The aim of the present study was to better understand how the sex of a defendant and of a victim in an ambiguous assault case impact juror verdicts and perceptions of the defendant. Juror sexist attitudes and the impact of these beliefs on decision making were also investigated. Mock jurors completed a measure of sexist attitudes and read a brief summary of an assault case in which the sexes of the defendant and victim were manipulated. Participants then rendered a verdict and provided sentencing recommendations. Mock jurors recommended the harshest sentence for the male defendant who assaulted a female victim. However, the female defendant, regardless of victim sex, was perceived as more psychopathic. Results are discussed in terms of the selective chivalry theory of sexism.  相似文献

This research tests the possibility that the reasonable woman as compared to the reasonable person test of hostile work environment sexual harassment interacts with hostile and benevolent sexist beliefs and under some conditions triggers protectionist attitudes toward women who complain of sexual harassment, We administered to a sample of undergraduates the ambivalent sexism inventory along with the fact patterns in two harassment cases and asked them to make legally relevant decisions under either the reasonable woman or person standard. We found that those high in hostile sexism, and women, found more evidence of harassment. However, those high in benevolent sexism did not exhibit the hostile sexism effects. Although men were less sensitive to the reasonable woman standard than women, under some conditions the reasonable woman standard enabled both genders to find greater evidence of harassment. The results are discussed from the perspectives of law and psychology.  相似文献

This article challenges the distinction the law draws between male and female. It focuses on the legal and medical treatment of intersexual people. Analysing the nature and rate of intersexuality it argues that there is a significant number of people who cannot be described as either male or female and instead exhibit a range of sexual characteristics. Until recently the law and medicine have insisted that intersexual people should be categorized as either male or female. Surgery was performed to ensure that they had the appearance assumed to be the 'norm' for a man or woman and the law followed this medical assignment of sex. Over the last couple of years the established medical practice and the legal treatment have been challenged. This article discusses the nature of these challenges and argues that there is a strong case for rejecting the traditional legal and medical approach to intersexual people. Cosmetic surgery on intersexual babies should be delayed until the individual is old enough to be able to choose their own sexual identity, which may be neither male nor female. The insistence that every person must either be male or female is no longer supportable in medical or social terms and a much wider range of sexual identities must be recognized by the law.  相似文献

Abstract

We examined sex offender treatment dropout predictors, in particular, the relationship of psychopathy and sex offender risk to treatment dropout in a sample of 154 federally incarcerated sex offenders treated in a high intensity sex offender treatment program. Demographic, criminal history, mental health and treatment-related data as well as data on risk assessment measures including the Static 99, Violence Risk Scale – Sexual Offender version (VRS-SO), and Psychopathy Checklist – Revised (PCL-R) were collected. Logistic regression and discriminant function analyses were used to identify predictors that made significant and unique contributions to dropout among all the variables under study. The Emotional facet of Factor 1 of the PCL-R and never being married were found to be the most salient predictors of treatment dropout and correctly identified about 70% of the cases. The implications of the findings for managing treatment dropout and for the treatment of psychopathic offenders are discussed.  相似文献

Recent increases in arrests of women have stimulated much controversy about the causes and extent of female crime and created much speculation about the differential treatment of female offenders by police officers. This article reports an empirical study of police processing of female offenders. During September–December 1978, 282 questionnaires were completed by police officers and detectives in a large, metropolitan area in a southeastern state. Each officer was asked to indicate a police decision in five hypothetical situations which varied by types of offense, race of the offender, sex of the offender, and demeanor of the offender. An analysis of the responses of the police officers indicates that decisions of police are not contingent on the sex and race of the offenders. The major variables in determining how police officers will respond are the nature of the offense and the manner in which the offender behaves when confronted by the officer.  相似文献

This study examined the attitudes of police officers and judiciary members toward wife abuse in Turkey and the relation between these attitudes and profession, ambivalent sexism (hostile/benevolent sexism), gender, and gender roles. The following instruments were used for the analyses: The Attitudes Toward Wife Abuse Scale (AWAS), the Ambivalent Sexism Inventory (ASI), and the Bem Sex Role Inventory. The participants were 300 police officers and 150 judiciary members selected from different regions of Turkey. Results showed that compared to judiciary members, police officers are more tolerant of physical and verbal abuse of women in marriage, but less tolerant of the idea of the victim leaving an abusive marriage partner. Similarly, men were more tolerant than women of those husbands who physically and verbally abuse their wives, but less supportive of the wife leaving the abusive partner. Profession and ambivalent sexism (hostile/benevolent sexism) were found to be the strongest predictors of attitudes toward wife abuse.  相似文献

Abstract

This paper reviews empirical findings on physical and sexual violence against female street working sex workers, drawing on the findings from the researcher's own study. Thirty-two female street sex workers were interviewed in a city in the South West of England during 1998. The ethical issues of researching female prostitution are discussed in relation to this specific research project. The main findings from the current literature and this original study highlight the possible connections between childhood sexual abuse, entrance into the sex industry at an early age, and continual experience of violence. This paper explores violence from pimps and clients as well as how the street environment exposes sex workers to risk. Concluding discussion explores the self protection strategies of individual sex workers and the female sex work community as a means of maintaining a survivor identity and not a victim identity.  相似文献

ABSTRACT

Intimate partner violence (IPV) continues to be viewed in gendered and heteronormative ways. Stanziani, Cox, and Coffey (2018, Adding insult to injury: Sex, sexual orientation, and juror decision-making in a case of intimate partner violence. Journal of Homosexuality, 65(10), 1325–1350) presented participants with a case of alleged IPV while manipulating the sex and sexual orientation of the aggressor/victim dyad. Results suggested participants view violence perpetrated by a man against a woman most abhorrently. The current study replicated and expanded that study, exploring how gender role beliefs influence participant decision-making. Female participants held more adverse attitudes towards IPV when a male assaulted a female. Further, participant gender role beliefs influenced decision-making. Specifically, males who endorsed higher levels of hegemonic masculinity perceived the crime to be less serious, while females who endorsed the same beliefs perceived the defendant as less likely to benefit from treatment. Overall, results suggest individual beliefs regarding gender roles and masculinity may influence their perceptions of IPV, regardless of the gender and sexual orientation of the aggressor and victim.  相似文献

A sex offender program delivered in a medium-security prison followed 109 treatment completers and 37 noncompleters for 2 years after release. Noncompleters, those who refused treatment or dropped out, had 6 times the rate of sexual and violent reoffending relative to completers. Among those who completed the program, however, positive evaluations of treatment change, such as quality of disclosure and enhanced victim empathy, found in posttreatment assessments did not correlate with recidivism. Furthermore, completers did not differ in their rates of recidivism from pretreatment rates predicted by the Static 99, an actuarial measure of anticipated sexual and violent recidivism. We conclude that the program did not influence propensities for sexual and violent recidivism but rather served as a prolonged screening instrument for sex offenders whose failure to comply with treatment attendance predicted higher rates of recidivism.  相似文献

Previous studies have shown that female offenders frequently receive more lenient judgments than equivalent males. Chivalry theories argue that such leniency is the result of paternalistic, benevolent attitudes toward women, in particular toward those who fulfill stereotypical female roles. Yet to date, studies have not examined whether such leniency is indeed associated with paternalistic societal attitudes toward women. The present study goes beyond the investigation of demographics and employs Glick and Fiske's (1996) concepts of hostile and benevolent sexism. We use these concepts to highlight the role of individual differences in attitudes toward women as a key to our understanding of lenient attitudes toward female offenders. Eight hundred forty respondents from a national sample of Israeli residents evaluated the seriousness of hypothetical crime scenarios with (traditional and nontraditional) female and male offenders. As hypothesized, hostile and benevolent sexism moderate the effect of women's "traditionality" on respondents' crime seriousness judgments and on the severity of sentences assigned.  相似文献
