Since the introduction and subsequent growth of the juvenile drug court movement in the mid‐1990s, practitioners have struggled to fully implement the Juvenile Drug Courts: Strategies in Practice. This struggle may lead to weaker outcomes for youth and a dysfunctional team atmosphere. Originally written as a two‐part technical assistance brief, this article will guide readers through the Juvenile Drug Court Development Cycle in order to help re‐direct practitioners to a more “back‐to‐basics” approach that focuses on collaboration, team dynamics, and decision making.  相似文献

The purpose of the article is to show through the analysis of some recent publications, art exhibitions, trials and other types of discourse, who is considered to be “an enemy” in Russia today and how law enforcement and the judiciary respond to so called “threats,” emanating from the constructed enemies. The analysis reveals some dangerous tendencies in the formation of a common identity for people living in Russia. For instance, search for a “national idea,” “traditional roots,” “patriotism,” and “distinctive nature,” aimed at the formation of this common identity and strengthening the state, is implemented in a way, which leads to the exclusion of ‚others’ and thus undermines the possibility to lay the foundation for the multicultural state based on peace, harmony and tolerance. Russia must become a common house for all ethnic, religious and linguistic minorities living in it, and no one representing them should be in a position of the less favored and less protected. National identity in a multinational state can be only a plural identity, providing for the possibility of living in several communities simultaneously.  相似文献

When arrest is mandated for domestic violence crimes the arrest of two individuals, or dual arrest, often occurs. This study examines the characteristics of the crime and the people caught in dual arrests, with a special emphasis on the women arrested. The data were drawn from a population of 4138 disposed family violence cases in the criminal court, 448 of their arrest records, and 90 prosecutor files. Thirty three percent of the 448 cases disposed were dual arrests. Persons subject to dual arrest were primarily white, young, nonurban, unmarried employed persons. The incident was likely to involve alcohol or drug use and physical beating with hands or fists. Forty percent of the women arrested were previously victimized in a domestic violence incident. Findings suggest that dual arrests may reflect both the differential use of violence in domestic relations and the over enforcement of policy by some police departments.  相似文献

While substantial sociolegal research has analyzed the deleterious effects of criminal records on life outcomes, little has examined the records themselves, or their relationship to the people they represent. In this article I take a novel tact, treating criminal records as the material, textual documentations of an individual's past. I then observe expungement seekers—people who encounter their own records—to understand their reactions. From this data, I use inductive theories of symbolic interactionism to theorize another collateral effect of the criminal record: it represents people in ways that depersonalize their social identities, and prevents them from communicating corrective self‐understandings to the governing bodies that author the records. I conclude with my main theoretical contribution: “having a criminal record,” literally, means having a textual proxy that the state has authored on its own terms, without input from the people whom it permanently represents, and while concealing from those people the apparatus behind authorship. As a consequence, the criminal records system serves as a barrier to reciprocal communication between ex‐arrestees and a legal system that represents them in ways that they may want to contest. This “wrongful representation” is a collateral effect of having a criminal record that impedes the ability of ex‐arrestees to manage or repair their relationship with the state that has punished them.  相似文献

This paper considers the popular visual jurisprudence of bumper stickers. Drawing upon a sample sticker/driver/vehicle assemblages observed at the Gold Coast, Australia in 2014, we argue that the meanings and messages projected by the assemblages have a significant legal dimension. The argument is located at the intersection of past research into bumper stickers, increased scholarly interest in the relation of law to automobility and especially recent considerations of the popular visual jurisprudence of the motor vehicle, its cultures and semiotics. In particular we argue that the sticker/driver/vehicle assemblage represents an engagement with law and legality. We suggest this goes beyond immediate denotations of brands with intellectual property or flags and the sovereign nation state to more essential engagement with consumer capitalisms law of the image, the friend/enemy distinction, the ouroboros of rights and the essential legality of living in a polis.  相似文献
