Feminism did not come easily to Germany's middle-class Jewish women. Moral outrage against white slavery and prostitution, however, led many religious housewives to join the Jüdischer Frauenbund (League of Jewish Women), a Jewish feminist organization. Their attitudes towards their ‘victimized’ or ‘erring young sisters’, their motivations for fighting white slavery, and the tactics they employed in their campaigns are examined in this essay. While they emphasized the virtues of purity and invoked Jewish ethical codes, theirs was not simply a morality crusade. The feminist founders of the Jüdischer Frauenbund (JFB) struggled to persuade their more conservative followers that the sexual abuse of women was linked to their inferior status in German society and Jewish culture. These leaders successfully convinced JFB members to take a giant step beyond their traditional family roles and charitable activities in order to challenge sexism. Thus the fight against white slavery became instrumental in serving wider feminist goals.  相似文献

Debates concerning the taxation of prostitution have occurred in taxation law and in feminist literature. This article will integrate the case of Polok v. C.E.C. [2002] E.W.H.C, 156; [2002] S.T.C. 361, within the feminist legal canon. The case is discussed in the context of the argument of the European doctrine of fiscal neutrality, which dictates that, regardless of legality as amongst member states, if an activity is levied to V.A.T. in one member state, V.A.T. should be levied on it in all member states. The doctrine of sovereignty accepts the possibility that the integrity of the V.A.T. system may be compromised by the levying of tax on illegal activities, in terms of the cooperation between tax and other aspects of the U.K.’s legal system. European law, feminist law, commodification and the marketplace are all considered within the context of these principles. The article also considers the place of Polok within standard feminist texts on prostitution. Different paradigms of prostitution define different aspects of prostitution as ‘problems’, and the article considers the implications within a feminist reconstruction of Polok of this. The article suggests that the challenge for a feminist analysis of Polok is to remain within the realm of European tax and competition law, and to render the perspective of the employees of the Polok taxpayers part of the substance of the deliberations of the case.  相似文献

While Denmark is widely known as a global exporter of cryopreserved sperm, Danish women’s eggs face a very different fate. This paper combines legal and rhetorical analyses with the concept of sociotechnical imaginaries. In establishing the genealogy of the sociotechnical imaginaries that shaped Danish regulation of the cryopreservation of eggs, we analyse the relevant Acts, Bills, preparatory work, and readings in Parliament, along with the concurrent public and ethical debates that over time relaxed the legal limit for the cryopreservation of eggs to the current five years and today continue to ignite discussions on elective egg freezing. We rely on welfare-state perspectives to discuss why reproduction, in the Danish context, is seen as a legitimate and appropriate sphere to regulate, and we turn to feminist theorizing to discuss the gendered implications captured in the sociotechnical imaginaries of the “Moral State”, “technologies to be tamed”, “the nuclear family”, and “technology as equality and hope”. We end by discussing how an interdisciplinary approach enriches our understanding of the legal, cultural, and political entanglements related to putting eggs on ice.  相似文献

This article provides a critical analysis of the manner in which prostitution and trafficking for the purposes of sexual exploitation was ??framed?? by official discourses in order to support the reforms in England and Wales contained within the Policing and Crime Act 2009. Drawing upon the recent work of Judith Butler, emphasis will be placed on how the schema of the vulnerable prostitute was fundamental to invoking emotional affects, which justified certain political effects, especially the move towards criminalising the purchase of sexual services. However, on closer analysis the article will uncover an agenda influenced by law and order/morality, immigration and a ??fear of the enemy??. Furthermore, it will be argued that New Labour??s framing of the problematic enabled the State to avoid dealing with the more difficult, but more urgent, issues of the differential distribution of wealth, precarity and the engendering of an ethical and global responsibility for the other.  相似文献

This article is an attempt to bring together knowledge about the Norwegian prostitution market, public debates on prostitution and prostitution laws and regulation in order to explore the processes whereby the prostitution setting is constituted. Norway has been the site of changes in the ways female prostitution takes place, changes that are being experienced by the women involved due to a growth in indoor prostitution. These changes seem to have been produced by, and to take part in, the production of new images of prostitutes and new means of prostitution control.  相似文献

Denmark has become a destination for single women, lesbians, and heterosexual couples wanting donated sperm. At the moment, women from Sweden, Norway, Germany, Italy, and the UK travel to Denmark. Simultaneously, waiting lists for donated eggs and age restrictions are prime motivations for infertile Danish women and heterosexual couples to leave Denmark and travel to Spain, the Czech Republic, the Ukraine, and Greece for egg donation. Informed by Donna Haraway’s notion of “the apparatus of bodily production”, Marcia Inhorn’s development of “reproductive flows”, and the use of Adele Clarke’s “situational analysis”, this paper explores the question: How do global reproductive pathways in and out of Denmark emerge when fertility travellers narrate, negotiate, and cross national borders to go through fertility treatment? Methodologically, we use a multi-sited and multi-modal approach centring on interviews with fertility travellers moving to and from Denmark in combination with ethnographic observations carried out in Danish and Spanish fertility clinics and an analysis of legal regulations. The paper concludes by discussing how the concept of reproductive pathways helps to theorize transnational movements of bodies and contributes to feminist scholarship on transnational reproductive travel.  相似文献

Political documents on gender equality in the Nordic countries contain interesting systematic variations in justification strategies and discursive commitments at different political-rhetorical levels. This is particularly apparent when political texts move from general gender equality to arguing about specific issues. This article looks at the variety of "versions" of gender equality that appear when the discourses of gender and the conceptualisations of power that inform Swedish political party documents are scrutinised. Consequences of different versions of gender equality for rhetoric about policy measures and rhetorical uses of "uniformity" versus "heterogeneity" are also discussed.  相似文献
