Seeking Universal Credit Ratings

Amid the EU’s ongoing sovereign debt crisis,the current international credit rating system has been accused of aggravating the world’s economic woes.Recently,Guan Jianzhong,Chairman of the Board and President of the Beijing-based Dagong Global Credit Rating Co.Ltd.,spoke to Beijing Review reporter Yu Yan about reforms in the current international credit rating system and Dagong’s role.Dagong is the first non-Western rating agency to assess the world’s sovereign credit and risks.

CRISIS FOCUS: Risks to Recovery

A sustained recovery of the global economy at a slow but steady pace should be expected in the first quarter of 2010, according to the quarterly report on global economic and financial outlook compiled by the International Finance Research Institute of the Bank of China. But three risks stand out, the report said, that threaten recovery efforts: the sovereign credit crisis, growing inflation pressures and increasing numbers of small and medium-sized U.S. banks filing for bankruptcy.

回顾分析1929年大崩溃、1980年代末日本的资产价格泡沫以及2008年美国次贷危机,发现每次资产价格泡沫的过度膨胀都伴随着大规模的信贷扩张;而信贷急速扩张的背后,则是长期繁荣所形成的大众乐观以至疯狂情绪.这意味着,应该从更长远的政策视野推进宏观金融调控体系改革,构建金融和实体经济双稳定框架,以降低实体经济、信贷扩张与资产价格波动的同周期性所引发的泡沫风险.     

The Path of Helpseeking: Perceptions of Law Enforcement Among American Indian Victims of Sexual Assault

The longstanding history of violence and oppression toward American Indians (AI) by the United States has created numerous problems for native communities, including high crime rates. AI women are sexually victimized more than other U.S. racial groups, but often receive very limited services. Secondary analyses of National Violence Against Women Survey data indicate that AI women's reasons for not reporting rape suggest ongoing suspicion of law enforcement. AI women, compared to others, more often said law enforcement would not believe or would blame them, and more often reported that they or their family dealt with the perpetrator. Many other barriers to helpseeking persist, including prejudice, conflict between Western and native values, language barriers, and poverty. AI communities also possess numerous resources that are specific to their cultures and their sovereign relationships with the U.S. government. More needs to be done to minimize barriers and make full use of community assets.     

Bond Market Integration: the Chinese Mainland and Hong Kong

This paper seeks to examine the integration of the evolving bond markets in the Chinese Mainland (CM) and Hong Kong (HK). To tap the international pool of capital, the CM government and CM enterprises have issued foreign currency bonds in HK and other developed markets. Since 1998 offshore CM bonds offered to the public have not been denominated in HK dollars probably because of concerns over the stability of HK's linked exchange rate and the differential credit ratings of the two economies. Even though HK has become increasingly well equipped to handle the clearing, settlement and custody of local and foreign currency bonds across its borders, it needs to continue to lobby for and attract CM government and corporate issues of foreign currency bonds (and Rmb bonds, if this were to be permitted) if it is to establish itself as a regional bond centre in Asia.

信用证是国际贸易中的一种重要的支付手段。信用证诈骗是发生在信用证结算过程中一种比较复杂的犯罪行为,社会危害性极大,惩治信用证诈骗犯罪对重塑社会信用具有十分重要的现实意义。笔者从概述信用证的运作机制入手,对信用证诈骗犯罪的特点、主要表现形式以及防范对策进行了较为深入的探讨,以期为打击、遏制信用证诈骗犯罪,建立完善的防控机制提供有益探索。

公司信用是公司履行义务的能力和行为的社会评价,其信用结构包括静态信用结构和动态信结构。静态信用结构包括：履行义务的能力、履行义务的意思、履行义务的行为、社会评价;动态信用结构包括：公司信用的开始、公司信用的变动、公司信用的结束。公司信用基础是公司资产,资产的范围包括：公司自有资产及他人为公司履行债务提供担保的资产。公司资产信用的理论基础就是公司独立人格理论及债的担保理论。     

How Do Americans Evaluate China's International Responsibility? An Empirical Assessment

China in recent years has been asked by other major powers to take a greater share in international responsibility in response to the rise in China's national capability. Negative perceptions about how China is dodging its international responsibility exist not only among policy makers around the world, but have spread to worldwide mass publics, especially across the American people. In this article, we apply the dataset from the ‘Americans’ Attitudes toward China Survey' (AACS) to investigate what the American public think of China's international responsibility and which factors explain the varying evaluations from different theoretical perspectives. The results indicate that Americans' negative evaluations of China's international responsibility are associated with poor ratings regarding China's fulfillment of its domestic obligations and apprehension regarding China's potential threat, but has little to do with China's international behavior. To reduce these negative evaluations, China needs to improve its human rights conditions, give people more political rights, and convince the American public of the benevolence of its ascending power. In addition, persistent efforts toward soft-power construction are also very important since Americans who are interested in Chinese culture or knowledge tend not to think that China is dodging its international responsibility.

The False Narrative On Basic Rights

正The U.S. has made human rights a central component of its foreign policy since the Jimmy Carter administration(1977-81). Carter, seeking to improve the international image of the U.S. in the aftermath of the Viet Nam War, criticized human rights abuses and the lack of political freedoms in various U.S.-allied dictatorships, including Chile and Nicaragua. Such criticisms were designed not only to enhance the reputation of the U.S. internationally but also to buttress and give credibility to its ongoing ideological warfare against the socialist world.

信用卡诈骗犯罪定性研究

信用卡诈骗罪是我国刑法中的一类新型犯罪。对于假借信用卡非法获取财物或财产性利益的行为,是否一概认定为信用卡诈骗犯罪,国内外理论和立法并不统一。以我国信用卡交易的实践及其交易规则为基础,分析我国信用卡诈骗犯罪的行为构造;在借鉴、考察国外相关立法和未来信用卡发展趋势等的基础上,提出:作为一种现代新型犯罪,我国刑法中的信用卡诈骗罪兼有传统诈骗罪和盗窃罪的双重属性。由此,可以有效避免实践中对相关犯罪行为定性上的分歧,并能适应未来信用卡犯罪的发展趋势。
