6月20日上午9时,我国治理车辆超限超载战役全面打响。安徽省25个“治超”执法检查站、9个公路规费稽查站的4000名执法人员,在高速公路和国、省道上同步展开24小时稽查,不让一辆超限超载车辆“负重上阵”,确保人民群众生命财产安全与道路畅通。据悉,此次整治以车货总重量超过20吨的超限超载车辆为重点,不超过20吨的车辆暂时不予以卸载;对蔬菜瓜果等鲜活农产品运输车辆原则上不实施卸载;从人性化和服务的角度出发,对首次超载被抓且主动卸载的车主,以批评教育为主,不实施处罚。治理工作总体上分为三个阶段。第一阶段从2004年5月中旬至2004年6月上中旬,为宣传和准备阶段。第二阶段从2004年6月20日至2005年2月28日,为集中治理阶段。第三阶段从2005年3月1日至2005年5月31日,为总结和建立长效机制阶段。  相似文献

唐山市丰润区是连接东北、华北和西北的重要通道,交通的优势带来了运输经济的持续繁荣,运输行业的违法行为也随之增多。一段时间违法违章运输更是愈演愈烈,超载超限曾一度达到运输总量的70%,并形成多样性、暴力性、对抗性的规律;不缴纳交通规费,随意改装车辆,出租黑车,随意占用公路用地搞建筑、违法广告等违章行为,特别是近几年,超出载重量几倍或几十倍的运输,使丰润的公路、桥梁受到灾难性的损害。虽然交通部门每年都要组织多次大规模的整治,但效果甚微,违法违规行为难以根治。  相似文献

在企业合规制度中,涉罪企业认罪既是启动合规考察的前提条件,亦能体现检察机关提前采取“准刑罚”措施的正当性。围绕中小微企业这一类主要适用对象,企业认罪的实践困境包含直接责任人员未参与罪名合意、认罪真实性与自愿性难以保障、检察机关接触企业认罪较晚等。究其原因,主要为“认事”与罪名合意之人发生分离、合规不起诉的优待及于直接责任人员、公诉裁量权较大且外在监督不足等。同时,从试点情况看,企业认罪的具体表现形式为第三方组织审查和建议采取何种合规计划、合规考察合格后检察机关是否不起诉等提供了参考和依据。面对诸多实践困境,应从赋予两类代表人员相关性权利、对直接责任人员慎用不起诉、逐步完善企业合规规则、强化公诉裁量权的外部“风控”因素四方面加以改进。  相似文献

Domestic abuse allegations have become a serious problem in our society. They present our court system with difficult decisions and problems. This becomes an even more difficult situation when the abused is an illegal immigrant. Many of the abused are too frightened or intimidated to go to the authorities for help. Public authorities process personal data. In most cases these data are processed because there is a legal obligation to do so, or because processing is necessary for the performance of a task carried out in the public interest. The right to be forgotten or to erasure will, in this situation, play a limited role in the protection of the rights of the individual. There is even a public interest in maintaining archives, thus in not forgetting. At the same time, the possibility exists that not forgetting might be more valuable for the protection of rights of data subjects then forgetting. In the case of data processing by public authorities, it is important that the processing is based on a law. A close watch should be held on the grounds that public authorities use to justify the processing. As the right to be forgotten will play a limited role in the protection of the rights of data subjects in the case of data processed by public authorities, it is important to emphasize the right of access and rectification of data. It is therefore essential that the controller is transparent to the public with regard to the processing of data.  相似文献

Informal economy functions without any formal social control for lack of a supervisory authority. Within a regulated locality the same activities would have an illegal character, but in that deviating situation those informal activities can thrive because the authorities do not intervene. Globalization of our western mixed market economy implies that also the aspect of government control takes on a global character. The fact that formal economies settle in places where an informal market is the rule leads to a combined action which, eventually, creates new market relations. In the present contribution we study the effects of a meeting between a formal and an informal market on the basis of a concrete case. An analysis of the market of medical products in Third World countries gives an idea of the new relations that arise when an informal market of natural medicines is confronted with a formal market of western medicines. We study both the situation in which there are no regulations and the situation in which the formal market is supported by economic regulations. This text illustrates how those situations can give rise to new opportunities for one group and to exploitation for another.  相似文献

Governing bodies have significant autonomy in the organisation of professional sport in the EU, a situation now supported by Article 165 TFEU. However the post‐Lisbon competence for sport does not grant any exemption for practices that infringe fundamental freedoms or competition law; such infringements can only be justified where they are a proportionate response to an inherent need in that sport. The football ‘transfer system’ has been the subject of a series of EU law challenges, but continues to place obstacles in the way of the free movement of players between Member States and may restrict the ability of most clubs to compete for the elite players. Court of Arbitration for Sport decisions in transfer dispute cases have entrenched this situation, and recent evidence casts doubt on both the ability of the authorities to justify the current system and the 2001 decision by the European Commission to sign it off as being an acceptable balance between the rights of the stakeholders.  相似文献

The International Criminal Court (ICC) has had to face manyobjective difficulties in its initial stage. The self-referralsby Uganda and the Democratic Republic of Congo (DRC) pose problems.As for Uganda, the unsealing of the indictments is an achievementfor the Court; however, the rhetorical conflict between thereferring government and the ICC, the continued insecurity innorthern Uganda and the fact that the accused commanders arenot in the custody of the Ugandan authorities highlight thedependence of the ICC on the cooperation of national governments.As for the DRC, the transfer to The Hague of one of the indictees,Lubanga, is significant. Supporters of the ICC hope that thistrial will help to ease many doubts about the direction of theCourt, as the Tadi case was able to do for the InternationalCriminal Tribunal for the former Yugoslavia (ICTY). The SecurityCouncil referral of Darfur is a mixed blessing, on a numberof grounds. However, the posture of Sudanese authorities andthe worsening of the situation in Darfur and eastern Chad clearlyindicate that the ICC does not yet have a deterrence capability.  相似文献

Activities of Finnish professional criminals across theFinnish-Estonian border in the 1990s are studied in the light of two typesof data: non-public intelligence records of Finnish police and customs, andexpert interviews with Finnish and Estonian crime investigators and liaisonofficers. For practical purposes, professional crime is defined here asoffences that are planned, involve considerable material values, and aresanctioned with imprisonment. The volume of crime taking place in thecross-border scene is assessed to be much larger than reported in publicsources based on police-reported crimes and court verdicts. The largestgroups of crimes involved have to do with the import of narcotics, alcohol,and cigarettes from Estonia to Finland, price differentials being the centraldriving force. The total profile of professional crime in this scene, however,involves a much broader scope of criminal activities, including evenlarge-scale frauds where Finnish fraudsters have taken advantage of the goodfaith of Estonian banks and businessmen. The lifetime of the operationsdescribed mostly remains below one year. Many of the persons involved,however, do represent long and persistent careers. Their criminal operationsare usually organised according to a project model rather than a stableorganisation model. The authors recommend national police, customs andtax authorities to join forces and share intelligence for a fuller overallpicture of the situation and for improved efficiency of control andprevention. Further, co-operation between Finnish and Estonian lawenforcement agencies is judged to be in serious need of improvement, if the authorities sincerely wish to get to grips with the voluminous operationsof professional offenders in this scene.  相似文献

In this article a comparison is made between the legal regulations in the Netherlands, Belgium, Germany, England and the USA. 部门行政法的划分标准不是单一的,必须同时考虑其规范对象。法律形 式、职能权限等多种因素,若于因素综合在一起共同使部门行政法有了自己的内涵。确定 部门行政法的调整对象,也须从多种角度进行比较分析,部门行政法主要规范行政相对 人,以保护行政权为主旨,侧重调整管理关系或私权关系;行政法则主要规范行政主体, 以限制行政权为主旨,侧重调整行政关系或公权关系。部门行政法的体系构架可以有不 同的选择模式,从职权行使的主体、各类管理关系以及行政权的范畴等多种角度都可以 构架部门行政法体系。  相似文献
