This paper examines the relationship between the rule of law and sustainable development. It does so from the perspective of the rule of law as a development end, and as a means to sustainable development. It offers a model for conceptualising and measuring the rule of law, including the two global indicators for SDG Target 16.3. It explores the wider relationship between the rule of law and other Sustainable Development Goals, and proposes a thematic approach to better understanding the associations between legal frameworks and development outcomes.  相似文献

本文阐明了中国环境法60年的发展概况、所取得的成就、所存在的主要问题以及今後的发展方向。主张在环境立法内容方面,加强有关环境治理、环境善治、公民环境权、环境民主、公秉参与、环境知情权、环境公益诉讼、政府环境责任及政府环境责任问责制方面的立法:在环境法学研究方面提出:促进研究范式从“主、客二分”到“主、客一体”的转变;促进环境法上的人的模式从经济人模式、主体人模式向生态人模式转变。认为环境法治理建设应该以可持续发展为目标,以生态文明为方向,以环境法治为灵魂,以维护环境正义公平为宗旨,以环境安全为前提,以人与自然和谐相处为核心,以环境民主为手段,以追求环境效益和环境效率为激励机制,以健全综合生态系统管理和环境“善治”机制为导向,充分发挥环境法律调整人与自然关系的作用,使其成为建设环境友好社会、资源节约型社会和生态文明社会的法律保障。环境法学应该研究生态化方法和综合生态系统管理理论,促进环境法向生态法转变,促进环境法律制度的生态化.  相似文献

States have customarily tended to compete with one another. Not always, however, is this tendency, or the underlying methods put to use, obvious. That states (provincial divisions in the US) were competing to attract incorporations by relaxing their regulatory standards, couldn’t be seriously observed and highlighted until mid-1970s. Today, a few would doubt the existence of regulatory competition in corporate law in the US. In this paper, the author examines the issue whether the EU is (likely to be) engaged in regulatory competition in the area of company law. Answering the question in affirmative, the author proceeds to examine the strength of the race to the bottom and the race to the top theories, as developed and argued in the US, for the European setting. Since the legal systems of Member States of the EU have certain very disparate “core values” along which those systems have historically developed, relaxation of standards in the EU would take place against different variables. Because of the multitude of variables, comparable variables are unlikely to yield comparable results; either of the race theories is unlikely to satisfactorily predict the regulatory behaviour of EU Member States. Instead, since “laxation” in respect of one variable would be met by “optimisation” in respect of the other, there is likely to be simultaneous races to the top and to the bottom among the EU Member States.  相似文献

Business students learning company law face a number of unique challenges. Therefore, instructors who teach company law to business students must carefully consider how their courses will meet these unique needs. This article will reflect on the challenges faced by business students studying company law before going on to consider how these challenges can be overcome. This work emphasises the importance of focusing on the learning outcomes of business students undertaking company law and the need for the module to be structured in order to meet the learning outcomes that provide business students with an understanding of the key principles relating to company law and its role and influence on business decision-making. This article introduces various aspects of technology business incubators (TBIs), emphasizing their increasing role in the spatial context where they are used as platforms and drivers of regional entrepreneurial ecosystems. It outlines the key themes of the emerging role of TBIs in sustainable regional development: TBI biodiversity of ecosystems; accelerating startups in the entrepreneurial university; TBI mechanisms challenged by green technology to sustain regional development; and TBIs’ connecting role between entrepreneurship education, experiential knowledge, and regional development. 股东积极主义是股东定期地以特定的公司经营政策为目标而实施的干预和影响行为.股东既可以通过正式地行使其法定权利影响公司的政策,也可以通过其它非正式的积极行为影响公司决策.对于前者,股东积极主义的法律界限要求股东积极行为不得违反股东忠实义务,禁止股东权利滥用,要求股东对自己的不当影响行为承担责任,其核心在于要求积极行为股东不得损害公司及其他股东利益.对于后者,则不宜直接将非正式股东积极影响行为确认为违法并予以禁止.  相似文献

可持续发展是人类未来的共同发展战略 ,它将人类社会发展与资源开发和环境保护结合起来 ,是当前最新的一种发展理念 ,并正在成为我国立法的一项指导原则。然而 ,能否在这一原则之下制定我国专门的可持续发展法律制度 ,以及可持续发展法律制度在现有法律体系和法律部门中如何定位和构建等 ,是法学界颇有争议的问题。本文认为 ,我国应当建立符合可持续发展内在要求的可持续发展法律制度 ,并应将其纳入我国社会主义市场经济法律体系之中予以规范。  相似文献

Democracy and the rule of law are the pillars of sustainable development and the guarantee of fundamental freedoms in any society. The rule of law is one of the prerequisites to creating an enabling environment that supports socio‐economic growth and political development. The future of democracy rests with the ability of democratic governments to observe the rule of law. The rule of law is the fulcrum of democracy and the pillar upon which the structures of democracy stands.
