Although parental compliance with court orders in child welfare cases is key to achieving physical parent‐child reunification and successful case closure, little research has examined how parent‐child relationship‐focused rehabilitative services uniquely influence case outcomes. This project fills this gap by investigating links between court ordering of and parental participation in Child‐Parent Psychotherapy (CPP) with court outcomes. Data were obtained from court records of 448 court‐involved parents. Hierarchical regressions revealed that greater participation in CPP led to reunification and successful case closure but not faster case closure. Courtroom professionals should consider parent‐child relationship‐based therapies as tools for achieving child welfare goals.  相似文献

In recent years, there has been much discussion within international fora about the need for a greater consensus on how to approach relocation cases. Empirical research on the lived experience of parents and children who have been through relocation disputes has an important role to play in providing an evidence base for decisions on policy. In this article, we summarize the findings of a 5‐year prospective longitudinal study of relocation disputes in Australia and make recommendations in the light of this and other research evidence concerning a new approach to relocation law. We argue that there should be no presumptions. Nonetheless there is an appropriate place for legislative or appellate guidance on how to approach these disputes. “Good faith” should be irrelevant to decision making, and children should not be placed in the center of the conflict. The adjudication of relocation disputes should be on the basis of asking three questions: First, how close is the relationship between the nonresident parent and the child and how important is that relationship developmentally to the child? Second, if the relocation is to be permitted, how viable are the proposals for contact with the nonresident parent? Third, if the relationship between the child and the nonresident parent is developmentally important to the child and is likely to be diminished if the move is allowed, then (a) what are the viable alternatives to the parents living a long distance apart? and (b) is a move with the primary caregiver the least detrimental alternative?

This article explores the issue of visitation between a child and parents in the context of child protection proceedings, addressing the following areas: 1) the importance of visitation in the context of family reunification; 2) the results of an informal study of visitation practices in several jurisdictions; 3) the law relating to visitation in child protection proceedings; 4) some best practices that have been identified by commentators; 5) the role of the judge regarding visitation issues; and 6) some recommendations for judges and court systems regarding visitation. The article concludes that visitation between a child and her parents often occurs too infrequently; as a result, the relationship between the child and parents can be damaged, the child can suffer further trauma, and the chances for successful family reunification may be reduced. Finally, judges and social service agencies can and must improve both the quality and quantity of parent‐child visitation.  相似文献

Mental health professionals frequently respond to requests for clinical information on parents in child protection cases; however, little data exist on the issues precipitating requests or on the controversial practice of offering “ultimate issue” recommendations in forensic clinical reports. We investigated 243 requests for clinical information on parents and 204 clinician reports submitted for use in child abuse and neglect proceedings in a large, urban juvenile court system. We coded 56 objective and qualitative characteristics regarding referral questions, pending legal issues, and four levels of recommendations. We found that the most common referral questions related to service planning, parenting ability, and/or parents' mental health functioning, and the most common pending legal issues were selection or change of a permanency goal and visitation arrangements. Levels of recommendations varied with type of legal decision, in that clinicians always offered direct recommendations for narrow, statute‐based issues (e.g., termination of rights, adoption) and less so for other issues. Community‐based evaluators were more likely to offer direct recommendations than court‐based clinicians. Based on the findings, we offer practice recommendations and directions for further research in forensic parenting assessment.  相似文献

Most research and clinical data dealing with child sexual abuse have focused on adult offenders (usually a parent or relative) and their child victims. More recently, however, the data are beginning to show that a sizeable number of these sexual encounters are being committed by juvenile offenders. Thus, parents and members of the helping professions are beginning to see that what had previously been labeled sexual experimentation may be more serious. Using 37 cases drawn from the files of a local Children and Family Service agency that met the study definition of a juvenile sexual offense, data are reported on the following variables: the age difference between the victim and the offender, the relationship between victim and offender, the act involved, the context in which the act occurred, the pattern of the sexual contact, problems the offender exhibited that may have resulted from the sexual encounter, and general demographic data about the offender's family.  相似文献

Over 70,000 children are ‘looked after’ by local authorities in England and Wales. Emerging research suggests that a significant proportion of their birth parents have either already lost a child to permanent adoption or will go on to lose others. These ‘repeat loss’ cases raise difficult questions about marginalized mothers and their reproductive autonomy. This article considers past and present tactics used by the state in its attempts to limit that autonomy, including institutionalization, sterilization, long‐acting contraception, and permanent adoption. It argues that the gradual democratization of intimate citizenship over the past century, defined as a person's ability to choose and direct their intimate relationships, has obliged the contemporary state to develop new tactics which aim to build personal capacity and to balance enhanced child protection with enhanced reproductive autonomy.  相似文献

Throughout the country, there is considerable inconsistency in how states regulate residential treatment programs for youth. In states with little oversight, the health and safety of youth are unprotected and they may be subject to substandard treatment, rights violations, and/or abuse. Three initiatives to address this issue are reported: (1) an Internet survey of youth who are former residents, (2) a four‐state pilot study of how states regulate and monitor residential programs, and (3) a bridge‐building conference between residential treatment providers and mental health leaders. Recommendations address the next steps for lawmakers, lawyers, judges, mental health and education professionals, and parents.  相似文献

This study compared outcomes over 1 year for two groups of separated parents, who attended two different forms of brief therapeutic mediation for entrenched parenting disputes. The two interventions each targeted psychological resolution of parental conflict, enhanced parental reflective function, and associated reduction of distress for their children. The child‐focused (CF) intervention actively supported parents to consider the needs of their children, but without any direct involvement of the children, while the child‐inclusive (CI) intervention incorporated separate consultation by a specialist with the children in each family, and consideration of their concerns with parents in the mediation forum. Repeated measures at baseline, 3 months, and 1 year postintervention explored changes over time and across treatments in conflict management, subjective distress, and relationship quality for all family members. Enduring reduction in levels of conflict and improved management of disputes, as reported by parents and children, occurred for both treatment groups in the year after mediation. The CI intervention had several impacts not evident in the other treatment group, related to relationship improvements and psychological well‐being. These effects were strongest for fathers and children. Agreements reached by the CI group were significantly more durable, and the parents in this group were half as likely to instigate new litigation over parenting matters in the year after mediation as were the CF parents. The article explores the potential of CI divorce mediation to not only safely include many children in family law matters related to them, but also to promote their developmental recovery from high‐conflict separation, through enhanced emotional availability of their parents.  相似文献

In child custody cases, courts will look to the best interests of a child to maintain visitation/custody rights only with the child's biological parent, not third parties. However, with a same‐sex couple, it is inevitable that one parent will not be the biological parent. Thus, when that parent is in a mini‐DOMA state, where same‐sex couples from non‐mini‐DOMA states do not have to be recognized, that parent will be viewed as a third party and lose all visitation/custody rights if the couple separates. This note advocates that mini‐DOMAs allow both the biological and nonbiological parents of a same‐sex couple to have visitation/custody rights of their children if it would be in the best interest of the children to do so.  相似文献

Parent–child contact problems may arise in the context of high conflict separation/divorce dynamics between parents. In cases where there are parent–child contact problems and children resist or refuse contact with one of their parents, there may also be incidents of child maltreatment, intimate partner violence, or compromised parenting that can be experienced by a parent or child as traumatic. The circumstances around separation and/or post‐divorce often result in intense stress for families. In this paper we distinguish between the stressful circumstances that may arise as a result of high interparental conflict and pulls for alignment from a parent, and the real or perceived trauma as a factor which contributes to resistance or refusal of a child to have contact with a parent. Interventions to address both trauma responses and the resist‐refuse dynamics are differentiated and discussed. After screening and assessment, the intent is to treat trauma responses with short‐term, evidence‐based therapy, either before or concurrent with co‐parent and family intervention.  相似文献

Several interventions have been developed to address children's resistance and/or refusal to have contact with a parent following separation and divorce. There remains little agreement about how best to evaluate the success of these approaches. To explore the experiences of parents in the Overcoming Barriers Program (OCB), an online survey was distributed to all previous participants. Of the 40 parents who completed the survey at least six months after attending OCB, findings suggest mixed results. Benefits of OCB were more pronounced when changes were made to the coparenting relationships. Improvements in the coparenting relationship were specifically related to children's spending more time with both parents and better parent–child outcomes postintervention. Findings suggest that both the quality of parent–child relationships and the time that the children spend with both parents are associated with reported improvements in the cooperative coparenting relationship as a result of attending OCB. Implications are discussed in terms of lessons learned for developing, delivering, and evaluating similar programs for strained parent–child relationships.  相似文献

Based on in‐depth interviews with thirty‐eight individuals on the front line of child welfare (educators, mothers, and child protection workers) this study analyzes the attitudes behind educators' acknowledged noncompliance with mandatory reporting of child abuse and neglect by teachers. Regulatory theory posits that “compliance” is affected by a mix of sanctions, capacity, motivation, and the perceptions of legitimacy and moral purpose associated with particular rules. Paradoxically, while the educators in this study were knowledgeable and supportive of the rule in principle, their accounts of reporting decision making were highly contextualized and ambivalent. The interview data suggests that existing theories of compliance may be usefully supplemented with an explicitly relational approach that better accounts for decision making in the contexts of care and dependency that characterize regulatory fields of human services such as education and child welfare.  相似文献

This paper describes how supervised visitation programs in Florida rapidly transitioned from in‐person supervised visits to virtual, online visits during the COVID‐19 pandemic to protect the health of families and staff. Structured telephonic interviews and an online survey revealed that although most program directors had not previously developed guiding policies or hosted such visits, within weeks they were providing hundreds of online “virtual visits” between children and their non‐custodial parents to maintain the crucial parent–child relationship in a safe manner. Vignettes from this data provide lessons regarding parent and child reactions to virtual visits, advantages and disadvantages of virtual visits from the programs' perspectives, and levels of enthusiasm for using virtual visits going forward. In addition, the data includes recommendations for new program guidelines and protocols for the ongoing use of virtual visits. Although it is too early to call these policies best practices, the study does offer insight into the challenges and opportunities afforded by virtual visits and can inform disaster planning that supervised visitation programs develop to prepare for inevitable future disruptions in services to families.  相似文献

When children are exposed to violence, interventions require the assessment of parents. Whether parents can create a safe environment, are able to hear their children's story of their exposure, and then can help them move forward in healthy life patterns, must be evaluated. When safety is established, treatment of parents must be focused on how the parent can enhance the child's sense of security and empathic connection. Assessment must identify the red flags that suggest a need for more intensive work with the parent to address these issues, before specific work with the child begins. Treatment can utilize the parent's best wishes for their child to help motivate parents do the work needed for their own and their children's recovery.  相似文献

It is increasingly common that children of divorce are geographically separated from one of their parents. This article considers the challenges that arise from that reality by exploring this problem from a variety of perspectives and by providing practical tips to minimize the impact of the distance. A review of the Ontario caselaw and Arizona Guidelines reveal that certain factors are important in the resolution of these disputes, including: the age of the child, mode of transportation between homes, distance, prior contact, and feasibility of virtual access. Court‐ordered access may include remedies that, absent the distance issue, may be considered extreme, including moving to overnight/extended access periods for young children, permitting children to travel unaccompanied, favoring the nonresident parent for holidays and vacation time, allowing children to decrease contact with the nonresident parent, and decreasing or terminating child support. Where distance dictates the in‐person and virtual access schedules, creative solutions are critical to the successful resolution of these cases. Forward thinking family law professionals can meaningfully help parents to achieve better outcomes for children.  相似文献

Juvenile delinquency courts in the United States generally require parents to attend all court hearings, but little is known about how parents' experiences in the court process affect their discussions of the justice system with their court‐involved children. Using multiperspectival and longitudinal data combining observations with interviews of parents and youth in two courts, this research finds that many parents discuss the legal process in negative terms with their children when parents are outside the presence of legal authorities. This research adds to the literature on legal socialization by examining how parents' perceptions of law and their experiences with the court become part of the socializing content provided by parents to their court‐involved children. Creating a more meaningful role for parents in the juvenile justice process may potentially lead to more positive discussions of the court process between parents and juvenile defendants.  相似文献

In recent decades, parents and youth involved in the child welfare and foster care systems have created myriad ways to have their voices heard and their concerns appreciated, including through collective self‐advocacy efforts. New forms of individual and communal advocacy have emerged, including with supportive professionals, that acknowledge the centrality of parents and youth in every decision being made about their lives and about the systems that control their lives. Nevertheless, studies of youth and parent engagement identify the numerous individual and systemic barriers to meaningful participation and self‐advocacy efforts and the challenges to overcoming those barriers. This essay explores how empowered parents and youth can surmount those barriers with the assistance of their professional allies. Ultimately, this individual and communal engagement will strengthen a family‐oriented child welfare system and a more responsive government in these uncertain times.  相似文献

One of the greatest challenges that parents face in child protection mediation (CPM) is to voice their concerns and negotiate on a relatively equal basis with the other mediation participants. This article considers how imbalances of power, limited confidentiality protection, and the personal problems that bring parents into the child protection process can limit a parent's ability to exercise self-determination in mediation and offers guidance for mediators seeking to conduct CPM in a manner that effectively empowers parents to meaningfully and collaboratively participate in mediation.  相似文献

This article studied the relations of children's mental health problems to the warmth of their relationship with their noncustodial father and custodial mother and the level of conflict between the parents. Using a sample of 182 divorcing families, multiple regression was used to test the independent effect of father warmth, mother warmth, and interparental conflict. Results indicated that father warmth and mother warmth were both independently related to lower child‐externalizing problems. However, the relations between mother and child warmth and child‐internalizing problems were different as a function of interparental conflict and level of warmth with the other parent. Implications for court practices and policies are discussed.  相似文献

A parent's right to maintain a relationship with his/her child lies within the Fourteenth Amendment of the U.S. Constitution; however, this right does not apply to every type of parent. Although the U.S. Supreme Court granted same‐sex couples the right to marry, they still face parental rights issues when their child(ren) are nonbiological or nonadoptive because they lack standing for custody and/or visitation as de facto parents. Moreover, the rise of nontraditional same‐sex‐couple families has been placing states in a predicament, and the lack of uniform rights for de facto parents creates great inconsistency across the United States. The creation of a uniform statute with specific elements distinguishing de facto parents from mere caretakers will grant same‐sex nonbiological parents standing and create uniformity across the United States.  相似文献
