Summary

Although the number of young prostitutes increases, little systematic research has been undertaken to gain more insight into the trafficking of these young women. The main object of the present study was to describe the processes (that is, grooming, incorporation, and maintenance) that underlie the trafficking of young women for prostitution. Police records of 16 adolescent prostitutes were analysed. Results show that these prostitutes were recruited by so-called ‘lover boys’ who applied various seduction techniques to make the vulnerable young women fall in love with them. In general, the young women were incorporated into prostitution by means of physical violence. To protect and secure their income and organization, the pimps used a wide range of power and control tactics, of which the use of physical violence can be considered the most effective.  相似文献

Although prostitution is illegal, millions of women sell sex in China. In the process, they experience significant abuse and harm at the hands of clients, madams, pimps, the police, and health officials. This article examines the legal consciousness of Chinese sex workers through their interpretations of these abusive experiences. It reveals how they think and talk about them, and how their reactions sometimes translate into concrete actions. My evidence shows that sex workers name abuse as harmful, blame others for it, and occasionally make claims. They also have strong opinions about prostitution policies, and the relationship between these regulations and their experiences of abuse. These findings place scope conditions on previous theories of marginalized people and the law, which suggest that powerless individuals perceive a more peripheral role of the law in their lives. In addition, this evidence enriches our understanding of legal consciousness in China by showing how debates around the concept apply more broadly than previously recognized.  相似文献

There is consensus that since the 1990s, we have experienced a spike in public concern over sexual offenders. Analyzing this concern as a moral panic, this paper argues that national television coverage, as it picks up local news, adds heat to the fire by re-naming the villain as an inadequate judicial system. This process helps to sustain a moral panic, while narrowing the available discourse about the nature of appropriate punishment. Drawing upon a well-publicized example of a media event in Vermont, this paper extends the theory of moral panics to add another stage to the process—a stage presented by the advent of cable news programming, the relationship between local and national media, and the explosion of blogs. In order for a panic to sustain over an extended time period, the rhetoric about it must transform. In particular, the claimsmaking about the nature of the problem must evolve. In particular, the panic has evolved from sex offenders as folk devils to an attack on judicial discretion. The development of the outcry over judicial discretion was due, in part, to media distortion of the case. I will thus trace the trajectory of this one case to demonstrate the role of the media in shaping and sustaining the panic.  相似文献

In 2000, the Dutch authorities lifted the ban on brothels in the Netherlands. The essence of their approach was to regulate prostitution. People of legal age could now voluntarily sell and purchase sexual services. Brothels which complied with certain licensing conditions were legalized. This paper critically assesses the logic of a position that argues that human trafficking is reduced when actors in the legalized prostitution sector are made responsible for what happens on their premises (using licensing conditions). This idea is confronted with empirical evidence about the Netherlands in general and the city of Amsterdam in particular. Furthermore, the paper addresses two questions. What are consequences of the regularization of prostitution for the criminal investigation and prosecution of sex trafficking? How do criminal justice agencies collaborate with regulatory authorities in the regulated and non-regulated sectors of the prostitution market? The main conclusion is that the screening of brothel owners and the monitoring of the compliance of licensing conditions do not create levels of transparency that enable sex trafficking to be exposed. The prostitution business retains many characteristics of an illegitimate market and the legalization and regulation of the prostitution sector has not driven out organized crime. On the contrary, fighting sex trafficking using the criminal justice system may even be harder in the legalized prostitution sector.  相似文献

The role of the media in the construction of social problems is well documented in the social science literature. In some cases, the process of constructing social problems creates a moral panic. In this paper, we contend that a moral panic occurred in the late 1990s regarding hate crimes because of the disproportionate amount of media attention given to the issue. From this panic grew a movement to enact the Hate Crimes Prevention Act of 1999. We quantify Goode and Ben-Yehuda’s (1999) indicators of a moral panic by triangulating sample data, official statistics, and editorials/opinion polls. Results suggest that a moral panic over hate crimes occurred in America during 1998 and 1999.  相似文献

Involvement of young people in prostitution has been an increasingly familiar phenomenon in recent years. This article explores some of the matters related to it during those years. First, it reviews what has been happening during the 1990s. Second, it demonstrates, via a recent case study, some of the issues, debates and controversies that are related to youth prostitution. Third, it examines the latest developments in the United Kingdom before considering some of the international developments and implications for those involved in youth prostitution. Finally, some of the effects of 'new technologies' are considered while contemplating what remains to be done about the battle to combat youth prostitution.  相似文献

When there is a period devoid of sensationalistic biker news, the public’s concern about outlaw bikers can be quite low. All it takes is one overt act of violence to heighten the public’s fear of Outlaw Motorcycle Gangs. Outlaw Motorcycle Gangs are the most current “dangerous class” which have been the subject of a moral panic in Canada. Outlaw Motorcycle Gangs as organized crime bodies are deemed to be the single most serious threat to the country—the enemy within. The gang war in British Columbia is fuelled by drugs supplied by the Hells Angels and there is a wide spread fear that these evildoers are trying to harm and tear apart the fabric of our society. This article provides a critical in-depth analysis of the construction of an Outlaw Motorcycle Gang moral panic with the focus on Canada. The roles played by the media, politicians, and the public in using isolated, violent incidents to support their interests will be examined along with the interactions between these groups and the resultant punitive actions directed toward members of Outlaw Motorcycle Gangs.  相似文献

Much has been written about sex trafficking in the past decade, although empirical studies have remained few. Even less research has been done on those who make a living by facilitating the movement of women and children in the sex industry. This paper is based on a three-year study in Tijuana, Mexico, in which 92 sex trade facilitators were interviewed. Findings suggest a far more complex social process than portrayed by the anti-trafficking literature. Men and women of diverse backgrounds developed niches in Tijuana’s sex industry, by bringing women into contact with customers. This business appeared to be dominated by Mexican entrepreneurs, with no evidence of any systematic collaborations with either local criminal organizations or foreign traffickers. There appeared to be no shortage of women willing to work in the sex industry, suggesting limited prospect for coerced prostitution. Still, a small number of pimps reported using “persuasion” to recruit women of particular types from interior Mexico. Commissions or referral fees were the most common form of income received by pimps for their services, and the rules on how money was to be made and split between sex workers and venue owners appeared well established. While a few respondents could sustain a livelihood through pimping, the majority held other jobs.  相似文献

Feminists have consistently viewed prostitution as a social problem and opposed state regulated or legalized prostitution. However, feminists in different eras have taken conflicting policy stands on the problem. Progressive era feminists and their organizations supported severe state suppression of prostitution. In contrast, contemporary feminist groups join prostitutes in support of decriminalization. Through historical analysis that compares feminist thought and organization of the two eras, this paper offers an explanation of this contradiction in policy positions based on shifts in feminist thought about the role of the state, particularly criminal sanctions, in addressing prostitution, and changes in the organizing strategies of feminists. The paper also offers important insights to contemporary feminists contemplating policy stands which rely on legal sanctions as a strategy and facilitate alliances with moral crusaders to redress social problems.  相似文献

In 1911 a new public morality act was enacted in the Netherlands. Article 250bis of the penal code states that it is forbidden to give opportunity for prostitution. This so called article on brothelkeeping was the result of growing pressure of a coalition between christian puritans, socialists and feminists at the end of the nineteenth century. In the nineteeneighties the government has proposed to scratch this general prohibition of brothelkeeping. This proposal results from another coalition, this time between feminists and bureaucratic powers. This change in the public debate on prostitution, and especially the influence of feminism, is analysed from a moral point of view. The Dutch prostitution issue is seen as a case of postmodern morality, that is to say as a result of bureaucratic needs for regulation and subjective experiences of the persons involved.  相似文献

Critics argue that the G.W. Bush administration deliberately misled the U.S. public about an Iraqi threat after 9/11 but empirical evidence that presidential deception influenced public support for war has been lacking. An examination of presidential rhetoric concerning Iraq in the U.S. media revealed that it changed in tone after 9/11, consistent with moral panic processes. Logistic regression analysis of public opinion leading up to the war revealed that shifts in support for invasion directly mirrored presidential rhetoric. The findings of this study suggest that the Bush administration engineered a moral panic over Iraq with the support of the media.  相似文献

This article examines a period of profound crisis about the English bar. The metaphor of "moral panic" is invoked in assessing the impact of five notorious cases of barristers' misconduct which riveted public attention between 1859 and 1863. Four of the barristers involved were subjected to "professional discipline" in what was the first spate of disciplinary proceedings for breaches of bar "etiquette." Professional "ethics" were applied in remarkably selective ways and amounted to a "shutting down" of laissez-faire professional practices. This was a crucial turning point in the English legd profession, and the effect was to transform the bar from a relatively open, unregulated status group into something akin to a rule-bound disciplinary regime.  相似文献

Recently, new social anxieties about transgender people have begun to emerge, framed as an issue of “grooming”—a term typically used in the context of child sexual abuse. In this way, moral panic about transgender people seems to be merging with oft-repeated social fears about pedophilia, resulting not only in policies criminalizing trans people and their allies but also in escalating hatred and threats toward trans-affirming educators. This pattern requires further inquiry. As a trans academic who has been at the center of moral panic, my own hate mail can provide material for this exploration. I conducted a content analysis of 231 letters and e-mails sent to me containing messages of hate, to answer the following research questions:
  1. What beliefs and understandings did my correspondents indicate having about me and my research?
  2. To what extent did my correspondents’ beliefs and understandings about me reflect intersecting contemporary moral panics around trans and queer people, pedophilia, and educators?
  3. What stated or implied goals did my correspondents aim to achieve by writing to me?
The findings of this study can add to understanding of how moral panics can converge, and the consequences of their convergence for marginalized groups in academia and beyond.  相似文献

In some instances, the criminal justice system is affected by a moral panic; that is, by an exaggerated social reaction to an assumed threat to moral values. When influenced by moral panic, courts demonize defendants and aggravate punishments. Are such responses legitimate? This article argues that by contrast to legitimate condemnation of criminal conduct, demonizing defendants ought never be legitimate. The legitimacy of aggravating punishment requires distinguishing between the sociological concept of legitimacy (“perceived legitimacy”) and the moral concept (“normative legitimacy”). Aggravation of punishment in response to moral panic might be perceived as legitimate since it expresses public perceptions about the severity of the threat to a social value, even when these perceptions are exaggerated; however, punishments that are proportionate to such a perceived, exaggerated, threat to a social value are unjust and unfair, and therefore are normatively illegitimate. When the panic subsides, courts tend to return to lower levels of punishment. The subsidence of the panic enables one to realize that a gap between perceived and normative legitimacy has been created during the panic. Should and can the gap be bridged retroactively in order to gain full legitimacy? One way to bridge the gap is to grant clemency that will reduce the punishment of defendants whose sentences were exaggerated unduly during the panic. The article proposes a more radical mechanism that allows for sentence re-evaluation in cases of moral panic.  相似文献

Upon leaving school, young people are expected to play an active part as citizens in a democratic society. Are schools providing them with the tools to do this? Citizenship is taught in schools, but to what extent is it practised? Many safety issues concerning student behaviour and student conflict confront school authorities. In what ways are students learning to take responsibility for the safety of their school environments? Generally, schools in New Zealand and in comparative jurisdictions continue to operate on a traditional authoritarian hierarchical basis. Within these structures students could rightly feel that schooling is something which is ‘done to them’ rather than their being engaged as active participants. School authorities have a moral and legal responsibility to maintain a learning environment which is physically and emotionally safe and free from hostility. Traditionally reactive measures such as searching, drug testing and exclusion are used by schools with the aim of fulfilment of that duty. Research indicates that these measures have met with limited success in terms of school safety, and that in any event they may expose school authorities to challenge from students on the basis that their rights have been violated.  相似文献

Recent shootings at schools around the country have resulted in widespread fear and panic among both students and parents, prompting a myriad of responses to make schools safer. Yet, empirical data suggest that despite the recent shootings, schools remain extremely safe places for children, and school violence is lower today than it was several years ago. The present research focuses on the construction of school shootings as a moral panic, with examinations of the roles played by the media, the public, and politicians in using isolated incidents (albeit heinous offenses) to support their interests. The interactions between these groups and the resultant punitive actions directed toward juveniles are discussed. This article provides a comparative analysis of various methodologies employed in building arguments regarding prostitution law and policy, and reflects on the proper aims of legal philosophy more generally. Taking Peter de Marneffe’s Liberalism and Prostitution (OUP 2010) as a launching point for these reflections, the article offers a mostly favourable review of the book as a whole, and defends the philosophical method as one (amongst other) valuable ways to argue about prostitution.  相似文献

Nigeria has a large number of adolescents living and making a living on the streets. This has been attributed to economic factors and exposure to all forms of risks. The result is the proliferation of prostitution among the adolescents with its attendant problems. This article considers the different forms of adolescent prostitutes: those in brothels, street walkers, call girls, and casual, part-time, or floating prostitutes, as well as the trafficking of adolescent girls across international borders. The causes of adolescent prostitution in Nigeria are largely economic, sociological, and socioeconomic factors. A two-dimensional approach was adopted in considering the attitude to prostitution. Coping mechanisms include endurance, self-medication, seeking medical attention, and adaptation. The effects of prostitution are psychological reactions, psychosocial damage, and the political implication, which damages the image of the nation. Approaches to combat adolescent prostitution in Nigeria include legislative steps, governmental efforts, policy making, awareness programs, and the efforts of nongovernmental organizations, community conscientization, and societal measures.  相似文献
