Contemporary commercial cremation is a reductive taphonomic process that represents one of the most extreme examples of postmortem human alteration of bone. The thorough reduction and fragmentation of cremated human remains often leaves little biological evidence of diagnostic value. Instead, non-osseous artifacts often provide the best evidence of the origin of the cremated remains, the identity of the decedent, and commingling of the remains of more than one individual. Once human remains have been cremated they are most commonly placed into a processor and reduced into small fragments and fine ash suitable for inurnment or scattering. The type of processor determines the size and utility of the particulates and artifacts available for analysis. The newest type of processors have changed the manner and degree of postmortem bone modification and altered the preservation of diagnostic bone fragments and cremation artifacts. This paper addresses the impact of the newest cremation procedures on forensic analysis of cremated remains.  相似文献

Following the death of 16 inhabitants of a nursing home within a period of 2 weeks, the prosecution ordered legal autopsies in all of the cases, which had not yet been buried or cremated, suspecting a neglect of nursing or active euthanasia respectively. Two out of a total of ten cases revealed drug overdoses which could have explained death. However, due to concurring causes of death, the evidence could not be furnished with adequate security. In the present case, the examinations helped--already in a preliminary stage of the investigations--to prevent the authorities from more expensive proceedings as well as the respective nursing home from being unjustly suspected of having committed a criminal offense.  相似文献

Human cremation is a common funeral practice all over the world and will presumably become an even more popular choice for interment in the future. Mainly for purposes of identification, there is presently a growing need to perform trace analyses such as DNA or stable isotope analyses on human remains after cremation in order to clarify pending questions in civil or criminal court cases. The aim of this study was to experimentally test the potential and limitations of DNA and stable isotope analyses when conducted on cremated remains.For this purpose, tibiae from modern cattle were experimentally cremated by incinerating the bones in increments of 100 °C until a maximum of 1000 °C was reached. In addition, cremated human remains were collected from a modern crematory. The samples were investigated to determine level of DNA preservation and stable isotope values (C and N in collagen, C and O in the structural carbonate, and Sr in apatite). Furthermore, we assessed the integrity of microstructural organization, appearance under UV-light, collagen content, as well as the mineral and crystalline organization. This was conducted in order to provide a general background with which to explain observed changes in the trace analyses data sets. The goal is to develop an efficacious screening method for determining at which degree of burning bone still retains its original biological signals. We found that stable isotope analysis of the tested light elements in bone is only possible up to a heat exposure of 300 °C while the isotopic signal from strontium remains unaltered even in bones exposed to very high temperatures. DNA-analyses seem theoretically possible up to a heat exposure of 600 °C but can not be advised in every case because of the increased risk of contamination. While the macroscopic colour and UV-fluorescence of cremated bone give hints to temperature exposure of the bone's outer surface, its histological appearance can be used as a reliable indicator for the assessment of the overall degree of burning.  相似文献

Dissolving bodies is a current method of disposing of human remains and has been practiced throughout the years. During the last decade in the Netherlands, two cases have emerged in which human remains were treated with acid. In the first case, the remains of a cremated body were treated with hydrofluoric acid. In the second case, two complete bodies were dissolved in a mixture of hydrochloric and sulfuric acid. In both cases, a great variety of evidence was collected at the scene of crime, part of which was embedded in resin, polished, and investigated using SEM/EDX. Apart from macroscopic findings like residual bone and artificial teeth, in both cases, distinct microscopic residues of bone were found as follows: (partly) digested bone, thin‐walled structures, and recrystallized calcium phosphate. Although some may believe it is possible to dissolve a body in acid completely, at least some of these microscopic residues will always be found.  相似文献

On January 31, 2000, Dr. Harold Shipman was convicted at Preston, England, of murdering 15 of his patients by administering lethal doses of diamorphine (pharmaceutical heroin). Investigations indicate that, during his working life, he killed about 220 to 240 of his patients. The bodies of many victims were cremated. Twelve victims were exhumed, and 9 of these deaths were included in the indictment. Most victims were elderly and had histories of natural disease. Autopsies confirmed known natural disease but showed no evidence of acute lethal events. Analysis of skeletal muscle disclosed significant quantities of morphine, to which the deaths were attributed. Circumstantial evidence was strong, as illustrated by the convictions in 6 deaths without autopsy or toxicology, because the bodies had been cremated. Organic compounds are remarkably stable in buried bodies. Even so, detection and quantitation of morphine in exhumed bodies may become problematic after burial for 4 years or more. Morphine glucuronide is slowly converted back to free morphine in the buried corpse.  相似文献

Title 9, Chapter 19, Article 3 of the Arizona Administrative Code requires all bodies that are to be cremated must have the death certificate reviewed by a county medical examiner. In Tucson, AZ, and surrounding Pima County, all cremation requests are submitted to the Forensic Science Center, where the death certificates are reviewed by one of 5 board-certified forensic pathologists. In 2002, there were 5557 cremation requests, and in 2003 there were 5662 cremation requests. Of these requests, 670 (12.1%) and 447 (7.9%) death certificates were flagged for further investigation in 2002 and 2003, respectively. Eventually, 47 cases (0.8% of total, 7.0% of flagged cases) were accepted as medical examiner cases in 2002, and 43 cases (0.8% of total, 9.6% of flagged cases) were accepted as medical examiner cases in 2003. In 2002, the majority of cases were handled as a records review; however, 4 cases were brought in for autopsy and 1 was certified after an external examination only. In 2003, all cases were certified via a records review. The manner of death in all but 3 of these deaths was certified as accident, with complications of remote trauma being the most common proximate cause of death. The 3 most common injuries were complications of fractured pelvis or femur (15 in 2002, 22 in 2003), head injury due to fall (18 in 2002, 8 in 2003), and complications of remote motor vehicle accident (3 in 2002, 6 in 2003). The other 3 deaths included 2 homicides, 1 in each year, and 1 suicide in 2003.  相似文献

A case of death due to car fire is described where the carbonised skull of the cremated corpse showed an ovoid defect of the cranial bone. The question arose whether this formed fracture was caused by a gunshot. But the reconstruction of the cranial remains with detached parts of the tabula externa provided evidence that the suspicious defect was to be classified as an uncommon heat-induced post-mortem artefact.  相似文献

Two experiments were performed to test the relevance of bryophyte (Plantae, Bryophyta) material for forensic studies. The first experiment was conducted to reveal if, and how well, plant fragments attach to footwear in general. In the test, 16 persons walked outdoors wearing rubber boots or hiking boots. After 24h of use outdoors the boots were carefully cleaned, and all plant fragments were collected. Afterwards, all plant material was examined to identify the species. In the second experiment, fresh material of nine bryophyte species was kept in a shed in adverse conditions for 18 months, after which DNA was extracted and subjected to genotyping to test the quality of the material. Both experiments give support for the usability of bryophyte material in forensic studies. The bryophyte fragments become attached to shoes, where they remain even after the wearer walks on a dry road for several hours. Bryophyte DNA stays intact, allowing DNA profiling after lengthy periods following detachment from the original plant source. Based on these experiments, and considering the fact that many bryophytes are clonal plants, we propose that bryophytes are among the most usable plants to provide botanical evidence for forensic investigations.  相似文献

Analysis of DNA from burnt bone fragment is the very hard work for the human identification in forensic casework. In general, cremated bone with an artificial damage is more difficult to get an intact DNA than a singed one because of the chemical and biological drastic changes such as protein denaturation and destruction. In this study, we pursue the best technical approach for the minimal damage and the contamination of DNA from other factors in the preconditioning and the extraction process based on over 70 years old Korean War victim skeletal that was burnt and buried in Korean Peninsula. First of all, we removed the pollutant and the dust from the burnt bones using dental instruments, and then incubated with EDTA buffer at 25 ℃ to remove inhibitors such as calcium and mineral. In order to compare the DNA preservation ability between a pellet and a supernatant, samples are repeatedly tested to collect washed EDTA buffer several times to separate. Each of isolated materials is secondly cleaned with the organic extraction method using phenol and analyzed mtDNA sequence with the in-house method for the ancestry assay. The better discrimination ability was appeared in the supernatant than the pellet. Nevertheless, many of the forensic geneticists use a powdering method for getting more DNA, we applied EDTA buffer in the preconditioning step to eliminate every contamination. As a result, the contamination factor was efficiently removed and the ancestry was estimated as per the written information. Consequently, cremated bone is identified to belong in the D4 mtDNA haplogroup which is commonly reported in ethnic groups in Asia especially Korea. This is a preliminary study of a human identification over an ancestry analysis to give information against a mass disaster in a future. Through a higher process optimization and better analytical methods toward more remains, which are genetically difficult to analyze, will support to examine the identity of the post cremated remains.  相似文献

Proton-induced X-ray emission (PIXE) is a spectroscopic technique that provides the researcher with the elemental composition of a given target material. In this paper, we illustrate the utility of PIXE analysis in two forensic contexts: (1) case of cremation in which the nature of the remains is questioned and (2) cases of death by gunshot wound. In the first case, elemental analysis by PIXE reveals that the purported cremated remains are not bone. The last two cases show that radiopaque metallic residue embedded in bone is composed of lead from a projectile.  相似文献

The transfer of materials between victim and perpetrator was first reported by Locard in the nineteenth century. While in recent years DNA testing has been very successful in matching biological material from crime scenes to perpetrators, the following cases demonstrate that other more time‐honored methods remain useful. Two cases of lethal assault are reported where the victims had bitten their assailants resulting in fragments of the perpetrators’ skin being wedged between their teeth which were discovered during post mortem oral examinations. As the fragments were able to be matched to injuries in the perpetrators, identification was established prior to confirmatory DNA testing. In case 1 a criminal conviction for manslaughter resulted, and in case 2 the identity of the assailant was confirmed. Examination of a properly exposed and illuminated oral cavity may provide useful evidence in assault cases. These cases represent an unusual dental variant of Locard's principle.  相似文献

Analyzing and identifying skeletal remains becomes increasingly difficult when remains have been cremated, especially in cases where the cremated material may have been intentionally contaminated with nonskeletal material. This study examined the potential of X‐ray fluorescence spectrometry (XRF) to detect the presence of nonskeletal contaminants in samples of cremains. Eleven samples of cremains were variably combined with concrete mix and analyzed using XRF. Photon counts of elements in each sample were analyzed, and the coefficient of determination (R2) using unweighted linear regression as a function of percent cremains was calculated. Results showed that with changes in the proportion of skeletal material and contaminant, there were significant (R2 > 0.90) changes in detected levels of phosphorus, potassium, zinc, aluminum, and sulfur. The use of XRF is concluded to be a valid approach in the identification of the presence of nonskeletal material in potentially contaminated cremains.  相似文献

The reduction of modern commercially cremated remains into a fine powder negates the use of traditional methods of skeletal analysis. The literature on the use of cremains weight for estimating aspects of the biologic profile is limited, often with conflicting results. This study re-evaluates the value of weight in the assessment of biologic parameters from modern cremated remains. A sample of adults was collected in northern California (n = 756), with a cremains weight averaging 2737.1 g. Males were significantly heavier than females (mean = 3233.2 g versus mean = 2238.3 g, respectively; p<0.001). Comparison of this sample with other previously reported samples from southern California, Florida, and Tennessee indicates a consistent sex difference, with the most similar mean values to the Tennessee study. Although cremains weight decreases with age as expected, the relationship is weak; thus, cremains weight cannot accurately predict age-at-death. While sex estimation shows considerable accuracy (86.3% for males and 80.9% for females), sectioning points may be population specific.  相似文献

目的探讨肌红蛋白对挤压综合征肾功能损害的病理形态学改变及法医病理学诊断价值。方法应用EnVision(两步法)免疫组化方法和LSAB免疫组化方法,对22例生前有较广泛肌肉软组织损伤的人尸体肾脏组织(损伤组)进行肌红蛋白检测,12例无上述病史的人尸体肾脏组织作对照(对照组)。结果损伤组有8例肾远曲小管及集合管管腔管型染色呈阳性或强阳性,均见于伤后36h至10d死亡者;有7例近曲小管、远曲小管和集合管上皮腔缘附近的胞浆及腔面肌红蛋白阳性或强阳性,最早见于伤后8h死亡者,伤后24h至48h死亡者最为显著;余9例未见上述改变。对照组12例上述部位均为阴性。结论肌红蛋白管型堵塞肾小管和肌红蛋白对肾小管上皮的直接损害是挤压综合征肾功能衰竭的重要病理形态学基础,两者对挤压综合征的法医病理诊断均具有重要价值。  相似文献

The authors report two cases in which examination of foreign material embedded in or adherent to bullets provided critical information in the reconstruction of a crime scene. Analysis of small particles by scanning electron microscopy (SEM) and energy dispersive X-ray analysis (EDXA) can be accomplished without destruction or injury of the particles. In one case, the detection and identification of mineral fragments embedded near the nose of a bullet provided conclusive evidence that the bullet had ricocheted from a fireplace before striking the victim. In the second case, analysis of particles from two bullets identified them as them as bone fragments, thus proving which shots fired from a police officer's gun had killed a suspected burglar. SEM-EDXA has not been widely used to identify such material on bullets, but should be considered a potentially powerful tool in forensic science.  相似文献

Due to their widespread use in domestic and commercial premises, polyurethane foams, as either fragmented or bulk foam, are types of evidence commonly found at crime scenes. The traditional approach to determining the evidential value of polyurethane foam (PF) involves comparing recovered and control fragments under low and high magnification, under various lighting conditions, as well as the comparison of their respective dye spectra. As with most forms of trace evidence, chemical comparison is also desirable. In this work, two approaches to chemically comparing foam fragments were investigated, i.e. inductively coupled plasma–optical emission spectrometry (ICP–OES) analysis of the Tin (Sn) content in different foam types; and gas chromatography–flame ionization detection (GC–FID) analysis of soluble components in PFs mobilized by dichloromethane. Seven different foam types were studied and their Sn content was found to be different. They also produced characteristic GC–FID chromatographic profiles whose compounds were identified with gas chromatography–mass spectrometry (GC–MS) analysis. This study suggests that incorporating chemical data obtained from GC–FID/GC–MS and ICP–OES into a case involving PF could be advantageous, as this will enable the forensic scientist to broaden the comparison between control and recovered fragments, and further assess the strength of the evidence. However, ICP–OES analysis is a destructive technique with a relatively short sample turnaround time, whilst GC–FID analysis is more time-consuming and non-destructive, requiring corroboration with GC–MS data. The values of these two analytical techniques in the forensic chemical characterization of PFs are discussed.  相似文献

This article examines trademark parody in statutory and mass media case law by, in part, analyzing several key cases which illustrate the use of quantitative social science research in the determination of trademark parody infringement. Although the definition and nature of trademark parody has not been settled definitively, courts’ attitudes toward survey evidence, particularly its probative value and materiality in the determination of copyright and trademark infringement litigation, have evolved over time. Courts now admit survey evidence if it meets certain methodological conditions. In trademark parody litigation, survey evidence pointing to a “likelihood of confusion” has evolved as the standard test of trademark infringement. However, there are questions whether vague, subjective concepts like “a likelihood of confusion” and “perception of substantial similarity” between trademarks can be adequately measured by consumer surveys. It is argued that multi‐method research which has both quantitative and qualitative aspects would provide more reliable data than the “one‐shot” surveys or case studies that are widely used in settling trademark infringement cases.  相似文献

In spite of increasing number of cremations in the U.S., little is known about weights of cremated remains. This research was undertaken in order to add to the limited literature on cremains weights and to explore variation. Weights of cremated remains were obtained from the East Tennessee Crematorium. The sample consists of 151 males and 155 females. Age, sex, and race were obtained for each individual. Males are about 1000 g heavier than females. Both sexes lose weight with age, but females lose weight at about twice the rate of males. East Tennessee cremation weights were compared with those from Florida reported by Warren and Maples, and those from Southern California reported by Sonek. East Tennessee results were also compared with an earlier study on ash weight of anatomical human skeletons carried out by Trotter and Hixon. East Tennessee cremations weigh about 500 g more than the samples from Florida and California, and about the same as the earlier anatomical samples. We hypothesize that variation reflects variation in body weight and activity. This variation must be taken into account when cremation weights are at issue.  相似文献

Abstract

In the course of a trial, the main task that every judge or juror has to face concerns the evaluation of various pieces of evidence from a variety of different sources, with the aim of integrating such data into a single, final verdict. Algebraic models have tried to explain and predict decisional paths by identifying formal, mathematical combinatory rules. The aim of the present research was to test two main integration information models, namely adding and averaging, when combining items of judicial evidence. In the first study, we investigated how the probability of guilt varied as a function of the value of the pieces of evidence and information presented, in legal and not legal professional samples. In the second study, we analysed combinatory rules with more complex and realistic experimental material. Results indicated that participants summed the values of pieces of evidence in a linear fashion when they had to provide estimates of guilt. We found evidence of an adding rule among both legal and not legal professionals as well as in simple and more complex judicial cases, thus providing even stronger support for the use and the generalization of a summative model. Theoretical and practical implications are discussed.  相似文献

Three cases are presented where fatal puncture wounds caused by broken glass were very similar to stab wounds inflicted by a knife with a single-edged blade. Thus, all three cases caused a murder investigation to be initiated. It could only be determined that these wounds had been caused by glass after a detailed forensic autopsy. In two of the three cases, the only evidence for this was the identification of glass fragments in the wounds. The importance of X-ray examinations is underlined because modern glass in common use is radiopaque. Glass fragments lodged in the wounds can reduce the loss of blood and thus, prolong the capacity to act despite severe injuries.  相似文献
