外层空间非军事化是国际社会的一个重要目标。虽然目前有一些关于外空活动的国际条约和文件，但它们对限制和禁止外空武器的规定很不充分，无法约束和制止外空的进一步军事化和把军备竞赛扩展到外层空间。在外层空间法形成发展过程中，国际条约关于外层空间非军事化的规定，使外层空间非军事化法律制度的构建具有可行性。联合国外空委应以控制外空军备竞赛为中心工作，制定控制外空军备竞赛的国际法律文书，弥补现有外层空间法律机制的漏洞，切实控制外空军备竞赛，确保外空的和平利用。     

外层空间反卫星武器法律规制研究

近年来,对于外层空间的探索利用,存在从强调合作的全球主义转向强调冲突的空间民族主义的趋势。外空局势波诡云谲,不仅体现初见端倪的关于外空资源等经济利益的争夺,更体现在军事领域中以反卫星武器试验为典型的外空武器化趋势与军备竞赛。数量剧增的空间碎片已经成为影响航天器寿命与安全的最重要因素之一,空间碎片减缓和清除已刻不容缓。但反卫星武器的使用却将进一步恶化外空环境,对全人类和平开发、利用和探索外空产生负面影响。以外层空间法和平利用外空原则、保护外空环境原则和武装冲突法区分原则、比例原则、限制原则为依据并结合实践视角,指出对反卫星武器加以规制的必要性与正当性。
