In a previous study, a survey‐based analysis of pathologist diagnoses of patterned injury was performed. Subjects were provided with photographs of “classic” injuries and asked to diagnose the lesion in the absence of history or context. There was a relatively low diagnostic consensus among respondents. A second survey suggested that the disparate answers were not due to a strong belief in different diagnoses, but instead reflected how the respondents dealt with ambiguity. A third survey was created that asked participants to evaluate patterned injuries of the skin, but provided history and contextual information. The addition of history and contextual information increased consensus from a median of 80% to 98% on a per‐question basis. Confidence increased from a median of 56%–92%. These results demonstrate the importance of history and context in medical diagnosis of patterned injuries of the skin.  相似文献

Preschool children (ages 48–70 months, N = 48) experienced 2 to-be-remembered events (i.e., the games Twister® and Shapes) that included either innocuous bodily touch or no touch. Participants were interviewed 7 days later and asked direct (“Did Amy kiss you?”) or suggestive “tag” questions (“Amy kissed you, didn't she?”) equated for content. Results indicated that children who were innocuously touched were no more likely to falsely assent to “abuse-related” touch questions (e.g., “Amy touched your bottom, didn't she?”) than were children who were not touched. However, children who were asked tag questions responded at chance levels, thereby making high errors of commission in response to abuse-touch questions relative to their no-tag counterparts who responded to “abuse questions” accurately 93% of the time. Children who were asked tag questions assented at a higher rate to general forensic questions (“Amy took your picture, didn't she?”) than did children asked direct questions, and children assented at higher rates to “abuse-touch” questions than to general forensic questions. Results are discussed in terms of prior research on interviewing techniques and adult influence on children's testimony.  相似文献

In a previous study, a survey‐based analysis of pathologist diagnoses of patterned injury in which participants were asked makes diagnoses from photographs in the absence of history or context. The level of consensus was low. A follow‐up survey was created to ask those who responded to the first survey why they answered as they did or why they were unsure of their answers. The most common reason for lack of consensus was that the lesion was nonspecific. Responses invoking ambiguity were more common than those that indicated a confident difference in diagnosis. There were differences between demographic groups, with age and experience being most prominent. These findings suggest that differences in image interpretation do not generally reflect firm differences in diagnosis as much as differing ways of dealing with ambiguity in the absence of history and context. A third survey will study the effect of the addition of contextual information.  相似文献

Abstract: Two major variations of polygraph “Control Question” testing, the Zone Comparison (ZoC) and the Modified General Question Test (MGQT) were evaluated. Within each, the type of control question, Exclusive or “time bar” (e.g., “Before you were 21, did you ever...”) and Nonexclusive or “no time bar”(e.g., “Did you ever….?”) was manipulated in a mock theft scenario, with 80 male and 40 female subjects randomly assigned to be either innocent or guilty. Polygraphic data collected by experienced field examiners were numerically scored by an evaluator blind to all aspects of the study. Decision accuracy was not related to the type of procedure (ZoC/MGQT) used or the subject’s sex. Accuracy was significantly related to the type of control question [χ2(2) = 11.46, p = 0.003; τc = 0.29]. Nonexclusive control questions produced greater accuracy than Exclusive control questions on both innocent and guilty subjects. These results and subjects’ self‐reports support the general “theory” on which control question (CQ) testing is based. The need for better empirical support of accepted dogma and current field practices is strongly indicated by these findings.  相似文献

This study (N = 218) examines potential moderators of the confidence–accuracy (CA) relation in eyewitness identifications. The design included five experimental interventions (accountability, context reinstatement, retrospective narration, hypothesis disconfirmation, and hypothesis generation), as well as one trait measure (public self-consciousness). Although the interventions were hypothesized to enhance the CA relation relative to a control condition, they did not do so. In fact, quite contrary to our initial expectations, only participants in the control condition displayed unqualified insight into their identification accuracy. We conclude that attempts to enhance awareness of the thoughts and reasoning process involved in an identification decision may frequently have minimal, or even counterproductive, effects. Instead, results of decision process measures suggest that the CA relation might be more effectively enhanced by increasing the salience of relatively automatic decision criteria (e.g., “did his face 'pop out' at me?”) and decreasing the salience of algorithmic identification strategies (e.g., “was I thorough in making my decision?”).

In conducting Compensation and Pension (C&P) examinations, one of the most significant sources of evidence supporting a veteran’s claim for service connection are found in the veteran’s service medical records and service personnel records. Although specific numbers are unknown, a majority of mental health providers who conduct C&P examinations are not veterans and have limited knowledge and understanding of the records they are being asked to review. In cases of an initial posttraumatic stress disorder (PTSD) examination, the Federal Register requires C&P examiners to determine if the veteran’s claim is consistent with the places, types, and circumstances of the veteran’s service. This article reviews specific data within personnel records to help verify those elements. Additionally, perhaps one of the most difficult types of evaluations faced by any C&P examiner is a PTSD claim for personal assault (e.g., military sexual trauma). This article reviews the types of information within the records to help identify specific “Markers” associated with personal trauma.  相似文献

In a previous Criminology article, Avakame (1998) applies hierarchical linear modeling (HLM) techniques to Supplementary Homicide Reports (SHR) to disentangle individual‐ and aggregate‐level factors associated with offending. A close reading of his analysis reveals serious flaws in the dependent variable, which renders the results meaningless. Although it is ambiguous whether Avakame intended to model homicide “risk” or “frequency,” either is problematic. “Homicide frequency” has no logical connection to the individual‐level predictors; “homicide risk” is constant in SHR data, which makes the analysis impossible. In detailing these problems, we spell out the logical data requirements and offer sound empirical examples for an HLM analysis.  相似文献

A major criticism of official statistics on crime is that they use inappropriate bases for computing rates. Here we investigate whether computing crime rates that contain in their denominators the number of exposures to risk of a specific event (e.g., residential burglary and auto theft) provides more accurate forecasts than employing the traditional FBI denominators as a base (e.g., the number of auto thefts and burglaries per 100, 000 persons living in the United States). Single equation, macrodynamic structural models are fitted to both the “traditional” and “alternative” forms of computing auto theft and burglary rates over the twenty-seven-year period from 1947–1974, in order to determine how well they perform on statistical and substantive grounds over the estimation period. Ex-post forecasts of the 1975–1979 observed crime rates, used to gauge the accuracy of these models, reveal few differences between the two kinds of rates in terms of how well they forecast. Both types of rates forecast well with the exogenous variables employed here and lead to similar substantive conclusions. The forecasts of the “traditional” rates are consistently, but only slightly, more accurate than those of the “alternative” rates (in most cases the differences are less than 1 percent). It is argued that the criticism of official data may be overstated and that little benefit accrues from the modification of the rate base for some purposes.  相似文献

Until recently, “direct controls” by parents have been summarily dismissed by delinquency researchers as theoretically and empirically unimportant. Although prior research indicates that various measures of direct parental controls (e.g., the amount of time spent interacting with parents) are related to delinquency, the correlations are uniformly weak and often not significant. However, when the term “direct control” is reconceptualized to include specific components—normative regulation, monitoring, and punishment—the results indicate that direct controls by parents have as great an impact on delinquency as that of “direct controls” or parental “attachments.” Further, the results suggest that the form of the relation between direct controls and delinquency is not simple, direct, and linear. Depending on which specific component of direct control is examined, its relationship to delinquency may be either linear or nonlinear, positive or inverse.  相似文献

Regions can be considered as “regional innovation systems,” but the question of whether and to what extent technology transfer is taking place at this or other (e.g., national and global) levels remains empirical. The theme issue contains a number of case studies of “regional innovation systems” within the European Union. Other papers elaborate on the pros and cons of the systemic approach to the technology transfer processes involved, or make comparisons across regions. In this introduction, the editors discuss the relations between regional policies, technology and innovation policies, and the integration of these different aspects into (potentially regional) systems of innovation. Under what conditions can “technology transfer” be considered as a mechanism of integration at the regional level?  相似文献

Many judges experience occupation‐specific stress, such as secondary traumatic stress (STS), burnout, compassion fatigue, and vicarious traumatization. A content analysis of 762 judges’ open‐ended responses to a survey asking whether they had suffered from STS revealed that judges moderately experienced most types of stress. Some case types (e.g., family court) and some job aspects (e.g., gruesome evidence) were particularly stressful. Judges reported both positive (e.g., social support) and negative (e.g., distractions) coping mechanisms. Interventions should be tailored to judges’ characteristics, (e.g., gender), job (e.g., family court), beliefs (e.g., that STS does not exist), and level of distress.  相似文献

Drawing upon control theory, school climate theory, and social disorganization theory, this study examined the relative influence of individual, institutional, and community factors on misconduct in Philadelphia middle schools. Using U.S. census data, school district data, police department data, and school climate survey data obtained from the administration of the Effective School Battery to 7, 583 students in 11 middle schools, we examined the following predictors of student misconduct: community poverty and residential stability; community crime; school size; student perceptions of school climate (school attachment); and individual student characteristics (e.g., age, race, sex, school involvement and effort, belief in rules, positive peer associations). “Community” was conceptualized in two ways: “local” (the census tract around the school), and “imported” (aggregated measures from the census tracts where students actually lived). We used hierarchical linear modeling techniques (HLM) to examine between- and within-school factors. Individual-level factors accounted for 16% of the explained variance; school and community-level factors (both local and imported) added only small increments (an additional 4.1–4.5%). We conclude that simplistic assumptions that “bad” communities typically produce “bad” children or “bad” schools are unwarranted.  相似文献

Individuals who are motivated to feign psychological problems to achieve a desired outcome (e.g., insanity defense) may overreport symptoms of psychopathology, with type of pathology being dependent on the setting. In the current investigation, we examined the utility of the overreporting validity scales (infrequent responses [F-r], infrequent psychopathology responses [FP-r], infrequent somatic responses [Fs], and symptom validity [FBS-r]) on the Minnesota Multiphasic Personality Inventory-2-Restructured Form (Ben-Porath and Tellegen 2008) to detect research participants instructed to simulate one of three mental disorders: major depressive disorder (MDD), schizophrenia (SCH), or post-traumatic stress disorder (PTSD). The restructured clinical (RC) and overreporting validity scale scores of bona fide psychiatric patients with a primary diagnosis of either MDD, SCH, or PTSD were compared to two groups of simulators—naïve (i.e., undergraduate students with no training in mental disorders) and sophisticated (i.e., individuals with advanced training in psychopathology or personal experience with the disorder asked to overreport symptoms). Examination of the RC Scale profiles revealed that the sophisticated simulators produced symptom profiles more similar to the profiles of the psychiatric patients than did the naïve simulators. For the overreporting validity scales, the sophisticated simulators were less likely to be detected as feigning compared to the naïve simulators; overall, the validity scales were able to distinguish patients from simulators and accurately classify most of the simulators regardless of their level of “symptom” sophistication. Examination and comparison of the validity scales revealed that across disorders and level of research participant symptom sophistication, the FP-r scale best differentiated simulators from patients.  相似文献

This study examines the effects of 14 estimator variables (e.g., disguise of robber, exposure time, weapon visibility) and system variables (e.g., lineup instructions, exposure to mugshots) on a number of measures of eyewitness performance: identification accuracy, choosing rates, confidence in lineup choice, relation between confidence and identification accuracy, memory for peripheral details, memory for physical characteristics of target, and time estimates. Subjects viewed a videotaped reenactment of an armed robbery and later attempted an identification. Characteristics of the videotape and lineup task were manipulated. Prominent findings were as follows: identification accuracy was affected by both estimator and system variables including disguise of robber, weapon visibility, elaboration instructions, and lineup instructions. Memory for peripheral details was positively correlated with choosing on the identification task but negatively correlated with identification accuracy.  相似文献

Against the backdrop of the COVID-19 pandemic and China’s regularized pandemic prevention and control, leading legal scholars from China, North America, and Eurasia participated in The 6th International Conference on Human Rights Protection under Pandemic Prevention and Control. Participants engaged in fruitful discussions on the normative necessity and practical relevance of the principle of proportionality in justifying their current governments’ anti-pandemic measures. Focusing on pandemic-related human rights conditions and rule of law challenges in global contexts, this article summarizes the participating scholars’ speeches through the integrated lens of human rights and the jurisprudence of health law in the COVID-19 containment phase. Speeches can be divided into six topical dimensions, involving normative utility, governance logic, reasonable limits, constitutional criteria, viable approaches, and post-pandemic challenges with respect to the principle of proportionality. To provide a more policy-relevant and theoretically sound framework for a community of common health for mankind, this article succinctly concludes with a series of overlapping consensus on the application of the principle of proportionality in the fight against the pandemic. This consensus, tentatively named the “Renmin Human Rights Consensus,” builds on five interrelated elements and generates five human rights assertions and a series of specific principles of health law.  相似文献

As part of a series of studies aimed at validating techniques in forensic odontology, this study aimed to validate the accuracy of ante-mortem (AM)/postmortem (PM) radiographic matching by dentists and forensic odontologists. This study used a web-based interface with 50 pairs of AM and PM radiographs from real casework, at varying degrees of difficulty. Participants were shown both radiographs as a pair and initially asked to decide if they represented the same individual using a yes/no binary choice forced-decision. Participants were asked to assess their level of confidence in their decision, and to make a conclusion using one of the ABFO (American Board of Forensic Odontology), INTERPOL (International Criminal Police Organisation) and DVISys? (DVI System International, Plass Data Software) identification scale degrees. The mean false-positive rate using the binary choice scale was 12%. Overall accuracy was 89% using this model, however, 13% of participants scored below 80%. Only 25% of participants accurately answered yes or no > 90% of the time, with no individual making the correct yes/no decision for all 50 pairs of radiographs. Non-odontologists (lay participants) scored poorly, with a mean accuracy of only 60%. Use of the graded ABFO, DVISYS and INTERPOL scales resulted in general improvements in performance, with the false-positive and false-negative rates falling to approximately 2% overall. Inter-examiner agreement in assigning scale degrees was good (ICC = 0.64), however there was little correlation between confidence and both accuracy or agreement among practitioners. These results suggest that use of a non-binary scale is supported over a match/non-match call as it reduces the frequency of false positives and negatives. The use of the terms “possible” and “insufficient information” in the same scale appears to create confusion, reducing inter-examiner agreement. The lack of agreement between higher-performing and lower-performing groups suggests that there is an inconsistency in the cognitive processes used to determine similarity between radiographs.  相似文献

Why do individuals or groups support vigilantism as a means of conflict resolution? Most researchers tend to agree that support for and participation in vigilantism occurs in “stateless locations,” that is, when formal justice institutions are weak or absent. Despite this general consensus, quantitative evidence of this relationship is limited to a handful of country‐specific studies that used only subjective survey‐based measures of institutional weakness. This study seeks to extend research on vigilantism by assessing the relationship between subjective and objective conditions of formal justice institutions and public support for vigilantism across 323 provinces in 18 Latin American countries by using the 2012 AmericasBarometer Survey. Specifically, this study uses multilevel logistic regression techniques to examine the variability of public support for lethal vigilantism within and across Latin American countries. When controlling for a wide range of potential confounds, the results show that the most robust predictors of support for violent vigilantism are subjective indicators of institutional illegitimacy, personal victimization, and punitive attitudes. Evidence also exists that objective insecurity, as measured by province‐level homicide rates, fosters public support for violent vigilantism in certain situations.  相似文献

Criminological research on legitimacy has focused almost exclusively on citizens’ normative assessment of legal authorities. However, this line of research neglects power-holders’ own assessment of their legitimacy or self-confidence in their moral validity of their claims to power. This paper examines the conditions on which prison officers as power-holders base their legitimacy claims. Data from semi-structured interviews and observation of prison officers in Ghana shows that prison officers in Ghana exude high power-holder legitimacy underpinned by favourable assessment of their “self-” and “perceived audience” legitimacy in the eyes of prisoners. While officers’ self-legitimacy was underpinned in their legal status (e.g., legality) and the uniforms (e.g., state insignia), perceived legitimacy was anchored in officers’ maintenance of authority via self-discipline, good and close officer–prisoner relationships, respect for prisoners as humans, and professional competence or making a difference in the lives of prisoners.  相似文献
