A number of studies have focused on public perceptions of police and have concluded that black citizens have lower evaluations of police than their white counterparts. A review of the recent literature reveals that few studies have compared black and white respondents on attitudes toward strike activity among police despite the growing militancy of public employees. In this paper, the significant relationship uncovered between race and attitudes of university undergraduates (F = 30.3; p = .0001) is validated by examining a referendum vote of the general electorate on the right of public employees to strike. Comparative analysis suggests that black citizens are more sympathetic to the problems and tactics of urban police than their white counterparts. Data from the municipal referendum indicated that eighty four percent of the variance in voting patterns could be explained by the percentage of registered black or white voters in the Memphis precincts.  相似文献

This paper explores the capacity of alternative theoretical perspectives to explain the self-reported criminality of black and white young adult females. When criminal involvement is regressed on the theory operation-alizations separately by race, a key difference emerges: For white women, significant effects are clustered in the social-psychological theory groups (bonding, attitudes, and maturation), but for the black women the social-psychological variables have only scattered and inconsistent eflects. Instead, for black women structural indicators emerge as the important predictors of criminal involvement.  相似文献

ABSTRACT

Despite equal employment opportunity laws, affirmative action policies, and studies which demonstrate the capability of females, women account for only 8% of all municipal police officers in this country. The underrepresentation of social groups in policing is not a new phenomenon and can be explained through the “denial hypothesis.” The present study uses tobit regression techniques to examine the variation in female employment as law enforcement officers in municipal police departments within the State of Florida. The findings indicate that the distribution of sworn female officers does not resemble local labor market conditions. Neither the degree of parity between men and women in local economic conditions nor the availability of a qualified female applicant pool affect agency gender composition.  相似文献

This paper analyzes the characteristics of 234 women abusers who came in contact with the Marion county prosecutor's office and municipal court in Indianapolis during the period from July 1984 to April 1985. The study examines the relationship between battering and such variables as age, race, alcohol, and/or drug abuse, the assailant's relationship to the battered women, criminal history, and employment status. A profile of the psychosocial characteristics of batterers and the implications for assessment and court-mandated treatment are also presented.  相似文献

This article examines the social organizational relationships and interactions that position African-American policewomen as outsiders within their own department. Their exclusion arises not only from dominant white males but from other subordinated groups such as white female and black male officers. The authors found persistent and pervasive patterns of sexual and racial discrimination. This qualitative research is based on data obtained from a population of all 21 black female police officers in a large urban city. The work experiences of black women in policing highlight several problematic areas. These women often experience gender discrimination related to professional abilities, job performance, and supervisory responsibilities. They experience racism in the form of derogatory remarks, and in the areas of hiring and promotion. Their marginality based on gender and race also is readily apparent in relationships among officers.  相似文献

This study examines the intersection of offenders’ race and gender in the sentencing process using data on felony cases sentenced in North Carolina. Analyses examine the likelihood that charges were reduced in severity between initial filing and conviction, the likelihood of imprisonment, and the length of sentence imposed, and test whether race affects punishment similarly for men and women. Results indicate that status characteristics predict both reductions in charge severity and the severity of the final sentence, and that racial disparity is conditional on gender. However, the results are not entirely consistent with predictions derived from the extant literature. Gender significantly predicts case outcomes at each stage, but black men were not uniformly disadvantaged, and black women received the least severe treatment in two out of four analyses. Theoretical implications for the intersection of race and gender in sentencing theories are discussed.  相似文献

In this Critical Review Essay, Professor Obiora brings together work from many traditions to address the issue of how differences among students beyond gender–and, in particular, differences in terms of race–might affect legal education. After situating the question in terms of the literature on legal education generally (including standard critiques), she delves into work on gender–in law generally, in kgal education, in moral development and learning, in language use, and in education generally–to elucidate hypothesized differences between men and women that might affect differential experience in law school. She then moves on to make the picture more complex by drawing on work that indicates cross-cultural and class-based variation around conceptions of gender. Using research by sociolinguists on educational processes and work by historians and feminists of color on the intersection of gender, race, and class, Professor Obiora suggests specific ways in which women of color and working-class women might diverge from middle-class white women in their approach to kgal education. In particular, she notes: (1) different speech patterns and linguistic socialization lend different meaning to “voice,”“silence,” and “interruption” in classroom interactions; (2) the historical distinction between public and private spheres has been much more sharply drawn for upper-middle-class white women than it has been for black and working-class women; (3) the exclusion of black women from male “chivalry” and feminine idealization necessitated the development of agency; black women could not afford to be passive. Given these points of divergence, but also given convergences among the experiences of women, Obiora suggests a complex and contextually sensitive approach to the issue of gender in legal education, one that takes seriously the differences that exist among women. During the past decade, criminological research has targeted gender as an important discriminator of criminal participation and persistence. Yet, the research question too often contrasts the criminality of males and females without taking into account key differences among female populations. In this paper, race and class combine to produce uniquely situated populations of females (e.g., “underclass” black females) who, when compared with their gender and racial counterparts, also appear to have unique patterns of criminality. Using the extant literature, black female violent crime is juxtaposed against that of white females and black males in order to show how crime varies across groups and the potential sources of those differences. Three theoretical perspectives (neo-Marxian, powercontrol, and socialist-feminist theory) are reviewed and evaluated for their intragender/racial inclusivity. Directions for further empirical research and theoretical development are suggested. Class-oppressed men, whether they are white or black, have privileges afforded them as men in a sexist society. Similarly, class-oppressed whites, whether they are men or women, have privileges afforded them as whites in racist society… . Those who are poor, black, and female have all the forces of classism, racism, and sexism bearing down on them (Mantsios, 1988:66–67).  相似文献

Although much has been learned in recent years about the victimization experiences of women, there remains a considerable knowledge gap with respect to the victimization of women of different racial and ethnic backgrounds. In order to confront this issue, we use the large number of cases available in the National Crime Victimization Survey (1992–2000) to examine the risk and protective factors associated with violent victimization among non‐Hispanic white, non‐Hispanic black, Hispanic, Asian/Pacific Islander, and Native American women. We then describe in more detail the violent incidents against these women, looking for distinguishing patterns across groups. Our results are useful for fine‐tuning theories of victimization to explain variance in violence for females across racial and ethnic subgroups.  相似文献

Those who champion the recruitment of minorities and women to the bench argue that black and female judges could bring about important policy changes. This study compared decision making by black and white and by male and female judges in sexual assault cases disposed of in Detroit Recorder's Court from 1976 to 1985. We found no racial differences and very few gender differences. The only exception was that female judges imposed longer prison sentences than did male judges. Considered together, the findings are indicative of the powerful influence of socialization on the legal profession and on the judicial role.  相似文献

Research on the minority group-threat hypothesis has often found that the percentages of black and Latino populations at the city level have predicted variations in municipal police resources, net of all measured control variables. To date, no study has linked changes in minority representation within a single city over time at the community level to changes in the allocation of police resources. This study tested the hypothesis in 74 New York City police precincts in 1975, 1982, and 1992. It found that increases in the percentages of Latino populations of precincts have predicted changes in police deployment, and the link between Latino populations and police deployment is nonlinear.  相似文献

Historically, women have been unwelcome in male-dominated police cultures; despite the gains acquired over many tumultuous years, policewomen continue to face significant obstacles. Men officers often promote the subordination of policewomen, and, because of this, some degree of emotional deterioration among women officers would be understandable. This study aims to evaluate the efficacy of such a hypothesis. Questionnaires were mailed to all municipal police departments in one southern state with 50 or more sworn personnel (n = 21) and produced 1,114 responses from 16 departments. Analysis revealed that women officers' (n = 89) professionalism, job satisfaction, stress, and confidence levels demonstrate a condition of psychological health and do not differ significantly from those of men officers. Essentially, the findings suggest that policewomen are mentally tough and resilient, and hence quite capable of modulating the demands of police careers.  相似文献

The implications of racial differences for shelter services has become an increasing concern with the expansion and development of shelters for battered women. This study employs bivariate cross-tabulations and discriminant analysis of shelter intake and exit interviews to determine the most influential variables in differentiating anglo, black, and hispanic women. The groups appear to be differentiated most by income and marital related variables, and very little by abuse and help-seeking variables. The findings suggest that the greatest differences overall are between anglo and hispanic women, and that additional economic and educational supports need to be directed to the hispanic group.  相似文献

A wealth of research suggests a direct association between minority group size and government social control, such as arrest or imprisonment rates. Prior work in this vein, however, gives scant attention to (1) types of law that explicitly address intergroup conflict and (2) regional variation in the salience of minority group threat. At the same time, research on organizational responses to law indicates that institutional linkages to legal environments dictate policy innovation and compliance, yet the relevance of such linkages for law enforcement agencies is less clear. The present research investigates these themes by focusing on law enforcement responses to hate crime in the United States. Data from a sample of large municipal and county policing agencies and their degree of compliance with the federal Hate Crimes Statistics Act are analyzed. Main effects models show that compliance with federal hate crime law is less likely in places with larger black populations, an intriguing finding in light of extant work suggesting that both formal social control and race-based hate crime offending are typically more prevalent where more blacks reside. This effect of black population size on compliance with hate crime law, however, is contingent on region. A positive correlation in the Northeast contrasts with an inverse association in the South. The findings also suggest that organizational facets of law enforcement agencies, notably their engagement in community policing, are associated with compliance. The results elaborate and qualify group threat explanations of government social control and contribute to a burgeoning literature on the utility of organizational theory in the realm of law enforcement.  相似文献

This study, which includes a comparison of American experience, focuses on women policing in India. Using a standardized survey questionnaire, data were collected from women officers on line duty in all district police departments in the State of Tamil Nadu, India, and in municipal and sheriff's departments in New Jersey. A discriminant analysis found important differences between the samples in the officer's preferred roles, with more of the officers from Tamil Nadu preferring a traditional role. Other differences were also found between the samples in terms of deployment experience, career commitment, perceived interests and perceived capability in performing various tasks compared with male officers. These differences appeared to be due to both organizational and cultural factors.  相似文献

The system of slavery, a reflection of a patriarchal and racist social order, legitimatized and facilitated not only the economic and racist oppression but the sexual exploitation of black slave women. An extensive review of the literature on slavery was used to address how slave women accommodated and resisted these multiple forms of oppression. The findings presented here indicate that as blacks, both sexes experienced the harsh and inhumane consequences of racism and economic exploitation. In response to their exploitation, there was a significant convergence in male and female involvement in such forms of "criminal" resistance, such as murder, assault, theft and arson. These actions were employed to improve the slaves' lot in life and to express opposition to the slave system. "Criminal" resistance therefore set the stage for black women's participation in the criminal activities characteristic of today. Findings also suggest that in response to sexual exploitation, gender specific forms of accommodation-eg., acting as breeders and sex workers-were utilized in order to make slave women's lives bearable. The article concludes that the various forms of accommodation served as a preface to black women's vulnerability to sex-oriented crimes within the context of the twentieth century American society.  相似文献

This article examines the interrelationships among women, race, and crime as presented by Adler. The empirical assertions concerning the pattern of crime for black and white males and females are examined using victim survey data. It was concluded that the explanations for racial differences in female crime and delinquency advanced by Adler have little value since the empirical differences they purport to explain are not supported by the data.  相似文献

Although the legal bases of affirmative action plans have been debated widely, empirical examination of their effectiveness has been limited. This paper examines the impact of affirmative action on the hiring and promotion of women in policing. A survey of municipal departments serving populations of more than 50,000 found that women still constitute less than 10 percent of all police officers. Nevertheless, multivariate analyses show that both court-ordered and voluntary affirmative action policies have had a statistically significant impact on the hiring but not the promotion of female officers. In addition, case study data from five agencies show that affirmative action policies have widened women's opportunities to receive specialized assignments. These findings suggest the importance of continuing affirmative action policies despite recent legal setbacks.  相似文献

国际法在国内法中的地位问题对致力于宪政改革的非洲国家来说,具有重要的意义。国际法与国内法的关系在理论上存在着分歧。在实践中,各国通常采用采纳或转化方式使国际法在国内法院中得以适用。非洲国家在实践中主要遵循了英国和法国的做法。南部非洲的一些国家不但在宪法中规定了国际法在国内法中的地位,而且还规定国内法院在对宪法或其他法律进行解释时,要利用或考虑到国际法。而其他许多非洲国家不愿将国际法直接纳入到它们的宪法中。不过,即使宪法中没有规定国际法地位的非洲国家,它们的法院在审理案件时也常会参照有关国际法的规定。  相似文献
