courts.  相似文献

The article explores the nature of Australian federalism by examining four major themes in the period from Hawke to Howard. The investigation of these themes – Australian conceptions of federalism; the role of party in shaping federalism; the way problems and politics have influenced policy‐making and thereby federalism; and the nature of federal judicial review – suggests that Australian federalism can most accurately be characterised as pragmatic. It appears as a federalism shaped by pressing problems, specific policy agendas and the prevailing political dynamic, rather than by overarching conceptions of federalism derived from political theory or articulated in party ideology. This pragmatic federalism explains important aspects of Australian federalism, especially the trend towards centralisation of authority.  相似文献

Debate on the relevance (or otherwise) of federalism to the development of the European Union is often characterised by mutual incomprehension on either side. Close inspection, however, reveals that the high temperature of argument may not be solely due to differing visions of the finalite politique. For the precise meaning of the federal concept in political science remains unsettled. This article looks back to the earliest origins of federalism, in order to establish a firm basis for suggesting improvements. The idea of divided sovereignty, ‘invented’ in America and now thought to lie at the heart of the federal concept, is identified to be a false construction. On these grounds, it is proposed that the definition of federalism be clarified today as not ‘a division of sovereignty between two levels of government’, but instead ‘a division of the powers flowing from sovereignty between two levels of government of equal status’.  相似文献

The benefits and costs usually ascribed to federalism are benefitsand costs of decentralization; they are, therefore, presentin unitary states that are in fact all decentralized. The benefitsand costs specific to federalism pertain to ownership rightsin constitutional powers. Federalism is superior to confederalismand unitarianism because the ownership rights peculiar to thatsystem of government are such that they ensure the perduranceof competition when one or more competitors are unsuccessful.They do so because under federalism, powers cannot be repossessedunilaterally. Ownership rights have to be enforced; as a consequence,there are also costs that are specific to federalism.  相似文献

These papers examine current Australian federalism from the perspectives of an academic and a practitioner. Both acknowledge the opportunities arising from the current White Paper process, as well as challenges in the face of substantial cuts of proposed funding from the Commonwealth to the States. They insist upon the need for renewed commitment to the idea of federalism, and the importance of sustainable fiscal arrangements within the federation. Challenges in Reforming Australian federalism reminds us of the kind of federalism operative in Australia – concurrent, not coordinate – and develops reform proposals accordingly.
