Currently, the EU-15 forms the only 'bubble' under the Kyoto Protocol and has negotiated an internal burden sharing. A strategic EU climate policy should include accession countries. Thus, even in the case of early ratification of the Kyoto Protocol by 2002, it would be sensible to form a bubble with all countries that are certain to be EU members during the commitment period 2008–2012. Of course due to Art. 4.4 of the Protocol the EU-15 has to stick to its own bubble. However, nothing prevents it from forming an implicit bubble including all first wave countries by inducing them to form a bubble on their own and transfer the surplus to the EU-15. Similarly, second wave countries should form a bubble of their own to co-ordinate JI and permit transfers to the EU. This would reduce the gap between business-as-usual and the target by about 50%. If ratification is delayed to a point where it is clear which second wave countries will be members by 2008, the bubble should be extended by those countries. When in 2005 target negotiations start for the second commitment period, the EU should negotiate a bubble consisting of all states being certain to be members by 2013.  相似文献

The Legal Education and Training Review identified gaps in law students’ key skills development and this paper considers how skills training in three key areas of mooting, negotiation and client interviewing can be maximised so that law students have a sense of themselves as lawyer as well as law student from the beginning of their legal education. The research identifies numerous benefits to learning law through skills-based activities, but also discovers some possible apprehensions about participating from a student perspective. This paper draws on data taken from students who engaged in short-term optional courses in client interviewing, negotiation and/or mooting and considers the responses to a survey conducted prior to participation, a reflective survey post-completion and a focus group exercise. In total 64 students responded to the questionnaire. The research explores the expected and actual benefits of participating in the courses, discusses how these impact on students’ perceptions of their employability and the types of activities considered most valuable. The article considers how, in light of the research, experiential learning can be put to best use within the law curriculum.  相似文献

One of the most striking recent developments in education in the Netherlands is the shift of powers from the central national level to the local level for several education policy fields, most notably for the policies aimed at reducing social and education disadvantages and those aimed at the integration of non-nationals into Dutch society. In this article, the influences from European and international law on this Dutch development are being discussed. The conclusion is that there must be a European influence on the contents of national policy matters as such in a general manner, but that the legislation influence stays behind in development.  相似文献

Abstract

The importance of proper response to victims of sexual abuse or assault has been well documented. However, despite their prominence as responders, little research has been conducted on training law enforcement officials to conduct this aspect of their jobs effectively. We describe results of a statewide survey of the adequacy of law enforcement officers' preparation to respond to victims of sexual assault. Results revealed a significant need for greater training on the topic, as well as a number of potential positive impacts of additional training and education, including feelings of better preparation, greater collaboration with external resources, more likelihood of victim participation in investigation, and more cases being brought to prosecution. Based on the results, we present a model of proposed benefits of additional training for police officers in sexual assault.  相似文献

This article discusses environmental policy integration—a concept so far mainly applied to domestic and European politics—at the global level. The article distinguishes between integration of institutions, of organizations, and of their bureaucracies, and it addresses both internal integration (within the environmental policy domain) and external integration (between environmental policies and non-environmental policies). The overall focus is on one set of policy reform proposals that have been salient in the global environmental governance debate for the last decades: the question of whether the creation of a world environment organization would improve the effectiveness, legitimacy, and efficiency of global environmental governance. We revisit this debate and explore the options for organizational change, including clustering, upgrading, streamlining, and hierarchical steering, with a focus on whether the reform proposals can bring about environmental policy integration. We conclude that in the longer term, upgrading of the UN Environment Programme to a UN specialized agency, with additional and increasing streamlining of other institutions and bureaucracies, offers the most potential for environmental policy integration and does not appear to be unrealistic.  相似文献

While some practitioners adopt a reductionist approach to inquiry in the cultural management discourse, this article is a critical reflection upon the practice of cultural management as an academic discipline. The article deals with a theoretical framework on how to formulate cultural management strategies that promote the sharing of cultural values throughout the global community. The article traces the history of graduate education in arts management from the late 1960s to the present, as well as discussing policy, research reports, and programs that have helped to build arts management as a comprehensive field of study. Though multidisciplinary in conception, the article posits that practitioners should acquire general training in the management sciences and proceed to professionalize in one distinct field of the arts and culture. Relevant courses in the social sciences and business studies should be incorporated as well. Five critical domains of cultural planning are discussed—arts and culture, citizenship and identity, spatial culture, communications, media and planning—as major concerns for the successful training of dynamic arts managers. The authors predict a time when cultural management will cease to be an adjunct discipline and become an independent school within the university system.  相似文献

After the European Union's accession to the European Convention on Human Rights the EU will become subject to legally binding judicial decisions of the European Court of Human Rights (ECtHR) and participate in statutory bodies of the Council of Europe (Parliamentary Assembly; Committee of Ministers) when they act under the Convention. Convention rights and their interpretation by the ECtHR will be directly enforceable against the EU institutions and against Member States when acting within the scope of EU law. This will vest the ECHR with additional force in a number of Member States, including Germany and the UK. All Member States will further be subject to additional constraints when acting under the Convention system. The article considers the reasons for, and consequences of the EU's primus inter pares position under the Convention and within the Council of Europe, and the likely practical effect of the EU's accession for its Member States.  相似文献

Ten countries of Central and Eastern Europe and the Mediterranean region joined the European Union in 2004. Two more new members from southeast Europe (Bulgaria and Romania) joined in January 2007. Given the diverse range of political, economic, social, and cultural contexts of these nations, EU enlargement and integration processes have entered a new phase of complexity. In this article, I analyze the cultural policy developments in eight of the new EU member states (the Czech Republic, Estonia, Poland, Latvia, Lithuania, Hungary, Slovakia, and Slovenia), examine in detail state and nonstate cultural funding patterns, and assess the influence of EU policy—especially with regard to the Culture Program, Structural Funds, and European cultural cooperation initiatives—for its impact on cultural policy development in the new member states. Next, I discuss the new forms of pan-European cultural cooperation, focusing on the development of networks, foundation initiatives, and observatories. Finally, I explore issues in development of cultural policy in the new member states and conclude with recommendations for the future of the enlarged EU.  相似文献

This article addresses practical implications for preventing lethal and nonlethal domestic violence (DV) that stem from recent research on male domestic homicide perpetrators. The role of risk assessment and batterer intervention programs is emphasized, including specific programming for treatment-resistant perpetrators. Adjunct interventions for related problems (e.g., anger, suicidal behaviour, substance abuse) are offered, and risk management tactics are summarized. The article highlights the significance of safety planning for victims and teaching youth skills for forming and maintaining healthy relationships. Possible solutions to the problem of DV perpetrators who avoid arrest also are highlighted (e.g., public awareness campaigns). Additionally, this article discusses approaches for dealing with psychopathic DV perpetrators, including the possible benefits of community education on psychopathy and early intervention for youth at risk for developing these traits. Some policy implications concerning DV and psychopathy also are covered. The article underscores the importance of coordinated community responses to DV.  相似文献

This article investigates the extent to which public higher education institutions participate in state-level arts policy through a history of selected budgets and a textual analysis of performing arts presenting centers at public higher education institutions in Virginia. Evidence from this research suggests that the arts policy field is altered by the emergence of public higher education institutions as policy actors. The findings have financial and decision-making implications for arts policy makers, university administrators, and arts agencies as the participation of public higher education institutions affords new opportunities and challenges for the state encouragement of the arts.  相似文献

This article considers how the legal and political order of the EU can cope if the ‘Ever Closer Union’ envisaged by the Treaties ceases to be inevitable. In particular, it focuses on what are the likely consequences if previously successful integration mechanisms such as integration through law (including adventurous pro‐integration interpretation by the Court of Justice of the European Union (CJEU)) and functional integration can no longer successfully push forward the integration process. It considers whether it is possible for the Union to ‘stand still’, that is, to maintain the current level of integration without either moving forward to more intensive integration or engaging in costly and disruptive disintegration. In order to substantiate this claim, the article looks at three areas, the law of citizenship, the Eurozone and the legislative structures of the Union, showing in each case that the neither the current degree of integration nor methods used in recent times to move the integration process forward provide a long term basis for policy.  相似文献

This article concerns a relatively novel issue: rule breaking and unlawful conduct by government bodies; to which degree does it occur, what is the nature of this misconduct, what are the underlying motives, and what are the consequences and possible solutions? Rule and law breaking is harmful for the credibility and integrity of a state and its law enforcement system. However, very little empirical research has been carried out into this issue, in comparison to research into state crime. There is little clarity about how public actors deal with criminal and administrative laws and rules in areas like environmental protection, safety regulations and working conditions. Do government bodies set a good example? Is their behaviour better or worse than the public and businesses? An analytical framework for research will be presented and also the results of an extensive research project in the Netherlands; the main themes of which have been benchmarked against data from the United Kingdom. The article will conclude with a summary of the main findings and a number of suggestions for further research and policy development.  相似文献
