Ethnographic evidence reveals that many crimes in poor minority neighborhoods evade criminal justice sanctioning, thus leading to a negative association between the proportion of minority residents in a neighborhood and the arrest rate. To explain this finding, we extend recent theoretical explications of the concept of legal cynicism. Legal cynicism refers to a cultural orientation in which the law and the agents of its enforcement are viewed as illegitimate, unresponsive, and ill equipped to ensure public safety. Crime might flourish in neighborhoods characterized by legal cynicism because individuals who view the law as illegitimate are less likely to comply with it; yet because of legal cynicism, these crimes might go unreported and therefore unsanctioned. This study draws on data from the Project on Human Development in Chicago Neighborhoods to test the importance of legal cynicism for understanding geographic variation in the probability of arrest. We find that, in neighborhoods characterized by high levels of legal cynicism, crimes are much less likely to lead to an arrest than in neighborhoods where citizens view the police more favorably. Findings also reveal that residents of highly cynical neighborhoods are less likely to engage in collective efficacy and that collective efficacy mediates the association between legal cynicism and the probability of arrest.  相似文献

Research findings show that legal cynicism—a cultural frame in which skepticism about laws, the legal system, and police is expressed—is important in understanding neighborhood variation in engagement with the police, particularly in racially isolated African American communities. We argue that legal cynicism is also useful for understanding neighborhood variation in complaints about police misconduct. Using data on complaints filed in Chicago between 2012 and 2014, we show that grievances disproportionately came from racially segregated neighborhoods and that a measure of legal cynicism from the mid-1990s predicts complaints about abuse of police power two decades later. The association between legal cynicism and complaints is net of prior complaints, reported crime, imprisonment, and other structural factors that contribute to the frequency and nature of interactions involving police and residents. Legal cynicism also mediates the influence of racially isolated neighborhoods on complaints. The mid-1990s is the approximate midpoint of a half-century of police scandals in Chicago. Our research findings suggest that contemporary complaints about police misconduct in highly segregated Chicago neighborhoods are grounded in collectively shared historical memories of police malfeasance. They also suggest that persistent complaints about police misconduct may represent officially memorialized expressions of enduring racial protest against police abuse of power.  相似文献

In Egypt in 2012, several anti‐harassment groups were established to respond to an increase in sexual violence in public spaces and to the failure of the state to tackle the issue. Anti‐harassment groups organized patrol‐type intervention teams that operated during demonstrations or public celebrations to stop sexual assaults. This article examines how activists perceived the police in five anti‐harassment groups between 2012 and 2014, and the role these perceptions played in groups' decisions about cooperating with the police, and on‐the‐ground strategies of action. I argue for a multidimensional view of legal cynicism that conceptualizes legal cynicism as composed of three dimensions: legitimacy (a sense that law enforcement agencies are not entitled to be deferred to and obeyed), protection (a perception that the law fails to protect rights and provide public safety), and threat (a perception that the law represents a threat). This approach helps uncover the various meanings that legal cynicism takes for different actors in different contexts, and how actors justify their strategies of action based on their specific perceptions of the police's legitimacy, protective role, and threat.  相似文献

It is a truism that police in India generally lack legitimate authority and public trust. This lack is widely understood by scholars, policy analysts, and police practitioners as being rooted in the institution's colonial development as a means of oppression, and its alleged corruption and criminalization in the postcolonial period. The social facts of situational hyper‐empowerment and the widespread decadence of police do much to explain their poor image and performance, but these explanations do not account for the fact that police in India are also structurally disempowered by cultural‐political and legal‐institutional claims to multiple and conflicting forms of authority that challenge and often overwhelm the authority of police. This structural disempowerment and its performances in everyday interactions between the police and the public constitute an ongoing social process of delegitimation of police authority in contemporary India. Following ethnographic analysis of this process of delegitimation, I explore the implications of focusing on police disempowerment for theorizations of the sources and capabilities of state legal authority more generally.  相似文献

Studies have found that African Americans are more likely to perceive racial biases in the criminal justice system than are those from other racial groups. There is a limited understanding of how neighborhood social processes affect variation in these perceptions. This study formulates a series of hypotheses focused on whether perceived racial biases in the criminal justice system or perceptions of injustice vary as a function of levels of moral and legal cynicism as well as of adverse police–citizen encounters. These hypotheses are tested with multilevel regression models applied to data from a sample of 689 African Americans located in 39 neighborhoods. Findings from the regression models indicate that the positive association between structural disadvantage and perceptions of injustice is accounted for by moral and legal cynicism. Furthermore, adverse police encounters significantly increase perceptions of injustice; controlling for these encounters reduces the strength of the association between cynicism and injustice perceptions. Finally, the findings reveal that cynicism intensifies the association between adverse police encounters and perceptions of criminal injustice. The results are discussed in terms of their implications for research regarding perceived biases in the criminal justice system and neighborhood social processes.  相似文献

Over the last four decades, the United States has witnessed a historic expansion of its criminal justice system. This article examines how street‐level criminalization transforms the cultural contexts of poor urban communities. Drawing on five years of fieldwork in Los Angeles’ Skid Row–the site of one of the most aggressive zero‐tolerance policing campaigns to date–the study finds that residents develop and deploy a particular cultural frame–“cop wisdom”–by which they render seemingly‐random police activity more legible, predictable, and manipulable. Armed with this interpretive schema, “copwise” residents engage in new forms of self‐presentation in public, movement through the daily round, and informal social control in order to deflect police scrutiny and forestall street stops. While these techniques allow residents to reduce unwanted police contact, this often comes at the expense of individual and collective well‐being by precluding social interaction, exacerbating stigma, and contributing to animosity in public space.  相似文献

In different theoretical traditions, negative social conditions, attachments, and interactions shape the way individuals view the law and its agents. Although most researchers acknowledge the conceptual distinction between different legal attitudes such as legal cynicism and police legitimacy, it remains unclear to what extent these attitudes stem from the same social sources. In the current study, therefore, we evaluate the social and individual factors that influence trajectories of legal cynicism and police legitimacy using a diverse community sample of youths in Zurich, Switzerland. Latent growth curve models were employed to examine patterns of change in legal cynicism and police legitimacy between 13 and 20 years of age. The findings show that legal cynicism and police legitimacy both decline into early adulthood and exhibit high rank-stability over time. Furthermore, we find that legal cynicism is closely related to individual characteristics that reflect one's inability to recognize or abide by their internal rules. By contrast, police legitimacy is shaped by socialization influences, particularly teacher bonds and police contacts. These results indicate a need to assess the measurement and interpretation of legal cynicism critically in relation to broader legitimacy beliefs and to investigate the shared and distinct sources of these different constructs.  相似文献

Research consistently reveals that fear of crime and perceived risk are demographically and ecologically patterned. Women and individuals in disadvantaged community settings report increased fear and perceptions of risk. For women, these fears and perceptions are tied to concerns about sexual violence specifically, whereas for individuals in distressed neighborhoods, crime rates, “incivilities,” and poor police‐community relations are often identified as important correlates. Here, we build from the insights of previous research by examining the gendered nature of perceived risk and risk‐management strategies among urban African‐American adolescents. Our findings suggest that both risk and risk‐avoidance strategies are strikingly different for young women and young men and are shaped by the gendered organizational features of neighborhood life. We propose that future research will benefit by continuing to investigate how social vulnerabilities function in tandem to structure risks across ecological settings.  相似文献

Niederhoffer, following Durkheim, proposed a linear causal model to explain police anomia. Using data from an availability sample of New York City police, he breaks into the chain of variables at frustration and terminates the analysis with cynicism measured by a twenty-item scale. This study replicates Niederhoffer's research with a population of urban police, examines the nature and incidence of cynicism, and tests the relationships between various indices of frustration, cynicism, and anomia. Contrary to Niederhoffer's expectations, cynicism is not prevalent among police outside New York City; cynicism my be described adequately only with reference to three dimensions; most indices of frustration do not significantly correlate with two subscales of cynicism; and cynicism does not intervene in the relationships between a number of independent variables and anornh. An alternate model based on Merton's conceptualization of anomin as the result of a discrepancy in cultural values and institutionalized means for attaining such goals was tested. It was found that perceived means-goals discrepancy vis-à-vis legal norms and goals intervened in the relationships between rank and anomia and years on force and anomia.  相似文献

The current work investigated impacts of local violent crime rates on residents’ willingness to trust neighbors. Crime has been thought to “atomize” community. Many works have considered impacts of crime on local social climate or vice versa. A smaller number of works have linked crime with general judgments about trustworthiness, but there has been little work on crime and trust of neighbors. 2002 survey data of 4,133 Philadelphia residents in 45 neighborhoods were combined with census and reported crime data to address this question. Multilevel, multinomial logit models confirmed that residents’ willingness to trust their neighbors varied significantly across neighborhoods for two response category contrasts: strongly agreeing or agreeing neighbors were trustworthy, each relative to strongly disagreeing. As expected, residents in neighborhoods with higher crime rates judged their neighbors as less dependable, even after controlling for local participation. Neighborhood crime and status impacts both depended on the contrast considered and on how status and crime were disentangled. Results align with some earlier works showing contingent effects of crime on ties, or contingent effects of ties on crime. Results extend earlier works by simultaneously focusing on one critical and central assessment of neighbors, showing important differences across response categories, and simultaneously finding extraneighborhood impacts.  相似文献

Although the conventional wisdom holds that increasing the number of minority officers will enhance residents' perceptions of police and the criminal justice system, further systematic investigation of this hypothesis may be needed. Building on the group‐position thesis, the representative bureaucracy theory, and prior research, this study investigates whether perceived minority police presence within residents' neighborhoods affects residents' perceptions of criminal injustice, whether this effect is more pronounced for minority residents and in minority neighborhoods, and whether perceived minority police presence has a stronger effect on perceptions of criminal injustice for minority residents in more integrated and white neighborhoods than minority residents in minority neighborhoods. Analyses of data collected from Los Angeles, CA, show that residents perceive a lower level of criminal injustice when they report that officers in their neighborhoods are not white‐dominated, and this finding is not dependent on the respondent's race/ethnicity or the racial/ethnic composition of the neighborhood. In addition, perceived minority police presence seems to have a weak to no effect on residents' perceptions of criminal injustice for Hispanic communities. We discuss these findings and their implications for theory, research, and policy.  相似文献

Literature on public perceptions of legal authorities in Chinese societies has been accumulating, yet a critical line of inquiry is missing, regarding the effects of the media. Relying on two nationwide samples, this study examines: (1) to what extent do Chinese and Taiwanese citizens trust their police and courts; and (2) how does media consumption influence Chinese and Taiwanese trust in police and courts, after controlling for a range of individual demographic, experiential, attitudinal, and locality variables? Results show higher levels of trust among Chinese than Taiwanese. Chinese trust their courts more than the police, but Taiwanese trust their police more than courts. Media exposure variables have limited effects on public trust in legal authorities. While frequency of consumption of television, newspaper, and the Internet does not influence Chinese or Taiwanese trust, exposure to foreign news lowers Chinese trust in legal authorities. Trust in media is closely connected to trust in legal authorities.  相似文献

Since Niederhoffer's pioneering work with police, much attention has been paid to cynicism in several criminal justice settings. This research has led to a concept of cynicism as multidimensional. Based on these research findings, this study investigated cynicism in a new setting—juvenile probation. The specific focus was cynicism toward the rehabilitative ideal in juvenile justice. The study found that professionalism and longevity had effects that were opposite to what has been found in other settings. Moreover, this study found that idealistic cynicism is independent of perceptions of procedural efficacy, delinquency etiology, and, importantly, JPO role performance. We take these results to be in keeping with a general conclusion that cynicism is a judgment that varies within and across settings, audiences, and philosophical ideals, which calls for continued research refined by greater appreciation of situational specificity.  相似文献

Public trust has become a critical issue in transitional societies, such as China and Taiwan, where the legitimacy and accountability of the government in general, and legal authorities in particular, have been frequently scrutinized. Based on nationwide random samples, this study tests the explanatory power of three theories, the social structural thesis, the institutional performance thesis, and the cultural thesis, in accounting for public trust in police in China and Taiwan. Results show that Chinese citizens have higher levels of trust in police than do Taiwanese. The higher level of Chinese trust, to a large extent, derives from greater confidence in macroeconomic conditions and satisfaction with government responsiveness. The performance thesis, thus, receives the strongest support. Results also show some support for the cultural perspective that traditional values, such as interpersonal trust, promote trust in police in both societies. Policy implications are provided for enhancing police legitimacy and facilitating police reform in China and Taiwan.  相似文献

This article presents data from the completed first wave of a multiwave comparative study of crime, danger, and informal social control that focuses on youth living in three high‐crime neighborhoods in Philadelphia, PA (N= 147). The study is a purposive sample of delinquent and nondelinquent young men and women in one predominantly African‐American, one predominantly Latino, and one predominantly white neighborhood, and researchers have completed in‐depth interviews and self‐reports with each subject. This article focuses on the narratives that youth living in high‐crime neighborhoods build around their contact with police and the strategies the young people propose for crime reduction in their communities. The data illustrate that most youth in each neighborhood are negatively disposed toward police and that this is grounded in the lived experience of negative encounters with law enforcement. However, when youth expounded on what they thought would reduce crime, they overwhelmingly chose increased and tougher law enforcement. We analyze these findings to determine whether support exists for a subcultural approach or a cultural attenuation/procedural justice argument, and we explore the implications of our findings for community‐based crime control.  相似文献

Using data from the Area‐Identified National Crime Victimization Survey (NCVS), we provide a national assessment of the impact of neighborhood immigrant concentration on whether violence is reported to the police. By drawing on multiple theoretical perspectives, we outline how the level of violence reporting could be higher or lower in immigrant neighborhoods, as well as how this may depend on individual race/ethnicity and the history of immigration in the county in which immigrant neighborhoods are located. Controlling for both individual‐ and neighborhood‐level conditions, our findings indicate that within traditional immigrant counties, rates of violence reporting in immigrant neighborhoods are similar to those observed elsewhere. In contrast, within newer immigrant destinations, we observe much lower rates of violence reporting in neighborhoods with a large concentration of immigrants. Our study findings reveal comparable patterns for Whites, Blacks, and Latinos. The results have important implications for theory, policy, and future research.  相似文献

“Predatory policing” occurs where police officers mainly use their authority to advance their own material interests rather than to fight crime or protect the interests of elites. These practices have the potential to seriously compromise the public's trust in the police and other legal institutions, such as courts. Using data from six surveys and nine focus groups conducted in Russia, we address four empirical questions: (1) How widespread are public encounters with police violence and police corruption in Russia? (2) To what extent does exposure to these two forms of police misconduct vary by social and economic characteristics? (3) How do Russians perceive the police, the courts, and the use of violent methods by the police? (4) How, if at all, do experiences of police misconduct affect these perceptions? Our results suggest that Russia conforms to a model of predatory policing. Despite substantial differences in its law enforcement institutions and cultural norms regarding the law, Russia resembles the United States in that direct experiences of police abuse reduce confidence in the police and in the legal system more generally. The prevalence of predatory policing in Russia has undermined Russia's democratic transition, which should call attention to the indispensable role of the police and other public institutions in the success of democratic reforms.  相似文献

While a considerable number of studies had been conducted to examine the effects of various variables on police behavior, very few studies had simultaneously analyzed factors that accounted both for police coercive and noncoercive behaviors. Equally limited is the research on the influences of officer characteristics and neighborhood context on police behavior controlling for all individual situational factors. Using observational and survey data collected by a large-scale project and hierarchical linear modeling techniques, this study assessed the effects of situational, officer, and neighborhood variables on police coercive and noncoercive actions, as well as the cross-level effects between these variables. Findings showed that situational characteristics played a strong role in determining officer coercive behavior, but not noncoercive activities. Similarly, officer-level predictors explained better officers' variation in coercive behavior than noncoercive behavior. Meanwhile, socially disadvantaged neighborhoods were more prone to receive coercive activities than were other neighborhoods. Implications for policy and future research are discussed.  相似文献

This ethnographic article explores the manner in which the Los Angeles Community Action Network (LACAN), a grassroots organization made up of homeless and low‐income Skid Row residents, generates video evidence for use in lawsuits against the Los Angeles Police Department (LAPD). For marginalized communities fighting police abuse, the 1992 acquittal of four LAPD officers charged with the beating of Rodney King demonstrated that even the most “obvious” and condemning video evidence is subject to reinterpretation and reframing by skilled legal professionals. In response, LACAN has developed interactional filming strategies designed to constrain officers' ability to offer alternative explanations, while alleviating disparities in court‐recognized authority. In the tradition of legal consciousness scholarship, this article “de‐centers” the law by shifting emphasis from formal judicial decisions in the courtroom to citizen groups in their own communities, as they learn to use legal norms and conventions in social justice campaigns.  相似文献

Since Niederhoffer’s (1969) pioneering work, police cynicism has been a staple in research on police officers and police work, various typologies of police officers and definitions of the police subculture or police personality rely to a greater or lesser degree on conceptions of cynicism and suspicion. More recent research has questioned both the validity of measures of cynicism and typologies of police officers. The present study examines the link between cynicism and job satisfaction which is implicit in the literature. Findings indicate not only that these two factors are correlated, but also that relationships reported between cynicism and other factors in policing are mirrored by correlations between those factors and a measure of job satisfaction. The question which arises is, to what degree are correlations reported in the literature spurious, resulting not from cynicism, as was thought, but from a more generic measure of job satisfaction?  相似文献
