The recently proposed new Copyright Directive was released on 14 September 2016. It has been described by EU law-makers as the pillar of the copyright package promised by the European Commission (EC), to be delivered before the end of Mr. Juncker's mandate. In its Communication of 6 May 2015, the EC had stressed “the importance to enhance cross-border access to copyright-protected content services, facilitate new uses in the fields of research and education, and clarify the role of online services in the distribution of works and other subject-matter.” The proposed Copyright Directive is thus a key measure aiming to address two of these three issues. However it is not without shortfalls.We have therefore decided to publicly express our concerns and send an open letter to the European Commission, the European Parliament and the Council to urge them to re-assess the new provisions dealing with mandatory filtering of user-generated content in the light of the CJEU case law and the Charter of Fundamental Rights of the European Union.In a more extended statement, we examine in details the text of both the explanatory memorandum and the Directive itself.Our conclusions are:1. A comprehensive re-assessment of Article 13 and Recital 39 in the light of the Charter of Fundamental Rights of the European Union and the E-commerce Directive (in particular Article 15) including CJEU case law is needed, as the proposed Copyright Directive does not expressly address the issue of its compatibility with both of these texts.2. Recital 38 does not clarify the domain and effect of Article 13. Rather, it creates confusion as it goes against settled CJEU case law (relating to Articles 14 and 15 of the E-commerce Directive and Article 3 of the Infosoc Directive). Recital 38 should therefore be deleted or substantially re-drafted/re-phrased. If the EU wants to introduce a change in this regard it should clearly justify its choice. In any case, a recital in the preamble to a directive is not an appropriate tool to achieve this effect.We hope that this exercise will prove useful for the debate that has now begun both in the European Parliament and in the Council.  相似文献

Summary and Conclusion The most difficult part of constructing a system of criminal sentencing is to be able to give a rationale for each sentence. Historically, this has been an unsurmountable hurdle because it required reformers to resolve the irresolvable conflict between utility and desert as sentencing goals and to measure the immeasurably complex relative utility of the alterative utilitarian strategies of deterrence, incapacitation, and rehabilitation. The good news is that we need not try to leap these insurmountable hurdles: the greatest utility is found in a desert distribution of liability and punishment. By following desert, the criminal law can establish its moral credibility with the public and thereby harness the real sources of social control—the power of social sanctions and internalized norms. In the context of criminal sentencing, this means the system must establish a reputation for giving offenders the precise amount of punishment they deserve. Despite the utilitarian importance of desert, however, nondesert concerns can govern the selection of the sanctioning method. As long as the total punitive bite of all aspects of an offender’s sentence is what the offender deserves, judges otherwise can be left free to construct the sentence they think will best avoid future crime. With a system of punishment units and punishment equivalencies, a desert-based determination of the amount of punishment can co-exist with a selection of sanctioning methods looking to nondesert, utilitarian considerations, such as the need for deterrence, incapacitation, and rehabilitation. Over a lengthy period of time, the author has acted as an expert witness for people seeking asylum in the United States from West Africa. The author has noted changes in the manner in which courts have treated these asylum seekers from the relatively easy process of the Clinton years to the much more hostile culture of the Bush ones. The author wishes to discuss the manner in which an anthropologist can use knowledge about the culture of the person seeking asylum and that of the political party in power to translate the motives of the asylum seeker in a favorable light. The author provides a number of examples of this process and of the changing culture of political administrations.  相似文献

Data protection regulations are undergoing a global reform. The European Commission proposed a reform of the EU data protection framework in 2012. One major driver for the reform has been the research on the consumer perceptions indicating that the consumers are worried about their personal privacy. However, there has been practically no research on perceptions of companies (the controllers of the personal data) and on the data protection reform. This research analyses the awareness and the willingness to act towards compliance regarding the proposed General Data Protection Regulation (GDPR) in Finland in 2013. The GDPR will replace the Finnish Personal Data Act and therefore plays a central role in the Finnish privacy regulation. This research found that the general level of awareness was low: only 43% of the controllers were aware of the forthcoming reform. The willingness to act or to take steps towards the compliance was even lower: 31% of controllers said that they are planning to act towards compliance during this year. These results indicate that the companies are quite unfamiliar with the reform that correlates with other relevant studies in Europe. Personal data are said to be the oil of the digital economy, the hottest commodity of the market today. There are companies that understand this, but the majority seems to ignore this at least what comes to their awareness regarding the reform, even the reform captures many of the best practices regarding processing of personal data.  相似文献

The Security Council is the only international body capable of authorizing the use of force in cases other than self-defence. Its main mission is to protect international peace and security, and this has been reinterpreted in recent decades to include the protection of human rights in situations of grave humanitarian emergencies as well as to allow it to exercise legislative powers. Given this extraordinary range of functions, it is worth asking whether the Security Council is justified in their exercise. Should the international community entrust such power to an institution with the authority, structure, and decision-making process of the Security Council? This article explores the implications of a distinctive tradition in political philosophy – namely, the public reason tradition – for judging the adequacy of some of the proposals for reform of the Security Council. I show that the scope of authority of the Security Council, as well as some of the proposals for reform, can be challenged on the basis of an emerging global public culture.  相似文献

This article examines the leading definitions of wife-battering and questions the emphasis on physical rather than nonphysical abuse. All dimensions of these definitions are analyzed, namely the form of abuse, severity, frequency, intention, and meaning. The final definition formulated is derived from these dimensions and from the accounts and experiences of battered women themselves. The incidence and etiology of wife-battering is then examined from an Australian perspective. Theories which concentrate either specifically on the profiles of the victim and perpetrator or on the family unit or external factors are discussed. Finally, women do remain in violent relationships and their reasons for doing so are considered.  相似文献

China's approach to ISDS reform is widely perceived as undecided and ambiguous. This paper provides the first detailed analysis of China's submission to the UNITRAL Working Group III and situates China's approach in the context of global dialogue of ISDS reform and competing reform proposals. The paper shows that China's open, flexible, and evolving approach to ISDS reform could be better understood by a contextual evaluation of the pertinent factors which have contributed to its formation. Moreover, this paper explains why China did not sign up to the EU's investment court system (ICS) proposal in the EU-China Comprehensive Agreement on Investment (CAI). Lastly, the paper argues that China should reconsider its attitude towards the ICS in the CAI context and that the EU's recent suggestion that the envisaged multilateral investment court may adopt an ‘open architecture’ is likely to enhance its appeal to China.  相似文献

Most states have recently altered legislation in response to the problem of drunken driving. Reforms are generally aimed at enhancing criminal justice response to offenders. This research examines the outcomes corollary to new drunken-driving legislation in one Michigan jurisdiction. Pre- and post-reform data are analyzed with significant difference tests in order to assess whether or not the objectives of increasing arrests, convictions, and sanctions for drunken drivers materialized through implementation. Overall, results indicated the partial realization of reform goals. Concluding considerations offer interpretations, along with recommendations for continued progress in impacting upon the problem of drunken driving.
