Whether news reports concerning foreign government proceedings enjoy the same level of protection from tortious liability as reports concerning domestic government proceedings is a question of great consequence for media in the United States, especially given the ever-increasing globalization of political and economic affairs. A growing number of libel cases generated by international journalism based in documents and meetings of government officials in other nations are testing the well-established fair report privilege in state and federal courts. This article, after analyzing the history, cases and commentary on the subject, concludes by recommending a liberal privilege for such reporting.  相似文献

2013年英国颁布了诽谤法修正案,其第5条对ISP进行了有针对性的立法,以ISP是否对发布的内容有影响或控制为标准,将ISP分为两类,并适用不同的责任构成,将通知即删除原则成文化,同时制定了明确的适用的规则。其总体方向是在坚持传统的基础上,确保法律与时俱进并且适用;在平衡言论自由与名誉权的基础上,寻求在最大程度上保护ISP而不是承担责任。英国2013诽谤法使我们从现实合理性方面审视我国网络诽谤立法及ISP现状,据此提出《侵权责任法》第36条第3款的修改意见及我国将来的网络诽谤立法或司法适用的一些基本原则。  相似文献

Nations in the Arab world are known for their restrictions on press freedom, with public officials often using defamation laws to hinder good journalism. To promote reform, this article analyzes defamation laws of six Arab countries – Egypt, Jordan, Kuwait, Lebanon, Libya and the United Arab Emirates – and compares them to international norms. In areas with strong press protections, three characteristics related to defamation law were identified. First, defamation cases should be handled by civil lawsuits rather than police complaints, so journalists are not threatened with jail for their reporting. Second, the law must afford greater scrutiny for public figures than for private individuals so that the powerful cannot stifle public debate. Third, truth must be an absolute defense against allegations of defamation, so that people cannot protect an undeserving good reputation. The analysis reveals that defamation provisions in these countries are not in alignment with international norms.  相似文献

美国近日修改《1930年关税法》授权美国商务部对以中国为代表的所谓"非市场经济国家"征收反补贴税,是对来自中国的进口产品新一轮贸易保护主义的表现。WTO规则并未禁止对"非市场经济国家"反补贴,因此美国此次修法并不违反其在WTO项下的义务,但美国如果对来自中国的产品按照"非市场经济国家"使用替代国方法进行"双反"救济,依据WTO争端解决上诉机构"对来自中国的产品的反补贴和反倾销措施"报告,将很可能违反WTO协定的"适当金额"要求,构成双重救济。中国当前最重要的是积极应对现实的"双反"调查,而长远的目标则是争取美国对中国完全市场经济地位的承认。  相似文献

随着经济全球化的深入发展,跨国纳税人的避税行为日益频繁,反避税立法成为国际税法和国内税法的共同任务。美国是世界上最早进行反避税立法的国家,其中,其受控外国公司立法,是世界上第一个CFC规则,已经成为其他国家相关立法的模板。由于越来越多的跨国纳税人利用递延纳税进行避税,CFC规则价值凸显,其在美国反避税法律体系中的地位也日趋重要,具体规则也日趋严厉。尽管美国CFC规则也面临一定的冲突和挑战,其反避税价值仍然值得我们深入研究。近年来我国也面临严峻的反避税任务,对美国反避税相关立法进行研究,对中国具有直接的现实意义。  相似文献

The ongoing review of defamation laws by the Jamaican government has sharpened the focus on the need to identify appropriate standards for public officials in libel actions in light of the growing recognition of a need for transparency. Conventional wisdom speaks to the indispensable role of the media to inform the public of government activities to facilitate the democratic process. Jamaica's unique history of colonialism, underdevelopment and poverty has led to a political system based on pork barrel economics – inimical to government transparency so necessary in a democracy. This article explores how British, Caribbean and U.S. jurisdictions have sought to manage the paradigm shift between the right to reputation and the need to ensure responsible and accountable governance. The aim is to identify a path of reform for Caribbean defamation law that ensures greater public official accountability and better incorporates twenty-first century notions of democracy.  相似文献

Following the execution of two German nationals in the United States in 2001, the International Court of Justice (ICJ) found the U.S. in violation of international law stating that foreign nationals must be notified of their right to contact their embassy. When they learned of this right ten years after their arrest, they were barred from raising the claim; and after exhausting available avenues in American courts, the German consulate took the case to the International Court of Justice. The U.S. executed the two men while the case was still before the ICJ, in spite of its request to stay the execution and German objections that “violations of Article 36 followed by death sentences and executions cannot be remedied by apologies or the distribution of leaflets”. This paper discusses the importance of consular notification to the fairness of prosecutions. Cases reviewed indicate the U.S. still frequently does not provide notification and is at times oblivious to the ICJ's ruling. The paper discusses reasons the U.S. should honor notification, including reciprocity for Americans traveling abroad and the larger development of international law. A final section provides several mechanisms for bringing U.S. practices into compliance that could be easily implemented. Recovery, profiling, and speculative searching of trace DNA (not attributable to a body fluid/cell type) over a twelve‐month period in a U.S. Crime Laboratory and U.K. police force are compared. Results show greater numbers of U.S. firearm‐related items submitted for analysis compared with the U.K., where greatest numbers were submitted from burglary or vehicle offenses. U.S. multiple recovery techniques (double swabbing) occurred mainly during laboratory examination, whereas the majority of U.K. multiple recovery techniques occurred at the scene. No statistical difference was observed for useful profiles from single or multiple recovery. Database loading of interpretable profiles was most successful for U.K. items related to burglary or vehicle offenses. Database associations (matches) represented 7.0% of all U.S. items and 13.1% of all U.K. items. The U.K. strategy for burglary and vehicle examination demonstrated that careful selection of both items and sampling techniques is crucial to obtaining the observed results.  相似文献

While Congress can attempt to overrule constitutional decisions of the Supreme Court by initiating the constitutional amendment process, an amendment is rarely a practicable option. Instead, Congress regularly tries to modify the impact of constitutional decisions with ordinary legislation. I analyze policy‐based responses to the Supreme Court's constitutional decisions that were initiated in Congress between 1995 and 2010. For each responsive proposal, I consider the relationship between the proposed legislation and the Court's legal holding and the relationship between the proposal and the public policy associated with the Court's decision. I find that Congress enjoys considerable success in reversing the policy impacts of the Court's decisions but is limited in its ability to overcome the Court's legal rules.  相似文献

Sparked by interest in game‐theoretic representations of the separation of powers, empirical work examining congressional overrides of Supreme Court statutory decisions has burgeoned in recent years. Much of this work has been hampered, however, by the relative rarity of such events; as has long been noted, congressional attention to the Court is limited, and most Court decisions represent the last word on statutory interpretation. With this fact foremost in our minds, we examine empirically a number of theories regarding such reversals. By adopting an approach that allows us to separate the factors that lead to the event itself (that is, the presence or absence of an override in a particular case) from those that influence the timing of the event, we find that case‐specific factors are an important influence in the incidence of overrides, whereas Congress‐ and Court‐specific political influences dominate the timing at which those overrides occur. By separating the incidence and timing of overrides, our study yields a more accurate and nuanced understanding of this aspect of the separation‐of‐powers system.  相似文献

Abstract. The first section takes up some main details of American constitutional history. At the end of that section and in section two, we concentrate on one constitutional doctrine in particular, judicial review. We argue that this doctrine rests, traditionally, on the foundational idea of a permanent tension between democratic institutions and basic rights. In section three, we deal with the problem just raised, by suggesting an alternative view of the relationship that exists between these fundamental constitutional elements. Here we attempt to show that there is an essential principled harmony between basic constitutional rights and democratic majority rule. And we try to locate judicial review within this alternative conception. Then in section four and in the conclusion we discuss the institutional arrangements for the practice of judicial review in the light of this alternative conception.  相似文献
