Abstract

Victims of rape are sometimes blamed for the assaults against them. Research has examined primarily female victims; much less is known about men as victims and whether victim age affects attributions of victim blame. Furthermore, the study investigated the effects of Belief in a Just World (BJW) on blame attributions. Employing a vignette-type experimental study with a 2 (gender of participant)×2 (victim's gender)×2 (victim's age)×2 (participant BJW score) between-subjects design and several measures of blame attributions towards victim and perpetrator as dependent variables, a community sample (n = 164) participated. The main results were as hypothesised, namely that young male victims were attributed more blame, particularly by participants scoring high on BJW. Overall, victim blame level was low and perpetrator blame was high, and BJW was a powerful predictor of blame attributions.  相似文献

We examined blame attribution as a moderator of perceptions of hate crimes against gay, African American, and transgender victims. Participants were 510 Texas jury panel members. Results of vignette-based crime scenarios showed that victim blame displayed significant negative, and perpetrator blame significant positive, effects on sentencing recommendations. Also as hypothesized, victim and perpetrator blame moderated the effect of support for hate crime legislation. Interaction patterns suggested that both types of blame attribution influence sentencing recommendations, but only for participants disagreeing with hate crime legislation. Three-way interactions with victim type also emerged, indicating that the effects of both types of blame attribution show particular influences when the victim is gay, as opposed to transgender or African American. Implications for attribution theory, hate crime policy, and jury selection are discussed.  相似文献

This study aimed to examine the relationship between negative experiences in childhood (physical-, sexual-, and emotional abuse and emotional neglect) and the risk for an individual to become a perpetrator of child maltreatment in adulthood. Participants were 337 female college students who completed self-report measures of childhood trauma and temperament. Risk for child abuse was assessed with the Child Abuse Potential Inventory. Results showed experiences of emotional neglect significantly predicted higher child abuse potential. Additionally it was shown that experiences of physical abuse significantly predicted higher child abuse potential but only in those individuals with high temperamental orienting sensitivity. These results underline the potentially damaging long-term effects of emotional neglect in childhood and indicate temperamental sensitivity may moderate the relationship between being abused as a child and being at risk for maltreating one’s own offspring.  相似文献

The primary purpose of the present study was to examine whether knowledge of the motivation of an offender can influence participant perceptions of victim and perpetrator responsibility for a sexual assault. In addition, the synergistic influence of victim gender and participant gender with offender motivation was explored. Participants were 171 men and women from a small Northeastern college exposed to a stimulus in which a rapist's motivation was varied as either sexual or violent. Participants were more certain that the stimulus described a rape, recommended a longer prison sentence for the offender, and assigned less blame to the victim when exposed to an offender motivated by violence as opposed to an offender motivated by sex. Offender motivation also interacted with participant gender and victim gender on participants' perceptions of victim blame and offender responsibility. The results suggest that an offender's motivation for rape can influence perceptions of the offender's and victim's responsibility for the assault.  相似文献

In this paper, I apply concepts of restorative justice, along with moral philosopher Joanna North's (1998) multistage model of the process of earning forgiveness to the case of 1960s antiwar militant, Katherine Power. Both frameworks assume that forgiveness ought to culminate in reconciliation between perpetrator and victim. On September 23, 1970, Katherine Ann Power, a 20-year-old college student, was a member of a group of five who were robbing a bank near Boston to support the movement against the Vietnam War. One from the group stayed at the bank and shot and killed a Boston police officer and father of nine. Under Massachusetts' felony murder law, all five were chargeable with murder. Power went underground for 23 years, remaining on the FBI's Ten-Most-Wanted list longer than any other woman in history. During her fugitive years, Power lived her life in a purposeful attempt to make atonement. Ultimately, though, she came to understand that her crime was not a private matter, but demanded social and relational modes of remediation, including public confession, public penance (in a penitentiary), and efforts at reconciliation with the family of her victim. So in 1993, she turned herself in, pleaded guilty to manslaughter, and began serving an 8–12-year sentence in Massachusetts. She completed her prison sentence in October, 1999. Power spent her years in prison engaging in reflection and action that maps well onto the first five stages of North's model and onto much of the restorative justice model. So far, though, Power's efforts have failed to yield the hypothesized reconciliation with her victims. Examination of the parallels and divergences between these theoretical frameworks and Power's narrative provides significant insight into the meaning, the promise, and the limits of reconciliation.  相似文献

Abstract

The current study explored how gender, group membership and different emotional reactions to the crime of domestic violence predict attitudes and endorsement of restorative or retributive justice practices. The experiment consisted of a 2 (victim group membership: Muslim- or Anglo–Australian)×2 (offender group membership: Muslim- or Anglo–Australian)×2 (Sex of participant) between-participants factorial design. Anglo–Australian participants (43 men; 50 women) were randomly assigned to one of the four manipulated conditions, and completed an online questionnaire that involved viewing a short video clip of a woman describing her experience as a domestic violence victim. Results revealed strong preferences for restorative justice in dealing with domestic violence, with women supporting this practice more than men. The crime was perceived as most severe and retribution was endorsed most strongly when the victim was Anglo–Australian (i.e. an in-group member). Intra-group violence was also perceived to be a greater breach of shared Australian values than inter-group (i.e. cross-cultural) domestic violence. Emotional reactions further predicted participants' responses, with hatred predicting stronger support of retributive ideals and sympathy for the victim predicting greater endorsement of restoration.  相似文献

This analogue study (written vignettes and videotapes) examines the influence of victim-perpetrator relationship (spouse or acquaintance), sex of perceiver, and type of abuse (psychological vs. physical) on attributions about victims and perpetrators of domestic abuse. College student participants (73 men, 108 women) were randomly assigned to condition. As expected, type of relationship influenced observer perceptions. Specifically, participants rated the victim of marital violence as more psychologically damaged and disturbed by the abuse than the victim of acquaintance violence. Furthermore, interaction effects showed that men, more than women, rated the actions of the married perpetrator as more of a victim's rights violation than the actions of the acquaintance perpetrator. Second, type of abuse was shown to influence perceptions of the perpetrator but not the victim. Sex-of-perceiver effects were also obtained. Women held the perpetrator more responsible and assigned less blame to the victim than did men. Legal and clinical implications are then discussed.  相似文献

Abstract

This research examined two aspects of gender effects in eyewitness accounts: whether there are gender differences in memory for a violent crime and how gender of perpetrator/victim affect witnesses' evaluations of perpetrator/victim behavior. Eighty male and 84 female university students saw a film showing a simulated manslaughter with either a male or female perpetrator stabbing a male or female victim. A female advantage was found in overall memory of the crime, and both a male perpetrator and a male victim were assigned more culpability than their female counterparts. It is suggested that females may have more elaborated categories for person information than males, which should facilitate female accuracy in person memory. Alternatively, the present findings may reflect a more general female advantage in episodic memory performance. Stereotype assimilation is suggested to account for the differential evaluations of a male and female perpetrator/victim.  相似文献

ABSTRACT

The present study examines the influence of prior relationship (with contextual information regarding the breakdown of the relationship) and perpetrator-target sex composition on perceptions of relational stalking. The study employed an experimental 7?×?2 independent measures design, and the sample comprised 1,260 members of the community residing in Australia, the United Kingdom and the United States. Participants received one of 14 versions of a hypothetical scenario and responded to scale items concerning the situation described. The situation was perceived to be most serious when the perpetrator was a stranger or a physically violent ex-partner and least serious when the perpetrator was an ex-partner of an unfaithful target. Scenarios involving a male perpetrator and a female victim were also perceived to be more serious than scenarios involving a female perpetrator and a male target. It is apparent therefore that the context of the relationship breakdown and the sex of the perpetrator and target significantly influence perceptions of relational stalking.  相似文献

The past several decades have seen the emergence of a movement in the criminal justice system that has called for a greater consideration for the rights of victims. One manifestation of this movement has been the “right” of victims or victims' families to speak to the sentencing body through what are called victim impact statements about the value of the victim and the full harm that the offender has created. Although victim impact statements have been a relatively noncontroversial part of regular criminal trials, their presence in capital cases has had a more contentious history. The U.S. Supreme Court overturned previous decisions and explicitly permitted victim impact testimony in capital cases in Payne v. Tennessee (1991) . The dissenters in that case argued that such evidence only would arouse the emotions of jurors and bias them in favor of imposing death. A body of research in behavioral economics on the “identifiable victim effect” and the “identifiable wrongdoer effect” would have supported such a view. Using a randomized controlled experiment with a death‐eligible sample of potential jurors and the videotape of an actual penalty trial in which victim impact evidence (VIE) was used, we found that these concerns about VIE are perhaps well placed. Subjects who viewed VIE testimony in the penalty phase were more likely to feel negative emotions like anger, hostility, and vengeance; were more likely to feel sympathy and empathy toward the victim; and were more likely to have favorable perceptions of the victim and victim's family as well as unfavorable perceptions of the offender. We found that these positive feelings toward the victim and family were in turn related to a heightened risk of them imposing the death penalty. We found evidence that part of the effect of VIE on the decision to impose death was mediated by emotions of sympathy and empathy. We think our findings open the door for future work to put together better the causal story that links VIE to an increased inclination to impose death as well as explore possible remedies.  相似文献

The present study addresses the perceptions of university students regarding punishments for individuals whom engage in the online solicitation of children for sex. Differences in biological sex and age of victim and sex of offender may influence university students’ views of punishment for this behavior. Using self-reports from a 2?×?2?×?2 factorial survey, the results indicate that respondent sex, political ideology, and offender sex are important factors in explaining punitiveness for engaging in the online solicitation of a child for sex. Interestingly, victim age was shown to not influence punitive perceptions of online solicitation of children for sex. These results are discussed in the context of policy implications.  相似文献

Just world research has shown that observers derogate victims more for their misfortunes if the perpetrator is not harshly punished (Lerner in J Personal Soc Psychol 1(4):355–360, 1980). However, few studies have investigated minority group derogation as a just world preservation strategy after instances of intergroup harm-doing. This study is among the first to demonstrate the derogation of both individual victims and of the victim’s minority group experimentally, using the context of a racist hate crime in Australia. In the present experiment, participants (N = 110) read a news article describing a hate crime against an Aboriginal Australian teenager and were informed that the perpetrator was harshly or leniently punished (secure vs. justice threat condition). Our results show that in the justice threat condition, participants not only derogated the individual Aboriginal Australian victim more after his death, they also expressed greater racism toward the victim’s group. An indirect effect of the justice threat condition on modern racism via individual victim derogation was observed, along with moderating effects of individual differences in belief in a just world. These findings provide support for the alarming hypothesis that racist hate crimes are not only the manifestation of a racist society, but may also bolster racial prejudices if leniently treated. The results highlight the important role of political and judicial authorities, whose response or non-response to a hate crime can exacerbate or ameliorate existing prejudices.  相似文献

Perpetrator and victim gender influence how blame is assigned in intimate partner violence (IPV) scenarios. Although men’s differential capacity to inflict and sustain harm is posited as the reason male perpetrators and victims receive more blame for IPV, it is possible that other aspects of the construct of gender, such as gender role beliefs, underscore these effects. Using a sample of 323 college students and a factorial vignette design that varied body sizes and genders of victims and perpetrators, we examined the extent to which perceptions of physical injury accounted for the effects of perpetrator and victim gender on blame attributions, and whether adherence to traditional gender roles moderated any influences of gender unassociated with perceived injury. For female perpetrators, participants estimated lower levels of perceived injury and greater victim blame, with the former effect predominantly accounting for the latter. Male victims were viewed as less injured and more blameworthy, but the latter finding was not predominantly driven by injury perceptions. Perceived physical injury also did not account for why females perpetrating against males were blamed least. Controlling for differences in perceived injury, those holding more traditional gender views blamed victims of female violence more than victims of male-perpetrated violence. Notably, variations in body physical size were not associated with injury perceptions or blame attributions. These findings overall suggest that gender does influence blame attributions by way of perceived physical injury, but other aspects of the construct of gender are also relevant to these evaluations.

Objectives

The development and application of methods to assess consistency in sentencing before and after the 2011 England and Wales assault guideline came into force.

Methods

We use the Crown Court Sentencing Survey to compare the goodness of fit of two regression analyses of sentence length on a set of legal factors before and after the assault guideline came into force. We then monitor the dispersion of residuals from these regressions models across time. Finally, we compare the variance in sentence length of equivalent types of offences using exact matching.

Results

We find that legal factors can explain a greater portion of variability in sentencing after the guideline was implemented. Furthermore, we detect that the unexplained variability in sentencing decreases steadily during 2011, while results from exact matching point to a statistically significant average reduction in the variance of sentence length amongst same types of offences.

Conclusions

We demonstrate the relevance of two new methods that can be used to produce more robust assessments regarding the evolution of consistency in sentencing, even in situations when only observational non-hierarchical data is available. The application of these methods showed an improvement in consistency during 2011 in England and Wales, although this positive effect cannot be conclusively ascribed to the implementation of the new assault guideline.  相似文献

The purpose of the current study is to examine the influence of multiple offender motivations (including no indication of a motivation), relationship length, and gender role beliefs on perceptions of a male-on-female date rape. A sample of 348 U.S. college students read a brief vignette depicting a date rape and completed a questionnaire regarding their attributions about the victim (culpability, credibility, trauma, pleasure) and perpetrator (culpability, guilt, sentencing recommendations). Results indicate that providing observers with information about the perpetrator's motivation was associated with lower victim blame. Relationship length is not predictive of rape attributions. Egalitarian gender role attitudes are associated with lower levels of victim blame. Overall, gender role attitudes exert a more significant influence on rape attributions than participant gender. The findings suggest that knowledge of an offender's motivation as well as observers' gender role attitudes can influence attributions about the culpability of victims and perpetrators of date rape.  相似文献

This study compares 202 juvenile offenders on a series of preoffense adjustment variables grouped into five categories: Family Dysfunction, School Adjustment, Prior Violence, Criminal Activity, and Substance Abuse. Emphasis is placed on the importance of distinguishing subgroups of violent youth based on the type of assault (interpersonal conflict or crime-related) and the youth's relationship to the victim (parent or other victim). Findings support the need to identify multiple developmental pathways and distinctive risk factors for different forms of juvenile violence.  相似文献

Abstract

This study investigates attributions towards the perpetrator, the victim and the victim's parents in a hypothetical internet solicitation case. A community sample of 187 respondents read a vignette outlining an internet chatroom conversation between a 10-year-old girl and a 25-year-old man, followed by a depicted sexual assault, before rating 26 attribution items. Principal components analysis extracted six reliable and interpretable factors which were then subjected to a two-respondent gender×two-victim age×two-victim internet naivety×two-parental neglect between-subjects multiple analyses of variance (MANOVA). While levels of victim naivety had no impact on any measure, parents who were neglectful of their child's online activities were deemed more culpable for their child's later abuse than were parents who took an active interest in their child's activities. In general, females deemed the victim more credible than males. Implications are discussed.  相似文献

A 2 × 4 × 4 factorial design was used to assess the effects of physical attractiveness in a domestic violence case. The attractiveness of both the defendant and victim were varied along four levels. Subjects were asked to read a domestic violence scenario where pictures of the defendant and victim were varied according their physical attractiveness. Results showed no significant effect of physical attractiveness in a juridic decision-making process in domestic violence. However, there were significant differences between male and female subjects in the sentencing of the defendant. This difference did not hold true for finding the defendant guilty or not guilty.  相似文献
