Abstract

The NATO bombing of Yugoslavia in 1999 led to the doctrine of R2P, which envisages the use of force in defence of human rights. But as the Kosovo conflict demonstrates, nothing is more destructive of human rights than war. The protection and promotion of human rights should be done through lawful and non-lethal means. This essay argues that citizens and states have a responsibility to peace as much as to human rights because human rights can only flourish in a condition of peace. This essay seeks to restore peace to its proper place in the discussion of international politics and human rights.  相似文献

Van Parijs’s Linguistic Justice for Europe and the World furthers a nascent examination of multilingualism within political philosophy, drawing on continental European contexts where multilingualism is the norm. Van Parijs argues, in effect for linguistic cosmopolitanism via English as the current world language, and this seems ostensibly to be a considerable improvement on ‘the untrammeled public monolingualism’ of Anglo-American political theory. However, Van Parijs’s account is flawed in four key respects. First, there is the fundamental problem of his reductionist account of language – by which language is viewed only in terms of its communicative uses and reach and not in relation to its symbolic and identity functions. Second is his simplistic advocacy of English as a global lingua franca, which ignores issues of power and inequality, along with related delimited access to high-status English language varieties. Third are the inherent limitations associated with his advocacy of linguistic territoriality, which recognizes state-sanctioned languages but little else, thus failing to mitigate existing linguistic hierarchies. Finally, the wider argument for English as a global lingua franca is inevitably underpinned by a monolithic/hegemonic view of English itself. This monolithic conception of English stands in contradistinction, not only to the actual plethora of Englishes in the world today, but also, more importantly, to their widely varying status and use in furthering cross-communication and related notions of social and economic mobility. The latter thus fatally undermines Van Parijs’s central argument linking social and economic mobility ineluctably to access to English.  相似文献

The policy push in favour of fostering a global lingua franca has shed overtly imperialistic underpinnings and been recast, but many of the same objections can be levelled at new attempts to justify an old policy. Efforts to explain the impetus towards linguistic uniformity through rational choice theory obscure the power dynamics behind choice of language in multilingual contexts. Invoking democratic engagement as a benefit of uniformity overestimates the role of linguistic diversity as a drag on participation and ignores more important forces. A focus on equality of opportunity and social mobility through lingua franca competence as justification for the policy reveals a shallow conception of equality and underplays the long-term consequences for non-lingua franca communities were equality of opportunity for individuals to be taken seriously. Finally, seeing the justice issues that arise out of competition between languages as one of ensuring adequate compensation to the losers underscores how thin is the conception of equality animating the approach; it purchases an inadequate level of equal opportunity for individuals at the expense of inequality amongst language communities.  相似文献

ABSTRACT

Roche’s article discusses ‘language oppression’ as a form of domination that is coherent with other forms of oppression along the lines of ‘race’, nation, colour and ethnicity. Scholars have defined language oppression as the ‘enforcement of language loss by physical, mental, social and spiritual coercion’. It is part of an evolving suite of concepts from linguistics, sociolinguistics and linguistic anthropology that examines issues of language discrimination, or ‘linguicism’. Roche explores one aspect of linguicism—language erasure—and how it relates to language oppression, focusing on Tibetans in the People’s Republic of China (PRC). He examines how language oppression is produced through practices of erasure: the ways in which certain populations and their languages are systematically rendered discursively invisible. He argues that the erasure of certain languages in the Tibetan context is systematically reproduced by two otherwise opposed political projects: the colonial project of the PRC state; and the international Tibet movement that seeks to resist it. He refers to the contingent cooperation between these two opposed projects as ‘articulated oppression’. In concluding the article he examines how the disarticulation of this oppression is a necessary condition for the emancipation of Tibet’s minority languages, and discusses the broader significance of this study for understanding language oppression, and its relation to other forms of oppression.  相似文献

This article focuses on key themes in the liberal philosophical debate over multiculturalism, as well as the responses of Canadian social and political actors to the September 11, 2001 attacks in New York and Washington. Since September 11, there has been a renewed popularity of arguments positing a 'clash of civilizations' between Muslim and Christian societies, and a new legitimacy advanced for 'ethnic profiling' in the name of security. The rapidity with which this has happened in Canada is particularly striking because of the country's liberal-democratic and multicultural tradition. The introduction of a national policy of multiculturalism in 1971 provided a new understanding of Canadian citizenship that was more inclusionary of immigrants and ethnic and racial minorities. Multiculturalism has also become a hotly debated ideal among Canadian, American and European political philosophers concerned with addressing the possibilities and limits of liberalism given ethnic diversity, and the limits of ethnic diversity given liberalism. Multiculturalism is typically presented as a 'problem' for liberal politics and ethics. Building on how multiculturalism policy in Canada has provided a more inclusionary discourse around citizenship, a defence of multiculturalism is advanced which rejects the essentialist treatment of 'culture' and 'cultural' groups. It is suggested that the unfolding discussions in Canada since September 11 demonstrate the ongoing tension between cultural essentialism and liberal individual rights. The Canadian experience points to the value of an anti-essentialist multiculturalism in challenging discrimination given that neither liberalism, nor liberal democratic states, are neutral in their allocation of resources and legitimacy among more and less powerful ethnic groups. It is argued that rather than multiculturalism, it is essentialist thinking, imagery and ideas which present the greatest 'problem' to the ethics of liberalism and the politics of liberal democracies like Canada.  相似文献

Abstract

Existing explanations for the emergence of human rights on the political agenda in ASEAN focus either on the role of external pressure on ASEAN member states to ‘do something’, or on the way those states copied the form, but not the function, of other regional organisations such as the EU. Both approaches tacitly acknowledge that given the strong preference for intergovernmental governance displayed by ASEAN, regardless of interpretations, that it was states that drove the institutionalisation of rights forwards. Through examining in detail the causes and consequences of the Vientiane Action Programme this article disagrees with that assertion. At crucial moments before and after 2004 it was the Working Group for the Establishment of an ASEAN Human Rights Mechanism, a track III actor, which both inserted human rights into ASEAN discussions and forged the link between protecting those rights and the continuing success of ASEAN's security goals. Through understanding the role of the Working Group as a norm entrepreneur, assisting in the localisation of human rights standards, this article suggests that existing explanations of ASEAN institutionalisation need to be revised to include a wider range of political dynamics than previously were acknowledged.  相似文献

Much has been written of late about language as a critical tool of research in international relations. Among critical international relations scholars, constructivists and poststructuralists have been the main proponents of using of language as a challenge to structural realist assumptions about world politics. Yet, it is not always clear why these critical scholars decide to turn to linguistic methodologies. This article reveals that there are compelling reasons for choosing language as a critical tool of analysis. But, contrary to current beliefs, it is important to note that constructivist and poststructuralist strategies of language are not always equivalent and compatible. This essay sorts out the divergent epistemological and political stakes involved in one's choice of a linguistic strategy. Different uses of language offer different critiques of mainstream international political practice. To illustrate this argument, the April 2001 US-China diplomatic crisis over the collision between a surveillance plane and a fighter jet is showcased. It is shown that constructivist and poststructuralist linguistic analyses provide challenging but not always complementary interpretations of the policies, diplomatic procedures, and verbal exchanges that took place during this confrontation.  相似文献

While the two dominant Eurocentric paradigms of world politics, realism and idealism, place greater emphasis on power and regime type, respectively, in their analyses of war, a recently promulgated Afrocentric paradigm of world politics suggests that cultural characteristics of states are significantly associated with the likelihood of interstate war. Drawing on these competing perspectives, I conduct a data analysis of the relationship between cultural homogeneity and interstate conflict in order to determine the extent to which Afrocentric theses on international conflict are borne out empirically. I find that cultural factors are significant correlates of interstate war as Afrocentrists suggest, although realist and idealist factors are more strongly associated with the likelihood of interstate war. In addition, the findings suggest that multiculturalism—especially ethnic diversity—is a more auspicious path for interstate peace.  相似文献

This review of Patten’s Equal Recognition suggests that minority rights can be grounded either in cultural accommodation rights or collective self-government rights. I defend four propositions: (1) individuals’ interests in membership in political communities cannot be reduced to their interests in being able to pursue their own conceptions of the good; (2) liberal states do not have to extend neutrality as equal treatment to self-government claims that intersect with their own jurisdiction; (3) claims for the establishment of public languages and territorial autonomy need to be justified on the basis of self-government rights rather than on grounds of equal treatment of cultural identities; (4) as a condition for their admission, immigrants can be expected to waive collective self-government rights rather than cultural protection rights.  相似文献

Abstract

Single-party, authoritarian states such as Vietnam are frequently characterised as having ‘closed’ political opportunity structures and ‘un-free’ socio-political systems. The validity of this observation depends, however, on the viewer's frame of reference. Seen from the perspective of active citizens, Vietnamese political structures offer increasingly greater space for collective action than a state-centred institutional analysis would predict. Episodes of contentious politics surrounding land disputes and public parks during 2007 provide evidence of the changing dynamics of participation in politics. Actors involved in these and similar campaigns are broadly optimistic about the future prospects for an opening of political space within the existing system. These findings are contrasted with international reports of violations of political rights and with the Vietnamese government's own efforts at legal reform. Although signals remain mixed, to some extent Vietnam might be becoming a ‘rice-roots democracy’ in practice, while remaining a single-party state. The voices and experiences of civil society actors will continue to shape opportunities and risks in the expansion of political space.  相似文献

Will Kymlicka has argued that 'democratic politics is politics in the vernacular'. Does this statement mean that democratic politics is impossible in a multilingual community, whether at the local, national, regional or global level? This paper discusses this assumption and maintains that democratic politics should imply the willingness of all players to make an effort to understand each other. Democratic politics depends on a willingness to overcome the barriers to mutual understanding, including the linguistic ones. Anytime that there is a community of fate, a democrat should search the available methods to allow deliberation according to the two key conditions of political equality and participation. If linguistic diversity is an obstacle to equality and participation, some methods should be found to overcome it, as it is exemplified by the Esperanto metaphor. The paper illustrates the argument with four cases of multilinguistic political communities: (1) a school in California with English-speaking and Spanish-speaking students; (2) the city of Byelostok in the second half of the nineteenth century, where four different linguistic communities (Polish, Russian, German and Yiddish) coexisted. This led Markus Zamenhof to invent Esperanto; (3) the linguistic problems of the Indian state and the role played by English – a language unspoken by the majority of the Indian population in 1947 – in developing Indian democracy; and (4) the case of the European Parliament, with 20 languages and a wealth of interpreters and translators.  相似文献

Within the umbrella of equal recognition, several principles of linguistic justice can be distinguished. A first, the per-capita principle, mandates prorating language recognition based on a per-capita distribution. A second, the equal-services principle, prescribes upholding the official languages as the languages in which the state speaks and in which public services are provided, irrespective of changing numbers of speakers. Alan Patten defends the prorated per-capita principle. I argue for the equal-services principle, which practically will often amount to a form of linguistic maximin: the more vulnerable the language, the more numerous the resources.  相似文献

This article compares the results of police reform in three post-Yugoslav states that vary in terms of local ownership. Using survey, focus group, and interview data gathered in Kosovo, Serbia, and Macedonia, we find that the public perceives the police force created and trained by international oversight as more capable and legitimate when compared to police forces that grew under local ownership. Insulation from political and societal influence led to a more capable and legitimate police force in Kosovo, while the politicization of the police force under local ownership undermined its capacity and legitimacy in Macedonia and Serbia.  相似文献

This review essay focuses on the problem of citizenship in three different areas, namely human rights, identity politics and surveillance. Heli Askola’s work focuses on the magnitude of demographic challenges that contemporary migrant-receiving states in the Global North face, and specifically focuses on the broader demographic picture of low birth rates, and increasing diversity and populations ageing; thus, focusing the problem of identity politics in the context of citizenship acquisition in Global North states. Richard Sobel’s book explores the empowerment of American citizenship, specifically through a unique reading of constitutional and political apparatus in the United States. Finally, Pramod Nayar’s work addresses state-based surveillance mechanisms like biometrics, biobanks and the internet within the context of citizenship and how new forms of subjectivity are forged within a culture of surveillance. These three works approach citizenship through a legal category of political membership, but also a process of political subjectivization.  相似文献

A review of the literature on citizenship shows a trend away from anchoring citizenship practices to the nation-state and a move towards recasting the concept in universal terms. The paper examines this trend by focusing on the writings of Held, Bohman, and Benhabib. It distinguishes their ‘deliberative’ approach to citizenship, and suggests that this leads them to reformulate citizenship in a way which differs little from human rights. Although the paper shares in the view that a move to a human rights politics would pave the way for a more equitable order, it argues that there is also a risk. By drawing on the agonistic perspective on democratic politics, the paper shows that the risk is that we might undermine democratic politics by reducing it to a single principle.  相似文献

The Association of South East Asian Nations (ASEAN) escalated its community building project significantly over the last decade, culminating in the launch of a reformed and substantially integrated ASEAN Community at the end of 2015. This article considers what might follow from this newly reformed and rhetorically people-focused version of ASEAN for matters of sexual orientation and gender identity and expression (SOGIE). In claiming to be people-oriented and people-centred, and by developing a regional rights regime, ASEAN opens itself to standards by which it can be measured and held to account. We critically review ASEAN 2025: Forging Ahead Together, and consider civil society's response, focusing on the critique offered by the ASEAN SOGIE Caucus, the peak civil society organisation for ASEAN SOGIE matters. We focus on three themes: identity, visibility politics, and rights. We argue that while ASEAN falls short of its own rhetorical standards, these same standards support a politics which keeps rights in contestation, enabling civil society to push for accountability to international standards, and a more democratic politics.  相似文献

Does fractionalization change over (short periods of) time? If so, are there any substantial implications for economic performance? To answer such questions, we construct a new panel data set with measures of ethnic, linguistic, and religious fractionalization for 26 former communist countries covering the period from 1989 to 2002. Our fractionalization measures show that transition economies became more ethnically homogeneous over such a short period of time, although the same did not happen for linguistic and religious diversity. In line with the most recent literature, there seems to be no effect of (exogenous) diversity on macroeconomic performance (that is, on per capita GDP growth). However, we find that dynamic (endogenous) ethnic diversity is negatively related to growth (although this is still not the case for linguistic and religious diversity). These findings are robust to different specifications, polarization measures, and instrument sets as well as to a composite index of ethnic‐linguistic‐religious fractionalization.  相似文献

Critical theoretical models usually aim to explain complex sociopolitical realities and open some space for constructive change. The "ethnic democracy model," developed by the Israeli sociologist Sammy Smooha, comes to justify the existing state structure in Israel in which democracy is selective and differential vis-à-vis the various social groups in Israeli society. A systematic critique of this model demonstrates the attempts made by Israeli political sociologists to turn the ethnic nature of Israeli democracy into a stagnant ideal-type in a time where regime dynamism and democratization is considered an ideal in world politics. In order to pinpoint the deficiencies in the ethnic democracy model, multiculturalism is utilized as a normative theory that better explains the sociopolitical reality in Israel. This paper concludes by suggesting searching for state recognition of the political benefits of differentiated citizenship and group rights to reduce the rising ethno-cultural conflict in Israeli society.  相似文献

In Equal Recognition, Alan Patten argues that in a proper relationship between normative political theory and democratic politics, we must make a clear distinction between two questions related to cultural rights: (a) authority (who should decide?) and (b) the substance of deliberation. The question he wants to explore, however, is not the authority question but the substantive question. The aim of this article is to show that an account of equal recognition cannot bracket out the democratic element. It argues, first, that Equal Recognition does not live up to its initial promise, as it contains a number of reflections and recommendations (on language rights, on secession, on the rights of migrants’ cultures) that either explicitly or implicitly include the democratic element. Second, it points at other important areas of political decision-making – such as electoral system design, districting, referendums, quotas – in which it is quite clear that in order to extend equal recognition to minority cultures, we are obliged to take decisions related to the design of democratic institutions.  相似文献

This lecture marks the seventieth anniversary of the Universal Declaration of Human Rights (UDHR) with an analysis of the Declaration's contemporary relevance. It considers whether, in today's turbulent and fractured political environment in which human rights abuses remain widespread, the UDHR still has a role to play. A case is made that the UDHR was, in fact, written precisely for a moment like now. The lecture starts by considering the important legal impact of the UDHR, whilst acknowledging that the legal enforcement of human rights sometimes overshadows the emotions of care and empathy that lie at the heart of both the Declaration and the whole concept of human rights. It then emphasises the significant role the UDHR has played in giving individuals a voice to hold states accountable. Finally, it explores the UDHR's ethical and inspirational vision that helped to create a baseline of norms and standards aimed at promoting diversity, mutual respect and peace. For all these reasons, the UDHR most certainly needs to be rejuvenated rather than retired.  相似文献
