医疗纠纷案件审理的法律适用若干问题初探

The performance of medical malpractice review panels

In this paper we present the results of an empirical study of Arizona's medical malpractice review panels. We compare insurance company claim files data from before and after the implementation of panels to analyze the effects of the panel system. The data indicate that although the frequency and average amount of recovery are not affected by the panel system, the system leads to an increase in the number of disputes seeking formal adjudication, an increase in the cost of the process, and a lengthening of the time within which disputes are resolved.     

Bonded labor characteristics of U.S. postgraduate medical training

Abuses in labor practices affecting hospital housestaff (residents) have become better understood with the 2002 filing of a federal lawsuit challenging U.S. resident hiring practices. Other initiatives to redress residency employment abuses have included labor action (unionization) and legislative initiatives at both the state and federal levels. This Article suggests that all such initiatives are fated to have limited success because they fail to take into account the economics of the residency system. The author argues that, in several key respects, the U.S. residency employment system resembles the self-perpetrating bonded labor systems of rural Asia. Consequently the Article proposes a radical restructuring of U.S. housestaff employment.     

Special Elections to the U.S. House of Representatives: A General Election Barometer?

Vacancies in the U.S. House of Representatives are filled using special elections. These elections occur off the usual American electoral cycle, and their results are routinely portrayed by the American mass media as indications of what to expect in the next general election. We examined the predictive power of special elections results with respect to the general election outcomes for the U.S. House of Representatives from 1900 to 2008. We found that special elections that yield a change in partisan control do have predictive power regarding general election results.     

美国反避税立法之CFC规则研究

随着经济全球化的深入发展,跨国纳税人的避税行为日益频繁,反避税立法成为国际税法和国内税法的共同任务。美国是世界上最早进行反避税立法的国家,其中,其受控外国公司立法,是世界上第一个CFC规则,已经成为其他国家相关立法的模板。由于越来越多的跨国纳税人利用递延纳税进行避税,CFC规则价值凸显,其在美国反避税法律体系中的地位也日趋重要,具体规则也日趋严厉。尽管美国CFC规则也面临一定的冲突和挑战,其反避税价值仍然值得我们深入研究。近年来我国也面临严峻的反避税任务,对美国反避税相关立法进行研究,对中国具有直接的现实意义。
