One theoretical explanation for the consistently high Southern homicide rates is that the South constitutes a "regional culture of violence." Although this perspective has not garnered much empirical support, sound theoretical alternatives have not emerged. The present study attempts to fill this gap by suggesting that emergency medical services are an overlooked intervening influence in the production of homicide and aggravated battery rates. Analysis of data from the 67 counties in Florida provides some support for the notion that the differential distribution of medical resources is partially responsible for variation in criminally induced lethality rates  相似文献

Utilizing a theoretical perspective (the “social supports model”) increasingly applied by stress researchers in other fields, the present endeavor explores whether social supports operate to shield officers from the stresses emanating from police work To investigate this issue, 91 suburban officers were administered a questionnaire that contained scales measuring four job-related stressors, four types of social supports, and two forms of psychological stress—work and life. With regard to the stressors, the data analysis revealed that feelings of dangerousness were significantly and positively related to both stress scales, while shift change and court problems increased only general lye stress. It was also found that supervisory support mitigates work stress while family support helps to reduce more general psychological discomfort. These latter results rein force the assertion that future research could profit by systematically exploring the circumstances, such as social supports, which enable police to cope effectively with the more stressful features of their work.  相似文献

The past several decades have seen the emergence of a movement in the criminal justice system that has called for a greater consideration for the rights of victims. One manifestation of this movement has been the “right” of victims or victims' families to speak to the sentencing body through what are called victim impact statements about the value of the victim and the full harm that the offender has created. Although victim impact statements have been a relatively noncontroversial part of regular criminal trials, their presence in capital cases has had a more contentious history. The U.S. Supreme Court overturned previous decisions and explicitly permitted victim impact testimony in capital cases in Payne v. Tennessee (1991) . The dissenters in that case argued that such evidence only would arouse the emotions of jurors and bias them in favor of imposing death. A body of research in behavioral economics on the “identifiable victim effect” and the “identifiable wrongdoer effect” would have supported such a view. Using a randomized controlled experiment with a death‐eligible sample of potential jurors and the videotape of an actual penalty trial in which victim impact evidence (VIE) was used, we found that these concerns about VIE are perhaps well placed. Subjects who viewed VIE testimony in the penalty phase were more likely to feel negative emotions like anger, hostility, and vengeance; were more likely to feel sympathy and empathy toward the victim; and were more likely to have favorable perceptions of the victim and victim's family as well as unfavorable perceptions of the offender. We found that these positive feelings toward the victim and family were in turn related to a heightened risk of them imposing the death penalty. We found evidence that part of the effect of VIE on the decision to impose death was mediated by emotions of sympathy and empathy. We think our findings open the door for future work to put together better the causal story that links VIE to an increased inclination to impose death as well as explore possible remedies.  相似文献

Research examining the impact of habitual offender laws on crime has suffered from numerous methodological problems, including failure to consider incapacitation effects that may be responsible for most of the laws' impact but that may not appear until years after the law is passed; not addressing simultaneity issues; and omitting needed control variables to avoid spurious or suppressed results. The present study specifies procedures that can be used to mitigate these problems. These procedures are used in the current study to estimate the impact of Florida's habitual offender law on crime using a multiple time series design, with data for 58 counties from 1980–1998.  相似文献

Although Megan's Law was passed more than 10 years ago, very little is known as to whether it reduces sex offender recidivism significantly. Using a retrospective quasi‐experimental design, we examine whether community notification has a deterrent effect by comparing the recidivism rates of 155 level 3 (“high public risk”) sex offenders released from Minnesota prisons between 1997 and 2002 who were subject to broad notification with two separate control groups who were not. The first control group (referred to as the prenotification group) contained 125 sex offenders released between 1990 and 1996 (the 7 years preceding the implementation of the Community Notification Act) who likely would have been subject to broad community notification had the law been in effect at the time of their release. The second control group (referred to as the non‐notification group) was composed of 155 offenders (37 level 1 and 118 level 2) released between 1997 and 2002 who were not subject to broad community notification. The results from the Cox proportional hazards models reveal that broad community notification significantly reduced the risk of time to a sex reoffense (rearrest, reconviction, and reincarceration) compared with both control groups. The findings were mixed, however, for both non‐sex and general reoffending. Whereas broad community notification significantly reduced the risk of timing to both non‐sex and general recidivism compared with the prenotification group, no such effects were found in the non‐notification group analyses. We discuss the implications of these results and attempt to explain why Megan's Law seems to reduce sex offense recidivism in Minnesota.  相似文献

Although available empirical evidence suggests that Minnesota's Determinate Sentencing Law has had little effect on prison incarceration, it is still uncertain whether the sentencing guidelines affected jail use. A few recent studies imply that the guidelines have had a positive effect on jail incarceration rates. Accounts have pointed to preexisting trends, more severe sanctioning of repeat property offenders, and judicial concern with prison overcrowding as possible underlying causes of this observed increase. Using longitudinal data and an ARIMA study design, we investigate the validity of these competing explanations. Our findings show that the onset of the sentencing guidelines increased judicial use of the jail sanction beyond the effect of preexisting trends. In addition, the effect of mitigated dispositional departures from the no prison/prison outcome on jail use is salient only when prison population levels are high. This latter finding supports the thesis that judicial concern with prison overcrowding motivated judges to circumvent the guidelines in order to shift the burden of incarcerating offenders from the state to the local level. The policy implications of these results for determinate sentencing reform are discussed.  相似文献

This article provides a brief history of a federally funded court improvement program, describes the Dane County Court Improvement Project, and discusses the implications of the project evaluation's findings. As part of Wisconsin's efforts under the federally funded state court improvement program, Dane County developed and evaluated a form of accelerated review of selected juvenile court cases. The accelerated review intended to expedite permanency outcomes for abused and neglected children in out-of-home care. The evaluation's findings of the initiative suggest that more frequent court reviews than those mandated by law may increase the likelihood of adopting children entering out-of-home care with no decrease in the likelihood of family reunification. However, because many of the children whose parental rights had been terminated had yet to be placed for adoption at the time of the study's conclusion, the encouraging early findings of the initiative should be regarded with some caution.  相似文献

Despite its long history in criminology, research on the relationship between macroeconomic conditions and rates of common crime remains limited. That is in part because many analysts doubt that any systematic relationship exists and in part because of disagreement with regard to the validity of the indicators typically used to measure economic conditions. We argue in this article that good theoretical reasons exist to expect macroeconomic effects on crime rates, but many theories imply that collective perceptions of economic hardship should have effects on crime that are independent of those of more “objective” economic indicators. To evaluate this argument, we examine the relationships between the Index of Consumer Sentiment and regional robbery, burglary, larceny, and motor vehicle theft rates in the United States between 1970 and 2003, which was a period of large swings in both consumer sentiment and instrumental crime. Controlling for several factors thought to influence temporal variation in crime rates, we find that consumer sentiment had significant effects on robbery and property crime rates over the period that were largely independent of the effects of unemployment and economic growth. We also find that consumer sentiment accounted for a sizable fraction of the crime decline during the 1990s and yields reasonably accurate predictions of changes in the four offenses in 2004 and in two of the four offenses in 2005. We conclude that the effects of collective economic perceptions should become an important focus of future research on crime trends.  相似文献

Sociology of organizations scholars have long recognized sex and gender as key features shaping interactional dynamics within groups, and several recent qualitative studies suggest that sex composition of gangs helps shape the gang experience for both boys and girls. Quantitatively, we add to this scant literature by testing competing hypotheses from the theories of Kanter, Blau, and Blalock, and examining whether youth gangs' sex composition influences members' characterizations of their gangs and their individual participation in delinquency. Our findings suggest that sex composition, independent of sex itself, is important in shaping the norms and activities of gangs and their members.  相似文献

Despite the plethora of studies of broken homes, multivariate studies comparing the effects of the broken home and other theoretically relevant measures of the quality of family life are rare. This study examines the family structure versus family function issue by testing the comparative effects on self-reported delinquency of family structure and jive measures of family function. Five types of delinquency are considered. The data were obtained from a 1980 survey of 152 high school students in a small midwestern town. Item analysis and data reduction techniques were employed to construct six family quality indices and jive delinquency indices. Two types of family structure were examined: presence of both biological parents in the home v. other and single- v. two-parent homes. Multivariate analyses controlled for the effects of age and gender. Bivariate tests of the relationships between broken homes and delinquency were not significant, except for a moderate relationship between broken homes and status offenses. In addition, a bivariate relation between single-parent homes and delinquency was observed for status offenses only. Other forms of family dysfunction all were significantly related to overall delinquency and to status offenses. Moreover, several measures of family quality evidenced significant bivariate relationships to property offenses. violent offenses, and drug offenses. The importance of the broken home was further diminished when the direct effects of broken homes and home quality were examined in multivariate tests. Regression equations showed home quality and gender, rather than family structure, to be the more important determinants of delinquency. The family structure coefficient was significant in only 1 of 10 tests, a regression of broken home and home quality on status offenses. Efforts to expand the analysis to identify specific areas of family dysfunction were unenlightening.  相似文献

This paper is concerned with the utility of police-reported rates of gang violence, particularly important in an era which stresses officially determined rates of violence. The basic question is whether police investigation procedures have a major impact on the police designations of homicides as gang related, a question of causal order answerable only by the triangulation provided by multiple forms of data analysis. With minor qualification, the results suggest that“gang” designations of homicides reject characteristics of the incident settings and participants, that intrusion of investigative processes on reported gang versus nongang homicide rates was minimal, and that gang homicide rates reported by these departments could be used as reasonable criteria for evaluating program impact.  相似文献

Although researchers have begun to document the programs and activities performed by police gang units, little research has examined why police gang units are created and why they have responded to local gang problems in the way they have over the past 10 years. Using a multimethodological research design, the present study examines the factors that shaped a Midwestern police department's response to its community's gang problem. The results from the present study lend support for the institutional perspective. The data suggest that the gang unit was created as a consequence of pressures placed on the police department from various powerful elements within the community and that, once created, the unit's response was largely driven by its need to achieve and maintain organizational legitimacy.  相似文献

While social scientists have long been interested in the issue of racial and sexual discrimination within the criminal justice system, they have concentrated on the decisions to convict and sentence and have paid relatively little attention to the decision to prosecute. This study examines the issue of pretrial discrimination by focusing on the prosecutor's decision to reject or dismiss charges against black, Anglo, and Hispanic male and female defendants in Los Angeles. The data reveal a pattern of discrimination in favor of female defendants and against black and Hispanic defendants. Hispanic males are most likely to be prosecuted fully, followed by black males, Anglo males, and females of all ethnic groups.  相似文献

This study evaluates the assumption that deprivation among African Americans and racial inequality lead to black interracial homicide due to racial conflict and antagonism. Using refined race‐adjusted Supplemental Homicide Report data, Uniform Crime Report data and census data, we test an alternative hypothesis that draws on the macrostructural opportunity theory to assess and more accurately specify the relationship between structural characteristics and black interracial homicide. We find that first, the relationship between economic factors and black interracial homicide can be explained in large part by high rates of financially motivated crime such as robbery, and second, that economic factors are associated with financially motivated but not expressive black interracial killings. Analyses of black intraracial killings are performed for comparison purposes. Collectively, the findings suggest that conflict‐based explanations rooted in racial antagonism and frustration aggression may be premature.  相似文献

Past studies of the impact of prison population on homicide rates have produced widely divergent results. Those using state-level data find small impacts, but those using national data find very large ones. We use displacement/free-rider theory to explore the difference between these results. Displacement, in the current context, refers to a criminal's movement away from states with higher imprisonment rates. Free riding occurs when a state benefits from criminals being incarcerated in other states. If the displacement effect holds, a state's prison population has a stronger impact on crime within the state than would be accomplished by deterrence and incapacitation alone. If the free-rider effect holds, higher prison populations outside the state reduce homicide in the state because criminals are incapacitated elsewhere. Using vital statistics data for 1929 to 1992, we conduct separate homicide regressions for each state using both in-state and out-of-state prison population as independent variables. We find that the out-of-state variable has a much larger (negative) association with homicide, indicating substantial free riding. We also find evidence of a small displacement impact.  相似文献
