新刑事诉讼法视阈下诱惑侦查的理性运用

诱惑侦查是实践中经常运用的一种侦查方式,由于诱惑侦查没有明确的法律地位以及在实施过程中伴随着侵犯人权的风险,导致诱惑侦查的争议不断。随着新刑事诉讼法的出台,尊重和保障人权作为一条基本原则出现,在诱惑侦查的使用过程中如何平衡惩罚犯罪与保障人权之间的关系成为一大难题。因此,只有根据新刑事诉讼法的相关规定来研究诱惑侦查的法律规制,才能致使诱惑侦查有效打击犯罪的同时又不致侵犯人权。     

关于侦审合一的思考

《刑事诉讼法》对公安机关的侦查、预审职权做了明确的规定 ,分别规定了侦查、预审的任务 ,确认了侦审分立。刑侦体制改革中实行侦审合一 (又称“侦审一体化”) ,与法律规定相悖 ,没有认真借鉴历史经验 ,影响了办案质量 ,弱化了公安机关内部的监督与制约。仍应实行侦查与预审分立制度。     

论诱惑侦查的法律规制

诱惑侦查作为非强制侦查手段之一受到很多学者的关注。学界更多的是关注这一侦查手段合法性的研究与争论 ,较少有人关注实施诱惑侦查的具体法律规制的问题 ,这一问题在侦查实践中非常重要 ,有必要规范和制订诱惑侦查的适用条件、适用范围、侦查主体和审批程序以及诱惑侦查使用不当的法律后果。     

公安机关刑事执法中刑事和解制度若干问题研究

公安机关刑事执法的核心就是刑事案件的侦查,在侦查阶段能否适用刑事和解制度一直存在着较大争议,反对者认为刑事和解在侦查阶段没有存在的法律空间,与公安机关的法定职权不符,并容易导致公安机关权力滥用。但侦查阶段适用刑事和解有利于及时化解社会矛盾,并有其自身的优势,更是构建和谐社会的要求。法律上的障碍可以通过立法来解决。目前侦查阶段刑事和解的案件适用范围主要是侵犯个人人身和财产法益的犯罪、犯罪人主观恶性较小的轻罪案件,以后可以扩展到严重的刑事犯罪。公安机关适用刑事和解不能忽视调查取证,应注意对话基础上赔偿协议的达成,同时也要改变和完善目前的执法考核指标体系。

悬赏通告是法律赋予公安机关侦破刑事案件的侦查手段之一,个人悬赏缉凶行为有侵犯侦查权的嫌疑,易侵犯公民的隐私权,实践中应增强公安机关的公力救济,完善悬赏制度。

诱惑侦查作为一种特殊的侦查形式,法律上并无相应的规定.实践中存在"犯意诱发型"和"提供机会型"二种具有不同特征类型的诱惑侦查,可以从作用对象、主观方面、行为强度三个方面来区分这二种类型,使用"犯意诱发型"诱惑侦查手段具有违法性,会引起法律后果;"提供机会型"并不违法,可以使用.
