This paper aims, firstly, to bridge debates on human rights and Transnational Corporations (TNCs) within practical philosophy and those within the business and human rights literature and, secondly, to determine the extent to which human rights duties can be assigned to TNCs. To justifiably assign human rights duties to TNCs, it is argued that these duties need to be grounded in moral theory. Through assessment of two approaches from practical philosophy, it is argued that positive duties cannot be assigned to TNCs because their bindingness cannot be grounded in moral theory. A positive argument is introduced to interpret TNCs’ human rights duties as corresponding to virtues rather than rights. Though such duties are indeterminate regarding what constitutes adequate performance, they can be made more determinate through legal instruments outside of positive human rights law. An approach is introduced exemplifying how such approaches can achieve the end of TNCs compliance with human rights norms.  相似文献

A great deal of constructivist international relations research on norms focuses on the diffusion of liberal human rights values. In contrast, this article analyzes how critics seek to undermine human rights principles in contexts where human rights norms are increasingly hegemonic. It argues that when norm challengers are frustrated by the institutionalization of human rights, they engage in transnational strategies to pursue their agendas. In norm proxy war, actors patronize surrogates in locales where norms are weak in the hope that victories abroad will reverberate internationally and at home. This dynamic is illustrated by American evangelical sponsorship of political homophobia in Uganda, culminating in that country’s draconian anti-LGBT legislation. When norms are resisted through outsourcing, actors contract out human rights violations in an effort to erode norms through practice, as evidenced by patterns of extraterritorial detention and extraordinary rendition to torture in the post-9/11 “Global War on Terror.” Identifying these patterns broadens understanding of potential pathways of norm contestation.  相似文献

Human rights is in crisis in the UK. It lacks significant political backing and public support. This ‘insider account’ of York becoming a human rights city suggests that there is a need to rethink approaches to human rights. The article looks at the strategies adopted in the city; the annual city‐based indicator report which provides the key reference point for all local activities; and the declaration of York as a ‘human rights city’ in 2017 alongside its subsequent impact. The discussion is linked to two debates within human rights: how to define and build a culture of human rights, and what it means for human rights to be truly relevant at a local level. The new approach advocated can be summarised as participatory, locally informed, and related to everyday concerns.  相似文献

Transnational knowledge networks provide organizations with information useful in addressing shared problems. Social media may enable the formation of those networks, yet their role in the process has received little attention. This article examines the structure and antecedents of two networks facilitated by the microblogging platform Twitter operating in the policy domain of emergency management. One network includes national-level government agencies responsible for disaster response and recovery operations; the other includes nongovernmental organizations in the form of Red Cross and Red Crescent national societies. We use a logistic regression quadratic assignment procedure to test hypotheses derived from related literature. While findings indicate that shared language and geographic proximity shaped network formation, both networks exhibit boundary spanning behavior in which organizations sought out information from high-profile, resource-rich organizations. Those organizations helped to connect otherwise regionally bound clusters and demonstrate the nascent potential of social media to create global transnational knowledge networks.  相似文献

Allen Buchanan argues that democracy ought to be added to the list of basic human rights, but he limits the conception of democracy to a minimum of electoral representation within the nation state, effectively collapsing human rights into civil rights. This, however, leaves him unable to address the problem of human rights failures occurring within established states that meet his standard of minimal democratic representation. In order to address this problem, I appeal to James Bohman's conception of the political human rights of all members of humanity, as opposed to the civil rights of the citizens of particular states. I argue that while this provides the basis on which to address the problem of human rights failures within minimally democratic states, Bohman's conception also entails the potential for deep tensions to arise between the different claims of civil and human rights.  相似文献

This paper is an initial attempt to link the concepts of human rights and power from a social constructionist perspective. It looks at aspects of the social history of natural and human rights and the relationship of this history to extant power relations. It suggests that conceptions of human rights have both challenged and sustained particular forms of power, thus playing a highly ambivalent role. The paper also examines and criticises the philosophical underpinnings of liberal and marxist approaches to the concept of human rights. In a concluding section it considers the possibility of constructing a power analysis which might provide a way of anchoring the concept of human rights in social practices.  相似文献

The emotions surrounding the question of Kosovo’s future owe their intensity to the long history of human rights abuses in the province. The years 1945–1966 and 1987–1999, in particular, saw harsh repression of local Albanians and a systematic favoring of local Serbs. Since June 1999, the province has been under international supervision, and, in this period, Serbs complain that they have been the victims of repeated acts of violence at the hands of Albanians. This article provides an overview of human rights abuses since 1945 and closes with a brief assessment of the international plan presented by UN mediator Martti Ahtisaari in February 2007.

Sovereignty and non-interference principles are trademarks of the Association of South-East Asian Nations (ASEAN) regional approach. Starting from 1993, ASEAN has been developing a process aimed at creating a human rights system. This process reached its acme in August 2013 when the ASEAN Human Rights Declaration (AHRD) was formally launched. In the frame of the tension between sovereignty and human rights, the paper firstly analyzes the roots of the ASEAN path towards the creation of the regional human rights system grounded on the Vienna World Conference debate. Next comes an analysis of the political commitments assumed by ASEAN in the last 20 years in the process of creating a human rights body in the region. Furthermore, the paper presents an in-depth analysis of the most problematic issues connected with the nature, functions, mandate, and purposes of the ASEAN Intergovernmental Human Rights Commission (2009).
