Recent national and international debates on truth and reconciliation in Uganda have emphasized the importance of incorporating local-level mechanisms into a national transitional justice strategy. The Juba Peace Talks represented an opportunity to develop and articulate sufficient and just alternatives and complementary mechanisms to the international criminal model. The most commonly debated mechanism is the Acholi process known as mato oput (drinking the bitter root), a restorative justice approach to murder. Drawing on 2 months of research in nine internally displaced persons’ camps in 2007, we examine local justice practices in the region of northern Uganda to consider their potential, promise and pitfalls to realizing a successful truth-telling process. We find that although local mechanisms could help facilitate reconciliation in the region, truth-telling is but one part of a conciliatory process complicated by a national context of fear and the complexity of the victim–perpetrator identity at the community level. These locally informed insights help move forward the debate on such mechanisms in Uganda and add useful insights into community processes in the field of transitional justice more generally.  相似文献

Abstract. This essay provides a critical assessment of an important contribution to the debate on institutional efficiency and inefficiency in European policy–making: the thesis on the 'joint–decision trap'. This trap was identified by Fritz W. Scharpf, first in German federalism and later in policy–making in the European Union. The essay argues that joint–decision traps may be a much more prevalent phenomenon than envisaged by Scharpf. However, the essay demonstrates that joint–decision traps are not inherent to joint–decision systems. The basic argument of the essay is that the effects of joint–decision systems on public policy is contingent upon the central government's ability to threaten intergovernmental actors with exit. If this is possible, joint–decision systems turn into an asset. This argument is made on the basis of an analysis of intergovernmental relations in Sweden, Norway, and Denmark and a comparison of the Scandinavian systems with those of France and Germany.  相似文献

This article explores the official cover up of the mysterious disappearance of naval frogman Lionel Buster Crabb in 1956. Existing histories of the affair have tended to focus on the manner of Crabb's death, advancing a series of plausible and suitably implausible explanations. Using recently declassified sources, this article, in contrast, seeks to use the Crabb affair as a window onto government secrecy and relations between the press and the intelligence services. It is argued that the affair was a climacteric for the intelligence community and its relationship with Fleet Street, rupturing long-standing taboos about secret service work and bringing to the fore a brand of investigative journalist determined to make front-page news of intelligence shortcomings and failure.  相似文献

The phenomenon of ‘social antisemitism’ is well known. By the beginning of the twentieth century, however, an idiosyncratic variant had emerged in France. Where, elsewhere, social antisemitism tended to be ingrained and unthinking, this French variant was (typically) more theoretical, and its practitioners tended to be among the most prominent authors and thinkers. It stressed the essential cultural differences between the ‘French’ and the ‘Israelites’, and the ‘separateness’ of the Jews within France, and also developed a series of facile generalizations about the essentially inferior nature of the Jewish intellect. Griffiths examines this phenomenon, both for its characteristics and for its widespread existence in French intellectual circles, by taking a specific subject: the reception of Lacretelle’s 1922 novel Silbermann. A wide range of writers and critics—a number of whom had in other circumstances a reputation for liberal values and attitudes, and had been among those who had deplored the excesses of the antisemitic mob during the Dreyfus affair—are found to echo the views put forward by Lacretelle in that novel, and even to elaborate on them. Many of these writers were to adopt a completely different attitude towards the Jews after the Second World War; when the position of the Jews was fully realized, their earlier ‘social antisemitism’ proved less powerful than their human sympathies. But this is not to devalue the importance of the danger posed by social antisemitism, which could provide the basis for far more virulent forms of racism to flourish.  相似文献

ABSTRACT

‘Divided’ cities – places of extreme exclusion and polarization – are sites where the paradox of both fragmentary and cosmopolitan capacity of the city comes to the fore. This article asks: What practices-in-landscape consolidate, construct and deconstruct the impression of a divided city? Drawing insights from the post-conflict Mostar, Bosnia and Herzegovina, the main argument I put forward is that urban infrastructures are a crucial medium through which social divisions and cohesions are performed and rearticulated on the ground. The article attends to the everyday of youth in Mostar turning to the politics of landscape as ways of life in the city.  相似文献

Abstract

Legal mobilization has spread in China over the past 20 years and is generally considered by both activists and scholars as a way to advance democracy and rule of law. Focusing on the mobilization in favour of migrant workers and on politically moderate practices, which are both more frequent and widely held as more successful, I argue to the contrary that resistance and reproduction of political domination are mutually constitutive. Public interest litigation and administrative litigation appear as new forms of political participation that constitute an internal regulation to the authoritarian regime, thus contributing to explain the regime's capacity to adapt and its durability. This article also accounts for new strategies developed by some lawyers that shun the courts and use law to ‘empower civil society’ and that thus do not contribute to structural reproduction. Though activists are struggling to turn their strategies into more institutionalized practices, they remain an ad hoc mechanism of internal control.  相似文献

Abstract

After Kim Jong-il's confession in 2002 that North Korean agents had abducted thirteen Japanese citizens in the 1970s and 1980s, North Korea has become the most detested country in Japan, and the normalisation of bilateral relations has been put on the back burner. The abduction issue has taken precedence in Japan even over North Korea's development of nuclear weapons and long-range missiles. It has also grossly overshadowed the atrocities for which Imperial Japan was responsible in the 20th century. Why has there been such strong emphasis on an issue that could be disregarded as comparatively ‘less important’? This article understands the ascendency of the abduction issue as the epitome of an identity shift under way in Japan – from the identity of a curiously ‘peaceful’ and inherently ‘abnormal’ state, to that of a more ‘normal’ one. The differentiation of North Korea as ‘abnormal’ emphasises Japan's own (claim to) ‘normality’. Indeed, by incarnating the perils of Japan's own ‘pacifist’ ‘abnormality’, which has been so central to the collective sense of Japanese ‘Self’ in the post-war period, the abduction issue has become a very emotional argument for Japan's ‘normalisation’ in security and defence terms. The transformation from ‘abnormal’ to ‘normal’ is further enabled by Japan trading places with North Korea in the discourse, so that Japan is defined as ‘victim’ (rather than former aggressor) and North Korea as ‘aggressor’ (rather than former victim). What is at stake here is the question whether Japan is ‘normalising’ or ‘remilitarising’, and the role of the abduction issue discourse in enabling such foreign and security policy change.  相似文献

Under the imperative of ‘prevention’, the process of information production for investigatory purposes forms a crossover between intelligence gathering and law enforcement. Digital surveillance programmes collect personal data prior to any probable cause of suspicion, whereas law enforcement activities are concerned with collecting evidence of crimes after the event. When future looking preventative approaches to the prosecution of crimes are forced into the linear, temporal narrative by which criminal investigations unfold, a tension emerges. The article demonstrates the ultimate incompatibility between ‘out of the ordinary’ intelligence activities and ‘ordinary’ criminal investigations by unearthing the procedural character behind evidence laundering.  相似文献

This article uses the Venezuelan case to shed light on the potential role of interest-group systems in discrediting liberal democracies and to identify challenges that the region's democracies are likely to confront in constructing effective and fair interest-group systems. It first analyzes the role Venezuela's interest groups played in discrediting its 40-year two-party democracy. It argues that the discrediting of a system heralded by many as the region's ‘model democracy’ cannot be understood by merely assessing how the structure of the group system excluded certain groups. The study shows that the inclusion of certain business interests in visible positions of power also helped discredit the two-party democracy. The article then compares the above system with the new group system which has emerged since 1998 as part of a new democratic system inspired by Latin America's 19th century Liberator, Simón Bolívar. This comparison reveals that the current system inverts the former system of inclusion and exclusion, even as it has retained a number of the old system's less virtuous features. Abstract

The ‘flexicurity’ strategy reached the top of the European Union's policy agenda in the mid-2000s. The strategy assumes an adult worker model family and aims to promote better, as well as more, jobs and to ensure that policies should further both flexibility in the labour market and security for workers. The article explores, first, the meaning of internal and external flexibility, and of employment-based security and the different implications for men and women. While the policy documents assume that flexicurity will increase gender equality, the mechanisms have not been specified. In fact, as the article shows, women are often more ‘flexible’ workers than men, particularly regarding their contractual arrangements and hours of employment. However, they tend not to be economically autonomous and, we argue, the supply-side policies advocated on the security side of the flexicurity matrix are insufficient to improve their position, which is strongly related to the gendered divisions of paid and unpaid work.  相似文献

Recently, the functioning of Austrian Social Partnership has been increasingly called into question. The strains on the system, often traced to the internationalisation of the economy and the related shift to neoliberally inspired policies, might make Austria prone to disorganising pressures. However, case studies infields of social and economic policy‐making crucial for international competitiveness (working time, vocational training, industrial policy) suggest that many elements of interest intermediation, concertation, and conflict resolution have remained constant over the last 30 years, entailing both elements of concertation and of conflict as well as different trends across policy areas.  相似文献

Abstract

The European Union increasingly uses ‘soft’ international arrangements rather than formal international agreements in establishing relations with non-EU states. This contribution aims to raise the question of to what extent a move from hard to soft law in relations between the EU and its partners can be seen as allowing the Union to ‘step outside’ the legal framework (if that indeed is what is happening) and disregard the rules and principles that define the way in which EU external relations are to take shape. Possible consequences include the risk that these instruments are not subject to appropriate safeguards, that parliamentary influence (by the European Parliament as well as by national parliaments) is by-passed and that transparency is affected. There are various reasons for the EU not to use formal procedures, but a turn to informality does come at a price.  相似文献

If the ‘move to the left’ in the 2000s in Argentina and Brazil was the result of a longer process of contentious mobilization from below, enacted primarily during the latter part of the previous decade, what kind of social imaginaries have been enacted in the newest wave of discontent and what is its likely effect on the post-neoliberal form of governance? The argument put forward here is that the newest wave of social protest elicits the re-enactment of the liberal imaginary indirectly expressed under the notion of the republic. This operation tends to undermine the bases of post-neoliberalism, i.e. ‘the popular’, ‘the national-popular’ and ‘anti-neoliberalism: the imaginaries that defined the move to the left in the region. A new activated public, associated with middle-class sectors, raises new demands and does not identify with the ‘anti-neoliberal’ camp. Inasmuch as this activation entails a dispute over the name of the people, it signals a slowdown in the efficacy existing populist formations possess to deepen the movement towards more radical reforms.  相似文献

The use of the term ‘imperial presidency’ in South Korea refers to the fact that the country's 1987 constitution grants the state's highest office holder de facto imperial powers with regard to domestic and foreign policy making. This version of the term therefore differs from Arthur M. Schlesinger's usage in the US context, which was critical of the discretionary powers exercised by US presidents in efforts to subvert the checks and balances of the US Constitution. Concentrating political power in the South Korean presidency severely curtails the work of the other political institutions, including its parliament (the National Assembly). Every time the presidency changes hands, the leadership structures of all other public institutions are subjected to major restructuring according to political loyalty, which interrupts their routine functioning. Overall, the presidency in its current form is dysfunctional and works as a barrier against democratic deepening. This article examines why lengthy debate over South Korea's imperial presidency has so far failed to result in comprehensive constitutional reform.  相似文献

There are two salient features of the referendums on EU membership in Estonia and Latvia. Firstly, the results with decisive pro-EU majorities went easily beyond expectations based on previous opinion poll trends, where these two Baltic states had shown less public enthusiasm for integration than other Central and East European countries. This fact owed much to convincing arguments about abandoning international isolation and about geopolitical choice, with strong historical overtones. The anti-accession cause in both countries suffered from various weaknesses even though, in Estonia though not in Latvia, Eurosceptical attitudes were in evidence. Secondly, there was much less support for EU entry among the strong Russian minorities in both countries. This difference was partly due to the higher incidence of economic circumstances in determining voting behaviour but also to the fact that pro-EU (hence, pro-West) arguments were implicitly and sometimes explicitly unfriendly to Russia. In turn, this also showed that the Soviet legacy was particular to these Baltic countries compared with other accession states from CEE.  相似文献
