One of the most common arguments about ‘new governance’ is that it is characterised by heterarchy rather than by hierarchy, creating horizontal modes of governance among a multitude of actors – public and private – involving all relevant stakeholders. Often implicitly and sometimes explicitly, this argument is linked with a normative democratic claim that praises the particular participatory features of ‘new governance’ as compared to ‘old governance’. Using as a case study European occupational health and safety policy, characterised by a shift from ‘old’ to ‘new governance’ since the 1990s, this article warns us that one should be very reluctant in making normative claims on new governance. The analysis of new governance modes such as comitology, agency networking, and social dialogue in this field shows that more horizontal and heterarchical governance does not mean automatically more participatory governance in terms of involving civil society actors and all stakeholders.  相似文献

This article takes a careful look at the recent state of sprawl among America’s 178 largest metropolitan areas through the lens of four sets of questions: (a) Measured at the metropolitan level, is sprawl really declining? Is it declining everywhere, or just in selected metropolitan areas? (b) If sprawl is indeed declining, are more compact growth forms on the rise? (c) If sprawl is indeed declining, is it the result of antisprawl land use and development policies? (d) Which metropolitan-level land market, demographic, and economic factors are most associated with changes in sprawl? It concludes that sprawl is indeed declining when measured by average population densities, but that the decline has been much less widespread if measured in terms of population growth in core-area neighborhoods, changing density gradient intercept and slope estimates, and increased employment clustering. In terms of policy, it finds no evidence that local regulatory regimes or growth management programs have had any effect on sprawl, but finds that the consistent administration of local regulatory programs in ways that incentivize infill development and send consistent signals to developers does contribute to reduced sprawl.  相似文献

The democratic state has been offering the conditions for legitimately levying taxes. Tax revenues have been securing the sovereign’s ability to act, policy aims pursued through taxation have been the outcome of a democratic process and the coercion backed institutions levying taxes have enjoyed the status of democratic legitimacy. But a twofold dynamic challenges this status quo. States are under pressure to address problems to which global taxation offers the most promising response. And phenomena like capital mobility impose constraints on the state’s ability to effectively use the policy instrument of taxation. Under what institutional arrangements could taxation be maintained as a justifiable instrument? And what should future institutional arrangements of public finance look like?  相似文献

What parties want – policy, office or votes – affects how they represent their voters, make strategic decisions and respond to external changes in society. What parties strive to accomplish is crucially important for what they do. Moreover, our knowledge of what parties want affects what we expect them to do. For instance, coalition theory assumes that parties have homogeneous goals, and hence are equally likely to join coalitions given the same circumstances. However, this article investigates this basic assumption of party goal homogeneity and finds that party goals do indeed diverge. The article demonstrates that party goals are influenced by party-specific factors such as party size, policy position and intra-party politics. It therefore suggests, further, that intra-party politics should be included more systematically in future studies of party behaviour.  相似文献

The terms well-being and welfare are Often bracketed together, especially well-being and state welfare. The level of well-being is believed to be higher in welfare states, and its distribution more equitable. This theory is tested here in a comparative study of 41 nations from 1980 to 1990. The size of state welfare is measured by social security expenditures. The well-being of citizens is measured in terms of the degree to which they lead healthy and happy lives. Contrary to expectation, there appears to be no link between the size of the welfare state and the level of well-being within it. In countries with generous social security schemes, people are not healthier or happier than in equally affluent countries where the state is less open-handed. Increases or reductions in social security expenditure are not related to a rise or fall in the level of health and happiness either. There also appears to be no connection between the size of state welfare and equality in well-being among citizens of the state. In countries where social security expenditure is high, the dispersion of health and happiness is not smaller than in equally prosperous countries with less social insurance spending. Again, increases and reductions in social security expenditure are not linked with equality in health and happiness among citizens. This counterintuitive result raises five questions: (1) Is this really true? (2) If so, what could explain this lack of effect? (3) Why is it so difficult to believe this result? (4) How should this information affect social policy? (5) What can we learn from further research?  相似文献

This article explores the politics behind the design of EU regulatory institutions. The EU has established an extensive ‘Eurocracy’ outside of the Commission hierarchy, including over 30 European agencies and a number of networks of national regulatory authorities (NRAs). The article examines the politics of institutional choice in the EU, explaining why EU policy-makers create agencies in some policy areas, while opting for looser regulatory networks in others. It shows that the design of EU regulatory institutions – ‘the Eurocracy’ – is driven not by functional imperatives but by political considerations related to distributional conflict and the influence of supranational actors.  相似文献

This article uses historical institutionalist theory to assess the impact of the Anglo-Irish Agreement of 1985 – often seen as the first step towards gradualist change in the role of the state in Northern Ireland. It uses new data to show how the elites who initiated the process conceived of it and to identify the mechanisms producing change. The study shows that the mechanisms of institutional change identified in comparative studies of industrial policy and welfare state development are also to be found in processes of intergovernmental ethnic conflict regulation. In turn, it highlights a mechanism of institutional change – ‘wedging’ – not discussed in the literature.  相似文献

Recent literature on Japanese foreign policy has focused on analysing the implications of Prime Minister Shinzo Abe's security legislation reform for the bilateral security alliance relationship with the US amidst a rising China and the right to collective self-defence. Its impact on Japan's multilateral security policy, in particular, peacebuilding, has so far received little attention. In what ways and to what extent does Japan play a peacebuilding role under this change? This article examines key implications of the security legislation reform, along with the renewal of Japan's Official Development Assistance charter, for its peacebuilding efforts. By taking Mindanao, the Philippines, as a case study, it argues that Abe focuses on taking a foreign aid-centred approach while showing little interest in sending Japanese Self-Defence Force. This article provides a counter-narrative to the claim that Japan is taking a more assertive approach to international security. Abe is more risk-averse as far as his approach to peacebuilding is concerned.  相似文献

In this paper we deal with two questions, (1) what are the origins of the current financial crisis, and (2) what did economists contribute, or why did economists fail to provide a convincing answer for the origins of the crisis, and possible solutions to overcome it? The economics profession apparently was unaware of the looming worldwide financial and economic crisis, and significantly underestimated its global dimensions and consequences. A first and preliminary analysis is undertaken to explore reasons for these failures. We conclude by pointing to some consequences for economics as well as for economic policy.  相似文献

How has China's food safety administrative system changed since it was founded in 1949? How can we periodize the process of this historical transformation in terms of regulators, regulatees, and regulatory tools? This review article offers an analytical framework that distinguishes three regimes in the history of China's food safety governance: an old regime of command and control (1949–1977), an intermediate regime of mixed instruments (1978–1992), and a new regime of regulatory governance (1993–ongoing). In the article the regimes' features, advantages, disadvantages, and development tracks are discussed, and the groundwork is laid for an analysis of China's emerging regulatory state. Finally, a new notion of “transitional regulatory state” is used to define the current Chinese regulatory state based on its food safety regulation.  相似文献

Regulation has been claimed to be acquired by the industry, yet while the economic regulation was often established with the approval and encouragement of the regulated industry, social regulation has usually been thrust upon industry following demands by public interest groups. Why would the social regulation still fail to produce behaviour, or results in accordance with the public interest, if the public interest groups initiated it? The failure to define clearly the concept of ‘public interest’ and the absence of adequately clear regulatory objectives would not provide all the convincing answers. The wish of the politicians to respond to a mischief before public concern dies down, seems to point towards the symbolic politics claims. Although lobbying is integral to democratic politics, it challenges the policy making process as the risks and opportunities associated with policy change are large. Lobbying regulations, belonging to the social regulations fold, have been observed as symbolic in Israel and are diluted by tricky loopholes. Recent research has used data from Centre of Public Integrity (CPI) in order to theoretically classify different regulatory environments. The CPI measures only what the law says, but it does not measure the outcome—the application of the law. This paper points out that the possible interaction of symbolic politics with social regulation may lead to the reoccurring legislative void, resulting in the dilution effect of the lobbying regulations, and it highlights the need to review the theoretical classification, and thereby, also the actual strength of the different regulatory environments. Assessments of the CIA's role in Latin America during the 1950s have tended to focus predominantly on the twin case studies of Guatemala and Cuba. Consequently, the Agency's role – and, more broadly, that of its head Allen Dulles – has come to be seen as one obsessed with covert action and relatively unimportant in terms of policy discussions. Dulles, in fact, has been portrayed as an unwilling and disinterested participant in policy discussions. The present article will challenge those assertions by suggesting that, by examining Dulles's role in the Eisenhower administration's discussions on Latin America, a different picture emerges – one that paints Dulles as an active and rational participant, and which raises important questions for our understanding of the CIA's role during the Eisenhower era.  相似文献

This study scrutinizes the functions and effects of various mechanisms of policy diffusion by taking the hyper-sovereigntist state of the People’s Republic of China as a hard test case. It demonstrates that a one-sided focus on the contribution of international or transnational interactions to policy diffusion may lead to severe misinterpretations. Thus, careful control studies of the domestic determinants of policy diffusion are indispensable for clearing up the focus. As the Chinese case reveals, politically orchestrated, tactical adaptation to international regulatory standards can be employed to promote a nation’s rise in the global political economy. Policy diffusion does not therefore automatically promote the establishment of credible, shared norms of global governance.  相似文献

Whilst the ‘successor party’ (SP) has a well-established place in the literature on post-communist Eastern and Central Europe, occasional references to its West European counterpart have tended to use the term loosely and not separate it out from other varieties of new party. Focusing on the question, ‘where do parties come from?’ – that is, the process of party origination – this article makes a case for viewing the SP as a distinct genus in the West European party hemisphere. The SP is defined as a party which is nominally and legally a new entity that takes the place of, and fills at least some of the political space vacated by, a single, defunct party of origin. The mortality of the ‘original party’ is a sine qua non. SPs emerge with a clear political inheritance. What this is and how they interpret and respond to the inheritance makes the case for their systematic study. The paper also asks, ‘where do new parties go to?’ (how do they evolve?). Debates over the future of new technologies frequently implicate governmental policies and regulation, the purpose of which has traditionally been to mitigate the dangers of new technologies through promotion of conditions of safe use. It is increasingly recognized, however, that regulation is predicated on a particular conception of the nature of risk which may or may not correspond to the views and beliefs held by society. Here I explore three broadly related questions in the context of the debates around agricultural biotechnology. First, what are the implications of varying conceptions of risk for regulatory policy in the United States and in the European Union? Second, what are the implications of differing conceptions of risk and resulting regulatory policy for agricultural trade relations between the two giants of international trade? And finally, what lessons might we draw from contemporary disputes over agricultural biotechnology?  相似文献

Years of neglect, combined with the recent development of a “hands on” judicial policy have resulted in a jail crisis in America. States, recognizing their contribution to this situation, have begun to develop policies designed to assist local jail officials in operating safe, humane, and constitutional facilities. These state efforts are a form o f mandating, and primarily concern minimum operating standards and inspections programs. In this research we investigate three questions related to state mandating of local jail operations: (1) what is the extent of state involvement, (2) what factors are associated with state involvement, and (3) what is the impact of state involvement? Our findings indicate (1) states have been active in developing and administering jail mandates, (2) state involvement is associated with state-level corrections policy, and (3) jail standards and inspections programs have a substantial impact on local jail performance. We conclude with a discussion of how state and local governments may proceed in the process of developing standards, inspections, and enforcement procedures.  相似文献

This article discusses housing and the welfare state in Norway in 1980 and 2005 by applying Esping‐Andersen's theories of welfare state regimes to this sector. How should Norwegian housing policy be understood in light of Esping‐Andersen's conceptual framework, and what is the impact of post‐industrial change? In 1980, Norwegian housing policy was mainly characterised by social‐democratic traits such as market regulation, substantial public expenditure and universal subsidies for both renters and a large owner‐occupied housing sector. The effects of post‐industrial changes, including deregulation of the credit and housing markets, marked a major turn in housing policy and the housing market in Norway. By 2005, Norwegian housing policy was mainly characterised by traits that are typical of a liberal welfare regime: market economics, low public expenditure and subsidies for small, targeted groups, while other segments of the Norwegian welfare state remain characterised by social‐democratic traits. Esping‐Andersen's claim that the effect of post‐industrial transformation was different in different welfare regimes is thus not supported by the case of the Norwegian housing sector.  相似文献

Although the powerful have always sought advice from the knowledgeable, it took the appeal of the policy sciences movement of the late 1940s and onward to build and consolidate a veritable industry of policy analysis and advice. 1 One of the hallmarks of this development was the advent of institutes that were exclusively devoted to produce research‐based policy arguments and to inject these into the policy‐making process. These organisations were referred to as ‘think tanks’. Half a century later, the project of the policy sciences movement has been amply criticised, and has mutated into various philosophies of policy analysis, each harbouring distinct and often conflicting perspectives on the nature and role of (scientific) knowledge in the battle of arguments that is public policy‐making. The first wave of the policy sciences movement's privileging of science‐based policy has not disappeared. In fact it is currently experiencing a revival under the banner of ‘evidence‐based policy’. But it has to compete with other views of public policy‐making which deconstruct the authority claim of scientific knowledge, emphasising instead its contestability. Yet there are now more organisations that refer to themselves, or can be labelled, as ‘think tanks’ than ever before. Why? And what does it mean to be a ‘think tank’ in the post‐positivist era and in the increasingly boundary‐less, highly networked societies of today? This article first surveys recent developments in the world of think tanks as reported by the international literature on the subject, and then examines the implications for understanding the nature and role of Australian think tanks.  相似文献

Is the extent of sex-based occupational segregation in U.S. state bureaucracies related to agency policy missions? Drawing on arguments by Lowi (1985), we contend that levels of sex-based occupational segregation in state bureaucracies vary depending on whether an agency's policy mission is distributive, regulatory, or redistributive. We employ data on the distribution of administrative and professional employees by sex in several types of state agencies across all 50 states for 1987–97. Our findings indicate high levels of occupational segregation among administrative cadres in agencies with distributive and regulatory policy commitments; however, professional workforces in these agencies have become less gender segregated over time. We find no evidence of occupational segregation among administrative and professional workforces in redistributive agencies. We argue that researchers need to examine the relationship between glass walls and other kinds of sex-based employment impediments, such as glass ceilings.  相似文献

This paper explores the impact of family law on the structuring of gendered citizenship in Syria where the state's family law accords male and female citizens different legal status, thus ordering the distribution of basic rights and duties along gendered lines. Partial centralization and fragmented secularization of judicial authority relates to the accommodation of religious groups, a policy which was continued after the establishment of territorial states in the 1920s. Family law maintained its religious tenets and was included as part of the state's jurisdiction. The impact of family law on citizenship is exacerbated in that membership in religious groups is mandated and monitored by the state. Citizenship is thus mediated through a citizen's membership in a religious group where the religiously based family law applies as state law. Seen in theoretical terms, family law plays a crucial role in structuring gendered citizenship in ways that limit the legal authority of female citizens as full members of the polity. Two questions are addressed: First, how and why does family law premise gendered citizenship in Syria? Second, what characterizes the debates regarding changes within family law that surfaced after 2003 following the political regime's liberalization efforts?  相似文献
