In Hirst v UK, the European Court of Human Rights ruled that the UK must end its blanket ban on convicted prisoners voting. In this paper I argue that the court’s reasoning undermines collective political self-determination by assuming away the essential connection between political citizenship and civil liberty in a representative democracy. I outline a democratic theory of imprisonment and argue that the democratic citizenship of imprisoned offenders is suspended not by their disenfranchisement but by their imprisonment. While many aspects of the UK’s penal practice are inconsistent with democratic self-government, the voting ban is not one of them. I conclude by outlining the numerous rights that prisoners should enjoy in a democracy.  相似文献

This special edition reflects on the contemporary relevance of the insights and concerns of David Marquand's book The Progressive Dilemma. In this Introduction, the editors set the scene for these reflections. They consider the structural changes that have occurred in politics since the 1990s: the impact of globalisation, the erosion of class identities, the rise of ‘identity politics’ and the continued fragmentation of the party system. There has been no reconciliation between the parties of the centre‐left, nor any re‐examination of the ‘liberal tradition’ and the potential for a new synthesis with revisionist social democracy. On the one hand, Corbynism is a radicalised metropolitan species of liberalism, while on the other there are plenty in Labour who stress the need for the party to re‐engage with the traditional, socially conservative values of the working class in a new ‘postliberal’ appeal. Yet the authors argue that those who broadly identify with progressive causes in British politics—animated by the various overlapping strands of social liberalism, social democracy and liberal socialism—have still to work out how to address the historic failings that Marquand so eloquently exposed, to create a new and inspiring intellectual vision that unites and energises the left and centre‐left.  相似文献

Partisan conflicts have been frequently analysed in comparative political science research. Yet little is known about the dimensions of political conflict at the local level in multi-level democracies. This article contributes to the literature on the estimation and analysis of party positions by first presenting a new dataset of more than 800 local party manifestos in Germany that allows for a systematic analysis of the dimensions of political conflict at the German local level. Secondly, it is demonstrated that (semi-)automatic content analysis of these texts offers a promising approach for gaining new insights into local party positions. Thirdly, the empirical analysis of German local party manifestos shows that partisan conflicts are not only structured along the left–right dimension but also along a dimension which distinguishes between parties addressing ‘local’ and ‘national’ issues to a varying degree in their manifestos, due to the different behaviour of established and populist parties.  相似文献

In taking stock of the ruling Fidesz party's project of ‘illiberal democracy’ in Hungary, this article first develops considerations based on Claude Lefort's democratic theory for critiquing ‘illiberal democracy’ and post-democracy alike, situating the former in an early 2010s post-democratic moment characterised by the emergence of a neoliberal crisis management regime in the Eurozone. ‘Illiberal democracy’ and ‘market-conforming democracy’ are both problematic from this standpoint insofar as they subordinate the key Lefortian dimension of democratic contestation to either the primacy of the markets or a reified conception of the ‘national interest’ as represented by a single party. The analysis then traces the development of ‘illiberal democracy’ and its construction of key signifiers such as the ‘national interest’ in programmatic speeches made by Viktor Orbán, from its beginnings in the post-democratic moment to subsequent crisis conjunctures in which it has redefined itself against ever newer threats.  相似文献

This article analyses the dramatic electoral decline of German social democracy since 2003. It argues that the SPD's decision, under the leadership of former Chancellor Gerhard Schröder, to engage in welfare state retrenchment and labour market deregulation during the ‘Hartz reforms’ (2003–05) demoralised the SPD electorate. The SPD subsequently lost half of its former electoral coalition, namely blue‐collar voters and socially disadvantaged groups, while efforts to gain access to centrist and middle‐class voters have failed to produce any compensating gains. While the SPD's decline from a large to a mid‐sized party is part of a larger transformation of the German party system, no political recovery is possible for social democracy without a fundamental change of strategy, namely efforts to regain former voters by offering credible social welfare and redistributive policies. The SPD will not be able to delegate such policies in a ‘convoy model’ to other parties, such as the Left Party; nor will a modest ‘correction’ of the earlier course, such as has been attempted since 2009 under the leadership of current party chairman Sigmar Gabriel, be sufficient to recover lost electoral ground.  相似文献

This article focuses on the relationship between discourses of economic development and prospects for democracy in Turkey. It does so by tracing the political discourse of high‐ranking government officials and journalists close to them to show how they use arguments for economic development as a tool to politically legitimise interventions into liberal democracy. I first illustrate the dangers caused by the discourse surrounding economic development to democracy by looking at the Gezi protests. I show how demands for pluralism and respect for different lifestyles—which are crucial aspects of liberal democracy—were instead framed by the government as chaos created by agents of the so‐called ‘interest rate lobby’ and provocations caused by those who want to stop Turkey's economic development. I analyse Gezi in comparative perspective with presidentialism debates and the corruption scandal of December 2013. In these cases too, demands for democracy, transparency, checks and balances are pitted against economic development. Citizens are made to choose between a vaguely defined notion of economic development and democratisation.  相似文献

The negotiation and contents of the Statute for an International Criminal Court (ICC) were strongly influenced by global civil society actors. After examining definitions of global civil society, this article will consider whether and why such involvement of non-governmental actors in international negotiations should be considered desirable. In particular it will assess, in the light of the ICC negotiations, to what extent global civil society democratizes international decision-making processes, considering as elements of democracy: transparency, equality and deliberation, representation and participation. While concluding that this is only very partially the case, the final section will suggest that the tortured democracy question is not the only justification for global civil society involvement in international fora. It will discuss the much overlooked and by no means unproblematic ‘ethical contribution’ of global civil society and offer a qualified defence of more international law, with more global civil society participation, on this basis.  相似文献

The ‘character’ of democracy is regularly summarised using political‐institutional measures of, for instance, ‘consensus’ or ‘majoritarian’ democracy. Yet, there is little quantitative‐comparative research on the origins of such configurations. Drawing on literature on endogenous institutions and constitutional design, this article proposes a model for the explanation of empirical patterns of democracy. Using a novel database of 26 continental (neighbouring) European democracies and Bayesian spatial modelling, the results indicate that while today's empirical patterns of democracy in terms of proportional power diffusion can be traced back to waves of democratisation rather than historical partisan power configurations, decentral power diffusion can partially be explained by socio‐structural factors, and spatial dependencies exist for all variants of power diffusion.  相似文献

This article considers if an emerging ‘polarised pluralism’ in the German party system explains the recent electoral fortunes of the Party of Democratic Socialism. While it finds that this approach usefully focuses attention on the dynamics of party competition in unified Germany, it nonetheless concludes that the conditions for polarised pluralism are not satisfied in Germany. In place of a ‘polarised pluralism’, this article suggests that a ‘regionalised pluralism’ better explains the rise of the PDS. The key components of regionalised pluralism, its comparative scope and its implications for party politics in Germany are considered.  相似文献

Populism has often been described as a great challenge and threat to Western democracies. Not surprisingly, at a time in which we are witnessing a significant rise in populist actors in Europe and the US, scientific analyses and commentary regarding populism have become particularly popular and, indeed, necessary. My aim in this article is to offer a brief yet comprehensive overview of the ongoing debates in a bid to problematise the supposed ‘imminent threat’ of populism in light of recent developments within the political systems and societies of established democracies, especially under conditions of crisis. I understand populism as a specific type of discourse, and thus as a way—among others—of doing politics and appealing to groups of people. Thus, I highlight the varying orientations that populist movements might take, depending on the ideological traditions with which they are closely articulated and the sociopolitical environment in which they manifest. Last, I relate the ‘populist surge’ to discussions regarding post‐democracy.  相似文献

Features of electoral systems have been found to have positive effects on evaluations of democracy. This article proposes that there are larger social forces that must be accounted for in such analyses. Using European Social Survey measures of democratic expectations and the ‘satisfaction with democracy’ item, this study tests for effects of electoral rules on perceptions of democracy. It is found that multipartyism/proportionality and preferential ballot structure appear to correspond with positive evaluations of elections and parties, and with greater satisfaction with how democracy is functioning. However, these relationships dissipate when corruption and income inequality are accounted for. This suggests substantial limits to the capacity of electoral reforms to enhance democratic legitimacy. It also suggests that studies of mass perceptions of democratic performance may over‐estimate effects of electoral rules if country‐level corruption and income inequality are not accounted for.  相似文献

This article explores the appropriation dynamics of international statebuilding in Burundi, with a focus on the period from 2010 to 2015. If international statebuilding is most commonly presented (and debated) as practices leaning towards the achievement of a liberal democracy, this article argues that it can also be used towards undemocratic ends. The central claim is the following: the (most) recent authoritarian trend observed in Burundi’s main political force in government, the National Council for the Defence of Democracy – Forces for the Defence of Democracy (CNDD-FDD), did not only occur against international statebuilding but also through its appropriation and, more specifically, through self-reinforcing subversion tactics of appropriation. The article conceptualizes these tactics, examines the factors of emergence and conditions of existence, and presents the main expressions along three major editorial lines of international statebuilding: pluralist democracy, vibrant civil society and respect of the rule of law.  相似文献

ABSTRACT

This article explores the deliberative costs incurred when political parties rely on strict discipline to attain unity. I begin with a brief discussion aimed at clarifying the notion of strict party discipline. The second section explores how such discipline affects the formation, expression and reception of dissenting views. In the third section, I go on to outline two approaches towards deliberation in Parliament: the epistemic approach and the political justification approach. I argue that the impact of strict party discipline on dissenting views entails costs on legislative deliberation conceptualised in either way. The fourth section highlights how intra-party deliberation could potentially mitigate the deliberative costs outlined in this article. Finally, I turn to the implications of my analysis for assessing party discipline, and then I take a closer look at the case of India’s anti-defection law, demonstrating why the deliberative costs outlined in this article are particularly severe there.  相似文献

ABSTRACT

This article considers the features of intergovernmental relations (IGR) on immigrant integration in Belgium and critically examines the dynamics that shape them. The characteristics of IGR on immigrant integration in Belgium are shown to vary over time and differ across regions and sub-policy areas (immigrant reception policies and anti-discrimination). The comparative case study indicates that the primary traditional theses of the international comparative IGR literature, namely classical institutionalism and party politics, do not provide insights into the nature and mechanisms of IGR on immigrant integration in Belgium. Less established variables like European integration and sub-state claims for distinctiveness constitute key explanatory variables. While European integration explains the increase of IGR over time, notwithstanding the appearance of party incongruence, sub-state claims for distinctiveness enlighten the more conflictual nature of IGR with Flanders, even in cases of more party congruence than for Francophone authorities.  相似文献

ABSTRACT

The study of citizenship as a political or moral ideal involves identifying core commitments and capabilities, the cultivation and exercise of which is often presented as a condition of being a ‘good’ citizen. Deliberative democracy was, at least until recently, associated with a conception of citizenship that endorses those qualities that equip us for a certain kind of respectful and reflective dialogue. This article reappraises this conception in light of the so-called ‘systemic turn’ within deliberative theory. It shows how systems thinking has displaced the traditional conception of deliberative citizenship, but that theorists have so far not elaborated a satisfactory replacement. A pluralist model is thus proposed, which casts light on the diverse qualities that a range of actors in a deliberative system might require. The resulting argument is not merely of interest to deliberative theorists, but to all who are concerned with the ethics of citizenship. The main reason is that it displaces the entrenched notion of a ‘good citizen’, in favour of the more heterogenous ideal of a ‘good citizenry’.  相似文献

Among the parties emerging from the ‘new social movements’ in Western Europe, the German Green Party represents the most successful of the ‘new type’ parties so far. This article surveys the salient features of the party, its programme, strategy and organisational structure, showing the problems the party faces in all three respects. This article offers a critique of the optimism generated by the new political culture of ‘European citizenship’ based on a historical analysis of the content and utilisation of citizenship laws in pre‐ and post‐reunification Germany. It argues that even if nationality ceases to be a barrier for democratic governance in a consolidated Europe, this development is likely to affect primarily those who are already citizens of a Member State residing in another Member State. The argument made here is supported by the case of ‘guest workers’ in Germany. Although there is growing evidence that especially the Turkish population in Germany enjoys a vast array of civil, social and locally defined political rights, their franchise beyond the ‘limits of citizenship’ does not alleviate larger impacts of the formalised cultural memory of who qualifies to be a German. The most‐documented example of the persistent strain of genealogy‐based nationalism in Germany is the admission and naturalisation policies applied to the ‘returning’ ethnic Germans from neighbouring states. Based on a comparative analysis of the historic treatment of ‘German’ versus ‘non‐German’ outsiders entering Germany, the article concludes that the still‐dominant definition of Germanness emphasising ancestral lineage (jus sanguinis) poses serious obstacles for the achievement of a civic/political self‐understanding in German society as well as in Europe at large.  相似文献

The Finnish electoral system has recently been changed to slightly increase proportionality, but nothing has been done to make cabinet alternatives more ‘identifiable’ before the election. This outcome poses a major puzzle for one important theoretical approach to electoral system change. This approach sees normatively ‘unbalanced’ systems as vulnerable to reform and would have expected a significant increase in the pre-electoral identifiability of competing cabinet options. The article explains the Finnish case by embedding it in a comparative model of normative tradeoffs in democratic design. Based on Finnish case evidence and a statistical analysis of 100 elections in 32 democracies (from 2001 to 2011), the article argues that the type of democracy exemplified by Finland is not normatively unbalanced. In particular, the lack of pre-electoral identifiability is compensated for by an unconstrained multidimensionality of partisan preferences. While it may be true that normatively balanced designs are more stable, there is more than one way to be balanced.  相似文献
