The information theory of legislative organization suggests that legislative committees are designed to provide their parent chamber with necessary information to legislate. Despite empirical evidence for various aspects of the theory, we have limited knowledge of committees’ influence on legislative outputs. I argue that informative committees are more than information providers, that they also substantively impact legislative outcomes. With supportive evidence from the US state legislatures, this article shows that the presence of an informative committee system not only lowers the number of bills introduced to the legislature but also enhances the chamber's efficiency in transforming legislative proposals into laws.  相似文献

The investigation of peer-to-peer (p2p) file sharing networks is now of critical interest to law enforcement. P2P networks are extensively used for sharing and distribution of contraband. We detail the functionality of two p2p protocols, Gnutella and BitTorrent, and describe the legal issues pertaining to investigating such networks. We present an analysis of the protocols focused on the items of particular interest to investigators, such as the value of evidence given its provenance on the network. We also report our development of RoundUp, a tool for Gnutella investigations that follows the principles and techniques we detail for networking investigations. RoundUp has experienced rapid acceptance and deployment: it is currently used by 52 Internet Crimes Against Children (ICAC) Task Forces, who each share data from investigations in a central database. Using RoundUp, since October 2009, over 300,000 unique installations of Gnutella have been observed by law enforcement sharing known contraband in the the U.S. Using leads and evidence from RoundUp, a total of 558 search warrants have been issued and executed during that time.  相似文献

In this article, we explore the role of legislative knowledge networks (LKN) in the enactment of tax policy in Argentina. Findings show that legislative innovation follows a hierarchical (power law) structure with a few distinct issue areas dominated by key enacted bills. Taxation in Argentina is well described by three main issue areas: the VAT laws, the income tax, and the revenue‐sharing legislation. We provide evidence that complexity in the status quo, as described by a larger number of important precedent laws, reduces the likelihood of final approval. Our research departs from existing models of delegation by considering complexity in the status quo rather than complexity in the proposal. We argue that more complex status quo should be accounted for when trying to assess whether legislators draft more or less detailed law initiatives.  相似文献

This paper looks to broaden understanding about the networks of firms located in Business Incubators (BIs). To achieve this objective, a framework for understanding the networks of incubator firms was constructed. We argue that networks at incubators can be seen in two dimensions. In the first dimension, we define incubator firm networking activities in terms of resource type, i.e. tangible and intangible resources. In the second dimension, we define networks of incubator firms as external and internal. Internal networks refer to the relationship among tenants while external networks refer to the firm’s relationship with other institutions such as a university and/or research centre. Networks of firms located at the Daresbury Science and Innovation Campus in the United Kingdom were investigated using a tenant survey. Findings show that incubator firms develop more networks to access intangible resources than tangible resources. The analysis explored and compared types of networks for highly innovative firms and medium to low innovative firms and found differences in their networking activity. With regards to policy recommendations, this study shows network support for incubator firms can be improved. It also shows that those concerned with developing BI policy need to recognize and appreciate that not all incubator firms have the same needs. We present strong evidence that governing coalitions in Italy exercise significant negative agenda powers. First, governing parties have a roll rate that is nearly 0, and their roll rate is lower than opposition parties' roll rates, which average about 20% on all final‐passage votes. Second, after one controls for distance from the floor median, opposition parties have higher roll rates than government parties. These results strongly suggest that governing parties in Italy are able to control the legislative agenda to their benefit. We also document significantly higher opposition roll rates on decree‐conversion bills and budget bills than on ordinary bills—results consistent with our theoretical analysis of the differing procedures used in each case.  相似文献

A simulation-based counterfactual is one way to solve the observational equivalence challenge that seemingly “partisan” majority-party roll rates can be observed in the absence of any actual party influence. We simulate no-partisan-agenda-control counterfactual roll rates and apply them across sessions of the US House of Representatives and 86 state legislative chambers to evaluate the extent to which observed roll rates provide evidence for party influence on the legislative agenda. After assessing and controlling for the baseline risk of majority-party rolls, there is significant evidence of party influence on roll rates in some state legislatures, particularly those with rules that grant parties more agenda power, and in the post-Reed’s-rules House of Representatives. Institutional rules interact with the (simulated) risk of a majority roll to shape observed roll rates across chambers and across time.  相似文献

One of the important arguments in favor of Science Parks is the claimed networking benefit. A total of 273 new technology-based firms (NTBFs) were surveyed. The assessing of academic knowledge and expertise by businesses located on site is a key principle of Science Parks. Science Park NTBFs stand out as a special group of small firms in terms of performance (Growth: sales and employment). The arguments presented in this paper recognize the complex nature of co-operative resources. The level of interaction in the innovation process between firms located on Science Parks and local universities is generally low, but it is higher than the level of interaction exhibited by firms that are not Science Park firms. The underlying premise of our research propositions (P1 and P2) is that the NTBF-specific co-operative resources will provide the firm with a competitive advantage. This paper, building on the resource-based theory and empirical evidence, argues that NTBFs working with universities that have more proximity achieve certain advantages. Proximity between NTBFs and universities promote the exchange of ideas through both formal and informal networks. Statistically significant differences between Science Park NTBFs and off-Park NTBFs were recorded with regard to product development in the last three years.  相似文献

Driving while intoxicated (DWI) offenses provide a unique focal point for research in criminology. In recent years, legislative and media attention has increasingly focused on the harmful acts of drunk drivers, but little is known of the characteristics of individuals arrested for driving while drunk or of the court processing and sanctioning of such offenders. The research presented here uses a variety of methodological techniques to analyze individual-level court processing data for persons convicted of DWI on a revoked license. We find that the population of persons processed for this offense have certain characteristics which are not unlike those of persons processed for street crimes. Further, we find evidence of differential sanctioning related to ethnicity and level of education. We conclude with a call for future investigation of court processing to understand better why the DWI legislative mandate is being applied differently across social groups.  相似文献

Business incubators strive to develop robust business and social networks to bring value to their resident companies in the form of intellectual and material resources. Yet, information about what motivates resident companies to participate in networking activities and the obstacles they face in trying to build effective networks is limited. This study employs a communication perspective to examine the process of incubation in an award-winning university business incubator. Using a combination of network analysis and in-depth interviews, the case study reveals the nature of communication in the internal network of 18 resident companies and the incubator administrators. Despite being on the cutting edge of innovations in technology use, study findings reveal face-to-face interaction in the incubator is predominant. The physical proximity of resident companies at the incubator influences who they talk to the most, suggesting incubator site design is important in creating an entrepreneurial environment. The case study also indicates resident company motivations for networking include a strong desire for social support to help manage stress, security of membership in an in-group, and increased access to material or information resources. The primary obstacles residents face to participating in networking and building relationships with each other include extreme time limitations during the early start-up phase, lack of ongoing information about other residents, and lack of trust related to keeping information about innovations and funding sources secure. Implications of these findings and recommendations for incubator managers for building successful and sustainable communication networks conclude the article.  相似文献

In this research note, I discuss results from a recent study assessing the impact that New Zealand's electoral and legislative system reforms had on levels of vote consensus achieved in the House of Representatives. Using a new legislative vote data set spanning from 1987 to 2007, I find evidence that the institutional changes fostered an increase in consensual legislative vote outcomes. I also provide a brief theoretical explanation of the developments and address a few issues concerning the measure of consensus used and the interpretation of the data.  相似文献

The Davis V. Bandemer case focused much attention on the problem of using statistical evidence to demonstrate the existence of political gerrymandering. In this paper, we evaluate the uses and limitations of measures of the seat-votes relationship in the Bandemer case. We outline a statistical method we have developed that can be used to estimate bias and the form of representation in legislative redistricting. We apply this method to Indiana state House and Senate elections for the period 1972 to 1984 and demonstrate a maximum bias of 6.2% toward the Republicans in the House and a 2.8% bias in the Senate.  相似文献

The availability and use of social networking sites creates both opportunities and risks for their young users. This article evaluates the applicability of the current legal framework to (cyber)bullying and sexting, two types of (potentially harmful) behaviour that are increasingly occurring between peers in the social networking environment. The analysis includes a mapping of applicable legislative provisions at the European and national level, an analysis of the Terms of Service of the largest social networking provider, Facebook, and an overview and assessment of self-regulatory initiatives that have been taken by the industry in this area in Europe. The ultimate goal is to identify a number of elements for a comprehensive strategy to ensure that risks of (cyber)bullying and sexting are dealt with in a manner that empowers young users.  相似文献

This article addresses legislative perceptions of constituents' interests and develops a theory of perception that highlights the role of information accessibility in the formation of legislative offices' views of their districts. I used original data regarding health policy in the U.S. House to analyze perceptions of constituents' interests. I found that legislators do not see all constituents in their district, nor do they see the largest constituencies. Rather, legislators are more likely to see active and resource‐rich constituents. These findings provide unique evidence of the influence of money in Congress and suggest that legislative misperception is both common and systematically biased.  相似文献

The combination of knowledge and innovation has become a cornerstone among knowledge and labour intensive enterprises. A growing number of enterprises are defined as knowledge intensive entrepreneurship ventures that have been widely studied in relation to their eco-system. However only few research have addressed this phenomenon to enterprises digital eco-system by adopting mainly a qualitatively approach. We point out that the relevance of the digital eco-system focusing on the role of social networking sites in relationship to innovation and knowledge. The use of social networking sites can provide a wealth of information about individuals and their networks, which can be utilised for various business purposes. It enables enterprises to create online communities and share user-created content. Within this context, enterprises actively interact with external actors such as customers, public institutions, and other businesses to acquire and absorb external knowledge, and then generate innovation. To gain insights from the global economy, 215 small to medium enterprises from different sets of global enterprises, both knowledge-intensive (e.g. management consulting, marketing and advertising, ICT and related services, legal and technical services) and labour-intensive (such as high tech and electronics, food and beverage, and consumer durables), were analysed. Via the Partial Least Square-Path Modelling the relationships between social networking sites, absorptive capacity, and innovation performance were measured. Therefore, recommendations are proffered as to what small-medium enterprises should do in order to enhance their innovativeness. The research ends with conclusions and implications to both scholars and practitioners.  相似文献

Machine learning models, especially ensemble and tree-based approaches, offer great promise to legislative scholars. However, they are heavily underutilized outside of narrow applications to text and networks. We believe this is because they are difficult to interpret: while the models are extremely flexible, they have been criticized as “black box” techniques due to their difficulty in visualizing the effect of predictors on the outcome of interest. In order to make these models more useful for legislative scholars, we introduce a framework integrating machine learning models with traditional parametric approaches. We then review three interpretative plotting strategies that scholars can use to bring a substantive interpretation to their machine learning models. For each, we explain the plotting strategy, when to use it, and how to interpret it. We then put these plots in action by revisiting two recent articles from Legislative Studies Quarterly.  相似文献

Our research addresses how individual member behavior and institutional variables affect legislative success in the U.S. House of Representatives. Using new measures of activity from the 103d Congress (1993–94), a count dependent variable, and negative binomial regression, our analysis assesses member effectiveness. We find that a member's activity level encourages legislative success, but gains are limited when members speak or sponsor too frequently. Our results provide a clearer picture of the role of legislative context and the relevance of institutions in determining a member's legislative successes and failures.  相似文献

Cost‐benefit models of career choice predict that potential legislators choose legislative careers when they expect greater utility from legislative service than from other options. In state legislatures, the utility of legislative service includes the monetary value of outside careers. I hypothesize that legislators are more likely to pursue outside careers when financial opportunity costs are higher or when they derive less non‐monetary value from legislative service. In particular, I posit that individual characteristics that predict labor market value (such as age, education, race, and sex) and legislative salary predict outside careers. I test this model employing a new dataset of individual outside‐career activity derived from financial disclosure reports. The findings strongly support the hypothesis that outside‐career behavior is a function of the financial opportunity costs of legislative service. In addition, I find that Republicans are more likely to hold outside careers than are Democrats. This research has important implications for the study of state legislative participation, legislative organization, and the Democratic bias hypothesis.  相似文献

This article considers Dworkin's influential argument against legislative intent in chapter 9 of Law's Empire. The argument proves much less than is often assumed for it fails to address the possibility that the institution of the legislature may form and act on intentions. Indeed, analysis of Dworkin's argument lends support to that possibility. Dworkin aims to refute legislative intent in order to elucidate his own theory of statutory interpretation. That theory fails to explain plausibly legislative action. Dworkin's argument does not refute legislative intent but instead suggests there is reason to think that the legislature is capable of intentional action.  相似文献
