The parole board plays an integral part in the reentry of offenders into the community from prison in most states; yet, little is known about the decision‐making practices of this group. In particular, few studies have used quantitative data to examine parole among a large group of offenders, and less is known about the direct and joint effects of race and ethnicity on this decision point. We extend previous work by considering variation in parole timing among a sample of young, serious offenders incarcerated in one state. Results from a series of proportional hazard models reveal substantial variation in parole timing. Consistent with the existing theoretical research on parole, parole actors are most concerned with community protection and heavily weigh measures of the current offense, institutional behavior, and the official parole guidelines score. The direct effects of race and ethnicity were also revealed. Black offenders spent a longer time in prison awaiting parole compared with white offenders, and the racial and ethnic differences are maintained net of legal and individual demographic and community characteristics. These findings provide important insight into the parole process and augment the existing theoretical work on disparities in decision making.  相似文献

An understudied contributor to the massive growth of American incarceration is an increase in the practice of reimprisoning parolees through parole board revocations—now referred to as “back-end sentencing.” To conduct the analyses outlined in this article, we use data from the California Parole Study to analyze the effects of three clusters of factors (parolees' characteristics, organizational pressures, and community conditions) on these sentences. Our analyses are informed by theories that have been used to explain “front-end” (court) sentences, which center on the focal concerns of social-control agents, labeling, and racial threat. Our results indicate that status characteristics—race/ethnicity and gender—affect the likelihood that criminal parole violators are reimprisoned. Moreover, certain “pivotal categories” of parolees—registered sex offenders and those who have committed “serious” or “violent” offenses—are much more likely to be returned to prison than others. Organizational pressure (prison crowding) also affects the likelihood of reimprisonment. Communities' political punitiveness affects the likelihood that technical violators are reimprisoned and that serious or violent offenders are reimprisoned for criminal violations. In this article, we use these findings to consider ways that mass incarceration is driven by both top-down policies as well as bottom-up organizational and community forces.  相似文献

Offenders who violate their conditions of release (parole violators) pose a threat to public safety and a unique challenge for parole officials. Historically, parole officers have simply revoked the parole of these offenders and returned them to prison; however, increases in state correctional populations have forced many jurisdictions to experiment with sanctions administered by parole officers in the community. Community‐based sanctions are sanctions administered by parole officers as consequences for noncompliance with release conditions that are ultimately intended to reduce parole violators’ odds of recidivism. Yet, the effects of these types of sanctions are still relatively unknown. Drawing from perspectives on formal and informal social control, this study involved an examination of the effect of community‐based sanctions on parole violators’ odds of recidivism. Findings revealed that formal controls such as community‐based sanctions that were applied with certainty, severity, and in a swift manner along with informal controls such as measures of offenders’ stake in conformity had effects on parole violators’ odds of recidivism and time to recidivism.  相似文献

Abstract

Since the early 1990s, many states in the USA have attempted to control sexual offending and, more narrowly, sexual recidivism by implementing longer prison sentences for sex crimes, sex offender registration and notification, residency restrictions, involuntary civil commitment and lifetime probation and parole. The early 1990s also marked the beginning of a decline in official rates of sexual offending, including sexual recidivism. This study reviews recent research conducted on Minnesota sex offenders in an effort to identify which policies, programmes and practices might have contributed to the drop in sexual recidivism rates that have been observed over the last few decades. By assessing what has, and has not, worked with Minnesota sex offenders, this study discusses how lessons learned from the Minnesota experience may apply to broader efforts within the USA and abroad to control sexual offending.  相似文献

Of shock incarceration on offenders identified as problem on a criminal history of alcohol-related crimes and self report of drinking ehavior, was examined. Problem drinkers and non-pronkers serving time in a shock incarceration program were compare similar offenders serving time in a regular prison environment. Attitude previously found to be associated with problem drinking were examined using a repeated measures design over a three month period. Problem drinkers in shock incarceration became less alienated and more prosocial in their attitudes compared to the problem drinkers in the prison inmates. Problem drinkers who graduated from shock incarceration were also found to adjust better on parole than offenders paroled from regular prison. Flowever, the behavior of problem drinkers as a group was more varied than that of non-problem drinkers, emphasizing the importance of and need for programs such as this to provide adequate support and after-care for problem drinkers and substance abusers.  相似文献

This article endeavors to illustrate the realities of prison life for sex offenders and the means by which they attempt to establish viable identities and acquire a survivable niche in the prison general population, particularly when established identities and protective niches are put at risk by entry into a sex offender treatment program. Qualitative data was collected by repeatedly interviewing a cohort of sex offenders for 6 months as they completed a basic sex offender treatment program. The findings indicate a need to include consideration of treatment context in understanding the limits of treatment gain in prison-based programs.  相似文献

Previous research revealed gender and racial differences in offender preferences for prison compared to alternative sanctions, in the amount of an alternative sanction offenders would serve to avoid prison, and in the severity ranking of criminal sanctions. Nevertheless, opinions of officers who supervised those clients have all but been ignored. In this study, this literature was extended by comparing perceptions of Kentucky probation and parole officers regarding the amount of alternative sanctions that offenders would serve to avoid one year of imprisonment to perceptions of the offenders whom they supervised regarding the same topic. Based on analysis of data from an electronic survey of approximately 230 probation and parole officers and approximately 600 probationers and parolees, results suggested that there were significant differences in “exchange rates” of officers when compared to those of offenders. Justifications for these findings and their implications for correctional policy and practice are discussed.  相似文献

Purpose

Legislative mandates that require GPS monitoring of offenders add to the existing logistical complexities of community supervision. Challenges in implementing GPS policies and practices are heightened by the lack of sound empirical research. Studies examining the relationships between GPS monitoring of sex offenders in the community and the legislative goals of public safety, deterrence, and cost effectiveness are virtually nonexistent. To begin to address this gap in the literature, this study examines the impact of a statutorily-based GPS monitoring program for adult sex offenders convicted of dangerous crimes against children and placed under community supervision.

Method

Official offender generated alert data for DCAC Sex Offenders in Maricopa County, AZ are examined from the time of legislative mandate for a subsequent two year period.

Results

Analyses highlight the significant number of equipment related alerts triggered by a loss of satellite signal for offenders under GPS monitoring as a key concern as well as a significant increase in officer workload as a result.

Conclusions

A divergence between legislative goals and practical application of mandated GPS monitoring programs exists. GPS technology is far more limited than anticipated and should be viewed as a tool rather than depended upon as a control mechanism.  相似文献

Research on electronic monitoring (EM) has ignored its effectiveness with high-risk, violent offenders. This article examines the effectiveness of using EM as a supervision tool for violent male parolees by comparing those who were mandated to such supervision who were released in fiscal year 1996 (N = 128) to a random sample who did not receive such supervision who were released in fiscal year 1995 (N = 158). Effectiveness was assessed by examining return to prison and time to failure within four years of release. The results indicated that, after controlling for relevant demographic and criminal history variables, EM had no direct effect on the likelihood of recommitment to prison or time until failure. Parolees who reported drug problems and those with lower parole-success likelihood scores were more likely to fail and to fail more quickly. Sex offenders on EM were less likely to return to prison than those not on EM, and those on EM who eventually returned to prison remained in the community longer than did those not on EM. Implications for the usefulness of EM as a tool in parole supervision are discussed.  相似文献

Texas established in 1999 outpatient civil commitment for sexually violent predators discharged from prison with or without parole. These individuals suffer from a behavioral abnormality, have been convicted of two or more sexually violent crimes and are deemed likely to reoffend. Civilly committed individuals are managed by a team composed of case manager (supervision), treatment provider, public safety officer (global positioning satellite monitoring), and other professionals. Treatment consists of individual and group therapy using a standard workbook. Out of 21 committed individuals, 7 are in the treatment, 1 died, 10 are in custody after breaking conditions of commitment that constitute a felony, and 3 await release from prison. Cost of outpatient civil commitment is less than $20,000/person/year compared with more than $100,000 for inpatient commitment in other states. Texas has found outpatient civil commitment to be an effective and relatively low-cost way to protect the public and treat the offender.  相似文献

Electronic monitoring strategies are being used increasingly for sex offenders across the United States. Despite this increased use, few researchers have considered the broader implications for probation and parole officers when these tools are used. In this study, attention was given to how the use of electronic monitoring for sex offenders is related to supervision goals, work load, the use of other supervision strategies, and state level policies. Findings showed significant differences in several areas. The conclusion focuses on community corrections policy implications.  相似文献

Female offender populations are growing at an unprecedented rate. The present study examines gender differences among a large sample of male and female offenders as related to seriousness of their offense and success on parole. Data analyzed were originally collected from a random sample of parole case files in California. Results revealed that although gender does significantly impact parole success, seriousness of the offense does not. Other significant factors include age at release on parole, criminal history, and measures of stability upon release. The need for wrap-around services, comprehensive treatment models, and funding for gender-specific services are discussed.  相似文献

Historically, there has been interest in the unfolding of criminal careers, especially in the persistence, specialization, and prediction of violent recidivism. Specialization in violent crime is particularly important as both the public and politicians have called for longer sentences, incapacitation, and prison expansion for violent offenders. However, research on the specialization of violent crime has been largely overlooked in spite of its importance to criminal justice practitioners and public interest. To examine the specialization in crime, this research uses data collected in Ohio in 1989 on a cohort of 3,353 parolees released from prison. Specialization is defined as the exclusive admission to prison for a violent crime with a subsequent violent recidivism offense. Logistic regression is used to delineate predictors of violent specialization. Race, county of commitment, age at release, time served, number of prior felony convictions, and number of prior parole revocations are found to be related to violent specialization.  相似文献

This paper extends previous research that performed a cost-effectiveness analysis (CEA) of the Amity in-prison therapeutic community (TC) and Vista aftercare programs for criminal offenders in southern California. To assess the impact of treatment over time for this unique sample of criminal offenders, a 5-year follow-up CEA was performed to compare the cost of an offender's treatment—starting with the in-prison TC program and including any community-based treatment received post-parole—and the effectiveness of treatment in terms of days reincarcerated. The average cost of addiction treatment over the baseline and 5-year follow-up period was $7,041 for the Amity group and $1,731 for the control group. The additional investment of $5,311 in treatment yielded 81 fewer incarceration days (13%) among Amity participants relative to controls—a cost-effectiveness ratio of $65. When considering the average daily cost of incarceration in California ($72), these results suggest that offering treatment in prison and then directing offenders into community-based aftercare treatment is cost-effective policy tool.  相似文献

PurposeEmpirical studies examining specialization/versatility among offenders have long been an area of interest among criminologists. This same focus has only relatively recently been directed toward sex offenders.MethodsUtilize matched random samples of male sex offenders released from prison pre- and post-Sex Offender Registration and Notification (SORN) in the state of New Jersey with eight years of follow-up for measuring recidivism.ResultsVarious specialization thresholds and individualized diversity index (D) scores disaggregated by recidivism offense type (e.g., violent, property, drug, and sex offenses) suggest that these sex offenders were more diverse than specialized. Furthermore, Tobit regression analysis revealed that alcohol problems, being a rapist, being a prior violent offender, and recidivism offense frequency significantly predicted versatility compared with being married and being a prior property offender, which were inversely related to versatility. Finally, sex offenders who were released from prison post-SORN demonstrated a higher level of specialization than sex offenders who were released from prison pre-SORN, yet their tendency toward specialization was almost exclusively a function of drug offenses not sex offenses.ConclusionsSORN policy implications and directions for future research are discussed.  相似文献

Objective

This paper addresses previous shortcomings in the literature on racial disparities in incarceration for drug offenders by taking advantage of a change in sentencing policy in California and a rich administrative dataset that is able to create a sample of comparable White and Black offenders.

Method

We use a nonparametric propensity weighting approach to identify similarly situated White and Black male offenders charged with drug-related offenses. We combine this approach with a difference-in-differences model to estimate the effect that a change in California sentencing law for convicted non-violent drug offenders had on racial disparities in prison and drug treatment dispositions.

Results

We find substantial reductions in the probability of a prison sentence after the policy change, but not differentially for Blacks. Blacks remain more likely to go to prison than similarly situated Whites after the policy, although the policy does lead to more referrals to treatment for Blacks.

Conclusions

This paper shows that even after comparing Blacks and Whites in similarly situated contexts that racial disparities in prison commitments remain after sentencing law changes that mandate diversion to drug treatment. The results suggests that addressing racial gaps in the commitments to state prisons will likely require more than shifting the eligibility of drug convictions for prison, as accumulated criminal histories are the primary driver of prison sentences. This means that expanding diversion options from prison alone will not reduce the racial gap in commitments to prison for drug offenses more than incrementally.

This was a cost-benefit study of a statewide program involving multiple community-based services for parolees in California. Program effectiveness was assessed by comparing program costs to incarceration costs avoided due to decreases in recidivism. During the first year following parole release, program participants on average stayed out of prison longer than the comparison population. Participants who completed any of the community-based services stayed out of prison substantially longer. The reductions in re-incarceration yielded a net saving of $21 million in incarceration costs over the study period, after the costs of the program and parole supervision were subtracted, or a 47 percent net return on each program dollar invested. This study did not include potential cost savings to other parties in the justice system. These findings suggest future investments in community-based correctional services might produce substantial financial benefits. A fuller apprehension of the potential benefits would benefit from continuing evaluations, including studies employing a true experimental design.  相似文献

To provide a ‘relief-valve’ for prison over-crowding, the Alabama Department of Corrections instituted a program for the community supervision of selected inmates by correctional officers. Since these officers were placed in a role very similar to that of parole officers, a condition akin to a natural experiment in job enlargement took place. Accordingly, it was hypothesized that officers in this program would report more positive attitudes and/or perceptions regarding personal accomplishment, professional orientation, and job satisfaction than two representative samples of institutional officers and probation/parole officers, respectively. Analysis supported the hypothesis and indicated that officers in the program enjoyed providing human services to offenders. Since no convincing evidence of a Hawthorne effect was found during a follow-up study conducted one year later, several implications of the study for expanding the correctional officer's role in providing human services within the prison environment are presented for consideration.  相似文献

This study uses data from 641 state prison parolees in California to examine the associations between methamphetamine use and three measures of criminal behavior: (a) self-reported violent criminal behavior, (b) return to prison for a violent offense, and (c) return to prison for any reason during the first 12 months of parole. Methamphetamine use was significantly predictive of self-reported violent criminal behavior and general recidivism (i.e., a return to custody for any reason). However, methamphetamine use was not significantly predictive of being returned to custody for a violent offense. These trends remained even after controlling for involvement in the drug trade (i.e., sales, distribution, or manufacturing).  相似文献

This study investigates self-control theory using official and selfreported criminal records of 500 adult offenders. Four items derived from rapsheets (aliases, date of birth, place of birth, and social security number) are used as indicators of the self-control construct. Negative binomial regression models indicate a significant inverse relationship between self-control and escape arrests, failure to appear violations, probation and parole violations, felony convictions, and prison sentences. Since system involvement entails discipline, tenacity, and responsibility, offenders with low self-control are more likely to experience a criminal justice system failure.  相似文献
