道德规范的产生和形成,有着深刻的社会经济根源,是由一定的社会物质生活条件和社会关系决定的。道德规范随着社会的发展而不断发展,具有历史性和继承性。在人类漫长的道德生活中,道德规范曾有过形态各异的表现形式,大体可以概括为图腾、禁忌、礼仪、风俗、箴言、准则、义务、责任等几种主要的表现形武。道德规范表现形式的历史演进,是一个由蒙昧到理性、由自发到自觉、由低级到高级的发展过程。  相似文献

This is the first in a series of five articles focusing on how Bernard Madoff’s confidence game (con game) worked. This paper first examines three con games in order to isolate their common elements. What went on in Madoff’s offices is generally what goes on in most con games: extensive preparations, elaborate props, pretense, victims convinced that they have much to win and little to lose, greed, and the ability to disorient and fool. That influence is transmitted by an immense variety of communicational modes, and may present an unlimited range of results. A grainy series of surveillance photographs was tendered into evidence at the trial of a young Aboriginal man accused of robbing a bank. Two police officers testified that they recognised him from the photographs. On appeal to the High Court of Australia, the judges thought that the hooded bandit in the image looked like the spectre from Hamlet. This article uses the discourse of “spectrality” to explore the consequences for law and ethics when haunted by the transgressive image. It examines the confrontation between the foundational illegality of the Australian nation, and the indigenous man who is accused of a crime against property.  相似文献

This review essay examines recent work in political theory on the ethics of immigration admissions. It considers arguments put forward by Michael Walzer, Peter Meilaender and David Miller, among others, for state control of borders. Such arguments tend to appeal to the value of political communities and/or the exclusion rights of democratic associations, and I argue that neither of these are successful. Turning to work by Joseph Carens, Phillip Cole, Michael Dummett and others who advocate open or much more open borders, the article considers various arguments that would support this stance, including appeals to freedom of movement, utilitarianism and social justice. I argue that rights to immigration need embedding in global principles of resource redistribution. In the conclusion I sketch a cosmopolitan approach to immigration by which impartial criteria such as population density and gross domestic product would determine how many migrants states have a duty to admit.  相似文献

Corporate governance has long been a feature of the arts and cultural sector and is a requirement for all cultural organisations seeking public funding, regardless of their size. However, despite the ubiquity of corporate governance in the arts and cultural sector, there is little research addressing the experiences of managers. This study examines the experiences of managers in performing arts organisations in working with their boards, based on data collected across 20 performing arts organisations in Australia using a stakeholder salience lens. Our results indicate that while the board is seen as a key organisational stakeholder, managers have a range of concerns about the governance role of boards, and in particular their limited effectiveness on the dimensions of legitimacy and urgency. We find that arts managers often must wrestle with competing agendas around creative autonomy and the low‐risk appetite of their management boards. Our findings highlight the need to re‐align, particularly in small‐ and medium‐sized organisations, the organisational needs of arts managers with corporate governance arrangements, without detracting from creative endeavours.  相似文献

This paper considers two specific difficulties in developing a code of ethics for the public sector, the contested nature of the values to be expressed in a code of ethics and the organisational demands of a corporate managerialist framework which uses performance indicators. Using the example of the Western Australian public sector code of ethics, the authors conclude that a good strategy for developing a public sector code of ethics will recognise contestability, demonstrate philosophical integrity in the code, mesh the code with identified performance indicators and provide whistleblower protection. The strategy described provides a sufficient framework for any public sector bureaucracy to develop a justifiable code of ethics for use by public sector employees.  相似文献

The topic of statesmanship has been largely neglected by public administration scholars. This article underscores the moral dilemmas and implications that arise when statesmen abandon their principles for the good of the state, as was the case when Thomas Jefferson purchased the Louisiana Territory from France without congressional consent. This example draws our attention to the important connections between statesmanship and administrative ethics. Jefferson's decision to abandon his strict constructionist principles to acquire Louisiana illustrates the ethical complexities of public administration, public management, and the democratic governance process.  相似文献

This paper argues that Weber ought to be read as a comparative ethicist who brings his German intellectual inheritance, especially Schopenauer and Nietzsche, to a dialogue with ethical traditions in India and China. It shows that Weber not only had a supple understanding of the tensions within Hindu ethics, his own account of value often closely corresponds to Hindu axiology and was enriched by an encounter with it.  相似文献
