Collaboration plays a key role in crafting good public policy. We use a novel data set of over 140,000 pieces of legislation considered in US state legislatures in 2015 to examine the factors associated with women's collaboration with each other. We articulate a theory that women's collaboration arises from opportunity structures, dictated by an interaction of individual and institutional characteristics. Examining the effect of a combination of characteristics, we find support for an interactive view of institutions, where women's caucuses accelerate collaboration in Democratic‐controlled bodies and as the share of women increases. Collaboration between women also continues in the face of increased polarization in the presence of a caucus, but not absent one. Our findings speak to the long‐term consequences of electing women to political office, the importance of institutions and organizations in shaping legislative behavior, and the institutionalization of gender in politics.  相似文献

This article offers the first broad‐based, systematic, times‐series assessment of the gender dynamics underlying congressional retirement. We extend the body of work on gender and representation by using the congressional retirement literature to develop an argument that accounts for the gender gap in the average length of congressional service. Our results indicate that women are less willing than men to remain in Congress when their ability to influence the legislative agenda stalls. Because of women's relatively early departures from the House of Representatives, our analysis suggests that prospects for women's representation are less promising than the conventional wisdom suggests.  相似文献

In this paper, I argue that Habermas' proceduralist model of law can be put to feminist ends in at least two significant ways. First, in presenting an alternative to the liberal and welfare models of laws, the proceduralist model offers feminism a way out of the equality/difference dilemma. Both these attempts to secure women's equality by emphasising women's sameness to men or their difference from men have placed the onus on women to either find a way of integrating themselves into existing institutions or to confront the so‐called question of women's difference. The proceduralist model renders this dilemma irrelevant. Instead, it proceeds from the fact of sexual difference; a fact that produces competing and conflicting needs and interests that require interpretation by both men and women. This, I argue, marks a change in the very way we conceptualise the so‐called problem of women's difference, insofar as the question is no longer framed in these terms. Second, I argue that this deliberative process over the interpretation of conflicting interests affects a fundamental shift in the nature of legal institutions themselves, insofar as law is no longer a vehicle for promoting male interests.  相似文献

Assumptions about gender role socialization dominated explanations for gender differences in responses to incarceration. We suspend these gender comparisons, which produced the focus on homosexuality and kinship networks in women's prisons, to determine how women's pre‐prison experiences, in the context of two different institutions, influence the way they “do time.” We analyze in‐depth interviews with a diverse sample of 70 female inmates housed in the California Institution for Women (CIW)—the oldest prison for women in the state—and Valley State Prison (VSP)—the newest prison for women. These two institutions differ in structure, size, and management philosophy, and accordingly necessitate the consideration of moderating situational effects. We use qualitative analysis to examine how women do time and to determine whether individual variations in doing time are similar across very different institutions.  相似文献

Legislatures worldwide are dominated by wealthy elites, who are often out of touch with the needs and problems of citizens. Research shows that the underrepresentation of the working class matters in terms of policy processes and outcomes. Yet the research on class has largely focused on blue‐collar representatives, who are primarily men. Working‐class women are more likely to hold pink‐collar jobs, or low‐status occupations dominated by women. We argue that pink‐collar legislators are uniquely positioned to legislate over education and social service policy. To test our argument, we combine a new coding of working‐class backgrounds that accounts for pink‐collar representation with state spending data on education and social services from US states over time. Modeling compositional budget data, we find that class and gender intersect to shape policy outcomes via state budget allocations, with women's pink‐collar representation associated with increased spending on both education and social services.  相似文献

We argue that partisan elected judges have an incentive to redistributewealth from out-of-state defendants (nonvoters) to in-stateplaintiffs (voters). We first test the hypothesis by using cross-statedata. We find a significant partisan effect after controllingfor differences in injuries, state incomes, poverty levels,selection effects, and other factors. One difference that appearsdifficult to control for is that each state has its own tortlaw. In cases involving citizens of different states, federaljudges decide disputes by using state law. Using these diversity-of-citizenshipcases, we conclude that differences in awards are caused bydifferences in electoral systems, not by differences in statelaw.  相似文献

The number of women in the legal profession has grown tremendously over the last 40 years, with women now representing about half of all law school graduates. Despite the decades‐long pipeline of women into the profession, women's representation among law firm partnerships remains dismally low. One key reason identified for women's minority presence among law firm partners is the high level of attrition of women associates from law firms. This high rate of female attrition undermines efforts to achieve gender equality in the legal profession. Using a survey of 1,270 law graduates, we employ piecewise constant exponential hazard regression models to explore gendered career paths from private law practice. Our analysis reveals that, for both men and women, the time leading up to partnership decisions sees many lawyers exit private practice, but women continue to leave private practice long after partnership decisions are made. Gender differences in leaving private practice also surface with reference to cohorts, areas of law, billable hours, firm sizes, and career gaps. Notably, working in criminal law augmented women's risk of leaving private practice, but not for men, while taking time away from practice for reasons other than parental leaves, hastens both men's and women's exits from private practice.  相似文献

Scholars often identify gerrymanders by examining changes to districts' partisan composition. However, advantages can also be gained by systematically varying the extent to which incumbents' constituencies remain the same. In this article, I examine the post‐2000 redistricting in 22 state legislatures. I find that parties, particularly in legislatures with low turnover levels, gain advantages from constituency manipulation, but that these advantages are counteracted by geographic redistricting regulations. Lastly, I find that ostensibly bipartisan outcomes nonetheless feature partisan constituency manipulation. These findings echo a growing literature that analyzes the geographic aspects of gerrymandering and highlight how turnover patterns motivate redistricting strategies.  相似文献

The Wheeler et al. (1982) data set of white-collar defendants is used to compare men's and women's socioeconomic profiles and occupations and the nature of their illegalities. The results show that a minority of men but only a handful of women fit the image of a highly placed white-collar offender. Most employed women were clerical workers, and most employed men were managers or administrators. Women were more likely to be nonwhite, less likely to have completed college, and owned less in economic assets. Men were more likely to work in crime groups and to use organizational resources in carrying out crimes, and their attempted economic gains were higher. Occupational marginality, not mobility, better explains the form of women's white-collar crime. The results raise questions about white-collar arrest data and the nature of crime and offenders in white-collar sentencing samples. They compel an investigation of the multiple injuences of gender, class, and race relations in generating varieties of white-collar crime and in being caught and prosecuted for white-collar crime.  相似文献

ABSTRACT

Women have worked as corrections officers (COs) in some adult male prisons in most states for the past two decades. However, the degree of acceptance of women COs and the perception of women officers' job performance by men officers have varied greatly. This study was based on the results of a survey of men and women officers working in men's prisons in a midwestern state. Comparisons of the officers' responses about women's acceptance, safety, and perceived job performance revealed some significant gender differences. The results indicated that while women faced some resistance among men officers, it was not to the extent suggested by previous research studies, and the resistance came primarily from more experienced men officers. Women officers were confident of their ability to work effectively in men's prisons. The resistance to women that persists among some men officers is likely to provide an obstacle for women seeking opportunities for advancement and promotion in adult male prisons.  相似文献

We evaluate two alternative explanations for the converging gender gap in arrest—changes in women's behavior versus changes in mechanisms of social control. Using the offense of drunk driving and three methodologically diverse data sets, we explore trends in the DUI gender gap. We probe for change across various age groups and across measures tapping DUI prevalence and chronicity. Augmented Dickey‐Fuller time‐series techniques are used to assess changes in the gender gap and levels of drunk driving from 1980 to 2004. Analyses show women of all ages making arrest gains on men—a converging gender gap. In contrast, self‐report and traffic data indicate little or no systematic change in the DUI gender gap. Findings support the conclusion that mechanisms of social control have shifted to target female offending patterns disproportionately. Little support exists for the contention that increased strain and liberalized gender roles have altered the gender gap or female drunk‐driving patterns.  相似文献

Drug markets are typically portrayed as male dominated, with men occupying the higher positions and women fulfilling the lower positions. Yet, the results of recent work highlight how women's participation and experiences in drug economies varies by the structure and organization of the specific market. We focus on the shake‐and‐bake (“shake”) methamphetamine (meth) market, which seems to have emerged mainly in response to legal attempts to curtail methamphetamine production. We explore how women adapt to structural changes and how they perform gender to navigate a market in which the focus is on personal consumption instead of on monetary gain. By relying on semistructured interviews with 40 women who cooked meth, we identify the gendered strategies they adopt and how these coincide with their position in the drug market. Cooking roles took three forms (partner, lead, and team), and each role was characterized by distinct patterns of gender performance and autonomy (emphasized femininity, matriarchal control, and gender neutral). We show that certain market conditions allow for increased participation among women in meth manufacturing. Yet, even within favorable conditions, variability remains in women's positions and gender performances. The findings highlight the role of organizational and legal context in shaping both the roles women adopt in drug markets and the ways they perform gender.  相似文献

Through the lens of the author's rapid appraisal and/or survey data from field studies in Ecuador, the Dominican Republic, Guatemala, Swaziland, and Guinea-Bissau, three main issues are examined: (1) the use of family in the family business by women and men microentrepreneurs (MEs) — i.e., differential involvement of family members in different work patterns and differential reliance on home-based businesses; (2) similarities and differences in men's vs. women's ventures (type of economic activities, gender composition of employees, loan repayment, reinvestment of profits, etc.); and (3) the impact of the business' income on the ME and his/her family well-being (using hypotheses from my general theory of gender stratification). This research builds on the recent scholarship that questions the anti‐agentic depictions of women's acts of violence. We inductively examine women's narratives of their violence to illuminate the diversity of motivations that appear to lie behind that violence. The narratives are drawn from a racially diverse sample of 205 women who were incarcerated in the Hennepin County Adult Detention Facility (Minneapolis, Minnesota). A life events calendar was used to assess women's involvement as both victims and offenders in violent crimes over the 36 months prior to their incarceration. We found that sixty‐six women provided information on 106 incidents of violence. Further, given the dominant theoretical framework in studying women's offending, we assess whether particular types of violent incidents are more likely to involve a partner as opposed to someone who is not a partner (friend, acquaintance, or stranger). Our contextualization of these events also includes an examination of the demographic and situational correlates of the incidents. Our findings reveal that women's reasons for engaging in violence are wide‐ranging and that we need not essentialize stereotypic views of gender in the study of violence.  相似文献

Sociolegal research has shed considerable light on gender inequality in the civil justice system. Existing research, however, rarely looks beyond court proceedings to examine gender inequality stemming from the prior stages in civil litigation. This article fills the gap by addressing the question of whether and how the early moments in disputing produce inequality between women and men. Based on a mixed‐methods study of divorce litigation in China, I identify two critical moments in the early stages in disputing: the initiation stage and the suit‐filing stage. Findings from the two stages indicate that, early on in disputing, the legal profession routinely dismisses and violates women's rights in marriage and family. Moreover, due to the legal profession's failure to convert important rights on the books into formal claims, women's marital grievances and rights claims fall through cracks long before they can enter court proceedings. These findings suggest that gender inequality can result not only from judicial decision making, but also from dispute processing conducted prior to—and outside of—court proceedings.  相似文献

Under what circumstances do men sponsor issues that are traditionally regarded as salient primarily to women? By examining the sponsorship of legislation in the upper and lower chambers of 15 state legislatures in 2001, we explored the conditions under which men are likely to focus attention on policy areas involving women's issues and children's issues. We found little effect of institutional context (such as party control of the legislature or diversity within the legislature) on the sponsorship behavior of either men or women. Personal characteristics such as race, education, age, and family circumstances are associated with sponsorship by men, but not by women. Committee service is also strongly associated with sponsorship behavior, particularly for men. Differences in sponsorship are relatively marked in the sponsorship of legislation that focuses on reproduction or other health issues particularly relevant to women. We conclude that the boundaries of the set of issues traditionally defined as “women's issues” may be changing over time and that it is important to recognize that the influences on the sponsorship of women's issues can be different for men than they are for women.  相似文献

This paper examines the relationship between gender composition and rural household strategies in Cavan, a county in north-central Ireland, during the first half of the 19th century. I show that the ratio of adult females to males was highest in small farm households that depended for their survival on intensively deployed family labour in agriculture, flax-cultivation and spinning. By contrast, households without land or with micro-holdings relied on the income from men's employment as agricultural labourers, supplemented by women's work as spinners. More substantial landholders employed men as agricultural labourers. In both of the latter categories household labour strategies centred on men's activities, with women's work representing an important supplement, whereas in the small-farm category household labour strategies centred on a strategic balance between men's and women's labour input. Amongst households engaged in linen weaving the ratio of women to men was lower across all landholding categories. Differences in gender composition resulted from a complex interplay amongst household labour and inheritance strategies in a changing socio-economic environment.  相似文献
