Administrative Justice in the Wake of I,Daniel Blake

This article argues that Ken Loach's film, I, Daniel Blake, invites deep reflection on the relationship between the individual and the state, and, more particularly, on the role of administrative justice in restoring a re‐imagined sense of citizenship. Drawing on earlier debates from the 1950s, as well as on more recent advocacy of the ‘connected society’, the article proposes that to meet such an ambition, administrative justice must be recognised as an overarching set of principles and values, rooted in a framework of human rights and with a reinvigorated public‐sector ombud‐institution at its centre. In this way, administrative justice might serve as an effective and restorative counterweight to more legalistic options for responding to public grievance, whether the result of routine encounters with the state or of a major breakdown in trust, such as that occasioned by ‘Grenfell Tower’.

Participation in the Wake of Adversity: Blame Attribution and Policy-Oriented Evaluations

In this paper we investigate to what extent perceptions of economic conditions, policy-oriented evaluations, and blame attribution affected Californians’ involvement in political activities in 2010. We use a statistical methodology that allows us to study not only the behavior of the average citizen, but also the behavior of “types” of citizens with latent predispositions that incline them toward participation or abstention. The 2010 election is an excellent case study, because it was a period when citizens were still suffering the consequences of the 2008 financial crisis and many were concerned about the state’s budgetary crisis. We find that individuals who blamed one of the parties for the problems with the budget process, and who held a position on the 2010 Affordable Care Act, were often considerably more likely to participate. We also find, however, that the impact of economic evaluations, positions on the health care reform, and blame attributions was contingent on citizens’ latent participation propensities and depended on the class of political activity.     

Terrorism and the Railroads: Redefining Security in the Wake of 9/11

This article examines the impact of the 9/11 attacks on railroad security. Railroad security has been traditionally defined as a problem of trespass and liability for deaths, injuries, and property damage sustained or caused by trespassers. It argues that the private freight railroad industry, not government, has largely directed the efforts to prevent terrorism and share information on suspected terrorist threats, through the prompt formation of a loosely coupled network of organizations coordinated by the industry trade association, the American Association of Railroads. The freight railroad network approach is contrasted with the efforts of Amtrak to gain public funds for its security efforts by connecting its survival with homeland security. Kingdon's model of the policy process is used to explain how 9/11 has presented an opportunity for railroads to use policy windows to gain benefits for the industry while at the same time resisting possible reregulation. It contrasts the network approach with the traditional hierarchical-bureaucratic form of organization used in the design of the Department of Homeland Security, and suggests it poses a valuable case study to see how information can be shared between widely divergent types of organizations, and test how best to prevent future terrorist events.

In the Wake of 'A Certain Maritime Incident': Ministerial Advisers, Departments and Accountability

This article considers the accountability of ministerial advisers and their relationship with departments in the light of 'the children overboard' incident. It argues that if ministers are not going to accept responsibility for the actions of their advisers then on those occasions the advisers should be separately accountable to the parliament. The article further suggests that the department heads have a particular responsibility for ensuring the integrity of ministerial advice, and proposes steps to reinforce their capacity to fulfil that responsibility.     

Containing Environmentalism: Risk,Rationality, and Value in the Wake of the Exxon Valdez

This article revisits regulatory debates about environmental valuation following the Exxon Valdez oil spill to argue that the spill can be seen as a constitutive moment in the rise of neoliberalism. I show that rationalizing environmental values was not simply about applying market rationality to the natural world, but entailed reexamining the nature of that rationality itself and its relevance to social behavior. I then trace the reverberations of these debates beyond the realm of environmental policy, highlighting an underappreciated legacy of the Valdez: the first credit default swap, executed in response to an unprecedented punitive fine leveled against Exxon. Illuminating the linked histories of environmental valuation, corporate environmentalism, and financialization through that event, I argue that environmental valuation is a political problem through which neoliberal strategies for the governance of life (both human and nonhuman) have been forged.     

Valuing the Earth and Each Other

In this short essay I briefly explore the utility of Marx’s theory for non-human nature and then proceed to consider his position on value after capitalism. Finally, I claim that many other types of theory contribute to the valuing of nature in the broad sense (beyond capitalism), and argue that proponents of these theories (along with Marxists) could not only learn from each other but also build affinity and solidarity in the construction of diverse economies and subjectivities. The “Leap Manifesto”, authored by representatives of Black Lives Matter, indigenous groups, unions, feminists, climate justice groups, and many others, is one example of the way forward.     

Wake Up to Reality: Taiwan, the Chinese Mainland and Peace Across the Taiwan Strait

Relations between the Republic of China (ROC or Taiwan) and the People’s Republic of China (PRC or Chinese mainland) have improved significantly since 2008. However, this study suggests that it will be difficult for the two sides to sustain the momentum in cross-strait relations unless Beijing—and to some extent Taipei—begin to recalibrate their relationship in a more pragmatic way and adopt some new thinking on the concepts of sovereignty and the political status of the ROC. In short, they need to figure out a way to acknowledge the fact that both the ROC and PRC exist.     

Escaping Earth: Human Spaceflight as Religion

What if we viewed the history of human spaceflight somewhat less through the lens of Cold War politics, which admittedly was central to the race to the Moon, but more as an expression of what might be called a religion of spaceflight? There seems to be a deeply religious quality to advocacy for the investment in and support for human space exploration, lending to the endeavor of a “higher purpose” that helps to explain both the generous nature of the actual investment and the ultimate unwillingness of Americans to eviscerate space budgets despite less than full support for space exploration. This article examines religious conceptions as a means of analyzing what might be termed a “space gospel.” I lay out here the proposition that human spaceflight may be viewed as a religion with similar attributes to those present in mainstream religious denominations. This approach to exploring the history of human spaceflight offers a different and useful frame of understanding that broadens basic conceptions about this aspect of the human past.     

Ripples Not Waves: A Policy Configuration Approach to Reform in the Wake of the 1998 Sydney Water Crisis

The aim of this article is to understand why, in the aftermath of the 1998 Sydney water contamination crisis, policy and institutional reform was comparatively minor—despite intense scrutiny and criticism of the framework of water policy in New South Wales (NSW). The article should be of serious interest to scholars interested in crisis and policy change, rather than simply those with a particular interest in water policy in Australia. It frames the Sydney case as a disconfirming one but finds that an understanding of the stability/change relationship in NSW water policy can only partially be understood through applying key contemporary institutional, actor, and interest‐centered explanations. Therefore, it probes the plausibility of an additional explanation and develops the rudiments of a new “policy configuration” approach to help explain policy stability and change. It concludes by suggesting that there is potential for a policy configuration perspective to be tested against other cases.     

Rebuilding the White Earth Nation through Constitutional Reform

The process of Native nations’ resurgence, called nation building, is a phenomenon largely neglected by mainstream political science in the United States. Empirical and theoretical gaps exist in the study of Native nations’ political structures. This article’s empirical focus is on the rebuilding process of the White Earth Nation in Northwestern Minnesota. The objective is to investigate the long-term process of White Earth governance (1913 to the present) in order to explain why the White Earth government reform of 2007–2013 failed in the final implementation phase. I analyze hitherto unknown archival materials using a case-specific theoretical framework that employs Indigenous studies approaches, Michel Foucault’s genealogy, and new institutionalism. My findings suggest that the return to the institutional status quo in White Earth governance results from path-dependent dynamics and the Anishinaabe internalization of an outwardly imposed governing structure.     

"The World Changed Today": Agenda-Setting and Policy Change in the Wake of the September 11 Terrorist Attacks

The September 11 terrorist attacks constitute a focusing event that have been said to have “changed everything” in America. However, the literature on focusing events, policy change, and the policy process suggests that the “windows of opportunity” opened by focusing events like the September 11 attacks do not automatically equate to policy change. This paper considers whether and to what extent the agenda and policies have changed as a result of the attacks. While the events of September 11 provided the impetus for change, the threat of terrorism was already well established in the policy stream, and September 11 only threw open the window of opportunity for policy change based, in large part, on preexisting ideas; many of these ideas were enacted. And in the case of aviation security, some innovation is evident in the area of cockpit security.     

Harmonization of Earth Observation Data: Global Change and Collective Action Conflict

ABSTRACT

Earth observation by satellites is the basis for integrated scientific assessment of global environmental change. Institutional arrangements to coordinate Earth observation data collection efforts recognize harmonization as essential for the scientific assessments that are sought. The goal of harmonization is to achieve compatibility of data polices among the various Earth observation science missions. In this article, I discuss the concept of harmonization and evaluate how Earth observation data policies influence the implementation of harmonization through an examination of a number of relevant actors, strategies, and systems. This includes the Committee on Earth Observation Satellites, the Integrated Global Observing Strategy, the former International Earth Observing System, the Group on Earth Observations, the Global Earth Observation System-of-Systems, and the Earth observation programs in the United States and Europe. The results of this study indicate that the problem for realizing an optimal harmonization lies in the differing preferences among actors as to how harmonization is formulated and then implemented. A number of recommendations are put forward here that can ameliorate the problems concerning the implementation of harmonization.
