论网络主权与新的国家安全观

互联网和全球网络空间的兴起发展,使传统绝对化的主权观念受到冲击,网络主权是国家主权在网络环境下的国家主权的自然延伸。互联网的自由化、无边界性与国家独立性、固定边界有着鲜明的不同,国家之间的相互依赖性大大增强,面临的复杂法律问题仅凭一国的力量也很难解决,加之国际组织的权力强化和地位提升,国家不得不让渡部分主权或自我限制主权,以促成国家之间的协调合作。同时国家安全问题也受到前所未有的挑战,信息安全成为国家安全的重要方面,树立新的安全观,提高信息保障能力成为信息时代维护国家安全的必然选择。     

Tort Reform and Physician Sanctioning

This article examines the relationship between changes in tort rules and the sanctioning of physicians by state medical boards. It compares the sanctioning rates for doctors in states that have passed tort reforms with the rates in states that have not made legislative changes. It concludes that alterations to the joint liability rule may have increased sanctioning, while the addition of pre–trial screening panels and regulation of attorney fees may have limited the number of physicians who receive punishment.     

Physician staffing and patient violence

We found an inverse relation between physical aggression by patients and physician staffing--when more physicians were available, physical aggression decreased. Episodes of nonphysical aggression increased with higher levels of psychiatrist staffing, but were not related to general physician staffing.     

CARICOM,the CSME,and absolute sovereignty: lessons learnt on the road towards regional integration

As a regional bloc, the Revised Treaty of Chaguaramas (RTC) provides an opportunity for all of its Member States to benefit from regional integration and to better withstand the effects of globalisation. This article examines two recent cases involving Guyana that were litigated before the Caribbean Court of Justice (CCJ) (the 2009 “TCL Case” and 2014 “Rudisa Case”) and discusses several important issues borne out during the cases, whereas also highlighting potential or emergent issues which may emanate from these cases in the future. These cases are analysed with a view to highlighting the important role of the CCJ in interpreting the RTC.
