This article examines the democratic status of irregular immigrants from the vantage point of different models of democratic inclusion. The argument developed is that irregular immigrants are in fact members of the democratic state by virtue of being subjected to the legally binding norms in the territory of the state. The extension of the vote and other political rights to irregular immigrants nevertheless remains problematic due to their ‘illegal’ status. Because this status follows from the restrictive border policies implemented by most contemporary states, it shows that the ideal of democratic inclusion is scarcely reconcilable with a policy of restrictive cross-border movement. The conclusion defended in the article is that the interest in keeping borders restricted reduces the prospects for democratic inclusion in contemporary states.  相似文献

This article considers the gap between the universal promise of human rights and the reality of the rights enjoyed by irregular immigrants in liberal democracies such as Australia and the United States. Against the idea that stronger international rights enforcement mechanisms will automatically improve the position of irregular immigrants, it argues that international law currently provides a warrant for the way in which countries like Australia and the United States treat irregular immigrants. After developing this argument, the article explores how irregular immigrants might employ the language of rights more effectively in their political mobilizations.  相似文献

Immigration scholars have noted the rise of a distinctive discourse concerning immigrants in the United States. The ‘immigrant threat’ discourse is said to portray immigrants as an existential threat to the country and contributes to highly restrictive enforcement policies. Through a close examination of national political debates concerning comprehensive immigration reform (CIR) (2005–2007), the paper shows that most politicians involved in this debate (from liberal Democrats to conservative Republicans) agreed with the basic assumptions of this general discourse. But the paper also identifies important variants on the ‘threat’ discourse and associated strategies. Hardline conservatives stressed that the essential ‘illegalness’ of immigrants posed a threat to the country. Protecting the nation state from this threat required policies to totally banish all undocumented immigrants from the country, irrespective of their ‘good’ conduct or exceptional circumstances. Moderate and liberal reform advocates agreed with the idea that undocumented immigrants posed a threat to the country. However, they believed that banishment alone could not address the threat. Instead they advocated a strategy of risk management whereby the population would be differentiated according to levels of risk (high to low priority) and policies of inclusion and exclusion would be adjusted accordingly. This would allow the government to incorporate low risk/priority immigrants while freeing government resources to target the ‘truly threatening’ groups (i.e., criminals, delinquents, homeless, repeat unauthorized entries, etc.). Thus, while both sides conceded that undocumented immigrants were a threat to the country, they developed important variants on the discourse and contrasting policy solutions to exert control over the population.  相似文献

During the past decade, regional development policies in the Netherlands have been dismantled. At the same time, economic development policies have been decentralised to regional and local government level. This has given rise to ‘local initiatives’ for implementing market‐oriented and market‐related development strategies. In the long run, decentralisation of economic policies results in a new type of regulation. It is not through administrative measures and public control that the state intervenes in economic development, but through indirect mechanisms to improve economic growth and innovation. The Keynesian model of regulation, based on far‐reaching intervention, is gradually being transformed into a more ‘modem’ model, characterised by flexible, fragmented, indirect and ‘invisible’ measures. The result is a fundamental change in the relationship between state and economy.  相似文献

The paper examines the consistency of recent Kantian justifications of state authority through reflection on the normative implications of states’ territorial nature. I claim that their conceptual structure leaves these accounts unable to close the justificatory gap that emerges at the transition from legitimate authority simpliciter, to legitimate state authority. None of the strategies Kantian statists have come up with in order to solve this problem – based on the proximity, occupancy and permissive principles – provides the needed grounds on which to carve up the earth’s surface into jurisdictional domains. Yet, I conclude that this does not require Kantians to cede statist grounds altogether but to take a distinctly ‘global perspective’ on states.  相似文献

Mill's harm principle declares that one's liberty of action may be interfered with by the state only if one has caused harm to others. Cases of culture clash involve unassimilated subjects, be they citizens, aliens, immigrants or national minorities, who violate the law while engaging in a practice that is a prevalent and legitimate part of their native culture or religion and which they do not regard as harmful. A Millian approach to the punishment of unassimilated subjects is explored by examining Mill's views on whether there is an objective standard of harm and Mill's discussions of free will, moral responsibility and the respect due to native cultures.  相似文献

As the first in a trio of pieces devoted to incorporating immigration into policy models, this review of research on immigrant earnings trajectories brings to light several findings. Controlling for demographic and human capital characteristics, immigrants often start their U.S. lives at substantially lower earnings, but experience faster earnings growth than natives with comparable years of education and experience. The extent to which the earnings trajectories of immigrants and natives differ varies by country of origin, with the source-country's level of economic development being a key determinant of the size of the U.S.-born/ foreign-born difference. The earnings profiles of immigrants from economically developed countries such as Japan, Canada, or Western Europe resemble those of U.S. natives who are of the same age and education level. In contrast, the earnings of immigrants from developing nations tend to start well below those of U.S. natives with comparable education levels and experience, but rise more rapidly than their U.S. counterparts. Comparing the earnings profiles of immigrants of similar age, sex, and years of schooling, over time and across groups, a strong inverse relationship emerges between their initial earnings and their subsequent U.S. earnings growth. In other words, the lower (higher) the initial earnings are, the higher (lower) the earnings growth. These and other research results have important implications for the projection of immigrant earnings and emigration in microsimulation models, as discussed in the two articles following this one: (1) "Adding Immigrants to Microsimulation Models" and (2) "Incorporating Immigrant Flows into Microsimulation Models".  相似文献

Territorial rights consist of the right to jurisdiction, the right to resources and the right to exclude immigrants and are assumed to be essential to state sovereignty. Scholars who have discussed the justification of these rights have mostly focused on the right to jurisdiction. Few engage with the implications of such justification for the right to exclude immigrants. This paper argues that the justification for territorial rights cannot justify the right of states to exclude immigrants. Allowing immigrants to settle within the territory does not undermine any of the interests territorial rights are meant to protect. In addition, the interests of current inhabitants do not provide sufficient reasons to grant the state the right to exclude immigrants from the territory that everyone has equal right to in an original situation. State sovereignty is therefore seen as compatible with open borders.  相似文献

How to generate legitimate forms of governance beyond the nation state is often considered a central question in contemporary world politics. To proceed in theory‐building, scholars need to systematically assign the theory‐driven assumptions on legitimate forms of governance beyond the nation state with the various, already observable, forms of global governance. This article aims to conduct a comparative appraisal of the legitimatory quality of different patterns of governance by applying a framework of indicators for their assessment. The indicators are selected from the scholarly debate within International Relations on the legitimacy of global governance arrangements and structured by a multidimensional concept of legitimacy (input, throughput, and output dimensions). This framework is then applied to international, transnational, and private forms of global governance in the field of Internet regulation in order to show how each of them tries to produce and maintain legitimacy, which strategies it applies, and in how it interacts with its stakeholders.  相似文献

The welfare reform bill adopted in the United States in 1996 limited the eligibility of immigrants for several government assistance programs, and early projections estimated that nearly half of the savings associated with the reforms would come from these immigrant restrictions. Several studies have found that subsequent program participation declined more for immigrants relative to natives, seemingly verifying the early projections. However, many of these restrictions were either rescinded by the federal government or superceded by state and local policies. In this paper, we first reproduce earlier findings that show the relative declines in program use among immigrants. We then show that much, but not all, of the relative decline in program use among immigrants can be explained by changing macroeconomic conditions. © 2004 by the Association for Public Policy Analysis and Management.  相似文献

This article develops a theoretical distinction between direct and indirect welfare chauvinism in order to analyze how electorally successful populist right‐wing parties transmit social policy preferences with significant redistributive implications for the shape of the welfare state. Direct welfare chauvinism occurs as a result of legislative changes that explicitly exclude recipients from social protection or reduce the level thereof on the basis of ethnicity. Indirect welfare chauvinism is the result of policy measures that apply to both natives and immigrants, but which deliberately negatively affect immigrants the most. Combining quantitative and qualitative analysis of labour market reforms in Denmark, where one of the most successful populist right‐wing parties in Europe – the Danish People's Party – held a pivotal position in the period 2001–11, the article traces the intentions and deliberate policy‐making strategies of the party. It shows that the distinction between direct and indirect chauvinism is a useful theoretical tool for understanding how the Danish People's Party can fulfill the expectations of both its electorate and its coalition partners, even if they point in different directions.  相似文献

This paper uses the Canadian 2006 Census and the Swedish 2006 register data to analyse the citizenship effect on the relative earnings of immigrants, using instrumental variable regression to control for citizenship acquisition. We ask: ‘Is there a citizenship effect and if any, in which country is it that we find the largest effect and for which immigrant groups?’ We add one further dimension, asking if the size of the co-immigrant population in the municipality has an effect on earnings. We find that the impact of citizenship acquisition is substantial in both Canada and Sweden. However, the place of birth of immigrants is important. In most cases, immigrant women in Sweden enjoy a higher citizenship premium than is the case for immigrant women in Canada. Amongst men the picture is more mixed. Most European groups receive a larger citizenship premium in Canada as compared to Sweden. Being in a city with more immigrants of the same background is better for earnings in Sweden than in Canada. However, being in a city with a lot of immigrants (regardless of origin) is better in Canada as compared to Sweden.  相似文献

Does intergovernmental structure have a systematic effect on the impacts of local governments' fiscal policy responses? Using empirical data from more than 800 local governments in five countries, the article concludes that intergovernmental structure is associated with the impact attributed to various fiscal management strategies. Such strategies have generally had greater impact in local governments in federal systems than those in unitary state systems. There are similarities between federal and unitary local governments regarding the fiscal management strategies that have least impact, and both types stress the importance of productivity gains via technology. But the differences in relative importance and level of impact are more striking than the similarities. In particular, fiscal management strategies involving the relations of the local government with other governments, such as obtaining intergovernmental revenue and shifting service provision to other governments, have greater impact in significantly more federal systems than in unitary state systems. These federal local governments also experience greater impacts from increasing user charges and raising local taxes. In contrast, local governments in unitary state systems place greater reliance on the more politically expeditious strategy of across–the–board expenditure reductions and on reductions of capital spending. These findings suggest that local governments in more decentralized systems have greater flexibility to manipulate relations with other governments in order to enhance their own fiscal situation. The data also suggest that the government's level of fiscal stress is not systematically associated with the level of impact from most fiscal management strategies, especially in the unitary state systems.  相似文献

Abstract

The large influx of immigrants to the United States and New York City from poorer countries has sparked considerable debate as to whether immigrants are becoming a “public charge” to American society. Most arguments have centered around immigrants’ use of cash assistance programs. This article compares immigrants’ receipt of rental housing assistance with that of native‐born Americans.

Bivariate analyses reveal that immigrants, as a group, are no more likely than native‐born households to use any form of rental housing assistance. Indeed, in most instances immigrants are less likely than native‐born households to receive assistance, with two exceptions: immigrants who have been in the United States since 1970 and immigrants from the former Soviet Union in New York City. Multivariate analyses reveal similar results, except that immigrants who have been in the United States since 1970 are no more likely than other immigrants to receive housing assistance when we control for other factors.  相似文献

In this paper, we have provided some support for several hypotheses about the determinants of which governors get reelected. The benefit from being a member of a particular party varies from state to state and from year to year. Personal characteristics such as age are also important. The logits give some support to the importance of coalition formation; reelection is easier in states with low voter turnout and in farm states. The paper is most concerned with the connection between the economic performance and the electoral success of incumbent candidates for governor, and we find support for a model of electoral acountability, in which governors are powerful in state governments and state governments have the ability to differentially tax fixed factors relative to neighboring states.This paper raises some important issues regarding the measurement of variables in political economy, which have wide applicability to other studies in the economics of politics. Peltzman (1988) finds that the difference between the growth rate in state personal income and the national growth rate over a one to four year period prior to the election does not affect gubernatorial electoral outcomes. Concurrently, we find that the current year's growth rate in state personal income and its difference from the national growth rate are not significantly related to electoral success but that the average deviation from predicted state personal income during the governor's tenure in office is significantly related to the odds of getting reelected. That is, the data reject simplistic views of voter behavior and support a sophisticated model of voter behavior. Similarly, Peltzman (1988) has greater success using more sophisticated, cumulative measures of national economic performance.  相似文献

If “the state” is considered as a historically grown social institution — and not only as a clearly defined set of institutions of legitimate order —, and if the evolution of legitimate and sanctioned state interventions in society is analysed from a functional politico-sociological perspective, than the emergence of new patterns of state functions in an increasingly global and interdependent socio-economic context is revealed. The paper analyses the following questions: How do recent state theories try to understand and explain the functional change of state institutions in their societal context? Can Norbert Elias’ theories of civilisation processes, of the emergence of the state, and his figuration theory facilitate the empirical analysis of the evolution of (post) modern state functions? Does an evolutionary perspective provide a basis for an “enlightened theory of the state”? Abstract

This year, over 630,000 prisoners will be released from state and federal prisons across the country—more than four times as many as were released in 1980. In this article, we examine the scope of the prisoner reentry issue—what is known about the intersection of housing, homelessness, and reentry and about the barriers returning prisoners face in securing safe and affordable housing.

Although the housing challenges are formidable, progress is being made on numerous fronts. We seek to frame the dynamics of the reentry housing discussion by highlighting the promising strategies that are emerging. These strategies, taken to scale, could help create a very different national policy on prisoner reentry. Ultimately, effective reentry strategies have the potential not only to reduce re‐arrest and increase public safety, but also to reduce homelessness.  相似文献

As immigrants constitute a large and rising share of both the population and the electorate in many developed democracies, we examine aspects of immigrant political behavior, a vital issue that has gone largely unexplored outside of the U.S. context. We focus on Germany and Great Britain, two countries that provide good leverage to explore both within-country and cross-national variation in Europe. Our overall aim is to assess the impact of the immigration context. As a first step, we investigate whether immigrants and natives have systematically different attitudes on two issues that have dominated postwar European politics: social spending and redistribution. With controls in place, we observe that immigrants are no more likely to support increased social spending or redistributive measures than natives and find support for hypotheses highlighting selection effects and the impact of the immigration regime. Where we do find an opinion gap, immigrants tend to have more conservative preferences than natives. As a second step, we explore the determinants of immigrant partisan identification in Britain and find that the salience of the immigration context helps explain immigrants' partisan attachment to the Labour Party.  相似文献

In parts of the developing world, private armed groups are acquiring sufficient capabilities to challenge the state as the sole legitimate fount of order and stability. As a result, there is emerging a notion of clientele politics in which the loyalty of citizens, rooted as it is in the need for protection, is devolving to sub-state actors with highly questionable motives. The result is a malignant dynamic in which the erosion of the state both stems (in part) from the rise of these private actors and reinforces it as well. In their quest for security, citizens are paradoxically drawn to the very groups that have undermined the social order-flawed though it may have been-and compromised individual security. The cases of Sierra Leone and Colombia are presented here in support of this contention; and while their experiences are certainly idiosyncratic, the broad conclusions they occasion hold true for countless other private armed groups challenging the state elsewhere in the world.  相似文献

In response to the dramatic rise in the number of unauthorized immigrants to the United States, every state has passed some form of immigration legislation. These laws appear to be predicated on a belief that unauthorized immigrants impose greater costs than benefits to state and local communities, including the labor market.
