Building upon A Manifesto In Defense of Democracy and the Rule of Law in the Age of ‘Artificial Intelligence’, we, the Transatlantic Reflection Group on Democracy and the Rule of Law in the Age of ‘Artificial Intelligence’, have reconvened to draft a second consensus manifesto that calls for the effective and legitimate enforcement of laws concerning AI systems. In doing so, we recognise the important and complementary role of standards and compliance practices. Whereas the first manifesto focused on the relationship between democratic law-making and technology, this second manifesto shifts focus from the design of law in the age of AI to the enforcement of law. Concretely, we offer 10 recommendations for addressing the key enforcement challenges shared across transatlantic stakeholders. We call on those who support these recommendations to sign this manifesto. The Fifth Edition of The Athens Roundtable on AI and the Rule of Law will take place on November 30th and December 1st, 2023. It will delve into pressing governance challenges posed by foundation models and generative AI across jurisdictions.  相似文献

Recently, Chinese government implemented and tested a trial waiver system in 18 large cities during 2016–2018. Using data collected from surveys of prosecutors and defense lawyers in one of the cities, the present study examines the main challenges in the implementation by comparing prosecutor and defense lawyer views. The main issues examined include the legal scope of trial waivers, the lawyer and victim roles in trial waivers, and the risk of corruption and power abuse. The findings indicate that lawyer respondents significantly differed from prosecutor respondents in their views on the issues. Defense lawyers were more likely to adopt a liberal stance and took a critical attitude toward the issues than prosecutors were. Their characteristic responses may well reside in their legal statuses and related interests in the Chinese legal context.

The success in compiling China's Civil Code benefits from factors such as China's complete system of civil law statutes, the methodology of the Pandekten System, and the private-law attributes of civil laws, etc. To construct the framework of China's environmental code, it is necessary to reference that success for theoretical and structural innovations. In addition, the fundamental features and inherent issues of China's existing environmental law system, such as its breadth, the extensiveness of origins of environmental law, the multiple implication of environmental legal relations, and the compound nature of the environmental legal liability system, should be taken into account. The layout structure of General—Specifics should be adopted for compiling China's environmental code, while moderate codification and extraction of the common factor (vor die Klammer zu ziehen) for connection with applicable rules of specific laws should serve as construction principles and methods for compiling the framework of China's environmental code. The environmental code should have five parts: General ; Pollution Prevention and Control ; Nature Conservation ; Green and Low-Carbon Development ; and Ecological and Environmental Responsibility.  相似文献

The buddha-nature literature has a significant place within the Indian Mahāyāna tradition and Tibetan Buddhism. While it is usually included in the so-called Last Wheel of the Buddha’s teachings, many Tibetan thinkers began to cast doubts about the textual significance of buddha-nature discourse in fourteenth-century Tibet. In this article, I will examine one particular case where there is apparent tension between multiple Tibetan masters over the importance of buddha-nature teachings. This paper primarily analyzes Dratsepa’s commentary to the Ornament (mdzes rgyan) written by his teacher, Buton. Dratsepa construes the Ornament as a work critiquing Dolpopa’s interpretation of the buddha-nature literature. He levels a barrage of criticisms against Dolpopa by referring to Indian śāstras and sūtras that are equally important to both of them, and also by tracing his own assessment of the tathāgata-essence teachings to early Tibetan scholars. In contradistinction to Dolpopa’s claims, Dratsepa offers several nuanced readings of the buddha-nature literature and complicates the notion of what it means to have tathāgata-essence, what a definitive or provisional meaning entails, and the relationship between the Middle Wheel and the Last Wheel teachings. In brief, Dratsepa’s text sheds light on one of the earliest discourses on the tension between self-emptiness and other-emptiness presentations.  相似文献

The right to privacy has been developed through judicial practice and has evolved from “the protection of the right to reputation” to “privacy interest” then to “privacy right.” The Civil Code of the People’s Republic of China (2020) clarifies the right to information privacy and the right to personal information as two independent personality rights and establishes a privacy priority protection mechanism for private information in civil law. The comparative efficiency of the right to personal information may mean that the protection of the right to information privacy is weakened or even replaced by the right to personal information. The uncertainty and fragmentation of private information also creates a wide gray space for judicial decisions. The development from traditional privacy right to information privacy right and personal information right is generally positive and shows the active legal response to the protection of private information in multiple ways. However, clarifications and systematization are required to increase the effectiveness of such protections.  相似文献

The study investigates the satisfaction with the work of the parliament of Brazilian Federal District. The survey was based on the competencies extracted from the institutional mission and targeted citizens who frequently use social networks. Inferential statistics were used to analyse the data. The results showed a great unsatisfaction about the institution. The most satisfied respondents are the less educated, while the most educated, older, and highest income respondents are the most unsatisfied. The results also highlighted the low interaction between respondents and the Chamber, the absence of an effective official communication channel, and actions associated with sustainable economic development will be more effective in increasing satisfaction.  相似文献

Trafficking in children has attracted worldwide attention in the last two decades primarily due to its links with global migratory movements and the role ‘transnational organised crime’ is perceived to play in these. Internal trafficking is largely ignored primarily because of a preoccupation with cross-border, transnational migratory movements. Arguably, the growth of the relevant literature has given rise to certain widespread perceptions about the uniformity in the trade characteristics and actors under the common rubric of ‘trafficking in human beings’. By capitalising on direct linguistic access to a wide range of Chinese open sources, the purpose of the article is to offer an account of the various dimensions of the issue as they present themselves in the particular Chinese context. Our main concern has been to perform a systematic presentation of this material in light of the extant wider literature. In the Chinese case the combination of socioeconomic, political and cultural factors set a complex picture that highlights the shortcomings of dominant ways of thinking about the phenomenon. This complex picture serves usefully to cast doubts with regard to how the criminal activity itself is being conceptualised as well as to perceptions of victimisation embodied in current discourses on human trafficking.  相似文献

Freedom of association and all institutions coming with it have not been accepted by the Chinese government. Instead, Chinese social organization administration is based upon the concept of association held by the Communist Party of China (CPC). The Chinese government had adopted a “total control” model of social organization administration in the era of totalitarianism before the “Opening-up and Reform”, leaving almost no room for social organizations to survive, because the CPC had regarded social organizations as “revolutionary” and “deconstructive”. The Chinese has adopted a graduated control system to administrate social organizations in the era of authoritarianism after the “Opening-up and Reform”, treating social organizations differently according to their threats to the ruling order and their utilities for economic development, because the CPC has viewed social organizations as a “challenging” but “auxiliary” power. The on-going “innovation of registration and administration of social organizations” is not a return to international standard regarding social organization administration in China, but only partial reform of the graduate control system still based upon the CPC’s conception of association as “challenging” but “auxiliary”. Social organizations capable of providing public goods in areas of economic development and social services are given more favorable treatment by the government while political and religious organizations are still tightly controlled by the government.  相似文献

Since the 18th National Congress of the Communist Party of China (CPC) held in 2012, XI Jinping, General Secretary of the CPC Central Committee, has made a series of vital expositions on the promotion of modernization of the national governance system and capacity in line with the rule of law. The law is the most important tool for governing a country, and the rule of law supports the national governance process and capacity. Promoting the rule of law on all fronts is an essential requirement for developing socialism with Chinese characteristics and promoting the modernization of the national governance system and capacity. Comprehensive law-based governance in all areas should be promoted to advance the modernization of national governance. This study examined maltreated and non-maltreated children’s (= 183) emerging understanding of “truth” and “lie,” terms about which they are quizzed to qualify as competent to testify. Four- to six-year-old children were asked to accept or reject true and false (T/F) statements, label T/F statements as the “truth” or “a lie,” label T/F statements as “good” or “bad,” and label “truth” and “lie” as “good” or “bad.” The youngest children were at ceiling in accepting/rejecting T/F statements. The labeling tasks revealed improvement with age and children performed similarly across the tasks. Most children were better able to evaluate “truth” than “lie.” Maltreated children exhibited somewhat different response patterns, suggesting greater sensitivity to the immorality of lying.  相似文献

Illicit use of drugs has received tremendous public attention in China in recent years, but little is known about the effectiveness of drug control practices, especially those adopted by the police. This study examines the effectiveness of drug control as perceived by drug users. The study uses surveys from 100 drug users who have voluntarily participated in nongovernmental treatment in Kunming. Results show that, inconsistent with prior research on campaign style policing, the majority of respondents were satisfied with the police in drug control. In addition, drug users’ evaluations of the police were significantly correlated with their age, marital status, perceptions of collective efficacy, and evaluations of their prior contacts with the police. Limitations of the research and future directions are also discussed.  相似文献

It is widely believed that the extension of protection against employment discrimination to women through Title VII of the Civil Rights Act (CRA) was a fluke, the product of an attempted “killer amendment” by civil rights opponents gone awry. My analysis challenges this conventional wisdom, showing that the coalition of Republicans and southern Democrats in support of the sex amendment to Title VII was consistent with broader patterns of support for the Equal Rights Amendment (ERA) in the early to mid‐20th century. In other words, support appears to have been sincere, not sophisticated—proponents preferred a CRA with the sex amendment to one without. I proceed to show that concern about the direct impact on women, and not simply the instrumental impact on labor, played an important role in motivating this support. But, I also find reason for caution in interpreting support for workplace rights as evidence of broad support for women's rights at this time.  相似文献

The present paper addresses the mutual relationship between society and law in shaping women’s law in Islam from the perspective of the sociology of law. It analyzes the role of pre-Islamic social, political, and economic structures in the Arabian Peninsula in modeling women’s law and highlights some customary laws which were rejected or revived and integrated in Islamic jurisprudence. In this regard, the paper reviews issues such as polygyny, rights to inheritance, marriage, the process of testimony and acceptable forms of evidence in legal matters, diyya (blood money), the exclusion of women from the judiciary and the system of issuing fatwa (legal opinion), natural right of guardianship (wilāya) of underage children after divorce, and regulations related to the veil. Finally, referring to the manner of the Prophet of Islam, the paper suggests that ?urf (custom) can be considered as a source of Islamic legislation alongside other commonly known sources of fiqh (Islamic jurisprudence).  相似文献

This article discusses China’s influence on the United Nations War Crimes Commission (UNWCC). It describes China’s participation in the discussion of war crimes investigation and punishment, emphasizing the particular influence of Chinese Representative Wellington Koo. The article examines Koo’s application of international law to address Japanese atrocities committed towards China, particularly in using the UNWCC as a means of ensuring that Japanese aggression did not go unpunished. Despite the inability to hold many Japanese war criminals accountable, the author emphasizes China’s remarkable impact on the UNWCC, and maintains that China continues to remain a strong force in international law.  相似文献
