论工会工作者的角色冲突和义务层级

工会及其工作者的角色规范和基本义务,直接源于工会的本义、地位、功能等事理逻辑,与人权法、宪法和工会法等法律直接关联;其义务具有道德属性和法律属性。在规范意义上,这种角色和义务具有法定性、强制性和排他性,不得以约定的义务对其形成妨碍或排斥。工会工作者接受雇主的聘任或委托,成为雇主的代表或代理人,并因此从雇主处获得利益,承担约定义务,是不正当、不合法的劳动行为,产生了逻辑性、结构性的矛盾或冲突,应当在立法上予以规范和矫正。即使不考虑这些现象的不法、消极性质,依据义务的规范依据,也足以论证工会工作者因这种兼职而产生的约定义务,在地位、效力、顺序上低于人权法、宪法、工会法给工会所直接规定的法定义务。     

浅谈工会在劳动争议处理中的作用

工会在劳动争议处理中发挥作用,首先要帮助和督促企业建立健全劳动争议调解组织和调解工作制度;依法调解劳动争议,做到维护企业和职工的合法权益;参与劳动争议仲裁工作,为职工诉讼提供法律帮助;开展培训工作,提高调解人员素质;建立健全预防预警制度,防止激化矛盾,为建立和谐稳定的劳动关系发挥促进作用。

随着国有企业改革的深化 ,厂务公开所面临的思想政治教育者和受教育者的深层矛盾不断反映出来。解决好这些矛盾 ,一要正确处理实行厂务公开和开展思想政治教育工作的关系 ,具体要正确处理厂务公开与企业改革、发展、稳定的关系 ,与职工代表大会的关系和与调动企业经营者和劳动者两个积极性的关系。二要正确运用思想政治教育的原理 ,加深厂务公开的深度 ,拓展厂务公开的幅度 ,把握厂务公开的尺度。     

female sex tourism: a contradiction in terms?

This paper argues that the ‘double-standard’ applied to male and female tourists’ sexual behaviour reflects and reproduces weaknesses in existing theoretical and commonsense understandings of gendered power, sexual exploitation, prostitution and sex tourism. It looks at how essentialist constructions of gender and heterosexuality blur understandings of sexual exploitation and victimhood and argues that racialized power should also be considered to explore the boundaries between commercial and non-commercial sex. This paper is based on ethnographic research on sexual–economic exchanges between tourist women and local men and boys in the informal tourist economy in Jamaica and the Dominican Republic.

College-student abstainers,moderate drinkers,and heavy drinkers: A comparative analysis

Comparison of college freshman male and female abstainers, moderate drinkers, and heavy drinkers indicated that male and female heavy drinkers were more likely than their abstinent counterparts to engage in social, cultural, and impulsive-deviant activities, to describe themselves as dominant and rebellious, and to experience exuberance, negative affect, and physical complaints. Female and especially male heavy drinkers also performed more poorly academically than did abstainers. 共同体视域下新时代劳动教育路径研究

加强劳动教育意义重大,关系到中国共产党的执政基础和民心向背,关系到学生的身心健康、 成长成才和正确价值观的形成,关系到人的全面发展和国家的未来。在马克思共同体视域下,劳动教育体现了 人与自然和谐共生、人与人和谐共处、人与社会和谐共存的关系。研究认为,当前劳动教育存在家庭教育错位、 学校教育缺位、社会教育低位等方面的掣肘,其内在原因是未能正确认识人与自然、人与人、人与社会之间的 辩证统一关系。研究建议：从构建共同体劳动教育理念、完善劳动教育课程体系、落实劳动实践育人功能等方 面着手,切实推进劳动教育,促进人的全面发展。     

Two Sides of the Same Coin? The Relations between Prosocial and Physically Aggressive Behaviors

The direct and indirect relations between six types of prosocial behavior and physical aggression were examined. Data were gathered from 252 college students (M age = 21.67 years; 184 women) who completed measures of sympathy, prosocial behavior, and physical aggression. Structural equation modeling revealed that sympathy fully mediated the relations between compliant prosocial behaviors and physical aggression, and partially mediated the relations between altruism and physical aggression and public prosocial behaviors and physical aggression. The findings suggest that the relations between prosocial behaviors and aggression are complex and that prosocial behavior should not be treated as a unitary construct. is Professor of Developmental Psychology at the University of Nebraska-Lincoln. The influence of sense of coherence,self-care and work satisfaction on secondary traumatic stress and burnout among child and youth residential care workers in Switzerland

The present study aimed to investigate the incidence of post-traumatic and secondary traumatic stress as well as burnout symptoms among child and youth welfare workers in residential care in Switzerland and to assess the predictive value of sense of coherence, self-care, and job satisfaction. A sample of 319 child welfare professionals in Swiss child and youth residential care was assessed using questionnaires that addressed sense of coherence, perceived collective efficacy, self-care, and work satisfaction, as well as symptoms of traumatic stress and burnout. Linear regression analyses were conducted to determine the influence of sense of coherence, self-care and job satisfaction on symptoms of burnout and traumatic stress. Enhancing sense of coherence, work-related self-care and work satisfaction could reduce stress symptoms and increase the well-being of child and youth welfare staff. The authors discuss how child and youth residential care institutions could improve these factors among their staff.

A Nurse and a Soldier: Gender,Class and National Identity in the First World War Adventures of Grace McDougall and Flora Sandes

In this article the author explores the ways Grace McDougall, Commandant of the First Aid Nursing Yeomanry (FANY), and Flora Sandes, Captain and combatant in the Serbian Army, negotiated gender, class and national identity and enhanced women’s claim to personal and collective power during their work at the Front during the First World War. The author analyses Sandes and McDougall’s writings and their accounts of personal heroism and focuses on two aspects: first, their participation in the physical dangers of war and the creation of audacious stories of physical bravery that aligned them with male combatants; and second, their performance of ingenuity, intellect and action that gave them power, status and credibility, and consolidated their leadership and authority. In their different ways, both women modelled resistance to female subordination and made the case for women’s participation in war.

高职院校《思想道德修养与法律基础》课教材体现了国家规划课程教学的规范性,在此基础上应提倡创新和灵活。地方文化资源能够丰富高职院校"基础"课教学内容,活化教学,使"基础"课教学更加具有针对性和实效性。在地方文化资源融入"基础"课的实践中必须坚持正确的政治方向,分清主次关系,去伪存真,加强实践教学。
